A presente dissertação objetiva ampliar o tratamento dogmático da modulação temporal dos efeitos da decisão que reconhece a inconstitucionalidade de atos normativos. Busca-se também abordar a perspectiva prospectiva no controle de legalidade e na aferição de juridicidade dos demais atos não normativos praticados no âmbito dos três poderes. Além de abordar os pressupostos teóricos subjacentes à abordagem prospectiva, foram analisados os sistemas de controle de constitucionalidade e os distintos regimes conferidos às situações de invalidade. Promove-se a releitura do tema de forma a reconduzir a modulação dos efeitos temporais à ponderação entre os princípios constitucionais violados pela norma que se pretende declarar inválida e os que tutelam as relações jurídicas que se formaram durante a vigência da norma declarada inválida. Discorre-se particularmente sobre o tema no Brasil, evidenciando-se que a perspectiva prospectiva não se circunscreve apenas ao regramento formal estabelecido pelas normas infraconstitucionais. Por fim, apresenta-se a modulação de efeitos como uma ferramenta valiosa de diálogo institucional, que pode permitir a conciliação dos espaços próprios dos poderes constituídos, temperando um eventual ativismo judicial. Evidencia-se que a modulação temporal de efeitos funciona como ponte entre as teorias empíricas e normativas. Vale-se de abordagens consequencialistas e institucionais sem se descurar da preocupação normativa e dogmática. Permite concomitantemente o debate mais intenso e o diálogo entre os poderes, tudo com o objetivo de se assegurar a concretização dos preceitos constitucionais de uma forma mais harmônica e sistemática.

Essa pesquisa de mestrado pretende compreender as relações entre: o homem executivo, o trabalho e as práticas corporativas contemporâneas, em uma sociedade capitalista, denominada nesse estudo, modernidade tardia. Para o estudo desse tema foram priorizados pontos de reflexão relacionados à prática corporativa, tais como: pensar o trabalho na contemporaneidade observando suas características que se aproximam e se distanciam de outros momentos históricos; entender o trabalho, seus significados, suas transformações e suas estratégias atuais; refletir a respeito da perspectiva que o homem tem sobre o tempo e sua relação com a mudança do seu modo de viver; discutir o processo de desumanização do trabalho e das relações interpessoais na contemporaneidade; conhecer as atitudes do homem diante do trabalho e da vida em uma sociedade capitalista; observar e descrever a configuração atual do mercado de trabalho em algumas empresas privadas nacionais e multinacionais no Rio de Janeiro. O estudo das questões citadas permitiu tecer articulações sobre como o homem contemporâneo se relaciona com o trabalho corporativo e com os demais aspectos da vida, bem como sobre o estreitamento do tempo livre e encurtamento da vida em função do culto da alta performance. A escolha metodológica realizada nesta pesquisa é a abordagem qualitativa e método de entrevista narrativa, que conjuga reflexões teóricas à investigação empírica, colocando em questão a realidade cotidiana de profissionais que ocupam ou ocuparam posições de liderança em empresas. As modificações na importância e desdobramentos do trabalho observados atualmente estão relacionadas com as alterações na maneira como nossa sociedade tem lidado com o tempo, sua aceleração e com a vida. Vida entendida de forma mais ampla, onde haja espaço para a realização profissional e pessoal em diferentes espaços, bem como a possibilidade de execução de um trabalho que coadune motivações, interesses e potencialidades do indivíduo com uma contribuição efetiva para a sociedade, alinhada aos valores individuais. A opção de utilizar a terminologia sociedade da modernidade tardia em detrimento de sociedade atual decorre da observação da progressiva incorporação dos ideais capitalistas associados à aceleração do tempo e das maneiras de vivê-lo, por qual vem passando os processos produtivos, o trabalho, e as demais dimensões da vida humana. O trabalho no mundo corporativo obedece a regras particulares, que além de articuladas ao modelo econômico vigente, o capitalista, embute práticas e rituais que enfatizam o culto da alta performance. A presente pesquisa pretende analisar o trabalho dos executivos. Para isso, buscaremos analisá-lo segundo os modelos adotados em algumas empresas privadas, que consideraremos como o mundo corporativo e as implicações da adoção desses modelos para o exercício de uma vida mais plena de sentido existencial, a partir da minha experiência corporativa e da análise das entrevistas com executivos.

