1. Introduction "The one that has compiled ... a database, the collection, securing the validity or presentation of which has required an essential investment, has the sole right to control the content over the whole work or over either a qualitatively or quantitatively substantial part of the work both by means of reproduction and by making them available to the public", Finnish Copyright Act, section 49.1 These are the laconic words that implemented the much-awaited and hotly debated European Community Directive on the legal protection of databases,2 the EDD, into Finnish Copyright legislation in 1998. Now in the year 2005, after more than half a decade of the domestic implementation it is yet uncertain as to the proper meaning and construction of the convoluted qualitative criteria the current legislation employs as a prerequisite for the database protection both in Finland and within the European Union. Further, this opaque Pan-European instrument has the potential of bringing about a number of far-reaching economic and cultural ramifications, which have remained largely uncharted or unobserved. Thus the task of understanding this particular and currently peculiarly European new intellectual property regime is twofold: first, to understand the mechanics and functioning of the EDD and second, to realise the potential and risks inherent in the new legislation in economic, cultural and societal dimensions. 2. Subject-matter of the study: basic issues The first part of the task mentioned above is straightforward: questions such as what is meant by the key concepts triggering the functioning of the EDD such as presentation of independent information, what constitutes an essential investment in acquiring data and when the reproduction of a given database reaches either qualitatively or quantitatively the threshold of substantiality before the right-holder of a database can avail himself of the remedies provided by the statutory framework remain unclear and call for a careful analysis. As for second task, it is already obvious that the practical importance of the legal protection providedby the database right is in the rapid increase. The accelerating transformationof information into digital form is an existing fact, not merely a reflection of a shape of things to come in the future. To take a simple example, the digitisation of a map, traditionally in paper format and protected by copyright, can provide the consumer a markedly easier and faster access to the wanted material and the price can be, depending on the current state of the marketplace, cheaper than that of the traditional form or even free by means of public lending libraries providing access to the information online. This also renders it possible for authors and publishers to make available and sell their products to markedly larger, international markets while the production and distribution costs can be kept at minimum due to the new electronic production, marketing and distributionmechanisms to mention a few. The troublesome side is for authors and publishers the vastly enhanced potential for illegal copying by electronic means, producing numerous virtually identical copies at speed. The fear of illegal copying canlead to stark technical protection that in turn can dampen down the demand for information goods and services and furthermore, efficiently hamper the right of access to the materials available lawfully in electronic form and thus weaken the possibility of access to information, education and the cultural heritage of anation or nations, a condition precedent for a functioning democracy. 3. Particular issues in Digital Economy and Information Networks All what is said above applies a fortiori to the databases. As a result of the ubiquity of the Internet and the pending breakthrough of Mobile Internet, peer-to-peer Networks, Localand Wide Local Area Networks, a rapidly increasing amount of information not protected by traditional copyright, such as various lists, catalogues and tables,3previously protected partially by the old section 49 of the Finnish Copyright act are available free or for consideration in the Internet, and by the same token importantly, numerous databases are collected in order to enable the marketing, tendering and selling products and services in above mentioned networks. Databases and the information embedded therein constitutes a pivotal element in virtually any commercial operation including product and service development, scientific research and education. A poignant but not instantaneously an obvious example of this is a database consisting of physical coordinates of a certain selected group of customers for marketing purposes through cellular phones, laptops and several handheld or vehicle-based devices connected online. These practical needs call for answer to a plethora of questions already outlined above: Has thecollection and securing the validity of this information required an essential input? What qualifies as a quantitatively or qualitatively significant investment? According to the Directive, the database comprises works, information and other independent materials, which are arranged in systematic or methodical way andare individually accessible by electronic or other means. Under what circumstances then, are the materials regarded as arranged in systematic or methodical way? Only when the protected elements of a database are established, the question concerning the scope of protection becomes acute. In digital context, the traditional notions of reproduction and making available to the public of digital materials seem to fit ill or lead into interpretations that are at variance with analogous domain as regards the lawful and illegal uses of information. This may well interfere with or rework the way in which the commercial and other operators have to establish themselves and function in the existing value networks of information products and services. 4. International sphere After the expiry of the implementation period for the European Community Directive on legal protection of databases, the goals of the Directive must have been consolidated into the domestic legislations of the current twenty-five Member States within the European Union. On one hand, these fundamental questions readily imply that the problemsrelated to correct construction of the Directive underlying the domestic legislation transpire the national boundaries. On the other hand, the disputes arisingon account of the implementation and interpretation of the Directive on the European level attract significance domestically. Consequently, the guidelines on correct interpretation of the Directive importing the practical, business-oriented solutions may well have application on European level. This underlines the exigency for a thorough analysis on the implications of the meaning and potential scope of Database protection in Finland and the European Union. This position hasto be contrasted with the larger, international sphere, which in early 2005 does differ markedly from European Union stance, directly having a negative effect on international trade particularly in digital content. A particular case in point is the USA, a database producer primus inter pares, not at least yet having aSui Generis database regime or its kin, while both the political and academic discourse on the matter abounds. 5. The objectives of the study The above mentioned background with its several open issues calls for the detailed study of thefollowing questions: -What is a database-at-law and when is a database protected by intellectual property rights, particularly by the European database regime?What is the international situation? -How is a database protected and what is its relation with other intellectual property regimes, particularly in the Digital context? -The opportunities and threats provided by current protection to creators, users and the society as a whole, including the commercial and cultural implications? -The difficult question on relation of the Database protection and protection of factual information as such. 6. Dsiposition The Study, in purporting to analyse and cast light on the questions above, is divided into three mainparts. The first part has the purpose of introducing the political and rationalbackground and subsequent legislative evolution path of the European database protection, reflected against the international backdrop on the issue. An introduction to databases, originally a vehicle of modern computing and information andcommunication technology, is also incorporated. The second part sets out the chosen and existing two-tier model of the database protection, reviewing both itscopyright and Sui Generis right facets in detail together with the emergent application of the machinery in real-life societal and particularly commercial context. Furthermore, a general outline of copyright, relevant in context of copyright databases is provided. For purposes of further comparison, a chapter on the precursor of Sui Generi, database right, the Nordic catalogue rule also ensues. The third and final part analyses the positive and negative impact of the database protection system and attempts to scrutinize the implications further in the future with some caveats and tentative recommendations, in particular as regards the convoluted issue concerning the IPR protection of information per se, a new tenet in the domain of copyright and related rights.

