The Habitats Directive has created a European network of protected areas combining environmental protection with social and economic activities. Although not clearly advocated in the Directive, participatory approaches have incrementally emerged in order to ensure an adequate management of the Natura 2000 network. This paper looks at the reasons why the European Commission on one side and the national/local authorities on the other side chose to engage in participatory approaches and assesses the structure, degree and scope of these approaches in the light of input and output legitimacy. Main findings are that participation was mostly implemented as a reaction to conflicts and out of a concern over policy implementation, two elements that continue to drive the philosophy of the Natura 2000 network‘s management. The limits of participation in Brussels are contrasted with the potential for more genuine and effective participation mechanisms on the field.

Policy implementation by private actors constitutes a “missing link” for understanding the implications of private governance. This paper proposes and assesses an institutional logics framework that combines a top-down, policy design approach with a bottom-up, implementation perspective on discretion. We argue that the conflicting institutional logics of the state and the market, in combination with differing degrees of goal ambiguity, accountability and hybridity play a crucial role for output performance. These arguments are analyzed based on a secondary analysis of seven case studies of private and hybrid policy implementation in diverging contexts. We find that aligning private output performance with public interests is at least partly a question of policy design congruence: private implementing actors tend to perform deficiently when the conflicting logics of the state and the market combine with weak accountability mechanisms.

The Autonomous Region of Castilla-La Mancha develops from the approval of the Spanish Constitution a whole executive and legislative branch to implement its policies on environmental protection. Marine protected areas (MPAs) are commonly employed to protect ecosystems from threats like overfishing. Ideally, MPA design should incorporate movement data from multiple target species to ensure sufficient habitat is protected. We used long-term acoustic telemetry and network analysis to determine the fine-scale space use of five shark and one turtle species at a remote atoll in the Seychelles, Indian Ocean, and evaluate the efficacy of a proposed MPA. Results revealed strong, species-specific habitat use in both sharks and turtles, with corresponding variation in MPA use. Defining the MPA's boundary from the edge of the reef flat at low tide instead of the beach at high tide (the current best in Seychelles) significantly increased the MPA's coverage of predator movements by an average of 34%. Informed by these results, the larger MPA was adopted by the Seychelles government, demonstrating how telemetry data can improve shark spatial conservation by affecting policy directly.

Biodiversity loss is one of the most significant drivers of ecosystem change and is projected to continue at a rapid rate. While protected areas, such as national parks, are seen as important refuges for biodiversity, their effectiveness in stemming biodiversity decline has been questioned. Public agencies have a critical role in the governance of many such areas, but there are tensions between the need for these agencies to be more “adaptive” and their current operating environment. Our aim is to analyze how institutions enable or constrain capacity to conserve biodiversity in a globally significant cross-border network of protected areas, the Australian Alps. Using a novel conceptual framework for diagnosing biodiversity institutions, our research examined institutional adaptive capacity and more general capacity for conserving biodiversity. Several intertwined issues limit public agencies’ capacity to fulfill their conservation responsibilities. Narrowly defined accountability measures constrain adaptive capacity and divert attention away from addressing key biodiversity outcomes. Implications for learning were also evident, with protected area agencies demonstrating successful learning for on-ground issues but less success in applying this learning to deeper policy change. Poor capacity to buffer political and community influences in managing significant cross-border drivers of biodiversity decline signals poor fit with the institutional context and has implications for functional fit. While cooperative federalism provides potential benefits for buffering through diversity, it also means protected area agencies have restricted authority to address cross-border threats. Restrictions on staff authority and discretion, as public servants, have further implications for deploying capacity. This analysis, particularly the possibility of fostering “ambidexterity”—creatively responding to political pressures in a way that also achieves a desirable outcome for biodiversity conservation—is one promising way of building capacity to buffer both political influences and ecological pressures. The findings and the supporting analysis provide insight into how institutional capacity to conserve biodiversity can be enhanced in protected areas in Australia and elsewhere, especially those governed by public agencies and/or multiple organizations and across jurisdictions.

