Commentary on the Booksellers' Bill (1737)

This Bill marks the first occasion on which the British legislature proposed to confer upon authors a lifetime interest in their literary works (with an additional eleven year post-mortem term vesting in their estates), as well as limited rights of translation and abridgement. In addition the draft legislation proposed to render null and void any contract purporting to assign an author's rights to another for a period of longer than ten years.
The commentary describes the background to the Bill, and in particular the attempts of the London book trade to secure more extensive legislative protection in both 1735 and 1737. It argues that the 1737 Bill is significant precisely because it was never made into law, and because it did not suit the best interests of the metropolitan booksellers. Instead, the book trade increasingly turned to the courts to further secure their commercial interests, giving rise to what is commonly referred to as the ‘battle of the booksellers' throughout the next 40 years.

Ohjelman kantavana ideana oli kuitenkin väkivallan välttämättömyys lännen valloittamisessa. Samalla show’hun kuuluneet intiaanit esiteltiin areenalla ja lehdistössä hyvin stereotyyppisinä vihollisina, maalattuina ja verenhimoisina. Lehdistö, joka välitti lukijoilleen varsin intensiivisiä kuvauksia tapahtumista showareenalla, huolestui esityksien vaikutuksista lapsiin ja nuoriin. Buffalo Billin yhteistyökumppanit rakensivat hänelle sankarillisen imagon viihderomaanien ja show’n avulla. Riitaisan avioeroprosessin myötä ennen niin hyvä julkisuuskuva lehdistössä alkoi murentua, kun naisseikkailut ja muut salaisuudet tulivat päivänvaloon. Suurista tuloista huolimatta Buffalo Billillä oli vaikeuksia hallita talouttaan anteliaisuutensa ja huonojen sijoituksien vuoksi. Iän karttuessa ja terveyden heikentyessä hänen roolinsa show’ssa väheni, minkä seurauksena myös median kiinnostus alkoi hiipua. Villin lännen show ajautui konkurssiin vuonna 1913, mutta sitä ennen se kiersi lukuisat kaupungit Pohjois-Amerikassa ja Euroopassa. Aikalaislehdistön mukaan Buffalo Bill ja show olivat tehneet suuren vaikutuksen Yhdysvaltojen entiseen siirtomaaisäntään Britanniaan ja seuraava askel on vertailla näiden kahden maan lehdistön suhtautumista esitykseen.

The evolution of the avian bill as a thermoregulatory organ.

The avian bill is a textbook example of how evolution shapes morphology in response to changing environments. Bills of seed-specialist finches in particular have been the focus of intense study demonstrating how climatic fluctuations acting on food availability drive bill size and shape. The avian bill also plays an important but under-appreciated role in body temperature regulation, and therefore in energetics. Birds are endothermic and rely on numerous mechanisms for balancing internal heat production with biophysical constraints of the environment. The bill is highly vascularised and heat exchange with the environment can vary substantially, ranging from around 2% to as high as 400% of basal heat production in certain species. This heat exchange may impact how birds respond to heat stress, substitute for evaporative water loss at elevated temperatures or environments of altered water availability, or be an energetic liability at low environmental temperatures. As a result, in numerous taxa, there is evidence for a positive association between bill size and environmental temperatures, both within and among species. Therefore, bill size is both developmentally flexible and evolutionarily adaptive in response to temperature. Understanding the evolution of variation in bill size however, requires explanations of all potential mechanisms. The purpose of this review, therefore, is to promote a greater understanding of the role of temperature on shaping bill size over spatial gradients as well as developmental, seasonal, and evolutionary timescales.