Differences in development among wheat cultivars are not only restricted to photoperiod and vernalization responses. When both requirements are fully satisfied differences may still arise due to earliness per se. It is not clear at present to what extent this trait is ‘ intrinsically ’ expressed (a constitutive trait) independently of the environmental conditions so that it might be selected under any thermal condition or if it may be altered to the extent of showing a crossover interaction with temperature in which the ranking of wheat genotypes may be altered. The present study assessed the influence of temperature on the intrinsic earliness for lines of diploid wheat characterized for their differences in a major gene for intrinsic earliness, but also possibly differing in their genetic background for other factors controlling this polygenic trait. To do so the lines were grown individually in two temperature regimes (16 and 23 xC) under long days having previously been fully vernalized. Multiple comparisons analyses were carried out among lines of the same allelic group for the Eps-Am1 gene. Results indicated that within each group there were lines that did not differ in their earliness per se, others differed but without exhibiting any linertemperature interaction and finally different types of interaction were shown, including cases where the ranking of lines was altered depending on the growing temperature. It is thus possible that the selection of a genotype based on its earliness per se in an environment might not represent the same performance in another location where temperature varied significantly.

The rate of leaf appearance of barley varies substantially with time of sowing. This variation has been related to both the length and the rate of change of photoperiod at the time of plant emergence. An outdoor pot experiment was conducted to test if rate of change of photoperiod directly affects phasic development and rate of leaf emergence of spring barley. Two photoperiod-sensitive cultivars (Bandulla and Galleon) were subjected to five photoperiod regimes: two constant photoperiods, of 14 and 15·5 h, and three different rates of change of photoperiod of c. 2, 9 and 13 min/day from seedling emergence to awn initiation. Photoperiod treatments significantly affected the duration from seedling emergence to awn initiation in both cultivars. Rate of change of photoperiod did not affect the rate of development towards awn initiation independently of the absolute daylength it produced. Although Bandulla had a longer duration than Galleon at any photoperiod regime, the cultivars did not vary in their sensitivity to photoperiod. When this phase was divided into the leaf initiation (LI) and spikelet initiation (SI) phases, it was evident that the sensitivity to photoperiod was not constant, being in general higher during the SI than during the LI phase. However, the magnitude of the change in sensitivity was cultivar-dependent, indicating that sensitivity to photoperiod during the different phases could be under independent genetic control. Final numbers of primordia (leaves together with maximum spikelet number) were negatively affected by increasing photoperiods, but once again, there was no evidence of any effect of the rate of change of photoperiod which was independent of the average photoperiod. Both cultivars showed similar sensitivities for final leaf number but maximum spikelet number was more sensitive to photoperiod in Galleon than in Bandulla. Highly significant linear relationships between leaf number and thermal time were found for all combinations of cultivars and photoperiod regimes (r2 > 0·98). The rate of leaf appearance (RLA) was