The decision in QCOAL Pty Ltd v Cliffs Australia Coal Pty Ltd [2010] QSC 479 involved an examination of a number of issues relating to the assessment of costs under the Legal Profession Act 2007 (Qld). The decision highlights a range of issues which, in slightly different circumstances, may have deprived the successful party of the right to recover costs by reference to the costs agreement.

Novel species of fungi described in the present study include the following from South Africa: Alanphillipsia aloeicola from Aloe sp., Arxiella dolichandrae from Dolichandra unguiscati, Ganoderma austroafricanum from Jacaranda mimosifolia, Phacidiella podocarpi and Phaeosphaeria podocarpi from Podocarpus latifolius, Phyllosticta mimusopisicola from Mimusops zeyheri and Sphaerulina pelargonii from Pelargonium sp. Furthermore, Barssia maroccana is described from Cedrus atlantica (Morocco), Codinaea pini from Pinus patula (Uganda), Crucellisporiopsis marquesiae from Marquesia acuminata (Zambia), Dinemasporium ipomoeae from Ipomoea pes-caprae (Vietnam), Diaporthe phragmitis from Phragmites australis (China), Marasmius vladimirii from leaf litter (India), Melanconium hedericola from Hedera helix (Spain), Pluteus albotomentosus and Pluteus extremiorientalis from a mixed forest (Russia), Rachicladosporium eucalypti from Eucalyptus globulus (Ethiopia), Sistotrema epiphyllum from dead leaves of Fagus sylvatica in a forest (The Netherlands), Stagonospora chrysopyla from Scirpus microcarpus (USA) and Trichomerium dioscoreae from Dioscorea sp. (Japan). Novel species from Australia include: Corynespora endiandrae from Endiandra introrsa, Gonatophragmium triuniae from Triunia youngiana, Penicillium coccotrypicola from Archontophoenix cunninghamiana and Phytophthora moyootj from soil. Novelties from Iran include Neocamarosporium chichastianum from soil and Seimatosporium pistaciae from Pistacia vera, Xenosonderhenia eucalypti and Zasmidium eucalyptigenum are newly described from Eucalyptus urophylla in Indonesia. Diaporthe acaciarum and Roussoella acacia are newly described from Acacia tortilis in Tanzania. New species from Italy include Comoclathris spartii from Spartium junceum and Phoma tamaricicola from Tamarix gallica. Novel genera include (Ascomycetes): Acremoniopsis from forest soil and Collarina from water sediments (Spain), Phellinocrescentia from a Phellinus sp. (French Guiana), Neobambusicola from Strelitzia nicolai (South Africa), Neocladophialophora from Quercus robur (Germany), Neophysalospora from Cotymbia henryi (Mozambique) and Xenophaeosphaeria from Grewia sp. (Tanzania). Morphological and culture characteristics along with ITS DNA barcodes are provided for all taxa.

O sistema eletrônico de votação em plenário é utilizado pela primeira vez. O Senador Jarbas Passarinho (PFL-AM) ressalta que com o novo processo a votação será mais ágil. A Comissão de Sistematização discute o capítulo dos direitos políticos e define quem poderá ser eleito e reeleito no Poder Executivo. A Comissão de Sistematização aprecia os três primeiros parágrafos do artigo 13º que trata dos direitos políticos: sufrágio universal, alistamento eleitoral, voto obrigatório e facultativo, elegibilidade e outros. O Deputado Egídio Ferreira Lima (PMDB-PE) faz um relato sobre a questão da idade para o cargo de Juiz de Paz. Constituintes criticam a idade de 25 anos para o cidadão se candidatar ao cargo de prefeito como declaram o Senador Nelson Carneiro (PMDB-RJ) e o Deputado Cássio Cunha Lima (PMDB-PB). Constituintes discutem o direito de voto aos 16 anos. O destaque é votado e aprovado na Comissão de Sistematização.

