De la capacité d’une société à repenser ses liens sociaux, dépend son développement à la fois politique, social et économique. L’État peut, pour contribuer de manière déterminante à la production de sens, développer des outils, entre autres des mécanismes de redistribution, susceptibles d’assurer la solidarité et la cohésion sociale. L’enjeu est d’importance pour certains pays comme la Namibie, dont l'histoire est marquée par le colonialisme et l'apartheid ─desquels il s'est libéré il y a à peine plus de vingt ans─ et qui sont construits sur une logique de séparation inégalitaire des droits et des ressources. À partir de l'exemple du Basic Income Grant (BIG), projet-pilote de revenu citoyen garanti mis en place dans un village de la Namibie entre 2007 et 2009, ce mémoire propose d'explorer l'apport du concept d'empowerment dans ce projet en tant qu'outil de déconstruction de ces structures inégalitaires. Après avoir exposé différentes conceptions des notions de pauvreté, de richesse et de développement, nous aborderons la question du revenu citoyen garanti et de la place qu'il peut prendre dans différents systèmes de protection sociale. Puis, nous tenterons de mieux cerner le concept d'empowerment pour finalement arriver à répondre à notre principal questionnement: le projet BIG permet-il effectivement l'émancipation ou au contraire, fait-il en sorte de renforcer le sentiment de dépendance et d'impuissance vécu par la communauté isolée, vivant dans des conditions d'extrême précarité? Des entrevues ont pour ce faire été conduites auprès de 15 participants, soit des membres du village d'Otjivero, des intervenants engagés dans le regroupement d'acteurs de la société civile namibienne étant à la source de l'initiative, et des représentants gouvernementaux. L’analyse de ces résultats est présentée en dernière partie de travail.

We compute the optimal non-linear tax policy for a dynastic economy with uninsurable risk, where generations are linked by dynastic wealth accumulation and correlated incomes. Unlike earlier studies, we find that the optimal long-run tax policy is moderately regressive. Regressive taxes lead to higher output and consumption, at the expense of larger after-tax income inequality. Nevertheless, equilibrium effects and the availability of self-insurance via bequests mitigate the impact of regressive taxes on consumption inequality, resulting in improved average welfare overall. We also consider the optimal once-and-for-all change in the tax system, taking into account the transition dynamics. Starting at the U.S. status quo, the optimal tax reform is slightly more progressive than the current system.

CONTEXTE : La mortalité infantile a diminué au Canada depuis les années 1990 et 2000 mais nous ignorons si toutes les classes socioéconomiques ont bénéficié également de ce progrès. OBJECTIFS : La présente étude portait sur les différences entre les taux de mortalité néonatale et postnéonatale et de mort subite du nourrisson entre les différents quintiles de revenu des quartiers au Canada de 1991 à 2005. MÉTHODES : Le fichier couplé des naissances vivantes et des décès infantiles au Canada a été utilisé à l’exclusion des naissances survenues en Ontario, au Yukon, dans les Territoires du Nord-ouest et au Nunavut. Les taux de mortalité néonatale et postnéonatale et de mort subite du nourrisson ont été calculé par quintile de revenu des quartiers et par période (1991-1995, 1996-2000, 2001-2005). Les rapports de risque (RR) ont été calculés par quintile de revenu et période avec ajustement pour la province de résidence, l’âge de la mère, la parité, le sexe du nourrisson et les naissances multiples. RÉSULTATS : En zone urbaine, pour toute la période étudiée (1991- 2005), le quintile de revenu le plus pauvre avait un risque plus élevé de mortalité néonatale (RR ajusté 1,24; IC 95% 1,15-1,34), de mortalité postnéonatale (RR ajusté 1,58; IC 95% 1,41-1,76) et de mort subite du nourrisson (RR ajusté 1,83; IC 95% 1,49-2,26) par rapport au quintile le plus riche. Les taux de mortalité post néonatale et de mort subite du nourrisson ont décliné respectivement de 37 % et de 57 % de 1991- 1995 à 2001-2005 alors que le taux de mortalité néonatale n’a pas changé de façon significative. Cette diminution de la mortalité postnéonatale et de la mort subite du nourrisson a été observée dans tous les quintiles de revenu. CONCLUSION : Malgré une diminution de la mortalité postnéonatale et du syndrome de mort subite du nourrisson dans tous les quintiles de revenu, les inégalités subsistent au Canada. Ce résultat démontre le besoin de stratégies efficaces de promotion de la santé visant spécifiquement les populations vulnérables. El acceso a la telefonía móvil en Colombia evidencia ciertas particularidades con respecto a otros países. En Colombia surgió una nueva alternativa de comunicación que consistía en la venta de minutos de celular en las calles y en pequeños negocios durante los primeros años de ésta década. En este documento se analizan las principales características de quienes usan esta modalidad de comunicación con base en una encuesta dirigida a usuarios y no usuarios de bajos ingresos. Se usa un modelo probabilístico para explicar las características de las personas que lo usan y se encuentra que las personas que están en la modalidad de contrato prepago y que viven en ciudades pequeñas tienen una mayor probabilidad de usar esta alternativa de comunicación. De otro lado se encuentra que quienes están con el operador dominante tienden a usar este servicio también de una forma más notoria. Estos resultados parecen indicar que los diferenciales de precios entre las llamadas off-net y on-net así como entre prepago y postpago son los que alimentaron el surgimiento de esta actividad