similar for both cultivars (c. 0·0185 leaves/°Cd) and did not alter during plant development or in response to the change in photoperiod at awn initiation. The range in RLA was greater for Galleon (0·0170–0·0205 leaves/°Cd) than for Bandulla (0·0173–0·0186 leaves/°Cd). Neither of these cultivars exhibited a significant relationship between rate of leaf emergence and photoperiod or rate of change of photoperiod. The lack of significant relationships between RLA and length or rate of change of photoperiod is in contrast with previous reports using time of sowing as a main treatment.

O trabalho teve como objetivo definir o regime de irrigação mais adequado para a bananeira no terceiro ciclo, nas condições dos Tabuleiros Costeiros da Bahia. O experimento seguiu o delineamento experimental em blocos casualizados, com quatro repetições e dez tratamentos, em um esquema fatorial 5 x 2, sendo cinco níveis de suprimento de água à cultura e duas cultivares de bananeira, a Prata-Anã (Grupo Prata) e a Grande Naine (Grupo Cavendish). Os tratamentos referentes aos regimes de irrigação foram definidos a partir de cinco frações da evapotranspiração da cultura, definidas, por sua vez, pelo produto da evapotranspiração potencial e dos coeficientes de cultura recomendados. O uso da irrigação antecipou a colheita da Grande Naine em relação à Prata-Anã em 45 dias. A lâmina de 415 mm foi considerada mais adequada para ser aplicada à cultivar Grande Naine, enquanto a lâmina de 554 mm foi a mais adequada para a bananeira 'Prata-Anã'. Os coeficientes de cultura tiveram uma amplitude de 0,44 a 0,89 e 0,58 a 1,18 para as cultivares Grande Naine e Prata-Anã, respectivamente.

El règim d'humitat d'un sòl constitueix un condicionant pel seu us agrícola, paisatgístic o forestal. Aquest fet ha portat a voler considerar aquesta informació a l'hora de dominar un sòl, per tal que els usuaris de mapes de sòls es puguin situar immediatament en consultar la llegenda d'un mapa concret. La determinació del règim d'humitat dels sòls planteja seriosos problemes per manca de mesures referents a perfils hídrics al llarg de l'any, mesures gens habituals als observatoris meteorològics. En el present treball s'analitza el model de Newhall per estimar el règim d'humitat dels sòls, i es discuteixen les seves deficiències quan s'aplica a una zona amb règim de pluges de tipus mediterrani. Finalment, s'estableixen les bases per modificar l'esmentat model, que han servit per desenvolupar el model Newhall-Jarauta.

Los regímenes de fuegos forestales están cambiando en Gran Canaria y los grandes incendios forestales son más probables que antiguamente. Esto es un cambio importante en el régimen de perturbaciones y una grave amenaza a la biodiversidad. El Plan de Prevención de Incendios Forestales de Gran Canaria, año 2002 dejó clara la obligación de cambiar las estructuras de vegetación de la Isla en dos ámbitos: paisaje y protección de zonas sensibles. El uso de fuego prescrito (años 2002-2005) ha resultado ser una herramienta especialmente eficiente en este ámbito y muy adecuada para compatibilizar las acciones de prevención de incendios con el mantenimiento de los procesos ecológicos. Estas primeras experiencias en Gran Canaria muestran la idoneidad de los tratamientos para establecer rodales resistentes al paso del fuego en zonas estratégicas (deducidas tras simulación con Farsite y FlamMap). Y revelan lo conveniente que es que estos rodales resistentes estén distribuidos por nuestros montes de modo que los incendios potencialmente grandes encuentren zonas en las que sea factible controlar los perímetros. Este control se pudo hacer eficientemente en el incendio de las Mesas de 17 de agosto de 2004.

