Auto-organização e autonomia em Hegel: uma abordagem a partir das linhas fundamentais da filosofia do direito

The German philosopher G.W.F. Hegel (1770-1831) had as one of his thesis in the doctorate the affirmation that philosophy can only be properly taken as a system. He intends with that to point out the identity between thinking and being. This is, for Hegel, the task of philosophy, i. e., to bring together all that was set apart. This position can be recognized in all his works and it is tried here to exemplify it in The Philosophy of Right and in special in the section dedicated to the abstract right. This one is the first moment of the text in question that begins with the statement of the dignity of the person confirmed in the property. The following moments make evident that the formal ones are also results. It becomes clear in this way that the all the moments create together an ongoing organization, disorganization and reorganization. This process reveals the relation as a constitutive element of thinking and being exemplified in the abstract right. Each moment overcomes the preceding one and comes out as a much more complex one. In the case of the abstract right what appears is the realization of a free subject in all that he does as the making of himself.

Os artigos de jornal no ensino superior: utilizando um recurso didático não-convencional no ensino do Direito

Trata-se de artigo decorrente de nossas práticas pedagógicas no ensino superior, particularmente no ensino de Direito Constitucional mediante a utilização de artigos de jornais. Essa idéia surgiu com a finalidade de despertar o aluno para a leitura de periódicos específicos da área, e de diminuir a distância no campo do conhecimento entre a eficácia jurídica e a eficácia social. Como é sabido, o ensino do Direito ainda contempla o padrão didático das aulas lidas, o recurso da subsunção e da simples repetição doutrinária, muitas vezes, lamentavelmente, alicerçadas em apostilas ou resumos que conduzem o aprendizado à mera reprodução de doutrina. Centralmente quanto ao ensino de Direito Constitucional, ao mesmo tempo em que pressupõe um íntimo relacionamento com os outros ramos do Direito, guarda enorme distância quando se trata da transmissão de seu conteúdo. O trabalho ora comunicado é resultante de um projeto desenvolvido mediante duas etapas: na primeira a busca é pela compreensão das normas e dos princípios existentes no corpo da Constituição e na posterior objetiva-se a tradução de tais normas e princípios no contexto social, com base nas discussões em artigos de jornal. Essas discussões são desenvolvidas, ainda que superficialmente, por meio da análise dos aspectos constitutivos da configuração textual dos artigos. O que se tem como resultados é a observação de que, mediante o recurso didático de artigos de jornais, o estabelecimento de uma discussão das normas e princípios constitucionais tem tornado a relação ensino-aprendizagem no curso de Direito mais interessante aos alunos e professor.

Apontamentos para uma crítica marxista do direito

Este artigo apresenta alguns apontamentos para uma sociologia jurídica marxista. Para isso, apreende o deslocamento do lugar do direito na obra marxiana a partir d A ideologia alemã e, em seguida, decompõe e analisa a questão jurídica em três planos: 1) relação de produção como relação jurídica, 2) as relações sociais institucionalizadas como formas jurídico-estatais socialmente reconhecidas como legítimas e 3) o direito como a ideologia jurídica (sistema de normas, crenças e valores segundo uma forma discursiva própria) que recobre os dois elementos anteriores e lhes atribui sentido e validade moral.

A filosofia do direito no sistema filosófico hegeliano

The Hegelian philosophy is presented as a progress in relation to other philosophies and it offers to take in itself all the other demonstrations. Thereby, Hegel intends to carry out his philosophical effort towards the establishment of a philosophical system. It is a comprehension recognized and exposed by Hegel in his doctoral thesis, i.e., that philosophy only becomes possible as a system. In this sense, the treatment dispensed to each one of his works necessarily evokes a relationship with all other. An work taken in isolation gets the feeling that something else should be presented, however, every work written by Hegel also contemplates a relation with his other works. In this sense, the objective here is to considerate Hegel’s Philosophy of Law in his philosophical system seeking to explicit its specific place, as well as its transit among the works of the thinker as a whole. The Philosophy of Law finds its particular moment in the ambit of the objective spirit or during the subjective spirit’s effectuation. However, it is assumed here the perspective that the Philosophy of Law represents, as the objective spirit does, a moment of mediation as well as a there-being whereby the absolute spirit’s effectuation would happen. Furthermore, Hegel’s Philosophy represents the presentation of what he considers as extremely important in philosophy, that is precisely, the need to sublate the separation between man and the world. It is not enough for Hegel, the affirmation of the being and the thinking in itself, but it is required to confirm them in their being other that will be evinced being itself. Thus, Philosophy is given as a reconstruction or as the factual knowledge as a science ceasing to be so only love of learning. This means in other words that philosophy deals with the world, in the world and for the world being much more than a speech to the world to be the talk of the world itself. If philosophy is the owl of Minerva who always arrives late, she does it for the reasons of the other to be recognized.

