If the need for change and improvement in the Commission’s ways of working became evident as of 1979, the reform process began with the Santer Commission. Although the public management reform seems to focus on reducing personnel and expenses, it goes further in the sense of modernization: budgetary reforms aim at budgeting results and performance; emphasis is put on individual responsibility and evaluation and on a more flexible approach to personnel management, strategic planning, and transfer of authority.

The Healthcare Commission’s recently published report ‘Spotlight on Complaints’ highlights a general state of malaise with the NHS’ approach to complaint management. The conclusion of this the second report by the Commission is clear, NHS Trusts still have much to do to improve the principle antecedents, which collectively construct complainants’ attainment of perceived justice.

Previous empirical assessments of the effectiveness of structural merger remedies have focused mainly on the subsequent viability of the divested assets. Here, we take a different approach by examining how competitive are the market structures which result from the divestments. We employ a tightly specified sample of markets in which the European Commission (EC) has imposed structural merger remedies. It has two key features: (i) it includes all mergers in which the EC appears to have seriously considered, simultaneously, the possibility of collective dominance, as well as single dominance; (ii) in a previous paper, for the same sample, we estimated a model which proved very successful in predicting the Commission’s merger decisions, in terms of the market shares of the leading firms. The former allows us to explore the choices between alternative theories of harm, and the latter provides a yardstick for evaluating whether markets are competitive or not – at least in the eyes of the Commission. Running the hypothetical post-remedy market shares through the model, we can predict whether the EC would have judged the markets concerned to be competitive, had they been the result of a merger rather than a remedy. We find that a significant proportion were not competitive in this sense. One explanation is that the EC has simply been inconsistent – using different criteria for assessing remedies from those for assessing the mergers in the first place. However, a more sympathetic – and in our opinion, more likely – explanation is that the Commission is severely constrained by the pre-merger market structures in many markets. We show that, typically, divestment remedies return the market to the same structure as existed before the proposed merger. Indeed, one can argue that any competition authority should never do more than this. Crucially, however, we find that this pre-merger structure is often itself not competitive. We also observe an analogous picture in a number of markets where the Commission chose not to intervene: while the post-merger structure was not competitive, nor was the pre-merger structure. In those cases, however, the Commission preferred the former to the latter. In effect, in both scenarios, the EC was faced with a no-win decision. This immediately raises a follow-up question: why did the EC intervene for some, but not for others – given that in all these cases, some sort of anticompetitive structure would prevail? We show that, in this sample at least, the answer is often tied to the prospective rank of the merged firm post-merger. In particular, in those markets where the merged firm would not be the largest post-merger, we find a reluctance to intervene even where the resulting market structure is likely to be conducive to collective dominance. We explain this by a willingness to tolerate an outcome which may be conducive to tacit collusion if the alternative is the possibility of an enhanced position of single dominance by the market leader. Finally, because the sample is confined to cases brought under the ‘old’ EC Merger Regulation, we go on to consider how, if at all, these conclusions require qualification following the 2004 revisions, which, amongst other things, made interventions for non-coordinated behaviour possible without requiring that the merged firm be a dominant market leader. Our main conclusions here are that the Commission appears to have been less inclined to intervene in general, but particularly for Collective Dominance (or ‘coordinated effects’ as it is now known in Europe as well as the US.) Moreover, perhaps contrary to expectation, where the merged firm is #2, the Commission has to date rarely made a unilateral effects decision and never made a coordinated effects decision.

