A partir de uma visão contemporânea do contrato o trabalho procurou, (i) reconstruir o marco teórico sobre qual se funda o contrato de concessão comercial no Brasil, registrando uma nota histórica sobre a criação da Lei nº 6.729/1979; (ii) avaliar a validade da lei estudada sob o enfoque do regime constitucional vigente; (iii) analisar o regime jurídico das convenções de marca previstas na lei e a utilização dessas convenções como mecanismos de incentivo de atuação dos concessionários dentro de suas respectivas áreas operacionais, conceituando-as; (iv) sugerir mecanismos de solução de conflitos decorrentes da atuação, pelos concessionários, fora de sua respectiva área operacional, especialmente a cláusula de mediação e arbitragem

Toxic effects of phytosanitary surfactants for jewel tetra (Hyphessobrycon eques). Surfactants are amphipatic molecules that reduce the surface tension of water and make up the inert components of pesticide formulations. Thus, the objectives of this study were: to estimate the lethal concentration (LC(I)50;96h); classify and evaluate water quality during testing of the following surfactants: Agral[registered trademark], Aterbane[registered trademark]BR, Ag-bem[registered trademark], Energic[registered trademark], Fixade[registered trademark] and Gotafix[registered trademark] for jewel tetra (Hyphessobrycon eques); and the signs of intoxication in the animals. For this, the fish were acclimated for ten days in the bioassay room. The animals were exposed to the surfactants in an entirely randomized design with three replications. The LC(I)(50;96h) of surfactant Agral[registered trademark] was 3.29 mg L-1; Aterbane[registered trademark] BR 8.21 mg L-1; Energic[registered trademark] 2.34 mg L-1; Gotafix[registered trademark] 4.37 mg L-1; Fixade[registered trademark] 3.38 mg L-1; and Ag-bem[registered trademark] 34.95 mg L-1. The variables of water quality were unchanged. The fish showed an increase in the opercular beating after exposure; 4 and 24 hours, loss of gasping ability; 48 hours, slow opercular beating; and 72 and 96 hours later, recovery. The surfactants Energic[registered trademark], Agral[registered trademark], Gotafix[registered trademark], Aterbane[registered trademark] BR and Fixade[registered trademark] can be classified as moderately toxics, and Ag-Bem[registered trademark] as slightly toxic for H. eques; this organism shows similar intoxication signs for all surfactants.

Abstract Montana's Lee Metcalf was an extraordinary Montana leader with an unbelievable record of accomplishment fighting for the little people against the forces of economic and political power. The public memory is so short that this film will serve to help reacquaint Lee & Donna Metcalf to most of those who were around during their time. But it will also provide an opportunity for new generations to receive a perspective of an important leader from an important time. (Language from YouTube version of the film, written and provided by Executive Producer Evan Barrett) Lee Warren Metcalf (January 28, 1911 – January 12, 1978) was an American lawyer, judge, and politician. A member of the Democratic Party, he served as a U.S. Representative (1953–1961) and a U.S. Senator (1961–1978) from Montana. He was permanent acting President pro tempore of the Senate, the only person to hold that position, from 1963 until his death in 1978. U.S. House of Representatives During his tenure in the House, Metcalf served on the Education and Labor Committee (1953–1959), Interior and Insular Affairs Committee (1955–1959), Select Astronautics and Space Exploration Committee (1958), and Ways and Means Committee (1959–1960). He became known as one of Congress's "Young Turks" who promoted liberal domestic social legislation and reform of congressional procedures. He introduced legislation to provide health care to the elderly ten years before the creation of Medicare. He earned the nickname "Mr. Education" after sponsoring a comprehensive bill providing for federal aid to education. He also voted against legislation that would have raised grazing permits on federal lands, and led the opposition to a bill that would have swapped forested public lands for cutover private lands. He was elected chairman of the Democratic Study Group in 1959. U. S. Senate Regarded as "a pioneer of the conservation movement", Metcalf worked to protect the natural environment and regulate utilities. He helped pass the Wilderness Act of 1964, and supported the creation of the Great Bear Wilderness and the Absaroka-Beartooth Wilderness. In 1962, he introduced a "Save Our Streams" bill to preserve natural recreation facilities and protect fish and wildlife from being destroyed by highway construction. He was a longtime member of the Migratory Bird Conservation Commission. He was also active on the issue of education. He was a leading supporter of the Elementary and Secondary Education Act, the effort to extend the G.I. Bill's educational benefits to a new generation of veterans, and the development of legislation to improve federally-aided vocational education.[1] The Peace Corps was established under leadership of Metcalf and Senator Mansfield. In 1983, by act of Congress, the Lee Metcalf Wilderness area was created in southwestern Montana in honor of the late Congressman. The Great Bear Wilderness and Absaroka-Beartooth Wilderness areas were also created as a result of Metcalf's efforts in Congress, in addition to the Lee Metcalf National Wildlife Refuge in Montana. Metcalf was ranked number 15 on a list of the 100 Most Influential Montanans of the Century by the Missoulian newspaper. Catecholaminergic polymorphic ventricular tachycardia (CPVT) is a cardiac channelopathy characterized by altered intracellular calcium handling resulting in ventricular arrhythmias and high risk of cardiac sudden death in young cases with normal structural hearts. Patients present with exertional syncope and the trademark dysrhythmia is polymorphic and/or bidirectional ventricular tachycardia during exercise or adrenergic stimulation. Early detection of CPVT is crucial because opportune medical intervention prevents sudden cardiac death. Mutations in the ryanodine receptor RYR2 explain nearly 70% of the CPVT cases and cause the autosomic dominant form of the disease. Mutations in calsequestrin 2 causes a recessive form and explain less than 5% of all cases. Genetic screening in CPVT, besides providing early detection of asymptomatic carriers at risk, has provided important insights in the mechanism underlying the disease. Mutational analysis of RYR2 has been a challenge due to the large size of the gene, 105 exons encoded for 4,967 amino-acids. In this review we analyze general concepts of the disease, differential diagnosis and strategies for genetic screening.

