L’arbitrage international, outre le recours aux tribunaux de l’État hôte, est la méthode la plus utilisée pour régler les différends relatifs aux investissements étrangers. Plusieurs accords internationaux d’investissement incluent des dispositions ayant trait à l’arbitrage sous l’égide du Centre International pour le Règlement des Différends relatifs aux Investissements (CIRDI) mis en place par la Convention de Washington de 1966. Les tribunaux arbitraux constitués sous l’égide du Centre sont ainsi appelés à trancher des différends qui concernent la conduite d’États hôtes vis-à-vis ses investisseurs étrangers ; leurs décisions ayant de fortes conséquences sur l’intérêt public, concrètement lorsqu’il s’agit de la protection de l’environnement. L’évolution croissante du droit environnemental et son empiètement sur la protection des investissements a déclenché une série de différends qui ne se limitent plus à mettre en cause des nationalisations ou des violations de contrats - comme auparavant - mais tournent souvent autour de mesures étatiques de politique publique qui impliquent des questions sensibles telles que, inter alia, la gestion de déchets dangereux, l’accès à l’eau potable, l’étalement urbain, la protection de la biodiversité. Par conséquent, le rôle des tribunaux CIRDI et de leurs décisions devient décisif dans le développement du droit des investissements et dans le débat sur la protection des investissements face aux mesures législatives en matière environnementale. Cette étude a pour objet d’analyser la place des considérations environnementales dans les sentences arbitrales CIRDI. Spécifiquement, il s’agit d’étaler les principaux arguments retenus par les tribunaux internationaux, et de dégager les grandes tendances jurisprudentielles en matière d’arbitrage international d’investissements face aux mesures environnementales.

This article is the result of a work of research conducted on the peri-urban interface of Popayan to detect its potential, restrictions and pathologies regarding the urbanization process. The Crucero Puelenje village, taken as a case study, is located in the south of the town center and it is recognized as one of the agricultural pantries of the city.The territory reading was focused on the macro-landscape as a result of the relationship between social groups and their physical and natural environment. Hence, this research process articulated technical and participatory methodologies that allowed determining the socio-cultural, environmental, physical-spatial, economic and political-administrative particularities of the territory with respect to urbanization and local development. Thus, the participatory component with the Crucero Puelenje community, both in the participatory workshops and in the census, gave feedback to the technical component considered as the guiding thread.This research found knowledge applicable to spatial planning and regional development from the study of the socio-environmental and territorial transformations impact caused by the urban sprawl of Popayán, and at the same time, it offered the Crucero Puelenje community the possibility of interpreting its territory and gaining insights about its planning.

El propósito de este texto es discutir el concepto de resiliencia y buscar su interés heurístico para los análisis de vulnerabilidad urbana. El término resiliencia es omnipresente en la retórica de las declaraciones internacionales, de las políticas públicas y en las reflexiones académicas en el campo de los riesgos y desastres en ciudades. Se discute esta noción con el fin de entender sus raíces y desvelar sus presupuestos ideológicos. Al mismo tiempo, el término resiliencia presenta el interés de fomentar debates y cuestiones teóricas en el campo científico y en el sociopolítico de la formulación de nuevas políticas públicas. Más allá de los enfoques focalizados sobre el fortalecimiento delas capacidades locales, los aportes heurísticos del concepto de resiliencia para los análisis de riesgos en el medio urbano provienen de sus fundamentos en la teoría de los sistemas complejos. Así, se resaltan nuevos enfoques y soportes conceptuales que permiten entender mejor la vulnerabilidadde las grandes aglomeraciones urbanas.

La participación en plusvalías (PPV) es el instrumento de política de una reforma de gran transcendencia en Colombia: la recuperación de las rentas del suelo y su movilización social. Durante la fase de implementación de la PPV se han venido estableciendo esquemas operativos fragmentados que propician una visión procedimental y atomizada del tributo, la cual promueve lógicas institucionales que potencialmente retardan su evolución plena como instrumento de política de suelo. El análisis de la trayectoria de varias décadas de las ciudades colombianas con la contribución por valorización (CV) sugiere que la continuidad y evolución de este instrumento y sus instituciones se derivan en gran parte del manejo “ingenioso” de esta política frente a su entorno de implementación. Por tratarse de un instrumento de recuperación parcial de plusvalías, constituye un precedente para la PPV a partir del cual es posible derivar valiosas lecciones. Este artículo presenta para discusión los factores de viabilidad y sostenibilidad identificados a través del análisis de la experiencia de implementación y del proceso general de consolidación de la CV; así como reflexiones que de allí surgieron sobre la dirección que en el mismo contexto debería dársele a la implementación de la PPV, de manera que se propicien condiciones de entorno favorables a la evolución institucional y sostenibilidad de la reforma.-----Participation in Land Value Increments (participación en plusvalías-PPV) is an essential policy instrument of the urban Reform in Colombia designed to capture and socially mobilize land rents originated by public decisions and investments. The analysis of its recent implementation process in Bogota provides evidence that current institutional arrangements are creating a general tendency amongst the institutions involved towards isolated procedural management, which potentially hinders the integrated vision required to manage the instrument at the policy level. Special Assessment (contribución por valorización-CV), an earlier form of partial value capture, has a long history in Colombia as an effective financialinstrument for urban management. Analysis of the factors that have contributed to successfully consolidate CV show that its technical evolution, continuity and political legitimacy have been strongly supported by integrated institutions and strategic management. Through comparative analysis, the experience with CV is used to draw some useful parallels and insights for a discussion about how PPV´s implementation process should be redirected towards strategic policy thinking and “smart value capture”.

