Pretende establecer, si la prisión preventiva, realmente cumple con su rol, esto es ser una medida cautelar, o si por el contrario, ha existido o existe excesos en su aplicación, llegando a determinar por tanto, que la prisión preventiva no debe constituir la regla general como expresamente se determina ya que se trataría de un acto arbitrario e injusto el privar la libertada en forma desproporcionada respecto de la pena que correspondería al delito del imputado a quienes cuya responsabilidad no ha sido todavía probado, esto sería una anticipación de la pena totalmente contraria a los principios elementales del Estado Constitucional y de los Derechos Humanos. La tesis se divide en cuatro capítulos; el primero se refiere al análisis de los principales principios que se deben observar y aplicar respecto de la prisión preventiva, siendo el principio de inocencia, excepcionalidad, proporcionalidad, provisionalidad, inmediación, legalidad y el debido proceso; el capítulo segundo, trata de las medidas cautelares, y dentro de esta esfera se analiza a la prisión preventiva, en nuestra realidad, y a la luz de la Constitución y los tratados Internacionales; los presupuestos contenidos en el art. 167 del Código de Procedimiento Penal; los indicios y la evidencia. En el capítulo tercero, se analiza el procedimiento garantista para ordenar la prisión preventiva; la audiencia de control de flagrancia y la audiencia de formulación de Cargos en los delitos no flagrantes. En el Capítulo cuarto, se analiza tres causas penales, y se concluye con las conclusiones y recomendaciones.

En la actualidad se estima que existen alrededor de 12 millones de personas apátridas, y que ninguna región del mundo está libre de esta problemática. Sin embargo, es difícil calcular el número preciso, ya que existen pocas estadísticas fiables sobre el tema y en varias ocasiones no existe consenso de a quien se debe considerar apátrida. La ley internacional define a los apátridas como toda persona que no sea considerada como nacional suyo por ningún Estado, conforme a su legislación, no obstante, existen también varias personas en el mundo a quienes, si bien no se les ha negado la nacionalidad formalmente, sin embargo, no pueden ejercer este derecho efectivamente, lo que ocasiona que exista un desacuerdo en la comunidad internacional sobre a quienes se les podría dar esta denominación. Este artículo recoge esta problemática, la contextualiza y la analiza a la luz de la situación de apatridia en el Ecuador.

Este texto se propone evaluar los alcances y limitaciones de algunas fuentes que se pueden utilizar para medir la desigualdad económica en períodos pre-estadísticos, en especial los inventarios post-mortem y algunos censos económicos efectuados por motivos fiscales de pretensión más universal. Ambos han sido usados por los historiadores desde hace tiempo y presentan diversos problemas. En el caso de los censos se ha señalado sobre todo la subvaluación de los capitales y en el de los inventarios el fuerte sesgo social y etario. Sin embargo, ambos tienen una potencialidad irreemplazable ante la falta de alternativas, pero requieren de recaudos y estrategias metodológicas para corregir dichos defectos.

Effective enforcement and compliance with EU law is not just a legal necessity, it is also of economic interest since the potential of the Single Market will be fully exploited. Enforcement barriers generate unjustified costs and hindrances or uncertainty for cross-border business and might deprive consumers from receiving the full benefit of greater choice and/or cheaper offers. The EU has developed several types of enforcement efforts (preventive initiatives, pre-infringement initiatives and formal infringement procedures). More recently, the emphasis has been placed on effective prevention. This CEPS Policy Brief analyses the functioning of one preventive mechanism (the 98/34 Directive) and assesses its potential to detect and prevent technical or other barriers in the course of the last 25 years. Based on an empirical approach, it shows that this amazing mechanism has successfully prevented thousands of new technical barriers from arising in the internal goods market.

In 2005 the EU and Turkey officially started accession negotiations that were intended to lead to Turkey’s full membership of the EU. Yet today, the Turkish accession process has virtually ground to a halt and lost all credibility. Talk of alternatives to full membership can be heard from various sides; we highlight four instances of what we call ‘parallelism’, namely the elusive concept of a ‘privileged partnership’, the EU-Turkey customs union, the recently launched ‘Positive Agenda’ and Turkish participation in the Energy Community Treaty. While a privileged partnership represents a more comprehensive but still remote framework for EU-Turkish relations, the latter three are merely an escape route from preaccession. We conclude our analysis with a discussion on Turkey’s possible membership of the European Economic Area, which in effect would serve none of the parties involved. We conclude that both partners, the EU and Turkey, would be well advised to remember their pre-accession commitments of 13 years ago – for their mutual benefit.

We suggest that climate variability in Europe for the “pre-industrial” period 1500–1900 is fundamentally a consequence of internal fluctuations of the climate system. This is because a model simulation, using fixed pre-industrial forcing, in several important aspects is consistent with recent observational reconstructions at high temporal resolution. This includes extreme warm and cold seasonal events as well as different measures of the decadal to multi-decadal variance. Significant trends of 50-year duration can be seen in the model simulation. While the global temperature is highly correlated with ENSO (El Nino- Southern Oscillation), European seasonal temperature is only weakly correlated with the global temperature broadly consistent with data from ERA-40 reanalyses. Seasonal temperature anomalies of the European land area are largely controlled by the position of the North Atlantic storm tracks. We believe the result is highly relevant for the interpretation of past observational records suggesting that the effect of external forcing appears to be of secondary importance. That variations in the solar irradiation could have been a credible cause of climate variations during the last centuries, as suggested in some previous studies, is presumably due to the fact that the models used in these studies may have underestimated the internal variability of the climate. The general interpretation from this study is that the past climate is just one of many possible realizations and thus in many respects not reproducible in its time evolution with a general circulation model but only reproducible in a statistical sense.

Disequilibria between Pb-210 and Ra-226 can be used to trace magma degassing, because the intermediate nuclides, particularly Rn-222, are volatile. Products of the 1980-1986 eruptions of Mount St. Helens have been analysed for (Pb-210/Ra-226). Both excesses and deficits of Pb-210 are encountered suggesting rapid gas transfer. The time scale of diffuse, non-eruptive gas escape prior to 1980 as documented by Pb-210 deficits is on the order of a decade using the model developed by Gauthier and Condomines (Earth Planet. Sci. Lett. 172 (1999) 111-126) for a non-renewed magma chamber and efficient Rn removal. The time required to build-up Pb-210 excess is much shorter (months) as can be observed from steady increases of (Pb-210/Ra-226) with time during 1980-1982. The formation of Pb-210 excess requires both rapid gas transport through the magma and periodic blocking of gas escape routes. Superposed on this time trend is the natural variability of (Pb-210/Ra-226) in a single eruption caused by tapping magma from various depths. The two time scales of gas transport, to create both Pb-210 deficits and Pb-210 excesses, cannot be reconciled in a single event. Rather Pb-210 deficits are associated with pre-eruptive diffuse degassing, while Pb-210 excesses document the more vigorous degassing associated with eruption and recharge of the system. Building upon existing Caribbean research by Condon and Duval, we assess how repetitive visiting is, or is not, important to youthful return migrants in their 30s and 40s, who have decided to return more permanently to Trinidad. Is it influential in their social and economic adaptations on return, and does this transnational practice lead to a more permanent return? Our analysis is based on 40 detailed narratives which were collected in 2004-2005. For some returnees, repetitive visiting is influential, for others one visit is enough and for a few, it makes no difference. Yet it is certainly a common practice for 'keeping in touch' among our transnational informants.
