We study the competition interface between two growing clusters in a growth model associated to last-passage percolation. When the initial unoccupied set is approximately a cone, we show that this interface has an asymptotic direction with probability 1. The behavior of this direction depends on the angle theta of the cone: for theta >= 180 degrees, the direction is deterministic, while for theta < 180 degrees, it is random, and its distribution can be given explicitly in certain cases. We also obtain partial results on the fluctuations of the interface around its asymptotic direction. The evolution of the competition interface in the growth model can be mapped onto the path of a second-class particle in the totally asymmetric simple exclusion process; from the existence of the limiting direction for the interface, we obtain a new and rather natural proof of the strong law of large numbers (with perhaps a random limit) for the position of the second-class particle at large times.

This paper addresses the broader unresolved issues posed by the patenting of genetic materials that are central to dealing with the tension between the patenting and competition schemes, namely distinguishing between what has already been 'discovered' and economically useful innovations (including the thresholds for novelty and non-obviousness), the exclusion of some subject matter from patenting and the restrictions on access to genetic resources to facilitate further innovation. The possible solutions of raising the threshold patenting standards, taking advantage of international intellectual property law developments and compulsory licensing are examined as ways to ameliorate the possibly detrimental consequences of current genetic material patenting practices. This study is a reflection on the Portuguese Framework Law on Social Economy, highlighting, from a critical point-of-view, its contribution to the explicit institutional and legal recognition of the social economy sector. It does so by defining the concept of social economy and listing the entities engaged in this sector, by defining its guiding principles and the mechanisms for its promotion and encouragement, and also by describing the creation of a tax and competition regime which will take into account its specificities. The setting up of this foundations of the social economy was based on the constitutional principle of protection of the social and cooperative sector, which substantiates the adoption of differentiating solutions in view of the positive discrimination of this sector.

This paper examines statins competition in the Spanish pharmaceutical market, where prices are highly regulated, and simulates a situation in which there is unrestricted price competition. A nested logit demand model is estimated with a panel of monthly data for pharmaceuticals prescribed from 1997 to 2005. The simulation indicates that the regulation of prices is similar in its effects to cooperation among producers, since the regulated prices are close to those that would be observed in a scenario of perfect collusion. Freedom to set prices and a regulatory framework with appropriate incentives would result in a general reduction in prices and may make the current veiled competition in the form of discounts to pharmacists become more visible. The decrease in prices would be partially offset by an increase in consumption but the net effect would be an overall decrease in expenditure. The counterfactual set-up would also lead to important changes in the market shares of both manufacturers and active ingredients, and a reversal of generic drugs. Therefore, pro-competitive regulation would be welfare-enhancing but would imply winners and losers.

This paper estimates the effect of judicial institutions on governance at the local level in Brazil. Our estimation strategy exploits a unique institutional feature of state judiciary branches which assigns prosecutors and judges to the most populous among contiguous counties forming a judiciary district. As a result of this assignment mechanism there are counties with nearly identical populations, some with and some without local judicial presence, which we exploit to impute counterfactual outcomes. Conditional on observable county characteristics, offenses per civil servant are about 35% lower in counties that have a local seat of the state judiciary. The lower incidence of infractions stems mostly from fewer violations of financial management regulations by local administrators, fewer instances of problems in project execution and project managment, fewer cases of non-existent or ineffective civil society oversight and fewer cases of improper handling of remittances to local residents.

Lâauteur fonde son argument sur lâimportance déterminante des conséquences économiques de la numérisation sur lâévolution des droits dâauteur afférant à la musique. La musique numérisée correspondant à un bien public, les prix de sa négociation tendent vers 0, et seules les contraintes légales telles que les droits dâauteur ou les ententes sur les prix, qui sont généralement proscrites par les lois sur la concurrence, peuvent sauver lâentrant intrépide ou lâopérateur mis sur le sable. Alors que les propriétaires de droits dâauteur maximisent leurs profits en prônant lâextension de leur champ dâapplication et en poursuivant leur application par les tribunaux, leur valeur sociale est mesurée en termes dâefficacité pour la promotion de lâinnovation. Lâindustrie de la musique a projeté le champ dâapplication des droits dâauteur si grossièrement loin auâdelà des limites de la raison par rapport à la musique numérisée que leur position légale sera attaquée inlassablement sur tous les fronts, que ce soit par une banalisation des infractions, ou par la résistance devant les tribunaux ou par des campagnes visant une réforme législative.

