Le devoir d’accommodement raisonnable a fait couler beaucoup d’encre, au Québec et ailleurs au Canada, au cours de la dernière décennie. Depuis la première fois où elle fût énoncée par la Cour suprême du Canada en 1985, les tribunaux ont été appelés à se prononcer à maintes reprises sur cette notion. Partant d’un concept juridique vague et peu précis, les décideurs ont cherché à définir le concept d’accommodement raisonnable à travers une étude approfondie de sa seule limite : la contrainte excessive. Il est désormais acquis que les employeurs ont l’obligation d’adapter le travail et les lieux de travail pour permettre aux personnes handicapées d’avoir accès à l’emploi sans discrimination. Le syndicat, tout comme le salarié visé par une demande d’accommodement, a également l’obligation de collaborer à la recherche de mesures de redressement. Ce mémoire propose une étude jurisprudentielle des concepts d’accommodements raisonnables et de contrainte excessive. Notre analyse portera sur les décisions des tribunaux judiciaires et administratifs rendues au Québec entre 1999 et 2010. La présente étude a pour objet principal d’analyser l’étendue de la notion de contrainte et à la circonscrire avec clarté et précision.

“At resale stores I have seen brand new clothes with original price tag still hanging from the sleeve. Some children have so many toys that they stay frustrated, not knowing which one to pick up for their next amusement. Presumably sensible adults trade in perfectly good cars just to have something shinier and newer. Didn’t us once live productive normal lives, without all these gadgets” [Cunningham (2005)]. During late eighties, nearly forty four percent of the participants, who took part in a consumer survey conducted in the US, responded positively to the question “My closets are filled with still 2 unopened items” [Faber and O’Guinn (1988)]. Reading such excerpts does not greatly surprise us anymore; as such reports have become common now. For many people shopping has moved beyond something that caters to their needs and wants and has become a hobby [Cunningham (2005)], an activity that they engage in to satisfy their hedonistic or pleasure-seeking goals [Ramnathan and Menon(2006), O’Cass and McEween (2004), Faber and O’Guinn (1989)]. Others look at their new possession as something that fills a void in their lives [Belk (1985), Diener et al. (1993)].

Land use has become a force of global importance, considering that 34% of the Earth’s ice-free surface was covered by croplands or pastures in 2000. The expected increase in global human population together with eminent climate change and associated search for energy sources other than fossil fuels can, through land-use and land-cover changes (LUCC), increase the pressure on nature’s resources, further degrade ecosystem services, and disrupt other planetary systems of key importance to humanity. This thesis presents four modeling studies on the interplay between LUCC, increased production of biofuels and climate change in four selected world regions. In the first study case two new crop types (sugarcane and jatropha) are parameterized in the LPJ for managed Lands dynamic global vegetation model for calculation of their potential productivity. Country-wide spatial variation in the yields of sugarcane and jatropha incurs into substantially different land requirements to meet the biofuel production targets for 2015 in Brazil and India, depending on the location of plantations. Particularly the average land requirements for jatropha in India are considerably higher than previously estimated. These findings indicate that crop zoning is important to avoid excessive LUCC. In the second study case the LandSHIFT model of land-use and land-cover changes is combined with life cycle assessments to investigate the occurrence and extent of biofuel-driven indirect land-use changes (ILUC) in Brazil by 2020. The results show that Brazilian biofuels can indeed cause considerable ILUC, especially by pushing the rangeland frontier into the Amazonian forests. The carbon debt caused by such ILUC would result in no carbon savings (from using plant-based ethanol and biodiesel instead of fossil fuels) before 44 years for sugarcane ethanol and 246 years for soybean biodiesel. The intensification of livestock grazing could avoid such ILUC. We argue that such an intensification of livestock should be supported by the Brazilian biofuel sector, based on the sector’s own interest in minimizing carbon emissions. In the third study there is the development of a new method for crop allocation in LandSHIFT, as influenced by the occurrence and capacity of specific infrastructure units. The method is exemplarily applied in a first assessment of the potential availability of land for biogas production in Germany. The results indicate that Germany has enough land to fulfill virtually all (90 to 98%) its current biogas plant capacity with only cultivated feedstocks. Biogas plants located in South and Southwestern (North and Northeastern) Germany might face more (less) difficulties to fulfill their capacities with cultivated feedstocks, considering that feedstock transport distance to plants is a crucial issue for biogas production. In the fourth study an adapted version of LandSHIFT is used to assess the impacts of contrasting scenarios of climate change and conservation targets on land use in the Brazilian Amazon. Model results show that severe climate change in some regions by 2050 can shift the deforestation frontier to areas that would experience low levels of human intervention under mild climate change (such as the western Amazon forests or parts of the Cerrado savannas). Halting deforestation of the Amazon and of the Brazilian Cerrado would require either a reduction in the production of meat or an intensification of livestock grazing in the region. Such findings point out the need for an integrated/multicisciplinary plan for adaptation to climate change in the Amazon. The overall conclusions of this thesis are that (i) biofuels must be analyzed and planned carefully in order to effectively reduce carbon emissions; (ii) climate change can have considerable impacts on the location and extent of LUCC; and (iii) intensification of grazing livestock represents a promising venue for minimizing the impacts of future land-use and land-cover changes in Brazil.

