This socio-legal thesis has explored the factors responsible for explaining whether and how redress mechanisms control bureaucratic decision-making. The research considered the three principal institutions of administrative justice: courts, tribunals, and ombudsman schemes. The field setting was the local authority education area and the thesis examined bureaucratic decision-making about admissions to school, home-to-school transport, and Special Educational Needs (SEN). The thesis adopted a qualitative approach, using interviews and documentary research, within a multiple embedded case study design. The intellectual foundations of the research were inter-disciplinary, cutting across law, socio-legal studies, public administration, organization studies, and social policy. The thesis drew on these scholarly fields to explore the nature of bureaucratic decision-making, the extent to which it can be controlled and the way that learning occurs in bureaucracies and, finally, the extent to which redress mechanisms might exercise control. The concept of control was studied across all its dimensions – in relation both to ex post control in specific cases and the more challenging notion of ex ante or structuring control. The aim of the thesis was not to measure the prevalence of bureaucratic control by redress mechanisms, but to understand the factors that might explain its presence or absence in a particular area. The findings of the research have allowed for a number of analytical refinements and extensions to be made to existing theoretical and empirical understandings. 14 factors, along with 87 supporting propositions, have been set out with the aim of making empirically derived suggestions which can be followed up in future research. In terms of the thesis’ contribution to existing knowledge, its comparative focus and its emphasis on the broad notion of control offered the potential for new insights to be developed. Overall, the thesis claims to have made three contributions to the conceptual framework for understanding the exercise of control by redress mechanisms: it emphasizes the importance of ‘feedback’ in relation to the nature of the cases referred to redress mechanisms; it calls attention to the structure of bureaucratic decision-making as well as its normative character; and it discusses how the operational modes of redress mechanisms relate to their control functions.

Fast Track Authority (FTA) is the institutional procedure in the Unites States whereby Congress grants to the President the power to negotiate international trade agreements. Under FTA, Congress can only approve or reject negotiated trade deals, with no possibility of amending them. In this paper, we examine the determinants of FTA voting decisions and the implications of this institutional procedure for trade negotiations. We describe a simple two-country trade model, in which industries are unevenly distributed across con- stituencies. In the foreign country, trade negotiating authority is delegated to the executive, while in the home country Congress can retain the power to amend trade agreements. We show that legislators’ FTA voting behavior depends on the trade policy interests of their own constituencies as well as those of the majority of Congress. Empirical analysis of the determinants of all FTA votes between 1974 (when fast track was first introduced) and 2002 (when it was last granted) provides strong support for the predictions of our model.

La Vicaría Episcopal de Promoción Humana-Caritas, es una institución designada para combatir la pobreza y las consecuencias que genera, trabajando en nombre de todos los hombres y mujeres de buena voluntad en la Arquidiócesis de San Salvador, guiados por la enseñanza social católica, como ha sido instruida por el pastor Mons. José Luis Escobar Alas, Arzobispo de San Salvador. Hablar del talento Humano y de las incidencias que las personas tienen en las empresas como sus conocimientos, habilidades, experiencias, aptitudes, pero sobre todo la creatividad posibilita dar soluciones a los problemas que las organizaciones enfrentan. Por tal razón se ha detectado que el ambiente interno de la organización no cuenta con procesos organizados en la eficiente administración del talento humano, tomando en cuenta que las personas son el pilar de toda institución. El desarrollo de un modelo de gestión del talento humano, para el buen desempeño administrativo del personal de la Vicaría Episcopal de Promoción Humana-Caritas, beneficiará a los empleados el poder contar con una administración que contribuya a la mejora del personal y a la aplicación de proyectos que se realizan, basándose en la Doctrina Social de la Iglesia y apoyando así a las comunidades que se benefician de dichos proyectos. Los objetivos que se perciben alcanzar con la elaboración del trabajo de investigación son los siguientes: OBJETIVO GENERAL: Proponer un modelo de gestión del talento humano que incida en el desarrollo administrativo del personal de la Vicaría Episcopal de Promoción Humana-Caritas de la Arquidiócesis de San Salvador. OBJETIVOS ESPECIFICOS: 1. Determinar la información bibliográfica necesaria para tener de base un marco de referencia que permita ampliar la investigación. 2. Analizar cómo se encuentra actualmente la institución para realizar un diagnóstico de la situación problemática a fin de poder encontrar una solución viable. Elaborar una propuesta para la Vicaría Episcopal de Promoción Humana-Caritas que permita mejorar el desarrollo de las funciones administrativas del personal.