"Lâauteure Lucie Guibault aborde la question des ""logiciels libres"" dans le cadre des droits dâauteurs et des brevets. Ces logiciels sont des programmes informatiques qui sont gratuitement distribués au public, dont la modification et la redistribution sont fortement encouragées, mais dont la vente ou la commercialisation est découragée ou même carrément prohibée. Ces caractéristiques particulières distinguent les logiciels libres des ""programmes propriétés"" traditionnels, qui se basent sur le principe que le créateur dâun programme en possède les droits de propriété et quâil est le seul autorisé à le modifier ou le vendre, sous réserve de sa capacité à faire cession de ces droits. Les logiciels libres sont fondés sur une idéologie de coopération, qui promeut la propagation des idées et des connaissances et qui favorise ainsi la création de meilleurs logiciels. Lâauteure présente les grandes caractéristiques des trois principales licences de logiciels libres, soit la ""General Public License"", la licence ""Berkeley Software Distribution"" et la ""Mozilla Public License"". Elle soutient que ces logiciels libres et les régimes normatifs qui les encadrent sont à lâorigine dâun changement de paradigme au sein des régimes européens et hollandais de protection des droits dâauteurs et des brevets. La première partie de lâarticle analyse les régimes des droits dâauteur des trois licences de logiciels libres. Lâauteure souligne que ces régimes ont été établis en se basant sur la prémisse quâil nây a pas de distinction significative entre les créateurs et les utilisateurs de logiciels libres. Les régimes normatifs reflètent cette situation en prévoyant un ensemble de droits et dâobligations pour les utilisateurs dans le cadre de lâutilisation, de la reproduction, de la modification et de la redistribution gratuite des logiciels libres. Lâauteur explique comment ces régimes normatifs sâintègrent au sein de la législation européenne et hollandaise, entre autre au niveau du droit de propriété, du droit commercial, du droit des communications et du droit des obligations. Lâauteur démontre que, de façon générale, ces régimes normatifs législatifs semblent sâêtre adéquatement adaptés aux nouvelles réalités posées par les règles de droits dâauteurs des logiciels libres. La seconde partie aborde la problématique du droit des brevets, tel que défini par la législation européenne et hollandaise. La plupart des utilisateurs et créateurs de logiciels libres sâopposent aux régimes de brevets traditionnels, qui limitent lâinnovation et les possibilités de développement techniques. Lâauteur décrit les différents régimes alternatifs de brevets offerts par les trois licences de logiciels libres. De plus, lâauteur présente lâencadrement légal pour ces nouveaux brevets, tel que défini par les législations européennes et hollandaises. Elle soutient que cet encadrement légal est inadéquat et quâil nâest pas adapté aux besoins des utilisateurs de logiciels libres."

Competitive Dialogue (CD) is a new contract award procedure of the European Community (EC). It is set out in Article 29 of the 'Public Sector Directive' 2004/18/EC. Over the last decades, projects were becoming more and more complex, and the existing EC procedures were no longer suitable to procure those projects. The call for a new procedure resulted in CD. This paper describes how the Directive has been implemented into the laws of two member states: the UK and the Netherlands. In order to implement the Directive, both lawmakers have set up a new and distinct piece of legislation. In each case, large parts of the Directiveâs content have been repeated â˜word for wordâ; only minor parts have been reworded and/or restructured. In the next part of the paper, the CD procedure is examined in different respects. First, an overview is given on the different EC contract award procedures (open, restricted, negotiated, CD) and awarding methods (lowest price and Most Economically Advantageous Tender, MEAT). Second, the applicability of CD is described: Among other limitations, CD can only be applied to public contracts for works, supplies, and services, and this scope of application is further restricted by the exclusion of certain contract types. One such exclusion concerns services concessions. This means that PPP contracts which are set up as services concessions cannot be awarded by CD. The last two parts of the paper pertain to the main features of the CD procedure â from â˜contract noticeâ to â˜contract awardâ â and the advantages and disadvantages of the procedure. One advantage is that the dialogue allows the complexity of the project to be disentangled and clarified. Other advantages are the stimulation of innovation and creativity. These advantages are set against the procedureâs disadvantages, which include high transaction costs and a perceived hindrance of innovation (due to an ambiguity between transparency and fair competition). It is concluded that all advantages and disadvantages are related to one of three elements: communication, competition, and/or structure of the procedure. Further research is needed to find out how these elements are related.