Aus den im Rahmen dieser Forschungsarbeit empirisch gewonnenen Erkenntnissen werden Gestaltungsempfehlungen für das Public Debt Management abgeleitet. Diese zeigen, dass ein wirtschaftliches Public Debt Management nicht ein ausschließlich kostenminimierendes (sparsames), sondern ein kosten-risiko-optimales Public Debt Management mit effektiven internen und externen Überwachungsinstrumenten und wirksamer externer Finanzkontrolle sein muss.

La importancia del sueño y las patologías relacionadas con el mismo son ampliamente reconocidas en el campo de la medicina y la neurología, sin embargo la mayoría de neurólogos dedican muy poco tiempo al estudio de estas entidades y muy raramente durante la valoración de los pacientes se indaga acerca de la presencia de trastornos relacionados con el sueño. Esto es sorprendente si tenemos en cuenta que pasamos casi un tercio de la vida durmiendo, además de la alta incidencia de trastornos de sueño en la población general. A continuación revisaremos los principales trastornos del sueño, su diagnóstico y tratamiento.

This paper examines the workaholism phenomenon in different work situations in Colombian company. Workaholism was defined as the individual’s steady and considerable allocation of time to work, which is not derived from external necessities (1). The research studies about workaholics and workaholism have been increasing a lot in the last years (2). Workaholism is an addiction that actually is affecting a lot of people around the world and has serious consequences in personal life, in the community and also in economy. Some of these researches are directed to explore ways to diagnose when a person is workaholic and when this situation may affect the performanceof the individual in work, daily life activities and especially in psychosocial area. Objective: this pilot study contributes to identify if Colombian workers present the main characteristicsof workaholism and if the job they perform is related to the presence of the characteristics of this addiction. Materials and method: for this pilot study used the Dutch Work Addiction Scale(DUWAS), this test suggests when a person has work addiction, trough the evaluation of two main components working excessively and working compulsively. Results: the study find differences for the two groups: the 67% of the AE group are over the average while only the 33% of the members of the O group are over it. Conclusions: these percentages show that the combinations of the components of workaholism are more evident in the population belonging to the administrative/executive jobs group, giving evidence that workaholism is presented in greater proportion in the population performance management positions.

También, se evalúan los efectos profundamente destructivos del problema tanto para los países como para los individuos y, plantea posibles soluciones a largo plazo. Los hechos y debates expuestos desde diferentes puntos de vista muestran la complejidad del tema pero ayudan al lector a formarse una opinión personal al respecto.

The euro area today consists of a competitive, moderately leveraged North and an uncompetitive, over-indebted South. Its main macroeconomic challenge is to carry out the adjustment required to restore the competitiveness of its southern part and eliminate its excessive public and private debt burden. This paper investigates the relationship between fiscal and competitiveness adjustment in a stylised model with two countries in a monetary union, North and South. To restore competitiveness, South implements a more restrictive fiscal policy than North. We consider two scenarios. In the first, monetary policy aims at keeping inflation constant in the North. The South therefore needs to deflate to regain competitiveness, which worsens the debt dynamics. In the second, monetary policy aims at keeping inflation constant in the monetary union as a whole. This results in more monetary stimulus, inflation in the North is higher, and this in turn helps the debt dynamics in the South. Our main findings are: •The differential fiscal stance between North and South is what determines real exchange rate changes. South therefore needs to tighten more. There is no escape from relative austerity. •If monetary policy aims at keeping inflation stable in the North and the initial debt is above a certain threshold, debt dynamics are perverse: fiscal retrenchment is self-defeating; •If monetary policy targets average inflation instead, which implies higher inflation in the North, the initial debt threshold above which the debt dynamics become perverse is higher. Accepting more inflation at home is therefore a way for the North to contribute to restoring debt sustainability in the South. •Structural reforms in the South improve the debt dynamics if the initial debt is not too high. Again, targeting average inflation rather than inflation in the North helps strengthen the favourable effects of structural reforms.
