Outra ainda é a sua interpretação que, sendo também literal, não pode esquecer a sua teleologia e história, art. 9º do Código Civil. E quando é que a lei entrou em vigor e em que espaço se aplica? Abstract: Genocide may prescribe? Unfortunately, it can. One thing is the law, another is its application. Another is its interpretation being also a literal, can not forget its teleology and history, art. 9 of the Civil Code. And when the law came into force and in what space does it apply?

The long march of modernization of the Western societies tends to be presented as following a regular sequence: societies and institutions were pre-modern, and then they were modernized, eventually becoming post-modern. Such teleology may provide an incomplete or distorted narrative of societal evolution in many parts of the world, even in the ‘post-modern heartland’ of Western Europe, with Portugal being a case in point. The concept of archaic post-modernity has been developed by a philosopher, José Gil, to show how Portuguese institutions and organizations combine elements of pre-modernity and post-modernity. The notion of an archaic post-modernity is advanced in order to provide an alternative account of the modernization process, which enriches discussion of the varieties of capitalism. Differences in historical experiences create singularities that may be considered in the analysis of culture, management and organization.

L'auteur esquisse la relation de l'utilitarisme et du christianisme sous l'angle triple des rapports entre le bien et le salut, le sacrifice et le sujet, la souffrance réduite ou affrontée. Le trépied ainsi proposé ne constitue pas une cage de fer, à laquelle toute comparaison et toute lecture devraient se soumettre ou se refuser, mais seulement une possible structure de dialogue et de débat, devant faciliter et fructifier l'interpellation réciproque de la morale utilitariste et de l'éthique chrétienne.

This study discusses the interactions of different decision-making mechanisms in the process of change of a successful entrepreneurial dairy firm in Vietnam. The purpose of the study is to construct a theoretical framework, which explains the interactions between effectual and causal decision-making processes in different phases of business, and to provide a real life example with practical recommendations for entrepreneurs and managers. In order to achieve this purpose, a preliminary theoretical framework was built, using process theories applied to different decision making modes, referred to as causation and effectuation. The case was studied through ethnographic research method, with three semi-structured interviews, one unstructured interview, secondary data and observations within four months in 2013-2014. After the data was analyzed, a modified framework was drawn from the result. The finding of this study shows that there was an interaction between effectual and causal decision-making processes in different stages of the company’s development. The entrepreneur applied effectual decision-making process to develop a unique business model and a new dairy market segment. However, when a new market demand arose, the company’s resources became insufficient, they thus had to shift to causation process to adapt to market change. Simultaneously, with better-accumulated resources, the entrepreneur continued the effectuation process to create another brand new dairy market segment. This study, thus, contributes to effectuation theory, emphasizing the necessity of combining effectual and causal decision-making processes in different phases of business. It is suggested that business would develop with an effectual process until a business model is viable for growth. It continues to use this process up to a certain degree. When the market changes, the company needs to collect more means to adapt to the changes. They need to set new goals and this is a shift to the use of causal process, which builds on prediction. It uses goals and teleology as driving mechanisms and tries to exploit and fill potential resource gaps to achieve these goals. At the same time, there are new iterations that look to establish new lines or types of business with the given means, which are now well established. This again employs effectual mechanisms, which are based on evolutionary process, until they reach the stage of viable tested business model. Moreover, this study hopes to provide know-how to entrepreneurs and managers of small companies in similar situations, suggesting how to combine effectual and causal decision-making processes to deal with various circumstances in different times.

L’historien n’écrit pas de nulle part. Ancré dans son présent et participant à la société, il en épouse – ou critique – les projets, les utopies et les grands récits. Nous proposons dans ce travail d’approfondir cet ancrage à travers une histoire croisée et comparée des expériences du temps de deux historiens français (Michel de Certeau, François Furet) et d’un historien-sociologue québécois (Fernand Dumont). Notre objectif est double : il s’agit d’établir, dans un premier temps, les correspondances entre leurs expériences lors de deux tournants, celui des années 1960 et celui des années 1970. Tout en prenant en compte les contextes des auteurs à l’étude, nous élargirons l’échelle d’analyse afin de cerner la contemporanéité d’expériences du temps qui ne se réduisent pas aux seuls cadres nationaux. Nous pourrons ainsi établir les coordonnées des régimes d’historicité à chaque tournant en contribuant à préciser les différentes combinaisons des modes futuristes et présentistes en jeu. Dans un deuxième temps, nous explorerons les liens entre historiographie et régime d’historicité afin de mettre en évidence les jonctions entre les considérations épistémologiques et l’horizon d’attente des historiens à l’étude. En abordant plus spécifiquement la question du rôle de l’historien dans sa société, nous jaugeons les transformations parallèles de son expérience du temps et de ses pratiques historiographiques. Le passage de l’expérience d’une Histoire en marche au tournant de 1960 à celle d’une histoire bloquée au tournant de 1970 affecte considérablement la place et le statut de l’historien. D’éminent passeur du temps à l’écoute du sens du progrès, l’historien voit son statut contesté et marginalisé, ce qui ne veut pas dire que son rôle est moins important. Qu’il débusque des alternatives passées ou court-circuite des téléologies, il est chargé de maintenir coûte que coûte ouverts les horizons du temps. Nous verrons spécifiquement le sens que prenait cette tâche à un moment où la possibilité d’une « société nouvelle », après Mai 68, pointait à l’horizon des contemporains.