Protected area downgrading, downsizing, and degazettement (PADDD) has been documented worldwide, but its impacts on biodiversity are poorly understood. To fill this knowledge gap, we reviewed historical documents to identify legal changes that altered the boundaries of Yosemite National Park. We identified two downsizes and five additions between 1905 and 1937 that reduced the size of Yosemite National Park by 30%. To examine the effects of these downsizing events on habitat fragmentation by roads, we compared protected, never-protected, and downsized lands at three spatial scales using four habitat fragmentation metrics: road density, fragment (land surrounded by roads) area-to-perimeter ratio, fragment area, and fragment density. In general, lands that were removed from protection, e.g., downsized, were more highly fragmented than protected lands and indistinguishable from never-protected lands. Lands where downsizes were reversed were less fragmented than lands where downsizes were not reversed. These results suggest that protected area downsizing may exacerbate habitat fragmentation, a key contributor to biodiversity loss globally. Furthermore, the case study in Yosemite National Park demonstrates that iconic protected areas in developed countries are not immune to downsizing. These findings underscore the need to account for PADDD and governance histories in ecological research, monitoring, and evaluation. As we move toward more evidence-based conservation policy, a rigorous understanding of PADDD is essential to ensure that protected areas fulfill their promise as a strategy for conserving global biodiversity.

Os ecossistemas florestais do Brasil abrigam um dos mais altos níveis de diversidade de mamíferos da Terra, e boa parte dessa diversidade se encontra nas áreas legalmente protegidas em áreas de domínio privado. As reservas legais (RLs) e áreas de proteção permanente (APPs) representam estratégias importantes para a proteção e manutenção dessa diversidade. Mudanças propostas no Código Florestal certamente trarão efeitos irreversíveis para a diversidade de mamíferos no Brasil. Os mamíferos apresentam papéis-chave nos ecossistemas, atuando como polinizadores e dispersores de sementes. A extinção local de algumas espécies pode reduzir os serviços ecológicos nas RLs e APPs. Outra consequência grave da redução de áreas de vegetação nativa caso a mudança no Código Florestal seja aprovada será o aumento no risco de transmição de doenças, trazendo sério problemas a saúde pública no Brasil.

The development of efficient programs of incentive to voluntary conservation in private lands require an extensive knowledge on the motivations of land owners for conservation and their degree of acceptance on the benefits offered. Thus, this paper intended to evaluate the motivations for the establishment of PNHRs, the difficulties faced by their recognition and the incentives received for their establishment and management in Mato Grosso do Sul, and also to discuss some possibilities of widening the benefits offered. To this end, people responsible for 34 PNHRs were interviewed between March/2008 and March/2009. The results show that conservation is among the main reasons for the creation of these areas, in spite of economical and personal factors also being mentioned. The slowness and the red tape during the process of recognition were also emphasized as problems; on the other hand, several PNHRs received or receive support for their creation or management. Finally, some considerations are made on the benefits offered to owners of PNHRs and their possibilities of widening throughout the state.

Brazilian agriculture covers about one-third of the land area and is expected to expand further We assessed the compliance of present Brazilian agriculture with environmental legislation and identified challenges for agricultural development connected to this legislation We found (i) minor illegal land use in protected areas under public administration, (ii) a large deficit in legal reserves and protected riparian zones on private farmland, and large areas of unprotected natural vegetation in regions experiencing agriculture expansion Achieving full compliance with the environmental laws as they presently stand would require drastic changes in agricultural land use, where large agricultural areas are taken out of production and converted back to natural vegetation The outcome of a full compliance with environmental legislation might not be satisfactory due to leakage, where pristine unprotected areas become converted to compensate for lost production as current agricultural areas are reconverted to protected natural vegetation. Realizing the desired protection of biodiversity and natural vegetation, while expanding agriculture to meet food and biofuel demand, may require a new approach to environmental protection New legal and regulatory instruments and the establishment of alternative development models should be considered

Realistic time frames in which management decisions are made often preclude the completion of the detailed analyses necessary for conservation planning. Under these circumstances, efficient alternatives may assist in approximating the results of more thorough studies that require extensive resources and time. We outline a set of concepts and formulas that may be used in lieu of detailed population viability analyses and habitat modeling exercises to estimate the protected areas required to provide desirable conservation outcomes for a suite of threatened plant species. We used expert judgment of parameters and assessment of a population size that results in a specified quasiextinction risk based on simple dynamic models The area required to support a population of this size is adjusted to take into account deterministic and stochastic human influences, including small-scale disturbance deterministic trends such as habitat loss, and changes in population density through processes such as predation and competition. We set targets for different disturbance regimes and geographic regions. We applied our methods to Banksia cuneata, Boronia keysii, and Parsonsia dorrigoensis, resulting in target areas for conservation of 1102, 733, and 1084 ha, respectively. These results provide guidance on target areas and priorities for conservation strategies.