At issue is whether or not isolated DNA is patent eligible under the U.S. Patent Law and the implications of that determination on public health. The U.S. Patent and Trademark Office has issued patents on DNA since the 1980s, and scientists and researchers have proceeded under that milieu since that time. Today, genetic research and testing related to the human breast cancer genes BRCA1 and BRCA2 is conducted within the framework of seven patents that were issued to Myriad Genetics and the University of Utah Research Foundation between 1997 and 2000. In 2009, suit was filed on behalf of multiple researchers, professional associations and others to invalidate fifteen of the claims underlying those patents. The Court of Appeals for the Federal Circuit, which hears patent cases, has invalidated claims for analyzing and comparing isolated DNA but has upheld claims to isolated DNA. The specific issue of whether isolated DNA is patent eligible is now before the Supreme Court, which is expected to decide the case by year's end. In this work, a systematic review was performed to determine the effects of DNA patents on various stakeholders and, ultimately, on public health; and to provide a legal analysis of the patent eligibility of isolated DNA and the likely outcome of the Supreme Court's decision. ^ A literature review was conducted to: first, identify principle stakeholders with an interest in patent eligibility of the isolated DNA sequences BRCA1 and BRCA2; and second, determine the effect of the case on those stakeholders. Published reports that addressed gene patents, the Myriad litigation, and implications of gene patents on stakeholders were included. Next, an in-depth legal analysis of the patent eligibility of isolated DNA and methods for analyzing it was performed pursuant to accepted methods of legal research and analysis based on legal briefs, federal law and jurisprudence, scholarly works and standard practice legal analysis. ^ Biotechnology, biomedical and clinical research, access to health care, and personalized medicine were identified as the principle stakeholders and interests herein. Many experts believe that the patent eligibility of isolated DNA will not greatly affect the biotechnology industry insofar as genetic testing is concerned; unlike for therapeutics, genetic testing does not require tremendous resources or lead time. The actual impact on biomedical researchers is uncertain, with greater impact expected for researchers whose work is intended for commercial purposes (versus basic science). The impact on access to health care has been surprisingly difficult to assess; while invalidating gene patents might be expected to decrease the cost of genetic testing and improve access to more laboratories and physicians' offices that provide the test, a 2010 study on the actual impact was inconclusive. As for personalized medicine, many experts believe that the availability of personalized medicine is ultimately a public policy issue for Congress, not the courts. ^ Based on the legal analysis performed in this work, this writer believes the Supreme Court is likely to invalidate patents on isolated DNA whose sequences are found in nature, because these gene sequences are a basic tool of scientific and technologic work and patents on isolated DNA would unduly inhibit their future use. Patents on complementary DNA (cDNA) are expected to stand, however, based on the human intervention required to craft cDNA and the product's distinction from the DNA found in nature. ^ In the end, the solution as to how to address gene patents may lie not in jurisprudence but in a fundamental change in business practices to provide expanded licenses to better address the interests of the several stakeholders. ^

Por un lado, los grandes grupos apuestan con riesgos mínimos y controlados; por otro, editoriales independientes tienen por objetivo descubrir nuevas voces con talento y calidad literaria. En el caso de Anagrama se ha abierto el catálogo a escritores como Bolaño, Aira, Pitol, Neuman o Pauls, pero también se ha creado una especie de redil anagramático, en palabras de Herralde, y así un grupo de escritores "de marca" disfruta del capital simbólico de la editorial, al tiempo que lo incrementa con el suyo propio gracias a su notable producción y su proyección internacional
