In 1962, Dr C. Henry Kempe and his colleagues published the single most important article written to date about child maltreatment: The Battered-Child Syndrome. This chapter analyses the threefold nature of what these authors achieved: clearly identifing the medical evidence of severe child physical abuse and naming it as a syndrome; identifying the medical profession's resistance to its identification; and then translating their scholarship into advocacy for social and legal change. The chapter also traces some of the effects of Kempe's work, including the nature and effect of the subsequent introduction of mandatory reporting laws in the USA and internationally.

Child sexual abuse continues to be a prevalent and complex problem in today’s society as it poses serious and pervasive mental health risks to child victims and their non-offending parents. The main objectives of this study were (a) to elucidate the psychological symptoms and support needs of parents of child sexual abuse victims as they present to group treatment, (b) to examine changes in psychological symptoms and support needs and their relationship with child functioning over the course of a parallel group treatment, and (c) to examine the impact of these factors on completion of group treatment. Participants included 104 sexually abused youth and their non-offending parent presenting to Project SAFE Group Intervention, a 12-session cognitive-behavioral group treatment for sexually abused children and their non-offending parents. This project had a unique advantage of utilizing a variety of demographic, parent-, and child-report measures, allowing for a more comprehensive examination of change in symptomatology and needs over the course of treatment. Several significant findings were noted, including the identification of four clusters of youth at pre-treatment, which were maintained at post-treatment; elevations on the CTQ Sexual Abuse scale; parents of youth sexually abused by a non-family member had significantly higher PSI-Restriction of Role subscale scores; parental expectations of a negative impact on their child were worse for older children; several parent characteristics predicted client treatment retention (e.g., older parents, lower SCL-90-R GSI scores); and an early age of onset of abuse also increased treatment retention. Future directions, recommendations, and limitations were discussed.

À la suite du dévoilement d’une agression sexuelle, l’examen médical est l’une des étapes importantes qui sont recommandées pour les enfants victimes, mais seulement certains d’entre eux le complètent. L’objectif de la présente étude est de vérifier si les enfants qui font l’examen anogénital à la suite du dévoilement d’agression sexuelle sont différents de ceux qui n’en font pas ainsi que de documenter les variables, notamment les caractéristiques de l’enfant, de la famille, de l’agresseur et de l’agression, qui pourraient prédire le fait de compléter cet examen. L’échantillon est composé de 211 enfants âgés de 6 à 13 ans recevant des services au Centre d’expertise Marie-Vincent. Une régression logistique binaire révèle que l’absence d’emploi de la mère (RC = 6,15), être victime d’une agression sexuelle très sévère (RC = 6,02), être victime d’un agresseur adulte (RC = 3,43) et provenir d’une famille monoparentale (RC = 2,89) contribuent à prédire si l’examen anogénital est réalisé ou pas à la suite du dévoilement. Les résultats confirment que les enfants complètent l’examen surtout afin de trouver des éléments de preuves et que parmi ceux qui pourraient en bénéficier pour leur bien-être, plusieurs ne sont pas rencontrés.

This study aimed to identify the work developed by the Judiciary to prevent sexual violence against children and adolescents within the family. The approach to social representations in a cultural perspective was used. The field study consisted in the 1st and 2nd Court of Crimes against Children and Adolescents, at the State Supreme Court of Pernambuco, Brazil. Participant observation, semi-structured interviews, and focus group with 17 subjects were the techniques for data collection, analyzed through the interpretation of meanings, allowing the identification of the category "The Judiciary as the ultimate level" and the following subcategories: "The public policies to prevent violence" and "The structure and dynamics of Courts". This study allows the visualization of the Judiciary's limitations with regard to the full protection and absolute priority, and that the work along with the victims demands investments in structure and human resources.

OBJETIVOS: compreender as representações sociais de membros do Poder Judiciário acerca da prevenção da violência sexual intrafamiliar contra crianças e adolescentes. MÉTODOS: pesquisa de abordagem qualitativa que teve como campo de estudo as 1ª e 2ª Varas dos Crimes contra a Criança e o Adolescente, no Tribunal de Justiça de Pernambuco, com participação de 17 sujeitos (juiz, assessor, técnicos e analistas judiciários). Observação participante, entrevistas semiestruturadas e grupo focal compreenderam as técnicas para coleta de dados, que foram analisados por meio da interpretação dos sentidos. RESULTADOS: a categoria "cultura penal" emergiu dos discursos, bem como suas subcategorias: "prevenção do crime" e "prevenção do dano". CONCLUSÕES: as representações dos sujeitos revelam uma dicotomia, caracterizando o conflito entre a tradição do Poder Judiciário e o direito novo, que abrange os princípios da proteção integral e da prioridade absoluta às crianças e dos adolescentes. O conceito de prevenção da violência sexual intrafamiliar contra crianças e adolescentes deve ser ampliado para além da mera prevenção do crime. A abordagem do problema por meio da prevenção requer que se incorpore ao Poder Judiciário uma cultura penal que abarque os princípios da proteção integral e da prioridade absoluta.