Background and Objective: Medication non-compliance is a considerable obstacle in achievinga therapeutic goal, whichcan result in poorerhealthcare outcomes, increased expenditure, wastage and potential for medication resistance. The UK Government’s Audit Commission’s publication ‘A Spoonful of Sugar’1 addresses these issues and promotes self-medication systems as a possible solution. The self-medication system within the Liver Transplant Unit (LTU) was implemented to induct patients onto new post- transplantation medication regimes ready for discharge. The system involves initial consultations with both the Liver Transplant Pharmacist and Trans- plant Co-ordinator, supported with additional advice as and when necessary. Design: Following ethical approval, evaluation of the self-medication sys- tem for liver transplant patients was conducted between January and March 2004 via two methods: audit and structured post-transplantation interview. The audit enabled any discrepancies between current Hospital guidelines and Liver Transplant Unit (LTU) practices to be highlighted. Patient interviews generated a retrospective insight into patient acceptance of the self-medication system. Setting: LTU, Queen Elizabeth Hospital, Birmingham, England. Main Outcome Measures: LTU compliance with Hospital self-medication guidelines and patient insight into self-medication system. Results: A total of seven patients were audited. Findings illustrated that self- medication by transplant patients is a complex process which was not fully addressed by current Hospital self-medication guidelines. Twenty-three patients were interviewed, showing an overwhelming positive attitude to- wards participating in their own care and a high level of understanding towards their individual medication regimes. Following a drugs counselling session, 100% of patients understood why they were taking their medica- tion, and their doses, 95% understood how to take their medication and 85% were aware of potential side effects. Conclusions: From this pilot evaluation it can be stated that the LTU self-medication system is appreciated by patients and assists them in fully understanding their medication regimes. There appear to be no major defects in the system. However areas such as communication barriers and on-going internet education were illustrated as areas for possible future investigation. Az árhatásfüggvények azt mutatják meg, hogy egy adott értékű megbízás mekkora relatív árváltozást okoz. Az árhatásfüggvény ismerete a piaci szereplők számára fontos szerepet játszik a jövőben benyújtandó ajánlataikhoz kapcsolódó árhatás előrejelzésében, a kereskedés árváltozásból eredő többletköltségének becslésében, illetve az optimális kereskedési algoritmus kialakításában. Az általunk kidolgozott módszer révén a piaci szereplők a teljes ajánlati könyv ismerete nélkül egyszerűen és gyorsan tudnak virtuális árhatásfüggvényt meghatározni, ugyanis bemutatjuk az árhatásfüggvény és a likviditási mértékek kapcsolatát, valamint azt, hogy miként lehet a Budapesti Likviditási Mérték (BLM) idősorából ár ha tás függ vényt becsülni. A kidolgozott módszertant az OTP-részvény idősorán szemléltetjük, és a részvény BLM-adatsorából a 2007. január 1-je és 2011. június 3-a közötti időszakra virtuális árhatás függvényt becsülünk. Empirikus elemzésünk során az árhatás függ vény időbeli alakulásának és alapvető statisztikai tulajdonságainak vizsgálatát végezzük el, ami révén képet kaphatunk a likviditás hiányában fellépő tranzakciós költségek múltbeli viselkedéséről. Az így kapott információk például a dinamikus portfólióoptimalizálás során lehetnek a kereskedők segítségére. / === / Price-effect equations show what relative price change a commission of a given value will have. Knowledge of price-effect equations plays an important part in enabling market players to predict the price effect of their future commissions and to develop an optimal trading algorithm. The method devised by the authors allows a virtual price-effect equation to be defined simply and rapidly without knowledge of the whole offer book, by presenting the relation between the price-effect equation and degree of liquidity, and how to estimate the price-effect equation from the time line of the Budapest Liquidity Measure (BLM). The methodology is shown using the time line for OTP shares and the virtual price-effect equation estimated for the 1 January 2007 to 3 June 2011 period from the shares BML data set. During the empirical analysis the authors conducted an examination of the tendency of the price-effect equation over time and for its basic statistical attributes, to yield a picture of the past behaviour of the transaction costs arising in the absence of liquidity. The information obtained may, for instance, help traders in dynamic portfolio optimization.

A cikkben a szerzők megvizsgálják a tudásmenedzsment komplex rendszerfejlesztési projektekben és az informatikai auditban játszott szerepét. Fő céljuk, hogy a tudásmenedzsment-rendszerek fejlesztéséhez kapcsolódó audit támogatására értékelési modellt készítsenek. Cikkükben megvizsgálják a tudásmenedzsmentnek az IT-auditban játszott általános szerepét, az auditban érintett tudásvagyon védelmének kérdését, a tudásmenedzsment-folyamatok szerepét a rendszerfejlesztésben (auditszempontból), a kontrollok implementálását, valamint a tudásmenedzsment és az IT-audittal kapcsolatos szabványok, módszertanok kapcsolatát. Az eredmények illusztrálására egy az Európai Unió 7. keretprogramjából finanszírozott nemzetközi projekt (GUIDE, IST–2003–507498) szolgál. ________________ Authors investigate the role of knowledge management in complex system development projects and IT audit. The primary goal is to provide an evaluation framework for an assessment of the development of special knowledge management solutions. On the other hand IT audit itself is a knowledge-dependent activity. The paper analyses the role of knowledge management in IT audit in general, the protection of knowledge assets during an audit, the role of knowledge management processes during system development (from audit point of view) and in the implementation of controls, the relationship of knowledge management with audit standards. Authors investigate the specialities of KM developments from audit point of view (particularly important aspects of audit, specific control objectives) A case study, based on experiences gained from GUIDE project (IST-2003-507498 funded by the European Commission’s 6th Framework Programme) illustrates the findings.

