La médecine traditionnelle indigène peut parfois se poser comme un instrument normatif désignant le malade comme celui qui transgresse l‘ordre établi par les ancêtres sacrés et permet à la maladie d‘advenir. Un tiers malveillant ou un sorcier peuvent également être les causes du désordre physiologique et moral du corps social communautaire. L‘étiologie navajo repose sur deux phénomènes : l‘existence de sociosomas (troubles liés à une mauvaise relation à l‘entourage) et de mouvements d‘exclusion ou d‘inclusion du corps étranger, de la conduite déviante. L‘étude de la figure du malade dans les mythes soulignera l‘aspect normatif des thérapeutiques navajo. Enfin, une réflexion sur la justification idéologique de l‘intégration des pratiques ancestrales au protocole de soin montrera dans quelle mesure la collaboration entre praticiens traditionnels et personnels de santé contribue à stigmatiser le malade comme l‘épitome de toutes les déviances : par rapport à la tradition mais aussi au modèle social dominant.

O presente artigo desenvolve-se em torno de três damas esclarecidas da sociedade portuguesa de setecentos: D. Leonor de Almeida (1750-1839), ou Alcipe; D. Catarina de Lencastre (1749-1824), ou Nathercia; e D. Teresa de Mello Breyner (1739-1798?), ou Tirse. Sabendo que o século XVIII foi um período marcado por mudança e controvérsia, pela emergência de novos paradigmas, pelo reequacionamento de estruturas mentais e tradições seculares – ainda que em Portugal se experimentasse uma certa resistência às teorias filosóficas emergentes – a questão que lançamos e procuramos analisar é: qual o reflexo destas transformações no universo feminino? Assim, partindo dos três exemplos referidos e a eles tornando, pretendemos problematizar três questões centrais no discurso iluminista – educação, leituras e viagens – observando como estas matérias, assaz discutidas e teorizadas ao longo do século XVIII, se repercutiram na formação feminina em solo português e, por outro lado, analisar o modesto mas expressivo papel que as referidas damas assumiram na propagação da cultura das luzes em Portugal.

Forgiveness has been subject of interest, mainly in the psychology fields of study. Relatively to the organizational context, this topic has been somehow put aside and settled as something that is purely an intra-individual phenomenon which organizations cannot force, or even stimulate. As conflicts are common within organizations and being often difficult to overcome, eyes have turned into the role forgiveness might take in this scenario. Despite forgiveness being accepted as an intrapersonal decision and a result of predisposition as it is a result of education and culture. This study, as some already done, refuses to accept forgiveness as an unchangeable behavior that cannot be manipulated or induced by managers or by organizational context. Therefore, offering a set of incidents as well as their classification, that have been identified by individuals performing different types organizational roles in different organization which is believed as being a genuine way of delivering to the reader a set of actions and behaviors that if taken, may incentivize or inhibit forgiveness.

At a time of global economic instability, to which Portugal is not oblivious, and aware that the main source of Portuguese State revenue relies on the collection of tribute, the National Republican Guard holds within its mission relevant assignments to the protection of the financial interests of the country, in particular, fiscal and customs. These assignments were inherited from the century - old institution Guarda Fiscal - with evidence given in this domain, which was integrated into the National Republican Guard in 1993, to adopt, a 1St model, that held a specialized unit – Brigada Fiscal, with surveillance and patrolling missions of costa and fiscal and customs supervision, throughout the national territory and maritime zone of respect. In 2009, the result of political decisions, reorganization the State's central administration, appears de 2Nd model, because the Brigada Fiscal assignments were divided by two specialized units - UAF with investigation skills, and UCC for patrolling and surveillance of the coast. Analyzed the legal spectrum of special legislation leading the criminal and transgression sector punitive (RGIT), in essence, is in the UAF that resides the role assignments from the scope of the investigation and supervision of goods in the national territory on a par with the tax authority. Tax inspection assignments, fiscal and customs of the National Republican Guard, are unmatched in the National Tribute System, constituting itself as a potentiality of this special body, in similarity of their counterparts - Spain and Italy; however, have some constraints, that urge to clarify and repair. Foreseeing the future, face the announced news of a new restructuring, on behalf of the interests of the country, and in order to raise the quality of performance of the tax inspection, fiscal and customs, the National Republican Guard shall maintain a model based on the experience already accumulated, obviously adapted to the new demands of a changing society. Despite the current model gain in efficiency, loses in effectiveness. However, the efficiency of a model, without the necessary resources, can never bring “the letter to Garcia” against any kind of infringements, criminal or transgressions. Unless better opinion, both tax structures of the National Republican Guard are valid as an instrument for the prevention and combat of these illegal types. Because they are strategic in pursuing the public interest, given the scarce resources of the country and be the National Republican Guard, the force with the means and know-how of this nature. The political power has the final word.

