his chapter considers the EU’s socio-economic constitution under the lens of humaneness. It argues that the EU’s unique socio-economic constitution demands equilibrium of socio-economic integration instead of widening the gap between economic integration at EU levels and social integration at national levels. While the EU lacks the legislative competences to achieve this equilibrium, the constitutional principle still prevails. Indeed, the EU competences reflect its own values as well as the socio-economic constitutions of its constituent Member States. These frequently do not allow for total state-governance of social spheres such as working life, education, care or other social services. Instead, societal actors are given scope to (co-)govern these spheres at national levels. Accordingly, the apparent tension between the EU’s socio-economic values and principles and its limited competences in the social policy field can be resolved through a dynamic interpretation of the EU Treaties towards a “constitution of social governance”. This interpretation reads the Treaties as authorising governance by societal actors. The chapter connects the idea of humanness to the ideals of social governance at EU level and proposes two options for practical application of the concept. These are rules for trans-national labour markets based on European collective labour agreements and a European higher education sector developed by agreements between universities.

La Loi constitutionnelle de 1867 ne contient aucune disposition expresse concernant un quelconque pouvoir pour les gouvernements fédéral et provinciaux de conclure des traités internationaux - ce pouvoir étant réservé, à l'époque de l'adoption de la Loi constitutionnelle de 1867, au pouvoir impérial britannique. Aussi, une seule disposition prévoyait les modalités de mise en oeuvre des traités impériaux au sein de la fédération canadienne et cette disposition est aujourd'hui caduque. Puisque l'autonomie du Canada face à l'Empire britannique ne s'est pas accompagnée d'une refonte en profondeur du texte de la constitution canadienne, rien n'a été expressément prévu concernant le droit des traités au sein de la fédération canadienne. Le droit constitutionnel touchant les traités internationaux est donc Ie fruit de la tradition du «constitutionnalisme organique» canadien. Cette thèse examine donc ce type de constitutionnalisme à travers le cas particulier du droit constitutionnel canadien relatif aux traités internationaux. Elle examine ce sujet tout en approfondissant les conséquences juridiques du principe constitutionnel du fédéralisme reconnu par la Cour suprême du Canada dans le Renvoi relatif à la sécession du Québec, [1998] 2 R.C.S. 217. De manière plus spécifique, cette thèse analyse en détail l’affaire Canada (P.G.) c. Ontario (P. G.), [1937] A.C. 326 (arrêt des conventions de travail) ou le Conseil prive a conclu que si l'exécutif fédéral peut signer et ratifier des traités au nom de l'État canadien, la mise en oeuvre de ces traités devra se faire - lorsqu'une modification législative est nécessaire à cet effet - par le palier législatif compétent sur la matière visée par l'obligation internationale. Le Conseil Prive ne spécifia toutefois pas dans cet arrêt qui a compétence pour conclure des traités relatifs aux matières de compétence provinciale. Cette thèse s'attaque donc à cette question. Elle défend la position selon laquelle aucun principe ou règle de droit constitutionnel canadien ou de droit international n'exige que l'exécutif fédéral ait un pouvoir plénier et exclusif sur la conclusion des traités. Elle souligne de plus que de très importants motifs de politique publique fondes notamment sur les impératifs d'expertise, de fonctionnalité institutionnelle et de démocratie militent à l’encontre d'un tel pouvoir fédéral plénier et exclusif. L'agencement institutionnel des différentes communautés existentielles présentes au Canada exige une telle décentralisation. Cette thèse démontre de plus que les provinces canadiennes sont les seules à posséder un pouvoir constitutionnel de conclure des traités portant sur des domaines relevant de leurs champs de compétence - pouvoir dont elles peuvent cependant déléguer l'exercice au gouvernement fédéral. Enfin, cette thèse analyse de manière systématique et approfondie les arguments invoques au soutien d'un renversement des principes établis par l'arrêt des conventions de travail en ce qui concerne la mise en oeuvre législative des traités relatifs à des matières provinciales et elle démontre leur absence de fondement juridique. Elle démontre par ailleurs que, compte tenu de l'ensemble des règles et principes constitutionnels qui sous-tendent et complètent le sens de cette décision, renverser l’arrêt des conventions de travail aurait pour effet concret de transformer l'ensemble de la fédération canadienne en état quasi unitaire car le Parlement pourrait alors envahir de manière permanente et exclusive l'ensemble des champs de compétence provinciaux. Cette conséquence est assurément interdite par le principe du fédéralisme constitutionnellement enchâssé.