L’objectif de cette thèse est de proposer une caractérisation du bien propre des touts écologiques, comme les communautés biotiques et les écosystèmes, dont peut être dérivée une notion de ce qui est bon pour eux. Ceci vise à défendre les deux principales approches holistes en éthique de l’environnement, c’est-à -dire l’approche pragmatiste défendue par Bryan G. Norton et l’approche écocentriste défendue par J. Baird Callicott, contre certaines objections ayant été soulevées contre elles, faisant valoir l’impossibilité pour les écosystèmes d’avoir un bien propre. Cette thèse répond à ces objections en mobilisant plusieurs ressources théoriques issues de la philosophie de la biologie et de la méta-éthique. Ces ressources sont notamment celles fournies par les discussions sur les notions de fonction et de santé en philosophie de la biologie, celles fournies par les conceptions néo-aristotéliciennes de la normativité en méta-éthique, et celles offertes par les discussions de philosophie de l’écologie sur le holisme et le réductionnisme, sur l’idée d’équilibre de la nature, et sur le concept de santé écosystémique. Cette thèse mobilise ces ressources afin d’élaborer les fondements philosophiques des notions de fonction écologique et de santé écosystémique, desquelles est dérivée une caractérisation du bien propre des écosystèmes.

Purpose - To present an account of cognition integrating second-order cybernetics (SOC) together with enactive perception and dynamic systems theory. Design/methodology/approach - The paper presents a brief critique of classical models of cognition then outlines how integration of SOC, enactive perception and dynamic systems theory can overcome some weaknesses of the classical paradigm. Findings - Presents the critique of evolutionary robotics showing how the issues of teleology and autonomy are left unresolved by this paradigm although their solution fits within the proposed framework. Research limitations/implications - The paper highlights the importance of genuine autonomy in the development of artificial cognitive systems. It sets out a framework within which the robofic research of cognitive systems could succeed. Practical implications - There are no immediate practical implications but see research implications. Originality/value - It joins the discussion on the fundamental nature of cognitive systems and emphasise the importance of autonomy and embodiment.

This chapter looks at three films whose Portuguese urban settings offer a privileged ground for the re-evaluation of the classical-modern-postmodern categorisation with regard to cinema. They are The State of Things (Wim Wenders, 1982), Foreign Land (Walter Salles and Daniela Thomas, 1995) and Mysteries of Lisbon (Raúl Ruiz, 2010). In them, the city is the place where characters lose their bearings, names, identities, and where vicious circles, mirrors, replicas and mise-en-abyme bring the vertiginous movement that had characterised the modernist city of 1920s cinema to a halt. Curiously, too, it is the place where so-called postmodern aesthetics finally finds an ideal home in self-ironical tales that expose the film medium’s narrative shortcomings. Intermedial devices, whether Polaroid stills or a cardboard cut-out theatre, are then resorted to in order to turn a larger-than-life reality into framed, manageable narrative miniatures. The scaled-down real, however, turns out to be a disappointing simulacrum, a memory ersatz that unveils the illusory character of cosmopolitan teleology. In my approach, I start by examining the intertwined and transnational genesis of these films that resulted in three correlated visions of the end of history and of storytelling, typical of postmodern aesthetics. I move on to consider intermedia miniaturism as an attempt to stop time within movement, an equation that inevitably brings to mind the Deleuzian movement-time binary, which I revisit in an attempt to disentangle it from the classical-modern opposition. I conclude by proposing reflexive stasis and scale reversal as the common denominator across all modern projects, hence, perhaps, a more advantageous model than modernity to signify artistic and political values.

This chapter re-evaluates the diachronic, evolutionist model that establishes the Second World War as a watershed between classical and modern cinemas, and ‘modernity’ as the political project of ‘slow cinema’. I will start by historicising the connection between cinematic speed and modernity, going on to survey the veritable obsession with the modern that continues to beset film studies despite the vagueness and contradictions inherent in the term. I will then attempt to clarify what is really at stake within the modern-classical debate by analysing two canonical examples of Japanese cinema, drawn from the geidomono genre (films on the lives of theatre actors), Kenji Mizoguchi’s Story of the Late Chrysanthemums (Zangiku monogatari, 1939) and Yasujiro Ozu’s Floating Weeds (Ukigusa, 1954), with a view to investigating the role of the long take or, conversely, classical editing, in the production or otherwise of a supposed ‘slow modernity’. By resorting to Ozu and Mizoguchi, I hope to demonstrate that the best narrative films in the world have always combined a ‘classical’ quest for perfection with the ‘modern’ doubt of its existence, hence the futility of classifying cinema in general according to an evolutionary and Eurocentric model based on the classical-modern binary. Rather than on a confusing politics of the modern, I will draw on Bazin’s prophetic insight of ‘impure cinema’, a concept he forged in defence of literary and theatrical screen adaptations. Anticipating by more than half a century the media convergence on which the near totality of our audiovisual experience is currently based, ‘impure cinema’ will give me the opportunity to focus on the confluence of film and theatre in these Mizoguchi and Ozu films as the site of a productive crisis where established genres dissolve into self-reflexive stasis, ambiguity of expression and the revelation of the reality of the film medium, all of which, I argue, are more reliable indicators of a film’s political programme than historical teleology. At the end of the journey, some answers may emerge to whether the combination of the long take and the long shot are sufficient to account for a film’s ‘slowness’ and whether ‘slow’ is indeed the best concept to signify resistance to the destructive pace of capitalism.
