It should come as no surprise that prisons can become breeding grounds for radicalisation and terrorism [1]. In many cases, extremist ideologies can flourish in prisons through recruiting vulnerable inmates to follow their path. Despite being a popular topic among researchers and policymakers, there still remain significant gaps in our understanding and many unanswered questions. This paper provides an overview on prisoner radicalisation, specifically exploring the role religion plays in prison and its link to radicalisation, prisoner vulnerability to radicalisation and the radicalisation process. The paper also outlines the current debate regarding where is the best place to house terrorist prisoners (isolation vs. separation). The paper concludes by identifying the major gaps in the literature and offers concluding remarks.

This paper grapples with the question of how progressive criminologists might approach working with people who have committed violent or predatory crimes, or are ‘at risk’ of doing so. Progressives have often been uneasy about ‘intervention’ with people who offend: but in the face of the destructiveness of violence, especially in some parts of the world, a posture of simple non-intervention won’t suffice. I suggest three central principles – which I call consciousness, solidarity and hope – that may guide us in developing ways of working with offenders that are both progressive and effective.

The sentencing of a self-confessed child sex offender and senior Brisbane Anglican priest Canon Barry Greaves in Brisbane District Court last Friday (April 24, 2009) is a significant event for many reasons and for many people. It is a significant event because Greaves was a priest at Boonah in the early 1980s when he committed the offences and because knowledge of his own sex offending against children failed to deter him from seeking and gaining high office in the Anglican Church. He accepted the position of being an Archbishop’s chaplain to Brisbane Archbishop Dr Peter Hollingworth in 1999. He stayed on as an Archbishop’s chaplain to the incoming Archbishop Dr Phillip Aspinall in 2002 and not even the disgrace of the sex scandal in the Brisbane Diocese resulted in a glimmer of guilt that maybe he was not an appropriate person to be providing pastoral care to other victims of sexual assault. Families of victims who were referred to Greaves for pastoral care are now flabbergasted by the double betrayal. “I went looking for comfort and now I discover I was confiding in a f***ing pedophile,” one woman said.

Despite policies of deinstitutionalisation, many people with intellectual disabilities in developed western countries continue to live in mainstream institutional settings, such as correctional facilities, rather than in the community with support from disability services. This paper reports on the life stories of 10 people with intellectual disabilities, who had been imprisoned in adult correctional facilities in Queensland. The pathways taken by these 10 people into and out of prison are marked by significant abuse, neglect, and poverty. Significant disparity and disconnection is also displayed between the policies and service approaches, particularly between the disability, mental health, and correctional systems in Queensland. Based on these findings, a framework for practice, which spans both generic and specialist services, is suggested.

Drink driving continues to be a major public health concern. Significant reductions in road fatalities have been achieved due largely to the Safe Systems Approach to road safety. However, serious injury due to road trauma has increased in most Australian jurisdictions. Some subgroups of drink drivers such as young drivers and Indigenous drink drivers are vulnerable to road trauma and have been less responsive to countermeasures based on the deterrence philosophy. Drink driving rehabilitation programs that use a combination of deterrence, education and social control models have been moderately successful in reducing recidivism. However, most of these programs do not adequately address alcohol related health concerns or the needs of drink drivers in remote and rural areas. Scant attention has also been given to the use of brief online drink driving interventions. The ‘Under the Limit’ (UTL) drink driving rehabilitation program has recently been revised to ensure that its content is contemporary, relevant and evidenced based. CARRS-Q has also developed a brief online program that targets first time convicted drink drivers who have a BAC under 0.15g/100mL and a culturally sensitive program that targets Aboriginals and Torres Strait Islanders living in rural and remote areas. These new developments will be discussed in the context of the most effective road safety educational policy and practice.

Purpose of this paper: International research identifies transgender people as a vulnerable group in prison systems, with basic needs often being denied. This paper outlines Australian contexts of incarceration, and links between institutional responses and the vulnerabilisation of transgender prisoners. Design/methodology/approach: The paper critically analyses Australian prison policies regarding the treatment of transgender prisoners. Findings: The policy analysis illustrates the links between institutional practices and the increased vulnerability of transgender prisoners. The paper argues that policies further criminalise, and potentially doubly punish, transgender prisoners. Research limitations/implications: This paper analyses the publicly available policies on regulating transgender people’s imprisonment. Given the limited Australian research into transgender prisoner’s lived experiences, there is a gap in relation to policies, their perception, and how corrective services personnel enact the limited procedures available to them in managing transgender prisoners. Practical Implications: Current policies and practices significantly enhance the vulnerability of transgender prisoners. This policy analysis highlights the critical importance of policy and practice reform in relation to housing, safety, health and welfare services, and misgendering. What is the original/value of paper: The policy analysis provides practitioners with an outline of critical issues that arise when transgender people are imprisoned and suggests key areas for future research.