On note de nos jours une intensification, aux États-Unis, de l’usage de la race en santé publique, une idée qui est parfois rejetée dans la mesure où elle est associée à des pratiques controversées. Les races sont vues, dans ce contexte, comme le produit du racisme, une technologie du pouvoir de l’État moderne qui a consisté à fragmenter l’humanité pour permettre les colonisations. C'est ainsi que la race a été prise en charge par le discours pour marquer la différence, discours qui est constitué d'un ensemble hétérogène de dispositifs, des institutions, des énoncés scientifiques, des normes et des règles. Le racisme s’est développé en parallèle avec l'affirmation d'un pouvoir sur la vie visant à assurer la gestion des corps et des populations, notamment par le biais des pratiques de santé publique. Cette thèse s'appuie sur une étude ethnographique réalisée sur un corpus de documents de la santé publique parus aux États-Unis et issus de bureaux fédéraux et d’une importante revue spécialisée dans le domaine sanitaire, et qui ont été publiés entre 2001 et 2009. Cette étude a analysé la manière dont la race est représentée, produite comme objet de connaissance, et régulée par les pratiques discursives dans ces documents. Les résultats confirment que le discours sur la race varie au cours du temps. Toutefois, les résultats indiquent la relative permanence en santé publique d'un régime racialisé de représentation qui consiste à identifier, à situer et à opposer les sujets et les groupes à partir de labels standardisés. Ce régime est composé d'un ensemble de pratiques représentationnelles qui, couplées aux techniques disciplinaires et à l’idée de culture, aboutissent à la caractérisation et à la formation d’objets racialisés et à des stéréotypes. De plus, cet ensemble d’opérations qui fabrique la racialisation, a tendance, avec la sanitarisation et la culturalisation, à naturaliser la différence, à reproduire l’ordre symbolique et à constituer les identités raciales. Par ailleurs, la racialisation apparaît tiraillée entre un pouvoir sur la vie et un pouvoir sur la mort. Enfin, cette étude propose une alternative postraciale qui envisage la constitution des groupes humains de manière fluide et déterritorialisée.

Why did a majority of French voters reject the Treaty Establishing a Constitution for Europe in the 2005 referendum? We argue here that the collective mobilization of the left-wing ‘No’ camp made the decisive difference through its formation of ‘Collectifs pour le non’, a coalition which facilitated the public expression of an anti-liberal and pro-European position capable of bringing together the Green and Socialist electorates, along with other parts of the left. Using a comprehensive analysis of the multi-organizational field of protest constituted by the mobilization of the left-wing ‘No’ camp, we show first that the mobilization was a ‘European affair’, in the sense that it developed a pro-European position in the context of struggles against liberal forces. Second, we show that the mobilization was also a ‘French’ affair because it relied on the high valuation of the ‘national’ mode of belonging, through the defence of the French state model.