In ''Nietzsche, Genealogy, History," Foucault suggests that genealogy is a sort of "curative science." The genealogist must be a physiologist and a pathologist as well as an historian, for his task is to decipher the marks that power relations and historical events leave on the subjugated body; "he must be able to diagnose the illnesses of the body, its conditions of weakness and strength, its breakdowns and resistances, to be in a position to judge philosophical discourse." But this claim seems to be incongruent with another major task of genealogy. After all, genealogy is supposed to show us that the things we take to be absolute are in fact discontinuous and historically situated: "Nothing in man-not even his body-is sufficiently stable to serve as the basis for self-recognition or for understanding other men." If this is true, then the subjugated body can never be restored to a healthy state because it has no essential or original nature. There are no universal standards by which we can even distinguish between healthy and unhealthy bodies. So in what sense is genealogy to be a "curative science"? In my thesis, I try to elucidate the complex relationship between genealogy and the body. I argue that genealogy can be a curative science even while it "multiplies our body and sets it against itself." Ifwe place a special emphasis on the role that transgression plays in Foucault's genealogical works, then the healthy body is precisely the body that resists universal standards and classifications. If genealogy is to be a curative science, then it must restore to the subjugated body an "identity" that transgresses its own limits and that constitutes itself, paradoxically, in the very effacement of identity. In the first chapter of my thesis, I examine the body's role as "surface of the inscription of events." Power relations inscribe on and around the body an identity or subjectivity that appears to be unified and universal, but which is in fact disparate and historically situated. The "subjected" body is the sick and pathologically weak body. In Chapters 2 and 3, I describe how it is possible for the unhealthy body to become healthy by resisting the subjectivity that has been inscribed upon it. Chapter 4 explains how Foucault's later works fit into this characterization of genealogy

The sOljihw6rd transgression of th.e northern Boreal See along the ~\festern Interior Seaway resulted in a meetlng with the northward edv6nclng waters from the GUlf of Mexico (Obradovich and Cobban, 1975). Th1s link was 1n eXlstence by late Albien time and 6llowed for the comm1ngl1ng of the prol1ferous Arctic and Gulf rnar1ne faunas (F1g. 1). By early Campanlan time, there was a widening of B6ffln Bay wlth a slrnult8neous subsidence 1n the Arct1c Archlpelago and Sverdrup 6as1n (W11liam and Stelck, 1975). Williams and Burk (1964) found 6 break 1n the marines sedlmentatlon in the f1anltoba area, suggesting Bland corlnectlon from the Dlstrlct of Keewatln through eastern M6fl1toba to the lake Sl~perlor reglon, lmplying that the only dlrect connection between the Interlor Sea with Baffln Bay, was yia the Arct1c. This hiatus was also documented by Meek and Hayden (1861) ln the United states between the Niobrara and Pierre Format1ons. Jeletzky (1971) suggested that the retreat of the sea towards the east was by a serles of strong pulses resultlng in the regression of the Campanlan and M66str1chtlan seas. During ttle Cretaceous1 the r1s1ng Corl1111era caused the western shoreline of the Interlor Sea to migrate eastwards and the Cordillera'l detritus produced deltaic cornplexes from the Mackenzie Valley to Ne\N Mexlcoo The foreland basin was continually subslding and thls down\",arplng aided in the eastward m1gration of the western shorel1ne. Thls also lndicates that trle water 'tIes becom1ng deeper in the central Plains sect10n of the Seaway (Fig. 2).

