Waiver of statutory requirements : Property Agents and Motor Dealers Act 2000 (Qld)

One of the many difficulties associated with the drafting of the Property Agents and Motor Dealers Act 2000 (Qld) (‘the Act’) is the operation of s 365. If the requirements imposed by this section concerning the return of the executed contract are not complied with, the buyer and the seller will not be bound by the relevant contract and the cooling-off period will not commence. In these circumstances, it is clear that a buyer’s offer may be withdrawn. However, the drafting of the Act creates a difficulty in that the ability of the seller to withdraw from the transaction prior to the parties being bound by the contract is not expressly provided by s 365. On one view, if the buyer is able to withdraw an offer at any time before receiving the prescribed contract documentation the seller also should not be bound by the contract until this time, notwithstanding that the seller may have been bound at common law. However, an alternative analysis is that the legislative omission to provide the seller with a right of withdrawal may be deliberate given the statutory focus on buyer protection. If this analysis were correct the seller would be denied the right to withdraw from the transaction after the contract was formed at common law (that is, after the seller had signed and the fact of signing had been communicated to the buyer).

Sistema de transmisión para vehículo de tracción trasera y motor delantero

El objetivo del proyecto es realizar el diseño de un sistema de transmisión para un vehículo de motor delantero y tracción trasera, haciendo especial hincapié en el diseño del segundo elemento de la transmisión: la caja de cambios. Se deben asegurar las prestaciones dadas por la ficha técnica del vehículo, un Ford Sierra xR4i 2.8, así como la transmisión de potencia máxima (150 CV/110 kW) y de par torsor (216 N·m/22 kg·m) del motor, el número de velocidades y las relaciones de marcha en la caja de cambios, la reducción final en el diferencial y los desarrollos. Para ello, se han estudiado, seleccionado (mediante catálogo comercial) y diseñado los distintos elementos del sistema de transmisión: embrague, caja de cambios, árbol de transmisión y diferencial. La aplicación del proyecto no está enfocada al mercado, es decir, no se va a comercializar la transmisión sino que esta será homologada para su uso particular, no competitivo, dentro de un circuito cerrado. Para llevar a cabo este proyecto se han dejado a un lado el estudio, la selección y el diseño de componentes eléctricos y electrónicos, ya que este se trata de un proyecto mecánico centrado en el diseño de los órganos de transmisión: ejes, rodamientos, elementos de unión, chavetas, engranajes... Los mecanismos desarrollados han sido los siguientes: - Embrague de discos de fricción. Concretamente, un embrague monodisco. - Caja de cambios de cinco velocidades montada sobre tres ejes (primario, intermedio y secundario). - Árbol de transmisión compuesto por un eje de sección circular hueca y dos juntas cardan de elección comercial a cada lado. - Diferencial convencional.

Canadian Shredded Wheat Company Fonds

In 1893 Attorney Henry Drushel Perky and William H. Ford invented a machine for the preparation of cereals for food. Perky soon realized that the actual cereal biscuits were more popular than the machines and he opened Shredded Wheat plants in Massachusetts and Niagara Falls, New York. In 1904, the Niagara Falls, Canada plant was opened. These factories also served as tourist attractions. In 1907, one hundred thousand people visited the plants on both sides of the border. In 1928, the company was sold to The National Biscuit Company and the product name changed to Nabisco Shredded Wheat. The name of the plant was changed to Nabisco Foods in 1956 to reflect the variety of foods that were being produced at that time. In 1985, Nabisco was purchased by J.R. Reynolds thus forming RJR Nabisco. In 1994, RJR sold its breakfast cereal business to Kraft Foods and the international licenses to General Mills. H.A.S. Dearborn letter, May 29, 1812

H.A.S. (Henry Alexander Scammell) Dearborn (1783-1851) was the son of Henry Dearborn, the American politician and veteran of the Revolutionary War and War of 1812. In the War of 1812, H.A.S Dearborn served as Brigadier General of the volunteer forces, responsible for the defence of Boston Harbour. From 1812-1829 he was collector of customs in Boston, from 1831-1833 he served as a representative from Massachusetts in the United States Congress, was adjutant general of Massachusetts from 1834-1843 and mayor of Roxbury from 1847-1851. Letter transcription: Dear Sir, My success in the line of recruiting has exceeded my most sanguine expectations. I have enlisted 24 1st Lt. 30—my 2nd Lt. 13, and my Ensign 9—Total 76. All very [ablebodied] men. In all probability my company will be full before the last day of June. I shall be in Boston on the 10th of June. I have not yet had the pleasure to hear of the arrival of your father at Boston. Please to offer my respects to your family, and to all my friends in the [office]. In haste, Yours, A.M. Clary.