Az Európai Bizottság 2011. júniusban nyilvánosságra hozott, a következő hétéves időszakot meghatározó pénzügyi keretéről szóló javaslatával elindult a tagállamok, illetve az intézmények közötti szakmai és politikai érvelés, az alkudozások sora. A két legfontosabb költségvetési tétel, a mezőgazdasági támogatások és a kohéziós források előnyös allokációja Magyarország és Lettország számára is kiemelt prioritás. A tárgyalások során Lettország érdeke az alacsony közvetlen mezőgazdasági támogatások emelése, míg Magyarország kedvező pozíciójának megtartásáért harcol. A kohéziós politikára tett Bizottsági javaslat mindkét ország számára hátrányos, így közös érdek a források összegének szinten tartása és a kedvezőtlen támogatási felső határ emelése. ______ Following the European Commission’s proposal on the next Multiannual Financial Framework was published in June 2011, tense debate started to defend national priorities. The proper allocation of the agricultural and cohesion founds is essential for both, Hungary and Latvia as well. Latvia’s objectives is to introduce fair direct payments to farmers, stipulating that the lowest payments must constitute at least 80 per cent of the average amount of the EU direct payments, while Hungary tries to defend its relatively favourable position by receiving almost the amount of the EU average. Common interest for Hungary and for Latvia in the EU budget talks is to retain cohesion financing at least at the current level and to change the unfavourable proposal on capping.

Today, global economic performance largely depends on digital ecosystems. E-commerce, cloud, social media, sharing economy are the main products of the modern innovative economic systems which are constantly raising new regulatory questions. Meanwhile the United States has an unimpeachable dominance in innovation and new technologies, as well as a large and open domestic market, the EU is only recently discovering the importance of empowering the European digital economy and aims to break down its highly fragmented cross-border online economic environment. As global economy is rapidly becoming digital, Europe’s effort to create and invest in common digital market is understandable. The comprehensive investigations launched by the European Commission into the role of social network, search engine, or sharing economy internet platforms, which are new generation technologies dominated by American firms; or the recent decision of the Court of Justice of the European Union declaring that the Commission’s US Safe Harbor Decision is invalid1 might be considered as part of an anti-American protectionist policy. However, these measures could rather be seen as part of a broader trend to foster European enterprises in technology developments.

Since the end of the Cold War, Japan's defense policy and politics has gone through significant changes. Throughout the post cold war period, US-Japan alliance managers, politicians with differing visions and preferences, scholars, think tanks, and the actions of foreign governments have all played significant roles in influencing these changes. Along with these actors, the Japanese prime minister has played an important, if sometimes subtle, role in the realm of defense policy and politics. Japanese prime ministers, though significantly weaker than many heads of state, nevertheless play an important role in policy by empowering different actors (bureaucratic actors, independent commissions, or civil actors), through personal diplomacy, through agenda-setting, and through symbolic acts of state. The power of the prime minister to influence policy processes, however, has frequently varied by prime minister. My dissertation investigates how different political strategies and entrepreneurial insights by the prime minister have influenced defense policy and politics since the end of the Cold War. In addition, it seeks to explain how the quality of political strategy and entrepreneurial insight employed by different prime ministers was important in the success of different approaches to defense. My dissertation employs a comparative case study approach to examine how different prime ministerial strategies have mattered in the realm of Japanese defense policy and politics. Three prime ministers have been chosen: Prime Minister Hashimoto Ryutaro (1996-1998); Prime Minister Koizumi Junichiro (2001-2006); and Prime Minister Hatoyama Yukio (2009-2010). These prime ministers have been chosen to provide maximum contrast on issues of policy preference, cabinet management, choice of partners, and overall strategy. As my dissertation finds, the quality of political strategy has been an important aspect of Japan's defense transformation. Successful strategies have frequently used the knowledge and accumulated personal networks of bureaucrats, supplemented bureaucratic initiatives with top-down personal diplomacy, and used a revitalized US-Japan strategic relationship as a political resource for a stronger prime ministership. Though alternative approaches, such as those that have looked to displace the influence of bureaucrats and the US in defense policy, have been less successful, this dissertation also finds theoretical evidence that alternatives may exist.

