Abstract Background. In 2011, Alabama, neither a border state nor hold a significantly large Hispanic population, passed the most restrictive state immigration law, The Beason-Hammon Alabama Taxpayer and Citizen Protection Act, HB 56. This omnibus law was far-reaching in its restrictions, including, but not limited to, identification, public services, employment, housing, and law enforcement. Objectives. This research explores the dominant tropes present in the narrative surrounding the anti-immigration legislative activity in Alabama that created fertile ground for the passage of such a punitive immigration law. Methods. Newspaper articles from 2007 to 2011 in Alabama¿s Birmingham News and Press-Register, the two most circulated newspapers in the state, were attained from NewsLibrary.com, an online database of 5,311 newspapers and other news sources. Results. Seven dominant tropes were identified in the articles that pushed for anti-immigration policies. These tropes claimed (1) the US-Mexico border is not secure, (2) the federal government has failed to enact comprehensive immigration reform, (3) immigrants steal jobs, hurt the economy, and (4) burden public services, (5) immigrants are criminals and terrorists, (6) they refuse to assimilate and learn English, and (7) there has been a dramatic percent change in the Hispanic and illegal populations. These tropes cumulatively worked together to create anti-immigration sentiment that pushed for the passage of HB 56.

Section 35 of the Insurance Contracts Act 1984 requires insurers offering insurance policies in six prescribed areas "to clearly inform" prospective insureds of any departure their policies may constitute from the standard covers established by the Act and its accompanying Regulations. This prescribed insurance contracts regime was designed to remedy comprehension problems generated by the length and complexity of insurance documents and to alleviate misunderstanding over the terms and conditions of individual policies. This article examines the rationale underpinning s 35 and the prescribed insurance contracts regime and looks at the operation of the legislation with particular reference to home contents insurance in Australia. It is argued that the means whereby disclosure of derogation from standard cover may be effected largely negates the thrust of the prescribed insurance contract reform. Recommendations to address these operational deficiencies are made.

There are currently no regulatory mechanisms, laws or policies that specifically provide rights to Indigenous peoples over their Indigenous knowledge and intellectual property. We strongly recommend that the commonwealth take the lead to ensure that national sui generis laws are developed (perhaps to operate initially in areas of Cth jurisdiction, such as IPAs and national parks). The development of such laws should be in tandem with practical guidelines to assist their implementation. A comprehensive, nationally consistent scheme for access to genetic resources, which offers meaningful protection of traditional knowledge and substantive benefit-sharing with Indigenous communities, has to be developed. There are already a range of reports/resources that urge these same reforms and that we direct the Enquiry to again; these include the Voumard Report (2000) – especially Fourmile’s Appendix 10 – “Indigenous Interests”, and Terri Jankes “Our Culture, Our Future (1998).

Cet article examine les complications juridiques mises de l’avant par la récente étude « Credibility on the Web » publiée par le groupe Consumers International. Selon cette étude, plusieurs sites n’étant affiliés à aucun manufacturier ou vendeur font leur apparition sur le Web afin d’offrir aux consommateurs certaines informations générales concernant divers produits et services. Malheureusement, puisque ces sites sont gérés par des tiers n’étant pas partie à la relation consommateur-commerçant, une nouvelle problématique juridique peut être mise de l’avant : quelle protection accorder aux consommateurs eu égard à leurs achats effectués suite aux mauvais conseils de ces sites ? Ce texte vise à mettre sur pied les fondements d’une telle problématique selon le droit de la consommation québécois et à envisager certaines pistes de solutions possibles concernant les recours que pourraient avoir les consommateurs contre de tels sites.