Since the first offshore Lake Erie well was drilled in 1941, the Grimsby and Thorold formations of the Cataract Group have been economically important to the oil and gas industry of Ontario. The Cataract Group provides a significant amount of Ontario's gas production primarily from wells located on Lake Erie. The Grimsby - Thorold formations are the result of nearshore estuarine processes influenced by tides on a prograding shelf and are composed of subtidal channel complexes, discrete tidal channels, mud flats and non-marine deposits. Deposition was related to a regressive - transgressive cycle associated with eustatic sea level changes caused by the melting and resurgence of continental glaciation centred in Africa in the Late Ordovician/Early Silurian. Grimsby deposition began during a regression with the deposition of subtidal channel complexes incised into the marine deposits of the Cabot Head Formation. The presence of mud drapes and mud couplets suggest that these deposits were influenced by tides. These deposits dominate the lower half of the Grimsby. Deposition continued with a change from these subtidal channel complexes to laterally migrating, discrete, shallow tidal channels and mud flats. These were in turn overlain by the non-marine deposits of the Thorold Formation. Grimsby - Thorold deposition ended with a major transgression replacing siliciclastic deposition with primarily carbonate deposition. Sediment was sourced from the east and southeast and associated with a continuation of the Taconic Orogeny into the Early Silurian. The fluvial head of the estuary prograded from a shoreline that was located in western New York and western Pennsylvania running NNE-SSW and then turning NW-SE and paralleling the present day Lake Erie shoreline. iii The facies attributed to the Grimsby - Thorold formations can be ascribed to the three zones within the tripartite zonation suggested by Dalrymple et ale (1992) for estuaries, that is, a marine-dominated facies, a mixed energy facies, and a facies that is dominated by fluvial processes. Also, sediments within the Grimsby - Thorold are commonly fining upwards sequences which are common in estuarine settings whereas deltaic deposits are normally composed of coarsening upwards sequences in a vertical wedge shape with coarser material near the head. The only coarsening observed was in the Thorold Formation and attributed to non-marine deposition by palynological evidence. The presence of a lag deposit at the base of the sediments of the Grimsby Thorold formations suggests that they were incised into the Cabot Head Formation. Further, the thickness of Early Silurian sediments located between the top of the Queenston Formation, where Early Silurian sedimentation began, to the top of the Reynales - Irondequoit formation are constant whether the Grimsby - Thorold formations are present or not. Also, cross-sections using a sand body located in the Cabot Head Formation for correlation further imply that the Grimsby Formation has been incised into the previous deposits of the Cabot Head.

The effec s of relative water level changes in Lake Ontario were detected in the ysical, chemical and biological characteristics of the sediments of the Fifteen, Sixteen and Twenty Mile Creek lagoonal complexes. Regional environmental changes have occurred resulting in the following sequence of sediments in the three lagoons and marsh. From the base up they are; (I) Till,(2) Pink Clay, (3) Bottom Sand, (4) Gyttja, (5) Orange Sandy Silt, (6) Brown Clay and (7) Gray Clay. The till was only encountered in the marsh and channel; however, it is presumed to occur throughout the entire area. The presence of diatoms and sponge spicules, the vertical and ongitudinal uniformity of the sediment and the stratigr ic position of the Pink Clay indicate that it has a glacial or post-glacial lacustrine origin. Overl ng the Pink Clay or Till is a clayey, silty sand to gravel. The downstream fining and unsorted nature of this material indicate that it has a fluvial/deltaic origin. Water levels began rising in the lagoon 3,250 years ago resulting in the deposition of the Gyttja, a brown, organic-rich silty clay probably deposited in a shallow, stagnant environment as shown by the presence of pyrite in the organic material and relatively high proportions of benthic diatoms and grass pollen. Increase in the rate of deposition of the Gyttja on Twenty Mile Creek and a decrease in the same unit on Sixteen Mile Creek is possibly the result of a capture of the Sixteen Mile Creek by the Twenty Mile Creek. The rise in lake level responsible for the onset and transgression of this III unit may have been produced by isostatic rebound; however, the deposition also corresponds closely to a drop in the level of Lake Huron and increased flow through the lower lakes. The o ange Sandy Silt, present only in the marsh, appears to be a buried soil horizon as shown by oxidized roots, and may be the upland equivalant to the Gyttja. Additional deepening resulted in the deposition of Brown Clay, a unit which only occurs at the lakeward end of the three lagoons. The decrease in grass pollen and the relatively high proportion of pelagic diatoms are evidence for this. The deepening may be the result of isostatic rebound; however, the onset of its deposition at 1640 years B.P. is synchronous in the three lagoons and corresponds to the end of the subAtlantic climatic episode. The effects of the climatic change in southern Ontario is uncertain. Average deposition rates of the Brown Clay are similar to those in the upper Gyttja on Sixteen Mile Creek; however, Twenty Mile Creek shows lower rates of the Brown Clay than those in the upper Gyttja. The Gray Clay covers the present bottom of the three lagoons and also occurs in the marsh It is inter1aminated wi sand in the channels. Increases in the rates of deposi ion, high concentrations of Ca and Zn, an Ambrosia rise, and an increase in bioturbation possibly due to the activities of the carp, indicate th this unit is a recent deposit resulting from the activities of man.

