Asset lending, unconscionable conduct and intermediaries

This article deals with cases where borrowers of loans for business or investment claimed their lender had engaged in asset lending which amounted to unconscionable conduct under the equitable doctrine or under the Australian Securities and Investments Commission Act 2001 (Cth). The article reviews recent cases, seeking to identify the key factors influencing a conclusion of, or against, unconscionable conduct. The article examines the practice of lending through intermediaries and how the application of agency law can insulate lenders from the wrongful conduct of intermediaries. The article explains the gap in the current position and discusses possible law reform which may remedy that.

La guerra de las computadoras de bolsillo en el aula.

La calculadora de bolsillo ha sido mal recibida por los profesores. Razones aducidas en contra: es discriminatoria en razón de su precio; es nociva para el alumno perezoso con el cálculo mental. El alumno de bachiller tiene que estar familiarizado con los automatismos del cálculo. Pero esa familiarización se ha debido producir antes de su ingreso en el bachillerato. El profesor de bachiller (de matemáticas o de física y química) que descubre deficiencias en las facultades operatorias que sus alumnos presumiblemente han de tener, no las mejorará con la simple prohibición de las calculadoras. La única solución es obligar a esos alumnos a ejercitarse por medio de la realización de cuadernos de cálculo que estén en el mercado y son para alumnos de 8 a 10 años. El profesor no puede prescindir de la calculadora porque parte de sus alumnos no tengan el hábito o la agilidad mental. Las calculadoras en general, son muy mal utilizadas por los escolares y algunos evitan todo cálculo mental, pierden todo sentido crítico y se someten a una dependencia peligrosa. ¿Por qué los escolares calculan mal? La culpa no la tiene la calculadora, cuya aparición en escena es reciente(1975 hay que buscarla en dos circunstancias : el cambio de programas de estudios al cambiarse la primaria en EGB; la eliminación de las pruebas de nivel (ingreso en el bachillerato, reválidas) ha hecho que dependa de la indolencia particular de cada docente la valoración negativa de los errores de cálculo observados en los alumnos y que no pueda suponerse como sería deseable un dominio de los automatismos de un alumno. Como consecuencia del curso de bachillerato en el que se encuentre. Estamos inmersos en la era informática y la enseñanza no puede ser ajena a esa realidad. Interesa orientar desde el principio al buen uso de la calculadora a los alumnos.

On data-centric misbehavior detection in VANETs

Detecting misbehavior (such as transmissions of false information) in vehicular ad hoc networks (VANETs) is a very important problem with wide range of implications, including safety related and congestion avoidance applications. We discuss several limitations of existing misbehavior detection schemes (MDS) designed for VANETs. Most MDS are concerned with detection of malicious nodes. In most situations, vehicles would send wrong information because of selfish reasons of their owners, e.g. for gaining access to a particular lane. It is therefore more important to detect false information than to identify misbehaving nodes. We introduce the concept of data-centric misbehavior detection and propose algorithms which detect false alert messages and misbehaving nodes by observing their actions after sending out the alert messages. With the data-centric MDS, each node can decide whether an information received is correct or false. The decision is based on the consistency of recent messages and new alerts with reported and estimated vehicle positions. No voting or majority decisions is needed, making our MDS resilient to Sybil attacks. After misbehavior is detected, we do not revoke all the secret credentials of misbehaving nodes, as done in most schemes. Instead, we impose fines on misbehaving nodes (administered by the certification authority), discouraging them to act selfishly. This reduces the computation and communication costs involved in revoking all the secret credentials of misbehaving nodes. © 2011 IEEE.