This thesis entitled “ Educational rights of the minorities under article 30 of the indian constitution.The study is divided into nine chapters.The object of the present study is to explore whether the judiciary has been successful in balancing the conflicting rights of the minorities and the state. The study also seeks to bring forth those judicial principles which have governed the operation of these rights and determined the limits of their application. Article 30 confers a special right on minorities to establish educational institutions of their own choice.This is an expression of the liberal and tolerent culture of our nation which is reflected in the Constitution. The idea is to foster unity' in diversity, ea unique characteristic of the Indian way of life.This study suggested that where a minority is a minority’ in the historical or national context and its claim is based on religion it must be defined and ascertained in terms of the population of the whole country irrespective of its being a numerical majority' in any particular State and the minority status. of linguistic group has to be ascertained in terms of the population of any particular State irrespective of its being a numerical minority in terms of the population of the whole country.A religious denomination also can be treated as a religion within the meaning of Article 30(1) provided it is having a separate organisation with doctrines and tenets and rites and practices of its own.

Abstract: Instead of the political reading of the EU Constitution adopted by advocates of constitutional patriotism, this article examines the European economic constitution. The four single market freedoms can be used by the Court of Justice to strike down Member State laws which represent deeply held aspects of national cultural identity. The article examines whether the court does in fact act in this way and proceeds to argue that the issue of identity protection does not stop with the court. In those policy areas where the court is more interventionist, and its case-law is perceived as an identity threat, one is likely to find binding Treaty-based derogations. Where, in contrast, the effect of the court's case-law poses less of a threat, one is more likely to see non-binding declarations. The article examines a number of policy areas in which specific cultural derogations and declarations are to be found, including abortion, property acquisition, football and alcohol control.

This article aims to create intellectual space in which issues of social inequality and education can be analyzed and discussed in relation to the multifaceted and multi-levelled complexities of the modern world. It is divided into three sections. Section One locates the concept of social class in the context of the modern nation state during the period after the Second World War. Focusing particularly on the impact of 'Fordism' on social organization and cultural relations, it revisits the articulation of social justice issues in the United Kingdom, and the structures put into place at the time to alleviate educational and social inequalities. Section Two problematizes the traditional concept of social class in relation to economic, technological and sociocultural changes that have taken place around the world since the mid-1980s. In particular, it charts some of the changes to the international labour market and global patterns of consumption, and their collective impact on the re-constitution of class boundaries in 'developed countries'. This is juxtaposed with some of the major social effects of neo-classical economic policies in recent years on the sociocultural base in developing countries. It discusses some of the ways these inequalities are reflected in education. Section Three explores tensions between the educational ideals of the 'knowledge economy' and the discursive range of social inequalities that are emerging within and beyond the nation state. Drawing on key motifs identified throughout, the article concludes with a reassessment of the concept of social class within the global cultural economy. This is discussed in relation to some of the major equity and human rights issues in education today.

The Sexual Constitution of Political Authority argues that there are good reasons to suppose that our understandings of state power quiver with erotic undercurrents. Through a series of case studies where a statesman's same sex desire was put on trial (either literally or metaphorically) as a problem for the good exercise of public powers, the book shows the resilience and adaptability of cultural beliefs in the incompatibility between public office and male same-sex desire.

Fluorene and thiophene units are commonly used in polymeric materials for electro-optical applications. Due to differences in reactivity, the final composition of polymers containing these components often differs from that used in their preparation. This contribution describes the synthesis of PPV type terpolymers built by fluorene, phenylene and thiophene units and their quantification by CPMAS NMR. The similarity of the three aromatic co-monomers makes it difficult to separate the analytical responses that would allow quantification of each copolymer unit in the chain. In this sense, we show that the combination of dipolar dephased CPMAS with radiofrequency ramp and proper spectral treatment allows a good estimation and quantification of the copolymer constitution. By close control of experimental variables affecting precipitation, solid-state compounds of the type Th(OH)(m)L4-m.nH(2)O, where L stands for 4-methoxy-benzylidenepyruvate, cinnamylidenepyruvate or 4-dimethylaminocinnamylidene-pyruvate; m=0 to 3 and n=0.5-3 were isolated. Chemical analysis, TG, DTG, DSC and X-ray powder diffractometry have been employed to characterize and to study the thermal behavior of these compounds in dynamic air atmosphere. In all cases, hydration water is slowly lost between 30 and 160degreesC; a continuous, slow rate, mass loss is observed thereafter and beyond 280-400degreesC the rate of decomposition/oxidation increased rapidly, to give ThO2 as the final product, beginning at 412-510degreesC. The results associated with the hydroxo-compounds indicate that the loss of constitution water (OH ions) and the decomposition / oxidation of the organic moieties occur as simultaneous process.