A aplicação de nutrientes via água de irrigação aumenta sua eficiência de utilização pelas plantas. O objetivo deste trabalho foi avaliar o efeito da adubação potássica e da irrigação na produtividade e qualidade de frutos de bananeiras, cv. Willians, na região do Médio Paranapanema, São Paulo. Foram avaliados quatro regimes hídricos: sequeiro; 0,7 da evapotranspiração de referência (ETo); 1,4 ETo, e 2,1 ETo, combinados com quatro doses de potássio (K): 0; 300; 600 e 900 kg ha.ano-1 de K2O, aplicados semanalmente via fertirrigação. Sob sequeiro, a adubação potássica foi aplicada durante o período chuvoso, parcelada em quatro vezes. Observou-se que a adubação potássica realizada via fertirrigação interfere positivamente tanto na produção como na qualidade dos frutos de bananeiras cv. Willians. Além disso, a fertirrigação favorece maior eficiência da adubação potássica quando comparada à adubação sob sequeiro.

We numerically simulate planar shock wave collisions in anti-de Sitter space as a model for heavy ion collisions of large nuclei. We uncover a crossover between two different dynamical regimes as a function of the collision energy. At low energies the shocks first stop and then explode in a manner approximately described by hydrodynamics, in close similarity with the Landau model. At high energies the receding fragments move outwards at the speed of light, with a region of negative energy density and negative longitudinal pressure trailing behind them. The rapidity distribution of the energy density at late times around midrapidity is not approximately boost invariant but Gaussian, albeit with a width that increases with the collision energy.

Os objetivos neste trabalho foram determinar os regimes térmicos de germinação das sementes de Theobroma grandiflorum, indicar a temperatura mais adequada para a condução do teste de germinação e propor critérios morfológicos de avaliação, visando a fornecer subsídios para inserir a espécie nas Regras para Análise de Sementes do Brasil. Os ensaios foram conduzidos em câmaras de germinação com fotoperíodo de 12 horas, utilizando vermiculita como substrato. A colheita das sementes de T. grandiflorum foi realizada na mesma população, porém de matrizes diferentes, em duas ocasiões: fevereiro (lote 1) e abril de 2010 (lote 2). Os testes de germinação foram realizados sob temperaturas constantes entre 10 e 40 ˚C, com intervalo de 5 ˚C. Três critérios foram avaliados: a protrusão (≥5 mm) da primeira estrutura visível (critério fisiológico); o alongamento do epicótilo (≥3 cm, correspondendo à emergência acima do substrato), e a formação de plântula normal (critério tecnológico). Adotou-se o delineamento inteiramente casualizado, com sete temperaturas e quatro repetições de 25 sementes. Para cada critério, foram avaliadas a porcentagem e variáveis de velocidade. Em sementes de T. grandiflorum, o hipocótilo é a primeira estrutura visível no processo de germinação. A protrusão foi observada entre 10 e 40 ˚C para o lote 1 e, para o lote 2, entre 10 e 35 ˚C. A ausência de desenvolvimento do epicótilo e de plântulas normais nas temperaturas de 10; 15 e 40 ˚C, em ambos os lotes, indica que a parte aérea é mais sensível a temperaturas extremas do que o hipocótilo e a raiz. O limite inferior de temperatura para o crescimento da parte aérea situou-se entre 15 e 20 ˚C, e o limite superior, entre 35 e 40 ˚C. A temperatura de 30 ˚C é recomendada para o teste de germinação das sementes de T. grandiflorum. Para o critério de plântula normal, a primeira contagem pode ser realizada aos 21 dias, e a contagem final, aos 35 dias. O alongamento do epicótilo (≥3 cm) é uma alternativa para avaliação mais rápida da germinação, necessitando apenas de 14 dias para a primeira contagem e 20 dias para a contagem final.

