«Sélective» et «statique» en théorie, la reprise de l'acquis de l'Union européenne dans le cadre de la voie bilatérale n'en donne pas moins lieu à une dynamique évolutive et expansive, exigeant un travail constant de coordination entre le droit européen, le droit bilatéral et le droit interne. Appelés à gérer ce travail de coordination, le juge et le législateur fédéraux ont traditionnellement opté pour un suivi «au cas par cas» de l'acquis, propre à préserver leur marge de manoeuvre ou à tout le moins l'image qu'il est politiquement convenable d'en donner. Cette approche pragmatique est toutefois inapte à maîtriser les dynamiques de la voie bilatérale. Elle est par ailleurs dommageable pour la cohérence de l'ordre juridique suisse tout comme pour sa lisibilité et prévisibilité, comportant de surcroît un risque accru de courts-circuits entre droit et politique. Les vicissitudes du régime du regroupement familial en Suisse, sous l'impulsion de la jurisprudence de la Cour de justice de l'Union européenne et notamment de l'arrêt Metock de 2007, fournissent une illustration exemplaire de ces propos. En retraçant les étapes de cette saga politico-judiciaire, le présent article met en exergue les choix stratégiques effectués par les autorités fédérales et, surtout, l'évolution de leur approche à l'égard du «suivi» du droit européen - évolution dont l'ATF 136 II 5, qui énonce la «nouvelle doctrine» du Tribunal fédéral en la matière, représente à ce jour l'aboutissement.

The Division of Criminal and Juvenile Justice Planning (CJJP) recently released its study of Iowa’s six adult drug courts, all of which are administered by community corrections agencies. Making heavy use of DOC’s ICON data base, CJJP examined completion rates, recidivism and substance abuse treatment. CJJP also compared drug court results with those of a group of offenders who were screened and declined or were rejected by drug court in 2003 (referred) and a sample of offenders starting probation in 2003 (probationers). CJJP tracked the offenders for approximately three years.

Intra-specific colour polymorphism provides a cryptic camouflage from predators in heterogeneous habitats. The orthoptera species, Acrida ungarica (Herbst, 1786) possess two well-distinguished colour morphs: brown and green and displays several disruptive colouration patterns within each morph to improve the crypsis. This study focused on how the features of the background environment relate to the proportion of the two morphs and to the intensity of disruptive colouration patterns in A. ungarica. As the two sexes are very distinct with respect to mass and length, we also distinctively tested the relationship for each sex. In accordance with the background matching hypothesis, we found that, for both sexes, the brown morph was in higher proportion at sites with a brown-dominant environment, and green morphs were in higher proportion in green-dominant environments. Globally, individuals in drier sites and in the drier year also had more intense disruptive colouration patterns, and brown morphs and females were also more striped. Colour patterns differed largely between populations and were significantly correlated with relevant environmental features. Even if A. ungarica is a polymorphic specialist, disruptive colouration still appears to provide strong benefits, particularly in some habitats. Moreover, because females are larger, they are less able to flee, which might explain the difference between sexes

Background: Chemoreception is a widespread mechanism that is involved in critical biologic processes, including individual and social behavior. The insect peripheral olfactory system comprises three major multigene families: the olfactory receptor (Or), the gustatory receptor (Gr), and the odorant-binding protein (OBP) families. Members of the latter family establish the first contact with the odorants, and thus constitute the first step in the chemosensory transduction pathway.Results: Comparative analysis of the OBP family in 12 Drosophila genomes allowed the identification of 595 genes that encode putative functional and nonfunctional members in extant species, with 43 gene gains and 28 gene losses (15 deletions and 13 pseudogenization events). The evolution of this family shows tandem gene duplication events, progressive divergence in DNA and amino acid sequence, and prevalence of pseudogenization events in external branches of the phylogenetic tree. We observed that the OBP arrangement in clusters is maintained across the Drosophila species and that purifying selection governs the evolution of the family; nevertheless, OBP genes differ in their functional constraints levels. Finally, we detect that the OBP repertoire evolves more rapidly in the specialist lineages of the Drosophila melanogaster group (D. sechellia and D. erecta) than in their closest generalists.Conclusion: Overall, the evolution of the OBP multigene family is consistent with the birth-and-death model. We also found that members of this family exhibit different functional constraints, which is indicative of some functional divergence, and that they might be involved in some of the specialization processes that occurred through the diversification of the Drosophila genus.

Sign vandalism has traditionally been a vexing problem for Iowa counties. The extent of the cost and incidence of these acts have never been fully ascertained, but a 1990 survey indicated that they cost Iowa counties more than 1.5 million dollars annually. In 1990, the Iowa Legislature recognized the seriousness of the problem and strengthened the existing sign vandalism law by increasing the penalty for illegal possession of a traffic control device from a simple to a serious misdemeanor. However, the courts must be willing to prosecute vandals to the magnitude provided in the Iowa Code. An educational campaign begun in 1987 involving over 200 Iowa school districts to educate students on the seriousness of the problem evidently did not have the effect of dramatically reducing the overall cost of sign vandalism in Iowa. This study sought to define the scope of the problem and possibly offer some effective countermeasures to combat sign vandalism and theft in Iowa.

In severe and variable conditions, specialized resource selection strategies should be less fre‐ quent because extinction risks increase for species that depend on a single and unstable resource. Psithyrus (Bombus subgenus Psithyrus) are bumblebee parasites that usurp Bombus nests and display inter‐specific variation in the number of hosts they parasitize. Using a phylogenetic comparative frame‐ work, we show that Psithyrus species at higher elevations display a higher number of hosts species com‐ pared with species restricted to lower elevations. Species inhabiting high elevations also cover a larger temperature range, suggesting that species able to occur in colder conditions may benefit from recruit‐ ment from populations occurring in warmer conditions. Our results provide evidence for an 'altitudinal niche breadth hypothesis' in parasitic species, showing a decrease in the parasites' specialization along the elevational gradient, and also suggesting that Rapoport's rule might apply to Psithyrus.

We know very little about the importance of history and physical examination compared to the importance of paraclinical tests in the diagnostic process in primary care. To answer this question, we examined prospectively 672 consecutive patients with chest pain in primary care. We recorded the timing and the clinical characteristics of the most frequent diagnosis. The resort to laboratory or other clinical tests and reference to specialist were influenced by: emergency consultation, potentially life-threatening aetiology, personal characteristics of the general practitioners' (GP) and patients' anxiety. GPs attributed the diagnosis to history and physical examination alone in 66% and to the association of history, physical examination and tests in 31% cases. This, clinical strategy remains the most important factor in the diagnostic process; even when they are insufficient, they allowed to generate hypotheses and guide investigations.

This report is Iowa’s Three-Year Plan, which serves as the application for federal Juvenile Justice and Delinquency Prevention Act formula grant funding (JJDP Act). The Division of Criminal and Juvenile Justice Planning (CJJP) wrote Iowa’s Three-Year Plan. CJJP is the state agency responsible for administering the JJDP Act in Iowa. Federal officials refer to state administering agencies as the state planning agency (SPA). The Plan was developed and approved by Iowa’s Juvenile Justice Advisory Council. That Council assists with administration of the JJDP Act, and also provides guidance and direction to the SPA, the Governor and the legislature regarding juvenile justice issues in Iowa. Federal officials refer to such state level groups as state advisory groups (SAG’s). The acronyms SPA and SAG are used through this report.

The information included in this report overviews system processing for delinquent youth. It also provides data and analysis from key system decision pointsand services.
