Understanding the legal implications of data sharing, access and reuse in the Australian research landscape

Researchers are increasingly involved in data-intensive research projects that cut across geographic and disciplinary borders. Quality research now often involves virtual communities of researchers participating in large-scale web-based collaborations, opening their earlystage research to the research community in order to encourage broader participation and accelerate discoveries. The result of such large-scale collaborations has been the production of ever-increasing amounts of data. In short, we are in the midst of a data deluge. Accompanying these developments has been a growing recognition that if the benefits of enhanced access to research are to be realised, it will be necessary to develop the systems and services that enable data to be managed and secured. It has also become apparent that to achieve seamless access to data it is necessary not only to adopt appropriate technical standards, practices and architecture, but also to develop legal frameworks that facilitate access to and use of research data. This chapter provides an overview of the current research landscape in Australia as it relates to the collection, management and sharing of research data. The chapter then explains the Australian legal regimes relevant to data, including copyright, patent, privacy, confidentiality and contract law. Finally, this chapter proposes the infrastructure elements that are required for the proper management of legal interests, ownership rights and rights to access and use data collected or generated by research projects.

A unified model for the dynamics of driven ribbon with strain and magnetic order parameters

We develop a unified model to explain the dynamics of driven one dimensional ribbon for materials with strain and magnetic order parameters. We show that the model equations in their most general form explain several results on driven magnetostrictive metallic glass ribbons such as the period doubling route to chaos as a function of a dc magnetic field in the presence of a sinusoidal field, the quasiperiodic route to chaos as a function of the sinusoidal field for a fixed dc field, and induced and suppressed chaos in the presence of an additional low amplitude near resonant sinusoidal field. We also investigate the influence of a low amplitude near resonant field on the period doubling route. The model equations also exhibit symmetry restoring crisis with an exponent close to unity. The model can be adopted to explain certain results on magnetoelastic beam and martensitic ribbon under sinusoidal driving conditions. In the latter case, we find interesting dynamics of a periodic one orbit switching between two equivalent wells as a function of an ac magnetic field that eventually makes a direct transition to chaos under resonant driving condition. Génesis de la formación permanente del profesorado de Educación Física

El presente artículo trata de realizar una revisión histórica sobre los inicios de la formación permanente del profesorado de educación física en España y más concretamente en el ámbito de la Comunidad Autónoma Andaluza, como uno de los elementos fundamentales de la mejora de la calidad docente en los actuales sistemas educativos. Para ello, se realiza una profunda revisión legislativa desde los primeros intentos de actualización y formación del profesor del siglo XVIII hasta los cambios educativos surgidos hasta después de la Guerra Civil Española. Las conclusiones han demostrado que aunque los docentes de Gimnasia (Educación Física actual) siempre tuvieron un tratamiento y consideración especial que les diferenciaba del resto de docentes de otras materias, en contra de lo que se podía pensar, siempre han estado presentes desde el inicio de las actividades de Formación Permanente, en las diferentes propuestas de actividades para poder mejorar su docencia e incrementar la consideración social de esta materia, como una parte importante de los diferentes planes de estudio.