Reunião da Mesa da Constituinte discute como será a votação do substitutivo da Sistematização no Plenário geral. Já existem propostas do Centrão e da Mesa. De acordo com o Senador Mauro Benevides (PMDB-CE), presidente em exercício da Assembleia Nacional Constituinte (ANC), a Mesa se encaminhará para a apresentação de outro substitutivo. Sessão solene conclui os trabalhos da Comissão de Sistematização dando por encerrada a votação do substitutivo, este encaminhado à Mesa da ANC. O Deputado Bernardo Cabral (PMDB-AM), faz considerações sobre os trabalhos da Comissão de Sistematização. O Senador Affonso Arinos (PFL-RJ) repete a frase de Benjamin Franklin: "Por haver vivido muito, fui levado a mudar de opinião várias vezes em assuntos importantes, assim aceito este projeto" e conclui declarando aceitar o projeto. O Deputado Amaury Muller (PDT-RS) afirma que embora os Constituintes façam um balanço positivo dos assuntos que foram tratados na Sistematização, reconhecendo seu trabalho, mantém-se a fé e a esperança de que os Constituintes no Plenário possam traduzir com fidelidade os compromissos que assumiram com a sociedade brasileira durante a campanha eleitoral. O Senador Mario Covas (PMDB-SP), a Deputada Sandra Martins Cavalcanti (PFL-RJ) e o Deputado Arnaldo Faria de Sá (PTB-SP) consideram que no Plenário alguns dos pontos do substitutivo serão reformados, enriquecendo o texto. O Deputado Carlos Sant'anna (PMDB-BA) ressalta a necessidade de alterações em questões formais como a língua, a estrutura e a harmonia do texto. O Deputado Luiz Inácio Lula Da Silva (PT-SP) espera que o projeto tenha melhorias no Plenário, pois a sociedade brasileira está na expectativa de que esta Constituição possa retratar sua luta nos últimos anos. O Senador Fernando Henrique Cardoso (PMDB-SP) crê que o resultado dos trabalhos será uma Constituição democrática e moderna.

The phenomenon of the downstream movement of brown trout fry has been noticed for a very long time by fish biologists. The work presented here, and taking place in the framework of the hydrobiological research of the INRA, represents the results of three years' observation of the movement downstream in the Lissuraga, a small stream in the French Basque country, in connection with certain environmental factors, which are shown. The authors have used a live experiment to compare, in an artificial stream, the ”descending” (or ”Nomadic”) fry with the ”resident” fry, caught by electric fishing in other parts of the stream.

The coupling efficiency of laser beam to multimode fiber is given by geometrical optics, and the relation between the maximum coupling efficiency and the beam propagation factor M-2 is analyzed. An equivalent factor M-F(2) for the multimode fiber is introduced to characterize the fiber coupling capability. The coupling efficiency of laser beam to multimode fiber is calculated in respect of the ratio M-2/M-F(2) by the overlapping integral theory. The optimal coupling efficiency can be roughly estimated by the ratio of M-2 to M-F(2) but with a large error range. The deviation comes from the lacks of information on the detail of phase and intensity profile in the beam factor M-2. (C) 2007 Elsevier B.V. All rights reserved.

We present descriptions of a new order (Ranunculo cortusifolii-Geranietalia reuteri and of a new alliance (Stachyo lusitanicae-Cheirolophion sempervirentis) for the herbaceous fringe communities of Macaronesia and of the southwestern Iberian Peninsula, respectively. A new alliance, the Polygalo mediterraneae-Bromion erecti (mesophilous post-cultural grasslands), was introduced for the Peninsular Italy. We further validate and typify the Armerietalia rumelicae (perennial grasslands supported by nutrient-poor on siliceous bedrocks at altitudes characterized by the submediterranean climate of central-southern Balkan Peninsula), the Securigero-Dasypyrion villosae (lawn and fallow-land tall-grass annual vegetation of Italy), and the Cirsio vallis-demoni-Nardion (acidophilous grasslands on siliceous substrates of the Southern Italy). Nomenclatural issues (validity, legitimacy, synonymy, formal corrections) have been discussed and clarified for the following names: Brachypodio-Brometalia, Bromo pannonici-Festucion csikhegyensis, Corynephoro-Plantaginion radicatae, Heleochloion, Hieracio-Plantaginion radicatae, Nardetea strictae, Nardetalia strictae, Nardo-Callunetea, Nardo-Galion saxatilis, Oligo-Bromion, Paspalo-Heleochloetalia, Plantagini-Corynephorion and Scorzoneret alia villosae.

In this article, we address the importance and relevance that social networks exhibit in their use as an educational resource. This relevance relies in the possibility of implementing new learning resources or increasing the level of the participant's connectivity, as well as developing learning communities. Also, the risk entailed from their use is discussed, especially for the students that have a low technological education or those having excessive confidence on the media. It is important to highlight that the educational use of social networks is not a simple extension or translation of the student's habitual, recreational use, but that it implies an important change in the roles given to teachers as well as learners; from accommodative learning environments that only encourage memorization to other environments that demand an active, reflective, collaborative and proactive attitude, that require the development/acquisition of technological as well as social abilities, aptitudes and values. It is also important to highlight that a correct implementation and adequate use will not only foment formal learning, but also informal and non-formal learning.