The purpose of this article is to provide an overview of the various United Nations instruments relevant to juvenile justice and to examine how knowledge of these can assist those interested in the protection and enhancement of young people's rights in the justice system. It is argued that whilst these instruments are variable they are valuable tools for unmasking the discriminatory and unjust treatment of young people who come into contact with the justice system.

El rol desempeñado por la opinión pública en el desarrollo de la política criminal actual justifica el incremento de investigaciones destinadas a evaluar las actitudes de los ciudadanos hacia el castigo. No obstante, los avances en este ámbito han sido limitados debido a la utilización de rudimentarios instrumentos de medida. Por ello, el presente trabajo tiene como propósito explorar el efecto que generan en la opinión ciudadana ciertas variables referidas al hecho delictivo y al infractor, precisando su contribución relativa y la interacción existente entre ellas. Para satisfacer este objetivo se recurrió a un diseño factorial de la encuesta, creando una población de 256 casos-escenario fruto de la combinación de cuatro factores: la edad del joven, su historial delictivo, el grado de implicación en el hecho y el tipo de delito cometido. Los mismos fueron distribuidos en grupos de ocho casos ordenados aleatoriamente y fueron suministrados a 32 sujetos. Posteriormente se aplicaron análisis de regresión logística binaria. Los resultados obtenidos revelan que la naturaleza violenta de los hechos, la implicación activa de los jóvenes y el historial delictivo son predictores importantes de las condenas punitivas. Sin embargo la edad, una variable fundamental en la configuración de la justicia juvenil, no resulta significativa. De este modo, el trabajo muestra el potencial explicativo de este conjunto de factores y debate sus implicaciones teóricas y metodológicas para la investigación futura en este terreno.

This article examines why England and Wales have comparatively one of the most stringent systems for the governance of sexual offending within Western Europe. While England and Wales, like the USA, have adopted broadly exclusionary, managerialist penal policies based around incapacitation and targeted surveillance, many other Western European countries have opted for more inclusionary therapeutic interventions. Divergences in state approaches to sex offender risk, particularly in relation to notification and vetting schemes, are initially examined with reference to the respective theoretical frameworks of ‘policy transfer’ and differing political economies. Chiefly, however, differences in penal policies are attributed to the social and political construction of risk and its control. There may be multiple expressions of risk relating to expert, lay, moral or emotive aspects. It is argued, however, that it is the particular convergence and alignment of these dimensions on the part of the various stakeholders in the UK – government, media, public and professional – that leads to risk becoming institutionalized in the form of punitive regulatory policies for managing the dangerous.

Media reporting of and public concern about sexual offending, particularly relating to children, affects and reflects political, policy and organisational responses to those convicted of such crimes. The development of regulatory policies on sexual offending has taken place within a highly emotive and overtly politicized public and policy discourse. This chapter charts the various ways in which the risks imagined or posed by sexual offenders have been conceptualised within public discourses and regulated and managed under the legislative and organisational ‘risk paradigm.’ Ultimately, it argues that risk-based responses to sexual offending are at best uncertain in their effects and at worst counterproductive, in that they often reduce the potential for successful reintegration. In seeking to look ‘beyond risk’, the chapter also explores the usefulness of restorative and related practices in supporting sex offender reintegration aimed at the primary and secondary levels of harm prevention.

