La Cour suprême du Canada (« Cour ») prône « ses propres valeurs» dans la détermination des droits économiques des Autochtones, dont la prédominance des intérêts économiques des non Autochtones, ainsi que la protection du couple souveraineté canadienne/primauté du droit. Ces valeurs sont maintenues avec constance par la Cour, malgré l'évolution du cadre juridique canadien applicable aux revendications des droits économiques par les Autochtones. Ce mémoire démontre que, depuis la constitutionnalisation des droits économiques des Autochtones en 1982, le domaine de la preuve - tant par l'invocation de règles de preuve que par l'appréciation de la preuve - est le principal outil invoqué par la Cour en rhétorique au soutien de la détermination des droits économiques des Autochtones selon ses propres valeurs. De plus, notre recherche nous a également permis de formuler plusieurs critiques relatives à l'indiscipline de la Cour dans l'application du domaine de la preuve dans les décisions portant sur les droits économiques des Autochtones.

El estudio de las relaciones transnacionales en las regiones de frontera, específicamente en la conformada por la provincia argentina de Misiones, el borde occidental del sur de Brasil y el este del Paraguay, cuyo punto de mayor gravitación es el tejido urbano-rural de Foz do Iguaçu, Ciudad del Este y Puerto Iguazú, nos enfrentó a la necesidad de plantear cuestiones teóricas y metodológicas para poder conocer y explicar el conjunto de relaciones existentes entre la formación socioeconómica y espacial regional, las prácticas de los agentes y colectivos de la sociedad fronteriza y los procesos de integración y globalización iniciados con el Mercosur. La recuperación de las categorías “imperio”, “imperialismo”, “estado imperial” y “sistema imperial”, nos situaron en una perspectiva mas adecuada frente a la complejidad del universo investigado.

La siguiente investigación tiene como fin exponer algunas de las múltiples actividades a través de las cuales se despliega la estrategia estadounidense de intervención en Africa, poniendo el acento en dos cuestiones: 1) aquellas acciones habilitantes de infraestructura, entrenamiento y asesoría a fuerzas locales, realizadas con el objeto de abaratar los costos políticos de la injerencia para el proyecto imperial y de cuidar los intereses corporativos ligados al modelo de acumulación extractivo; 2) aquellos programas que buscan incidir sobre la subjetividad de determinados segmentos poblacionales -para el Pentágono potencialmente insurgentes- a partir de una combinación y rediseño de elementos de represión con otros mecanismos de dominación cultural.

Luego de las resistencias que George W. Bush generó en la región, la llegada de Barack Obama despertó esperanzas en algunos mandatrios latinoamericanos. En el presente artículo analizamos el vínculo entre Estados Unidos y el resto del continente, a partir del análisis de las últimas dos Cumbres de las Américas: la de Puerto España (2009), en la que primó la expectativa por la relación entre iguales que prometió el recién asumido presidente demócrata; y la de Cartagena (2012), cuando emergió una nueva agenda impuesta por América Latina, pese a las presiones de Washington. Estas cumbres se inscriben en diferentes etapas de la relación entre Estados Unidos y el resto del Hemisferio, que muestran alcances y límites de las estrategias de la Casa Blanca, y reconfiguraciones regionales para enfrentar el poder de Estados Unidos.

Ti K-edge x-ray absorption near-edge spectroscopy (XANES) and Raman scattering were used to study the solid solution effects on the structural and vibrational properties of Pb(1-x)Ba(x)Zr(0.65)Ti(0.35)O(3) with 0.0 < x < 0.40. Compared with x-ray diffraction techniques, which indicates that the average crystal symmetry changes with the substitution of Pb by Ba ions or with temperature variations for samples with x=0.00, 0.10, and 0.20, local structural probes such as XANES and Raman scattering results demonstrate that at local level, the symmetry changes are much less prominent. Theoretical XANES spectra calculation corroborate with the interpretation of the XANES experimental data.

We report on the detection of the transport Barkhausen-like noise (TBN) in polycrystalline samples of Bi(1.65)Pb(0.35)Sr(2)Ca(2) Cu(3)O(10+delta) (Bi-2223) which were subjected to different uniaxial compacting pressures. The transport Barkhausen-like noise was measured when the sample was subjected to an ac triangular-shape magnetic field (f similar to 1 Hz) with maximum amplitude B(max) approximate to 5.5 mT, in order to avoid the flux penetration within the superconducting grains. Analysis of the TBN signal, measured for several values of excitation current density, indicated that the applied magnetic field in which the noise signal first appears, B(a)(t(i)), is closely related to the magnetic-flux pinning capability of the material. The combined results are consistent with the existence of three different superconducting levels within the samples: (i) the superconducting grains; (ii) the superconducting clusters; and (iii) the weak-links. We finally argue that TBN measurements constitute a powerful tool for probing features of the intergranular transport properties in polycrystalline samples of high-T(c) superconductors. Objective-To examine changes in the prevalence of cigarette smoking in 35 study populations of the World Health Organisation's MONICA Project. Design-Data from two independent, community-based surveys conducted, on average, five years apart. Setting-Geographically defined populations in 21 countries mainly in eastern and western Europe. Subjects-Randomly selected men and women aged 25-64 years. Numbers of participants in each study population ranged from 586 to 2817 in each survey. Main outcome measures-Changes in proportions of current smokers, ex-smokers, and never-smokers by age and sex using data collected by standardised methods. Results-Among men, smoking prevalence decreased in most populations, by three to four percentage points over five years. In Beijing, however, it increased in all age groups-overall by 11 percentage points. Among women there were increases in smoking in about half the populations. The increases were mainly in the age group 35-54 years and often in those populations where smoking prevalence among women has been relatively low. Conclusions-Smoking initiation by middle-aged women in parts of southern and eastern Europe and among men of all ages in Beijing is a matter of concern. The various public health measures that have helped to reduce smoking among men in developed countries should be vigorously extended to these other groups now at growing risk of smoking-related disease.

Hypoeutectic AI-Si alloys represent the most widely used alloy system for cast aluminium applications. This system has a unique behaviour with respect to grain formation where an increase in silicon content results in a transition to larger grain sizes after a minimum at an intermediate concentration. As a result of the already large solute content, grain refinement by solute additions is inefficient and nucleant particles from the common aluminium grain refiners are not as effective as in wrought alloys. However, casting conditions, such as a low pouring temperature, that promote the formation of wall crystals tie. crystals nucleated in the thermally undercooled layer at or next to mould walls) are very effective in yielding a small grain size. This paper presents results of an investigation of the effect of low superheat and mould preheat temperature on grain size. It was found that pouring temperature controls the effectiveness of the wall mechanism while mould preheat has little effect until high preheat temperatures at which a large increase in grain size occurs. The observed changes in grain size are explained in terms of the balance between nucleation rate and survival rate of crystal nuclei resulting from changes in superheat and mould temperature.