A poda de frutificação em citricultura pode ser aplicada com o objetivo de controlar o crescimento vegetativo e promover a formação de novos ramos frutíferos. Neste sentido, o objetivo deste trabalho foi avaliar diferentes regimes de poda manual em pomares jovens de Laranjeiras 'Valência', cultivadas em manejo convencional. Utilizou-se um pomar com espaçamento de 5,0 x 2,5 m, implantado em 2001 no município de Montenegro-RS, Brasil. Os tratamentos, com início em 2004, foram: A - Testemunha (sem poda); B - Poda anual de 15%; C - Poda bienal de 15%; D - Poda bienal de 30%; e E - Poda trienal de 30% do volume da copa. O delineamento experimental foi de blocos ao acaso, sendo quatro repetições e quatro plantas por parcela. Foram avaliados o número de frutos, massa total e massa média de frutos nas safras de 2006, 2007 e 2008. Foram avaliados aspectos relativos à qualidade dos frutos, como teor de sólidos solúveis totais (SST), acidez total titulável (ATT) e relação SST/AT. As podas de frutificação não alteraram significativamente a produção total de três safras, nem a qualidade físico-química dos frutos, em pomares de laranjeiras 'Valência' com menos de sete anos de idade, em sistema de manejo convencional.

We explore the possible association between the microquasar LSI +61°303 and the EGRET source 2CG 135+01/3EG J0241+6103 by studying, with a detailed numerical model, whether this system can produce the emission and the variability detected by EGRET (>100 MeV) through inverse Compton (IC) scattering. Our numerical approach considers a population of relativistic electrons entrained in a cylindrical inhomogeneous jet, interacting with both the radiation and the magnetic fields, taking into account the Thomson and Klein-Nishina regimes of interaction. Our results reproduce the observed spectral characteristics and variability at γ-rays, thus strengthening the identification of LSI +61°303 as a high-energy γ-ray source.

S u b s u r face fluid flow plays a significant role in many geologic processes and is increasingly being studied in the scale of sedimentary basins and geologic time perspective. Many economic resources such as petroleum and mineral deposits are products of basin scale fluid flow operating over large periods of time. Such ancient flow systems can be studied through analysis of diagenetic alterations and fluid inclusions to constrain physical and chemical conditions of fluids and rocks during their paleohy d r og e o l ogic evolution. Basin simulation models are useful to complement the paleohy d r og e o l ogic record preserved in the rocks and to derive conceptual models on hydraulic basin evolution and generation of economic resources. Different types of fluid flow regimes may evo l ve during basin evolution. The most important with respect to flow rates and capacity for transport of solutes and thermal energy is gr avitational fluid flow driven by the topographic configuration of a basin. Such flow systems require the basin to be elevated above sea level. Consolidational fluid flow is the principal fluid migration process in basins below sea level, caused by loading of compressible rocks. Flow rates of such systems are several orders of magnitude below topogr a p hy driven flow. Howeve r, consolidation may create significant fluid ove rpressure. Episodic dewatering of ove rpressured compart m e n t s m ay cause sudden fluid release with elevated flow velocities and may cause a transient local thermal and chemical disequilibrium betwe e n fluid and rock. This paper gives an ove rv i ew on subsurface fluid flow processes at basin scale and presents examples related to the Pe n e d è s basin in the central Catalan continental margin including the offshore Barcelona half-graben and the compressive South-Pyrenean basin.

RESUMO Na pós-colheita do abacaxizeiro, a podridão-negra é considerada como um dos principais problemas na comercialização dos frutos. A doença é causada pelo fungoChalara paradoxa (De Seynes) Sacc.. Apesar da importância deste patógeno para a cultura, são poucas as informações relacionadas ao estudo do mesmo, com base em características fisiológicas in vitro. Assim, o objetivo do trabalho foi avaliar o crescimento micelial, a esporulação e a germinação de C. paradoxa, em diferentes condições de cultivo. A partir de placas contendo colônias puras do isolado de C. paradoxa, foram retirados individualmente discos para inoculação em diferentes meios. A incubação das placas foi feita em três diferentes regimes de luminosidade e em três diferentes temperaturas. Para o crescimento micelial, esporulação e germinação, as melhores condições de cultivo in vitro de C. paradoxa foram os meios aveia (OA) e batata (PDA) em alternância luminosa a 25°C, os meios batata (PDA) e abacaxi (PJA) no escuro contínuo, na mesma temperatura.