A abertura política do Brasil à democracia promoveu uma série de mudanças legislativas e de organização do Estado. Na área da infância e adolescência, após a promulgação do Estatuto da Criança e do Adolescente (ECA), foram criados conselhos de nível federal, estadual e municipal, com o objetivo de promover e defender os direitos dessa população específica. Também foram formados os Conselhos Tutelares compostos por membros da sociedade civil, diretamente eleitos pela população, com a função de informar e promover esses direitos localmente. Utilizando a metodologia qualitativa-quantitativa do Discurso do Sujeito Coletivo, a pesquisa analisou a percepção e opinião dos conselheiros tutelares a respeito de situações que envolvem a prática sexual voluntária heterossexual e homossexual de adolescentes da faixa etária de 12 a 17 anos. Os dados foram colhidos com o uso de questionários semiestruturados para autopreenchimento, apresentados em visita técnica aos membros dos 44 Conselhos Tutelares do município de São Paulo. Além do perfil social e familiar, foram coletadas opiniões dos conselheiros quanto à autonomia dos adolescentes e suas noções de desrespeito legal, além de sugestões de orientação de condutas frente a três casos hipotéticos de prática sexual realizada por adolescentes. Responderam à pesquisa 80 (36,4 por cento ) conselheiros de um total de 220, de 29 (65,9 por cento ) dos 44 Conselhos Tutelares da cidade. Observou-se que apresentaram tendência a reproduzir os modelos tradicionais negativos da sociedade brasileira no julgamento da prática sexual de adolescentes, avaliando sua ocorrência pela ótica moral e de opinião de familiares e outros adultos. Mais da metade não associa tais práticas a impactos específicos sobre a saúde e os direitos sexuais e reprodutivos dos adolescentes, nem realiza encaminhamentos para sua promoção. Adotam noções desiguais de gênero do senso comum, que remetem à preocupação com a imagem e impactos da publicização da sexualidade de meninas, não fazendo o mesmo para adolescentes meninos e veem as práticas homoafetivas sob a ótica da violência e sedução, associando-as à necessidade de orientação psicológica e problemas de saúde mental. Considera-se que conselheiros tutelares estão pouco preparados para lidar com a sexualidade de adolescentes e normalmente treinados para avaliá-la tal qual a violência sexual que acomete crianças. Como possuem status local de legitimidade, são procurados e tem poder de averiguação e encaminhamento público de ocorrências, terminando por, muitas vezes, desrespeitar os direitos humanos de adolescentes quanto à expressão e vivência da sexualidade e da prática sexual saudável. Considera-se fundamental discutir o papel dos Conselhos Tutelares frente aos direitos de adolescentes, de forma que ao contrário do proposto na democratização do país, não se configurem como mais um instrumentos de exercício de poder para perpetuar desigualdades sociais. Na área da sexualidade, a defesa dos direitos de adolescentes passa pelo respeito a sua sexualidade, acesso à informação, à garantia de serviços públicos que efetivamente os atendam para proporcionar exames, contracepção, prevenção de doenças sexualmente transmissíveis, etc., com respeito a sua cidadania, especificidades, necessidades, autonomia e dignidade pessoal, promovendo-os e defendendo-os frente a famílias, comunidade, a toda a sociedade e ao próprio poder público.

This article examines advocacy of Catholic restorative justice for clerical child sexual abuse from the standpoint of feminist criminological critiques of the use of restorative mediation in sexual offence cases. In particular, it questions the Catholic invocation of grace and forgiveness of survivors of abuse in light of critical feminist concerns about the exploitation of emotions in restorative practices, especially in regard to sexual and other gender-based offences. In the context of sexual abuse, the Catholic appeal to grace has the potential for turning into an extraordinary demand made of victims not only to rehabilitate offenders and the church in the eyes of the community, but also to work towards the spiritual absolution of the abuser. This unique feature of Catholic-oriented restorative justice raises important concerns in terms of feminist critiques of the risk of abuses of power within mediation, and is also incompatible with orthodox restorative justice theory, which, although it advocates a ‘spiritual’ response to crime, is concerned foremost with the rights, needs and experiences of victims.

Parent partner mentoring programs are an innovative strategy for child welfare agencies to engage families in case planning and service delivery. These programs recruit and train parents who have been involved in the system and have successfully resolved identified child abuse or neglect issues to work with families with current open cases in the child welfare system. Parent partner mentors can provide social and emotional support, advocacy, and practical advice for navigating this challenging system. Insofar as parent partners share similar experiences, and cultural and socioeconomic characteristics of families, they may be more successful in engaging families and building trusting supportive relationships. The current study presents qualitative data from interviews and case studies of families who were matched with a parent partner in a large county in a Midwestern state. Interviews with families, parent partner mentors, child welfare agency staff, and community partners and providers suggest that parent partner programs may be just as beneficial for parent partner mentors as they are for families being mentored. These programs can build professional skills, help improve self-esteem, provide an avenue for social support, and may potentially prevent recidivism. Parent Partner programs also provide a mechanism for amplifying family voice at all levels of the agency.

While these policies assert that they are based on neuro-scientific discoveries, their relationship to neuroscience itself has been debated. However, what is clear is that they portray a particular understanding of children and childhood, one that is marked by a lack of acknowledgment of child personhood. Using an analysis of key government-commissioned reports and additional advocacy documents, this article illustrates the ways that the mind of the child is reduced to the brain, and this brain comes to represent the child. It is argued that a highly reductionist and limiting construction of the child is produced, alongside the idea that parenting is the main factor in child development. It is concluded that this focus on children's brains, with its accompanying deterministic perspective on parenting, overlooks children's embodied lives and this has implications for the design of children's health and welfare services.