L’intégration des technologies de l’information et de la communication (TIC) en contexte éducatif représente un moyen concret d’action et de réflexion en sciences de l’éducation. Les scientifiques et les acteurs de terrain se questionnent sur l’intégration des technologies et sur les moyens à mettre en place afin de réussir ce processus parfois complexe. De fait, la pénétration des outils technologiques dans les établissements scolaires a été exponentielle ces dernières années. Il est aujourd’hui nécessaire de comprendre selon quelles perspectives ces outils s’intègrent en salle de classe. Un exemple marquant est celui de la tablette tactile, récemment intégrée massivement dans les écoles d’Amérique du Nord et d’Europe. Cet outil, relativement récent dans la sphère scolaire, demande une réflexion précise vis-à-vis des pratiques pédagogiques des enseignants et des processus d’intégration inhérents. Afin de répondre à ces questionnements, nous avons élaboré une recherche en trois temps. Dans un premier temps, nous avons dressé un portrait exhaustif des pratiques pédagogiques des enseignants utilisant quotidiennement la tablette tactile en salle de classe. Ce portrait nous permet d’esquisser une synthèse des usages et réalités pédagogiques qui entourent cet outil. Dans un deuxième temps, nous avons répertorié, analysé et classifié les modèles d’intégration des TIC présents dans la littérature. L’analyse de ces modèles nous a permis d’en extraire les forces et les lacunes intrinsèques. Ensuite, nous avons créé un modèle synthèse rassemblant les réflexions issues de ces analyses. En parallèle, nous avons créé une typologie permettant d’identifier et de classifier ces modèles. Dans un troisième temps, nous sommes partis des pratiques pédagogiques des enseignants et du modèle général d’intégration des TIC que nous avons conçu afin de comprendre quel était le processus d’intégration de la tablette en salle de classe. Les résultats obtenus mettent en évidence que l’utilisation de la tablette induit des usages pédagogiques novateurs qui facilitent l’enseignement et qui favorisent l’apprentissage des élèves. Cependant, nous constatons que la tablette n’est pas utilisée à son plein potentiel et que certains usages devraient être envisagés selon une perspective plus efficiente et adaptée. En ce qui concerne les processus d’intégration, nous avons identifié plusieurs éléments indispensables: ces processus doivent être itératifs et constructifs, des facteurs internes et externes doivent être considérés et des niveaux d’intégration doivent être identifiés. Le modèle ainsi conçu spécifie le modèle à privilégier et les aboutissants à considérer. À la suite de cette étape, nous avons conçu un modèle d’intégration spécifiquement dédié à la tablette. Celui-ci met en évidence, au-delà des caractéristiques définies dans le modèle général, une nécessaire formation, une implication des acteurs, un ajustement constant des pratiques pédagogiques et une itération indispensable. À la suite de ces considérations, nous constatons que le processus d’appropriation de la tablette est en cours de construction et que les nouvelles implantations, comme les existantes, doivent procéder à une analyse minutieuse des tenants et aboutissants des pratiques médiées par l’intégration de l’outil. En fin de document, une synthèse des résultats et des recommandations est proposée afin de favoriser l’intégration de la tablette tactile - et des TIC en général – dans la salle de classe.

Dans quelle mesure la montée de la reddition de comptes et de l’évaluation en éducation est-elle significative d’un déclin de la confiance de l’Etat, des administrateurs scolaires et des usagers dans la capacité des organisations scolaires à remplir correctement leurs missions ? N’est-elle pas également symptômatique d’une perte de confiance à l’égard des enseignants et de leur professionnalisme? Nous traiterons ces questions en proposant une réflexion à partir des théories de la confiance en sciences sociales. Nous distinguerons en particulier les théories qui s’interrogent sur les conditions de confiance dans les transactions économiques et celles qui raisonnent la confiance « politique » dans les institutions. Nous argumentons que les dispositifs d’accountability tendent surtout à réduire l’incertitude des clients/managers quant aux risques d’opportunisme et d’opacité des opérateurs scolaires. Il s’agit de favoriser la bonne marche « du marché » ou de « l’organisation productive » scolaire, au risque d’une perte d’autonomie professionnelle des enseignants et sans pour autant que l’Ecole ne redevienne une institution politique «digne de confiance ».