The lower Silurian Whirlpool Sandstone is composed of two main units: a fluvial unit and an estuarine to transitional marine unit. The lowermost unit is made up of sandy braided fluvial deposits, in shallow valleys, that flowed towards the northwest. The fluvial channels are largely filled by cross-bedded, well sorted, quartzose sands, with little ripple crosslaminated or overbank shales. Erosionally overlying this lower unit are brackish water to marine deposits. In the east, this unit consists of estuarine channels and tidal flat deposits. The channels consist of fluvial sands at the base, changing upwards into brackish and tidally influenced channelized sandstones and shales. The estuarine channels flowed to the southwest. Westwards, the unit contains backbarrier facies with extensive washover deposits. Separating the backbarrier facies from shoreface sandstone facies to the west, are barrier island sands represented by barrier-foreshore facies. The barrier islands are dissected by tidal inlets characterized by fining upward abandonment sequences. Inlet deposits are also present west of the barrier island, abandoned by transgression on the shoreface. The sandy marine deposits are replaced to the west by carbonates of the Manitoulin Limestone. During the latest Ordovician, a hiatus in crustal loading during the Taconic Orogeny led to erosional offloading and crustal rebound, the eroded material distributed towards the west, northwest and north as the terrestrial deposits of the fluvial Whirlpool. The "anti-peripheral bulge" of the rebound interfered with the peripheral bulge of the Michigan Basin, nulling the Algonquin Arch, and allowing the detritus of the fluvial Whirlpool to spread onto the Algonquin Arch. The Taconic Orogeny resumed in the earliest Silurian with crustal loading to the south and southeast, and causing tilting of the surface slope in subsurface Lake Erie towards the ii southwest. Lowstand terrestrial deposits were scoured into the new slope. The new crustal loading also reactivated the peripheral bulge of the Appalachian Basin, allowing it to interact with the bulge of the Michigan Basin, raising the Algonquin Arch. The crustal loading depressed the Appalachian basin and allowed transgression to occur. The renewed Algonquin Arch allowed the early Silurian transgression to proceed up two slopes, one to the east and one to the west. The transgression to the east entered the lowstand valleys and created the estuarine Whirlpool. The rising arch caused progradation of the Manitoulin carbonates upon shoreface facies of the Whirlpool Sandstone and upon offshore facies of the Cabot Head Formation. Further crustal loading caused basin subsidence and rapid transgression, abandoning the Whirlpool estuary in an offshore setting.