Le 29 juillet 1994, Megan Kanka, une jeune fille de sept ans de la municipalité de Hamilton au New Jersey, est enlevée, agressée sexuellement et tuée par ce qui se révélera être son voisin d’en face, Jesse Timmendequas. À l’époque, l’assaillant de Megan avait déjà fait l’objet de deux condamnations pour agression sexuelle. Suite à cette tragédie, les parents de Megan luttèrent pour la création d’une loi qui révélerait automatiquement au public l’identité et le lieu de résidence des délinquants sexuels. Moins de trois mois plus tard, la « Loi de Megan » était ratifiée. Ainsi un répertoire étatique centralisé de délinquants sexuels en partie disponible au public fut créé. Notre étude se centre sur ce cas et tente de comprendre comment une construction particulière de la délinquance sexuelle comme problème social mena à la réponse pénale spécifique qu’était la Loi de Megan. Pour ce faire, nous analysons les discours et argumentaires politiques en lien avec l’affaire. Huit entretiens avec différents acteurs impliqués dans le débat politique menant à la création de la loi de Megan furent effectués. Une analyse de plus de 150 articles de journaux et de quelques projets et textes de lois fut également effectuée. Nos résultats soulignent d’abord le rôle primordial qu’avait le contexte sociopolitique autant sur la construction du problème social de la délinquance sexuelle que sur la solution qui lui était liée. L’analyse du cas nous indique également que la dyade problème-solution s’élabora en conjonction, dans un cadre temporel uniforme, dont les seules étapes détectables sont celles du narratif de la mort de Megan et de l’élaboration concrète de la loi. En d’autres mots, la mort de Megan ne constituait qu’un point focal qui permit à des acteurs de mettre en pratique des concepts déjà largement partagés. L’étude conclue en liant le contexte sociopolitique du Canada à celui retrouvé dans notre étude de cas et suggère qu’une construction similaire de la délinquance sexuelle comme problème peut facilement être envisageable chez nous. Si personne ne souhaite l’occurrence d’une situation comparable à celle vécue par Megan Kanka et sa famille, cet élément nous apparaît comme étant celui qui propulserait réellement cette construction sur la place publique, à condition bien évidemment qu’une personne ou un groupe de personnes en fassent une question à débattre.

Les objectifs du présent mémoire étaient d’identifier les dimensions présentes dans la Statique-99R, l’échelle actuarielle de prédiction de la récidive sexuelle la plus utilisée, et de tester leur validité prédictive. Une analyse factorielle exploratoire des items de l’instrument en a extrait trois dimensions : la déviance sexuelle, l’orientation antisociale et le détachement émotionnel. Des analyses de régressions de Cox ont révélé que ces facteurs affichaient une validité prédictive différentielle; la déviance sexuelle ne prédisait que la récidive sexuelle, alors que l’orientation antisociale ne prédisait que la récidive violente non sexuelle et la récidive générale. Le détachement émotionnel affichait une validité prédictive incohérente. Des analyses de courbes ROC ont indiqué que la dernière révision de la Statique-99, la Statique-99R, surpassait pratiquement en tout point son prédécesseur. Ces mêmes analyses indiquaient que la validité prédictive de l’échelle était similaire pour les agresseurs sexuels de femmes et d’enfants.

Le présent mémoire cherche à déterminer s’il existe des facteurs qui conduisent aux aveux chez les agresseurs sexuels durant un interrogatoire. Dans ce but, notre étude est basée sur 183 dossiers d’agression sexuelle traités par le Service de police de la Ville de Montréal. Les 137 participants qui ont fait une ou deux victimes (un dossier par victime) étaient âgés de 15 à 71 ans au moment du crime, et sont majoritairement francophones, caucasien et sans emploi. Toutes les variables sélectionnées ont été divisées en trois catégories : les caractéristiques de l’agresseur, les caractéristiques du crime et les caractéristiques contextuelles de l’interrogatoire. Les agresseurs sexuels qui ont avoué leur crime avaient les caractéristiques suivantes : caucasien, célibataire, n’ayant pas utilisé la menace ni causé de blessures, la victime était un garçon ou une femme adulte. Il n’y avait, contre eux, ni preuves matérielles ou biologiques, ni présence de sperme sur la victime, et il n’y a pas eu de séance d’identification. De plus, ils ont subi plusieurs interrogatoires, souvent dans un bureau privé en présence d’un seul interrogateur, qui n’est pas l’enquêteur principal, mais ils ont écrit et signé leur déclaration. Ces résultats devraient aider les policiers à cibler les facteurs les plus favorables aux aveux tout en montrant qu’il s’agit généralement d’un ensemble de facteurs qui conduisent les agresseurs sexuels aux aveux lors d’un interrogatoire.