The study of the generation of landfill gas contributes to the understanding of the relationship between gas production and other parameters, such as time of disposal of waste and moisture (rainfall) and, thus, can subsidize the viability study for energy. This study aims to evaluate the interference of the time of disposal of waste and moisture (rainfall) in the production and composition of biogas generated at the landfill in Rio Claro - SP. As a result it was observed that for the landfill studied, the average percentage of methane in biogas ranged from 49.9% to 54.7%. It was found that moisture (rainfall) and the time of waste disposal are parameters which do not cause significant changes in methane concentration in biogas. However, when analyzed the flow of biogas, which had the maximum average value of 152.86m3/h and minimum average value of 15.47m3/h was observed great interference of moisture (rainfall) and the time of disposal of waste, because well of gas located in newer areas of the landfill showed higher values of flow rate than the areas where the landfill was the beginning of the arrangement. The same way, it was observed that in the dry season flow of biogas decreased in all drains gas analyzed

Entre o direito à ternura e a 'pedagogia do amor': a dimensão (sócio-) afetiva da identidade docente

No mundo globalizado, a complexidade dos processos subjetivos e objetivos envolvidos na construção das identidades singulares e culturais exige pensar como o sujeito da atualidade sofre, experimenta e vivencia a diversidade de influências culturais nas quais está imerso. Neste contexto, escolheu-se, de um lado, a figura do professor como objeto de estudo, para saber como esta complexidade de processos perpassa a construção de sua identidade docente vinculada ao desenvolvimento pessoal, mas também profissional. Por outro lado, a influência dos livros de autoajuda também será objeto de estudo por apresentar um papel cada vez mais presente no preenchimento da perda de autoestima do professor, assim como da “perda de subjetividade”, visando elevar “a moral” dos professores, mas que nos passa a compreensão de uma contribuição dúbia para o exercício da profissão. Assim, nosso olhar volta-se para a questão da construção da identidade desse professor e do exercício de sua profissionalidade, considerando a questão da dimensão afetiva como um dos constructos da autoestima docente e de sua identidade. Tendo como referência esses pressupostos, este trabalho tem como objetivos: (a) averiguar nas políticas públicas de formação de professores como a dimensão (sócio-)afetiva (ou dimensão pessoal) vem sendo tratada nas propostas de formação docente; (b) identificar nos docentes que atuam em escolas da rede de ensino, educação básica, os aspectos constitutivos da dimensão (sócio-)afetiva (ou dimensão pessoal) da identidade do professor; e (c) assinalar nas descrições dos professores respondentes (a partir de fonte documental ou questionário) a existência ou não da literatura de autoajuda no cotidiano docente. Interferência do método de previsão populacional no desempenho hidráulico de uma rede coletora de esgoto sanitário

The non existence of sewage services creates an unhealthy environmental, causing impact extremely prejudicial to the human health. In Brazil, this item represents the biggest deficit in the basic sanitation these days, and only about 50% of the population is attended. The sewage collection network is a needful system for the basic sanitation. Between the parameters of the project of a system of collection and sewage transportation, the definition of the population that will be attended is one of the most important variables, and that should be done based on criterion of population growth and in accordant to directrix presents in the comprehensive city plan. In this paper, were evaluated methods of growth based on the geometric growth rate, on the population density and on the number of residents per dwelling, and also mathematics models of growth prediction, emphasizing in the geometric growth and on the logistic curve method. That way, the goal of this paper were value the hydraulic performance in one of the watersheds delimited by the sewage network magnification work existent in the city of Cacoal–RO. Using simulation with different scenarios, the results pointed that the hydraulic performance of the system were strongly affected by the population determination method used. For the same drained area the diameters range from 150 to 250 mm as well as the trench’s deep, where some stretches exceeded the maximum values contained in the standard. Besides, the variation of the sewage contribution rate due the population variation estimated in different scenarios, led to alterations in others important project parameters, such as slope, shallow pool, tensile stress and spreading velocity