The whale shark is the largest fish in the ocean, A tourism industry based on interacting with whale sharks has developed recently in Ningaloo Marine Park, off the coast of Western Australia, This is the only known, accessible place in the world where whale sharks congregate in significant numbers, Results from surveys of participants in the 'whale shark experience' are reported, with the experience found to be extremely satisfying for most consumers, Yet management questions relating to diver-to-shark separation distances, the appropriate number of operators, and the use of regulation, self-regulation and economic instruments, remain, The nexus between experiential aspects of the whale shark attraction and such management concerns is examined, and the usefulness of appropriate research in resolving management questions established, It is concluded that a judicious combination of management approaches is required to ensure the sustainable development of the whale shark tourism industry. A anta Tapirus terrestris (Linnaeus, 1758), último representante da megafauna Pleistocênica na região Neotropical, representa um importante grupo funcional, pois dispersam uma grande variedade de espécies vegetais, especialmente frutos. No entanto, o padrão de frugivoria da espécie pode variar entre diferentes áreas. Dessa forma, nosso interesse foi investigar o grau de frugivoria da espécie em duas diferentes áreas no estado do Espírito Santo e a sua importância para a dinâmica florestal. Para isso, foram coletadas amostras fecais, através de busca ativa em diferentes ambientes na Reserva Biológica do Córrego do Veado (Rebio Córrego do Veado) e na Reserva Particular do Patrimônio Natural Recanto das Antas (RPPN Recanto das Antas), durante o período de janeiro de 2011 a novembro de 2013. Após a triagem do material biológico, as sementes foram individualizadas, classificadas quanto às características e grupos ecológicos e identificadas até o menor nível taxonômico possível. Foi obtido um esforço amostral de 130 dias, resultando em 325 amostras fecais coletadas, sendo 53,2% da Rebio Córrego do Veado e 46,8% da RPPN Recanto das Antas. Do total de amostras, 41,8% estavam depositadas dentro ou próximas a corpos d’água e 58,2% na serrapilheira/substrato seco. A dieta da anta foi composta por 94,1% de fibras e 5,9% de frutos. Foram encontradas duas vezes mais amostras contendo sementes na RPPN Recanto das Antas do que na Rebio Córrego do Veado. Das 30 morfoespécies encontradas nas amostras, 15 foram identificadas em nível específico, as quais estão distribuídas em oito famílias. As famílias mais representativas foram Anacardiaceae, Fabaceae e Myrtaceae. As espécies mais freqüentemente encontradas nas amostras foram Spondias macrocarpa Engl. e S. venulosa (Engl.) Engl. Do total de sementes encontradas 60% apresentam dispersão zoocórica e 46,7% são sementes grandes e muito grandes e 50% possuem fruto do tipo carnoso. Das morfoespécies encontradas, sete foram registradas em ambas as unidades de conservação, 21 foram encontradas apenas na RPPN Recanto das Antas e duas foram encontradas na Rebio Córrego do Veado. Isso pode indicar que o ambiente na RPPN Recanto das Antas pode fornecer mais frutos que na Rebio Córrego do Veado, o que pode ser um resultado do histórico de perturbações da última reserva. Na década de 1980, 80% da Rebio Córrego do Veado foi queimada em um incêndio e, atualmente, o entorno da reserva é composto principalmente por pastagens. Ao contrário, a RPPN Recanto das Antas, apesar de sua área ter sofrido extração seletiva na década de 50, está inserida no maior remanescente de Mata Atlântica do Espírito Santo. Ainda que a anta possua uma dieta composta por uma variedade de frutos nas áreas de estudo, ela aparenta ser menos frugívora do que em outras áreas da Mata Atlântica. Contudo, é evidente a importância de T. terrestris na dispersão de um grande número de espécies vegetais, especialmente as espécies com sementes grandes, aumentando o recrutamento de espécies de plantas que não são dispersadas por outras espécies animais.