Generalmente las intervenciones urbanas son sectoriales y carecen de un enfoque transversal, lo que dificulta el ejercicio de la planificación y la gestión, y afecta negativamente la construcción de una visión de ciudad de largo plazo. Es por ello que esta monografía busca establecer la importancia de diseñar y ejecutar intervenciones urbanas estratégicas, por medio del análisis de un proyecto. El proyecto 22@Barcelona es un ejemplo de una intervención urbana estratégica porque logra, entre otras cosas, dar respuesta a distintas necesidades y problemáticas a través de una propuesta: urbana, económica y social. En esta ocasión se analizará la relación entre los componentes: económico y urbano del proyecto, a la luz de los postulados de la Planeación Estratégica Urbana; lo que permitirá concluir que éste no es ni un proyecto urbano, ni económico, sino ambas cosas, y es precisamente esto lo que lo hace loable.

Salt marshes constitute habitat islands for many endemic animal species, particularly along the California coast, where urban sprawl has fragmented this habitat. Recreational activities in salt marshes have increased recently, posing an interesting problem: how do endemic species lacking alternative habitat modify their tolerance to humans? We assessed seasonal and site variations in three tolerance parameters (distances at which animals became alert, fled, and moved after fleeing) of California's endangered Belding’s Savannah Sparrow ((Passerculus sandwichensis beldingi). We approached individuals on trails in three salt marshes with different levels of vehicle and pedestrian traffic. Belding’s Savannah Sparrows became aware and fled at shorter distances in the salt marsh coincident with greater levels of recreational activity as a result of habituation or visual obstruction effects. Seasonal effects in tolerance varied between sites. Alert and flight initiation distances were higher in the pre-nesting than in the non-breeding season in the site with the highest levels of recreational use likely due to greater exposure of breeding individuals; however, the opposite seasonal trend was found in each of the two sites with relatively lower human use, probably because individuals were less spatially attached in the non-breeding season when they foraged in aggregations. Distance fled was greater in the non-breeding than in the breeding season. Our findings call for dynamic management of recreational activities in different salt marshes depending on the degree of exposure to humans and seasonal variations in tolerance. We recommend a minimum approaching distance of 63 m and buffer areas of 1.3 ha around Belding's Savannah Sparrows.

This paper reviews the evidence in favour of the compact city and considers whether it is a viable policy option. Environmentalists, acadenics and politicians have all expressed strong support for the compact city as a basis for sustainable development. A review of the literature broadly confirms the claims made on its behalf, in particular that it is energy efficient and that it plays a crucial role in preventing rural land loss. It is further shown i) that there is nothing inevitable about the established pattern of urban dispersal, and ii) that although urban land is charaterised by a number of contstraints on development,it could in principle satisfy much of the projected demand for housing. Yet urban sprawl continues. Some of the reasons for this in the case of residential development are examined by comparing the residential development process with the principles of sustainable development. The general conclusion of the paper is that proposals for urban containment are likely to be strongly resisted by housebuilders.

During the process of development and urban sprawl in the city of Presidente Prudente (SP), some factors as the emergence of new centralities, the change in lifestyles and the expansion of equipments and urban infrastructure contributed to the dismantling and little appropriation of the central open space system. In this sense, the work is about the loss of continuity between the central squares of the city - Monsenhor Sarrion Square, July 9 Square, Bandeira Square and Nossa Senhora Aparecida Square - using different methodologies for character evaluation of each square, identifying the inviting and unattractive aspects of their spaces. The relations between these squares and its surroundings are characterized by analyzing interesting visual played on sketches, to complement character evaluation. Among these studies, it is also analyzed two spatial structures related to the squares – Calçadão and Quintino Bocaiuva Street - which have important architectural referring to the city's history and contribute to the central open space system configuration. General considerations obtained through diagnosis provided subsidies for the projectual proposed intervention, which aims to provide appreciation of the character of these public spaces and their articulation, promoting their use and constituting, thus, an important urban-environment set