La teoría económica ha demostrado que en mercados imperfectos la redistribución de la renta puede incrementar el bienestar social y dar lugar a situaciones en las que todos los agentes económicos involucrados puedan mejorar el nivel de bienestar. Se demuestra que la implantación de un regimen fiscal de subvenciones también puede mejorar los efectos en mercados competitivos perfectos, que se derivan de economías externas de escala.

The implications of categorising income as "personal services income" and the actual meaning of this term have been marked with uncertainty. The Commissioner of Taxation has long asserted that "personal services income" inherently may not be derived by an entity other than the person whose exertions produce the income. In Liedig v FCT (1994) 28 ATR 141, however, Hill J held that in the absence of a specific legislative provision, there was no basis for the Commissioner's doctrine. The specific legislative measures Hill J required were put in place through the New Business Tax System (Alienation of Personal Services Income) Act 2000. In certain circumstances this Act prevents interposed entities from deriving personal services income. Such payments are attributed instead to the individual who performs the services.

It will also be seen, however, that these provisions do not apply to entities that are conducting a "personal services business". It is submitted that the combined effect of, inter alia, the Act's definition of "personal services income" and "personal services business" is to give the Act a narrower scope than the Commissioner's personal services doctrine. Moreover, it will be submitted that the statutory definition of personal services income also suffers from the same flaws that Hill J identified as relevant to the Commissioner's personal services doctrine.

It is a privilege to have the opportunity to respond to the comments on my monograph1 provided by Mark Gergen, Glenn May, and Gordon Longhouse. Their comments, which are inevitably coloured by their very different perspectives, reflect the considerable expertise that each one of them has in the area of the income taxation of financial instruments. Indeed, it is with some hesitation that I offer a response in defence of various portions of the analysis presented in my monograph in support of some pretty modest proposals in this extremely difficult area of income tax law. Although I spent considerable time exploring some necessary first principles and their implications for the design of a system for the income taxation of financial instruments, I made several concessions to certain practical constraints that led me to support, in some measure, the status quo reflected in certain of the existing literature, as well as the legislation in a select group of countries. On the assumption that many readers may be unfamiliar with the monograph, I propose to respond by outlining much of my analysis in the monograph and the proposals that are the logical outcome. Throughout the outline, I will highlight and respond to what I see as the important points of difference emphasized by Gergen, May, and Longhouse.

International taxation is concerned mainly with the equitable allocation of cross-border income between countries in which income-earning activities take place. Such allocation has traditionally been governed by the arm’s-length principle, which has been interpreted as requiring a comparable transactional pricing approach. This approach assumes that each member of a multinational enterprise (MNE) group is a separate entity and that the transactions between related parties can be separated and compared with arm’s-length transactions. It has, however, proved difficult to apply comparable transactional pricing to internationally integrated businesses, especially those involving intangibles and services, and formulary apportionment has been suggested as an alternative. Essentially, formulary apportionment treats the MNE group as a single economic entity. The group’s profit is allocated to members according to a formula that reflects the particular member’s contribution to the production of that profit. A rich academic literature exists which either defends or attacks this alternative approach. The OECD and national governments have rejected formulary apportionment mainly on the ground that it violates the arm’s-length principle. This article proposes a global profit split (GPS) method for allocating international income. The GPS would allocate the global profit of an integrated business to each country in accordance with the economic contributions made by components of the business located in that country. The allocation would be based on a formula that would reflect the economic factors that contribute to profit making. While the GPS draws on elements of the traditional formulary apportionment and profit split methods, it also differs from them. The author discusses in detail the key issues involved in designing the GPS. She also presents and evaluates the main policy and pragmatic justifications for the adoption of this innovative approach. The author argues that the GPS is not only theoretically and practically superior to traditional income allocation methods, but also consistent with the arm’s-length principle. On the basis of historical developments, interpretation of article 9 of the OECD model tax convention, and international tax policy considerations, the author establishes that the GPS is not a radical departure from the arm’s-length principle, but rather a natural development in its evolution. She concludes that the law of evolution ison the side of reform because the GPS would provide for a fair and effective allocation of income derived from globally integrated business activities.

Taxpayers and tax authorities recognise that complex Australian income tax law is in need of simplification - during the past decade there have been two ineffective attempts at simplification of the tax law - first by redrafting the law in plain English without addressing structural issues - second by the proposed wholesale replacement of the legislation with a new foundation, incorporating most of the causes of the complexity in the current law - with tax law growing in size and complexity, new paths to simplification must be considered.