An Enantiornithes specimen from El Montsec was initially described as an immature individual based upon qualitative traits such as its relatively large orbit and overall proportions of the skull and the postcranium. In this study we re-evaluate the precise determination of the ontogenetic stage of this individual, establishing a cross-talk among taphonomic, anatomic, and morphometric data. The exceptional preservation of the specimen has allowed pondering ontogenetic influence versus preservational bias in features like the external patterns of bone surfaces, instead of being aprioristically considered due to taphonomic alterations only. The rough texture of the periosteal bone associated with pores in the distal, proximal and mid-shaft areas of the humeral shaft, indicates a subadult stage when compared with long bones of modern birds. Forelimb proportions of embryo and juvenile Enanthiornithes are equivalent to those of adult individuals of other taxa within this clade, though this is not a reliable criterion for establishing a precise ontogenetic stage. The El Montsec specimen may be attributed a close adulthood, yet only if growth regimes in Enantiornithes are considered equivalent to those in Neornithes birds.

Although abundant in the number of individuals, the Atlantic salmon may be considered as a threatened species in many areas of its native distribution range. Human activities such as building of power plant dams, offshore overfishing, pollution, clearing of riverbeds for timber floating and badly designed stocking regimes have diminished the distribution of Atlantic salmon. As a result of this, many of the historical populations both in Europe and northern America have gone extinct or are severely depressed. In fact, only 1% of Atlantic salmon existing today are of natural origin, the rest being farmed salmon. All of this has lead to a vast amount of research and many restoration programmes aiming to bring Atlantic salmon back to rivers from where it has vanished. However, many of the restoration programmes conducted thus far have been unsuccessful due to inadequate scientific research or lack of its implementation, highlighting the fact that more research is needed to fully understand the biology of this complex species. The White and Barents Seas in northwest Russia are among the last regions in Europe where Atlantic salmon populations are still stable, thus forming an important source of biodiversity for the entire European region. Salmon stocks from this area are also of immense economic and social importance for the local people in the form of fishing tourism. The main aim of this thesis was to elucidate the post-glacial history and population genetic structure of north European and particularly northwest Russian Atlantic salmon, both of which are aspects of great importance for the management and conservation of the species. Throughout the whole thesis, these populations were studied by utilizing microsatellites as the main molecular tool. One of the most important discoveries of the thesis was the division of Atlantic salmon from the White and Barents Seas into four separate clusters, which has not been observed in previous studies employing nuclear markers although is supported by mtDNA studies. Populations from the western Barents Sea clustered together with the northeast Atlantic populations into a clearly distinguishable group while populations from the White Sea and eastern Barents Sea were separated into three additional groups. This has important conservation implications as this thesis clearly indicates that conservation of populations from all of the observed clusters is warranted in order to conserve as much of the genetic diversity as possible in this area. The thesis also demonstrates how differences in population life histories within a species, migratory behaviour in this case, and in their phylogeographic origin affect the genetic characteristics of populations, namely diversity and divergence levels. The anadromous populations from the Atlantic Ocean, White Sea and Barents Sea possessed higher levels of genetic diversity than the anadromous populations form the Baltic Sea basin. Among the non-anadromous populations the result was the opposite: the Baltic freshwater populations were more variable. This emphasises the importance of taking the life history of a population into consideration when developing conservation strategies: due to the limited possibilities for new genetic diversity to be generated via gene flow, it is expected that freshwater Atlantic salmon populations would be more vulnerable to extinction following a population crash and thus deserve a high conservation status. In the last chapter of this thesis immune relevant marker loci were developed and screened for signatures of natural selection along with loci linked to genes with other functions or no function at all. Also, a novel landscape genomics method, which combines environmental information with molecular data, was employed to investigate whether immune relevant markers displayed significant correlations to various environmental variables more frequently than other loci. Indications of stronger selection pressure among immune-relevant loci compared to non-immune relevant EST-linked loci was found but further studies are needed to evaluate whether it is a common phenomenon in Atlantic salmon.