Recent research has shown that University students with a history of self-reported mild head injury (MHI) are more willing to endorse moral transgressions associated with personal, relative to impersonal, dilemmas (Chiappetta & Good, 2008). However, the terms 'personal' and 'impersonal' in these dilemmas have functionally confounded the 'intentionality' of the transgression with the 'personal impact' or 'outcome' of the transgression. In this study we used a modified version of these moral dilemmas to investigate decision-making and sympathetic nervous system responsivity. Forty-eight University students (24 with MHI, 24 with no-MHI) read 24 scenarios depicting moral dilemmas varying as a function of 'intentionality' of the act (deliberate or unintentional) and its 'outcome' (physical harm, no physical harm, non-moral) and were required to rate their willingness to engage in the act. Physiological indices of arousal (e.g., heart rate - HR) were recorded throughout. Additionally, participants completed several neurocognitive tests. Results indicated significantly lowered HR activity at baseline, prior to, and during (but not after) making a decision for each type of dilemma for participants with MHI compared to their non-injured cohort. Further, they were more likely than their cohort to authorize personal injuries that were deliberately induced. MHI history was also associated with better performance on tasks of cognitive flexibility and attention; while students' complaints of postconcussive symptoms and their social problem solving abilities did not differ as a function of MHI history. The results provide subtle support for the hypothesis that both emotional and cognitive information guide moral decision making in ambiguous and emotionally distressing situations. Persons with even a MHI have diminished physiological arousal that may reflect disruption to the neural pathways of the VMPFC/OFC similar to those with more severe injuries.

Despite general endorsement of universal human rights, people continue to tolerate specific human rights violations. I conducted a two-part study to investigate this issue. For Part I, I examined whether people tolerated torture (a human rights violation) based on the morality and deservingness of the target. Participants tolerated torture more when the target had committed a highly morally reprehensible transgression. This effect was mediated by the target’s perceived deservingness for harsh treatment, and held over and above participants’ abstract support for the right to humane treatment. For Part II, hypocrisy induction was used in an attempt to reduce participants’ toleration of the torture. Participants were assigned to either the hypocrisy induction or control condition. Unexpectedly, participants who tolerated the torture more in Part I reduced their toleration the most in the control condition, possibly because of consistency and floor effects. Limitations and implications of the findings are discussed.

Ce mémoire analyse la réception de l’auteur autrichien Thomas Bernhard (1931-1989) au regard des scandales qui ont marqué sa carrière. Tantôt identifié comme l’imprécateur de l’Autriche, tantôt comme écrivain exceptionnel, il aura remis en question le rôle de son pays dans le national-socialisme et multiplié les attaques ad hominem. Il aura tenu un rôle ambigu dans l’espace public. Tout en insistant sur le caractère fictif de ses œuvres, il se mettait en scène de façon provocatrice dans le discours public ainsi que dans sa fiction. Ce mémoire s’intéresse au fonctionnement du scandale en tant qu’événement social complexe ayant lieu dans l’espace public. Les chercheurs s’entendent pour considérer le scandale comme un trouble ou une irritation résultant d’une transgression, apparente ou avérée. Il s’agit en outre d’un phénomène intégré dans l’ordre social et géré par les médias, caractérisé par l’actualisation des valeurs morales. Dans la présente étude, il est postulé que le capital symbolique (cf. Bourdieu) joue un rôle d’a priori et de catalyseur dans les scandales. Une accumulation initiale de capital symbolique assure une visibilité médiatique automatique. Le capital d’identité de Thomas Bernhard – soit la personnalisation du capital symbolique – est hybride et complexe, de sorte qu’il est difficilement appréciable. La difficile appréciation du capital de l’auteur se traduit par l’incertitude des journalistes et du public quant à son message : réactions dispro-portionnées, critique du particulier perçue comme mise en cause de l’universel. Toute dé-claration, toute œuvre de Bernhard est assujettie à ses prestations « scandaleuses » antérieu-res. Ce mémoire insiste sur le caractère autoréférentiel du scandale et s’intéresse aux actes de langage performatifs (cf. John L. Austin). Le corpus comporte des romans de Bernhard, leurs recensions, des articles de quotidiens, des lettres de lecteurs, des documents juridiques ainsi que la correspondance entre Bernhard et Siegfried Unseld.