One of the primary accomplishments of Governor Forrest Anderson in 1969-71 was the reorganization of the Executive Branch of Montana government, something that had been attempted six different times between 1919 and 1962 as state government had grown from twenty agencies to almost 200 uncontrolled boards, bureaus and commissions. The chaotic structure of the executive branch disempowered governors of both parties and empowered the private corporations and organizations that were the power structure of Montana. With remarkable political acumen, Governor Anderson figured out how to get that near impossible job done. Central to his efforts was the creation of an Executive Reorganization Commission, including eight legislators and the Governor, the adoption of a Constitutional Amendment that limited the executive branch to no more than twenty departments under the Governor, and the timely completion of a massive research effort to delineate the actual structure of the twenty departments. That story is told in this episode by three major players in the effort, all involved directly with the Executive Reorganization Commission: Tom Harrison, Diana Dowling and Sheena Wilson. Their recollections reflect an insider’s perspective of this significant accomplishment that helped change Montana “In the Crucible of Change.” Tom Harrison is a former Republican State Representative and State Senator from Helena, who was a member of the Executive Reorganization Commission. As Majority Leader in the Montana House of Representatives in 1971, he was the primary sponsor of the House’s executive reorganization bill and helped shepherd the Senate’s version to passage. Harrison was the Republican candidate for Attorney General in 1976 after which he practiced private law for 3 more decades. He served in the Montana Army National Guard for almost 34 years, rising to the rank of Colonel in the position of Judge Advocate General. He was a founding Director of Federal Defenders of Montana (legal representation for indigents accused within the Federal Judicial System); appointed Chairman of the original Montana State Fund (workers' compensation insurance) by Gov. Stephens; served as President of the Montana Trial Lawyers Association, Helena Kiwanis Club and St. Peter's Community Hospital Foundation, as well as Chairman and Director of AAA MountainWest; and was a founder, first Chairman and Director of the Valley Bank of Helena for over 25 years. Diana Dowling was an attorney for the Executive Reorganization Commission and helped draft the legislation that was passed. She also worked for Governor Forrest Anderson and for the 1972 Constitutional Convention where she prepared and directed publication of official explanation of the new Constitution that was mailed to all Montana voters. Diana was Executive Director of the Montana Bar Association and for 20 years held various legal positions with the Montana Legislative Council. For 12 years she was a commissioner on the National Conference of Commissioners on Uniform State Laws and for 7 years was a member of Montana State Board of Bar Examiners. Diana was the first director of the Montana Lottery, an adjunct professor at both Carroll College and the UM Law School, and an administrative officer for Falcon Press Publishing Co. Diana is currently - and intends to continue being - a perpetual college student. Sheena Wilson came fresh out of the University of Montana to become a Research Assistant for the Executive Reorganization Commission. Later she worked for seven years as a field representative in Idaho and Montana for the Mountain Plains Family Education Program, for thirteen years with Congressman Pat Williams as Executive Assistant in Washington and Field Assistant here in Montana, owned and managed a Helena restaurant for seven years, worked as Executive Assistant for State Auditor John Morrison and was Deputy Chief of Staff for Governor Brian Schweitzer his full 8 years in the Governorship. Though currently “retired”, Sheena serves on the Montana Board of Investments, the Public Employees Retirement Board and the Capitol Complex Advisory Council and is a partner in a dry-land wheat farm in Teton County that was homesteaded by her great uncle.