Par une approche analytique, cette étude en éthique clinique a examiné la problématique de la demande d’assistance médicalisée pour mourir formulée dans le cadre des soins de fin de vie. Partant du fait que cette demande sollicite les soignants dans leur savoir et leur savoir-faire, surtout dans leur savoir-être, cette étude rend d’abord compte d’un fait : bon gré mal gré l’interdit de l’euthanasie par la loi et la déontologie médicale, ainsi que le débat contradictoire à son sujet qui dure déjà voici quelques décennies, il arrive de temps à autres que les soignants œuvrant en soins de fin de vie, soient confrontés à une demande d’assistance médicalisée pour mourir. Cette demande qui émane de certaines personnes en fin de vie et / ou de leurs proches, est souvent source de malaise pour les soignants à l’endroit de qui elle crée des défis majeurs et fait naître des dilemmes éthiques importants. Plus particulièrement, cette demande interroge toujours la finalité même des soins de fin de vie : est-ce que l’aide pour mourir fait partie de ces soins ? En réponse à cette question difficile, cette démarche réflexive de soignant chercheur en éthique montre qu’il est difficile de donner une réponse binaire en forme de oui / non ; il est difficile de donner une réponse d’application universalisable, et de définir une généralisable conduite à tenir devant une telle demande, car chaque cas est singulier et unique à son genre. Cette étude montre prioritairement que l’humanisation de la mort est à la fois un enjeu éthique important et un défi majeur pour notre société où la vie des individus est médicalisée de la naissance à la mort. En conséquence, parce que la demande d’assistance médicalisée pour mourir sollicite les soignants dans leur savoir et leur savoir-faire, cette étude montre toute l’importance de la réflexivité et de la créativité que doivent développer les soignants pour apporter une réponse constructive à chaque demande : une réponse humanisant le mourir et la mort elle-même, c’est-à-dire une réponse qui soit, sur le plan éthique, raisonnable et cohérente, une réponse qui soit sur le plan humain, porteuse de sens. D’où, outre l’axiologie, cette démarche réflexive montre que l’interdisciplinarité, la sémantique, l’herméneutique et les grilles d’analyse en éthique, constituent des outils réflexifs efficaces pouvant mieux aider les soignants dans leur démarche. Sur quelles bases éthiques, les soignants doivent-ils examiner une demande d’assistance médicalisée pour mourir, demande qui se présente toujours sous la forme d’un dilemme éthique? Cette question renvoie entre autre au fait que cette demande sollicite profondément les soignants dans leur savoir-être en relation des soins de fin de vie. Aussi bonnes les unes que les autres, qu’on soit pour ou contre l’euthanasie, plusieurs stratégies et méthodes d’analyse sont proposées aux soignants pour la résolution des conflits des valeurs et des dilemmes éthiques. Mais, ce n’est pas sur cette voie-là que cette étude invite les soignants. C’est plutôt par leur réflexivité et leur créativité, enrichies principalement par leur humanisme, leur expérience de vie, leur intuition, et secondairement par les différentes méthodes d’analyse, que selon chaque contexte, les soignants par le souci permanent de bien faire qui les caractérisent, trouveront toujours par eux-mêmes ce qui convient de faire dans l’ici et maintenant de chaque demande. C’est pourquoi, devant une demande d’assistance médicalisée pour mourir qui leur est adressée dans le cadre des soins de fin de vie, cette démarche éthique invite donc les soignants à être « des cliniciens créatifs, des praticiens réflexifs» . C’est pour cette raison, sur le plan proprement dit de la réflexion éthique, cette étude fait apparaître les repères de l’éthique humaniste de fin de vie comme bases axiologiques sur lesquels les soignants peuvent construire une démarche crédible pour répondre au mieux à cette demande. L’éthique humaniste de fin de vie située dans le sillage de l’humanisme médical , où l’humain précède le médical, renvoie au fait qu’en soins de fin de vie où émerge une demande d’aide à la mort, entre le demandeur de cette aide et le soignant, tout doit être basé sur une confiante relation d’homme à homme, même si du côté du soignant, son savoir être dans cette relation est aussi enrichi par sa compétence, ses connaissances et son expérience ou son savoir-faire. Basée sur l’humanité du soignant dans la démarche de soins, l’éthique humaniste de fin de vie en tant que pratique réflexive émerge de la créativité éthique du soignant lui-même et de l’équipe autour de lui ; et cette éthique se situe entre interrogation et transgression, et se définit comme une éthique « du vide-de-sens-à-remplir » dans un profond souci humain de bien faire. Car, exclue l’indifférence à la demande de l’assistance médicalisée pour mourir, son acceptation ou son refus par le soignant, doit porter sur l’humanisation de la mort. Cette dernière étant fondamentalement définie par rapport à ce qui déshumanise la fin de vie.