Knowing where pinnipeds forage is vital to managing and protecting their populations, and for assessing potential interactions with fisheries. We assessed the spatial relationship between the seasonal distribution of Pacific harbor seals (Phoca vitulina richardii) outfitted with satellite transmitters and the seasonal distributions of potential harbor seal prey species in San Francisco Bay, California. Pearson’s correlation coefficients were calculated between the number of harbor seal locations in an area of the San Francisco Bay and the abundance of specific prey species in the same area. The influence of scale on the analyses was assessed by varying the scale of analysis from 1 to 10 km. There was consistency in the prey species targeted by harbor seals year-round, although there were seasonal differences between the most important prey species. The highest correlations between harbor seals and their prey were found for seasonally abundant benthic species, located within about 10 km of the primary haul-out site. Probable foraging habitat for harbor seals was identified, based on areas with high abundances of prey species that were strongly correlated with harbor seal distribution. With comparable local data inputs, this approach has potential application to pinniped management in other areas, and to decisions about the location of marine reserves designed to protect these species.

Abstract—In the first of two companion papers, a 54-yr time series for the oyster population in the New Jersey waters of Delaware Bay was analyzed to develop biological relationships necessary to evaluate maximum sustainable yield (MSY) reference points and to consider how multiple stable points affect reference point-based management. The time series encompassed two regime shifts, one circa 1970 that ushered in a 15-yr period of high abundance, and a second in 1985 that ushered in a 20-yr period of low abundance. The intervening and succeeding periods have the attributes of alternate stable states. The biological relationships between abundance, recruitment, and mortality were unusual in four ways. First, the broodstock–recruitment relationship at low abundance may have been driven more by the provision of settlement sites for larvae by the adults than by fecundity. Second, the natural mortality rate was temporally unstable and bore a nonlinear relationship to abundance. Third, combined high abundance and low mortality, though likely requiring favorable environmental conditions, seemed also to be a self-reinforcing phenomenon. As a consequence, the abundance –mortality relationship exhibited both compensatory and depensatory components. Horseshoe crabs (Limulus polyphemus) are valued by many stakeholders, including the commercial fishing industry, biomedical companies, and environmental interest groups. We designed a study to test the accuracy of the conversion factors that were used by NOAA Fisheries and state agencies to estimate horseshoe crab landings before mandatory reporting that began in 1998. Our results indicate that the NOAA Fisheries conversion factor consistently overestimates the weight of male horseshoe crabs, particularly those from New England populations. Because of the inaccuracy of this and other conversion factors, states are now mandated to report the number (not biomass) and sex of landed horseshoe crabs. However, accurate estimates of biomass are still necessary for use in prediction models that are being developed to better manage the horseshoe crab fishery. We recommend that managers use the conversion factors presented in this study to convert current landing data from numbers to biomass of harvested horseshoe crabs for future assessments.

Quantification of predator-prey body size relationships is essential to understanding trophic dynamics in marine ecosystems. Prey lengths recovered from predator stomachs help determine the sizes of prey most influential in supporting predator growth and to ascertain size-specific effects of natural mortality on prey populations (Bax, 1998; Claessen et al., 2002). Estimating prey size from stomach content analyses is often hindered because of the degradation of tissue and bone by digestion. Furthermore, reconstruction of original prey size from digested remains requires species-specific reference materials and techniques. A number of diagnostic guides for freshwater (Hansel et al., 1988) and marine (Watt et al., 1997; Granadeiro and Silva, 2000) prey species exist; however they are limited to specific geographic regions (Smale et al., 1995; Gosztonyi et al., 2007). Predictive equations for reconstructing original prey size from diagnostic bones in marine fishes have been developed in several studies of piscivorous fishes of the Northwest Atlantic Ocean (Scharf et al., 1998; Wood, 2005). Conversely, morphometric relationships for cephalopods in this region are scarce despite their importance to a wide range of predators, such as finfish (Bowman et al., 2000 ; Staudinger, 2006), elasmobranchs (Kohler, 1987), and marine mammals (Gannon et al., 1997; Williams, 1999).

In this study we analyzed the diets of 26 nekton species collected from two years (2000 and 2002) off Oregon and northern California to describe dominant nekton trophic groups of the northern California Current (NCC) pelagic ecosystem. We also examined interannual variation in the diets of three nekton species. Cluster analysis of predator diets resulted in nekton trophic groups based on the consumption of copepods, euphausiids, brachyuran larvae, larval juvenile fishes, and adult nekton. However, many fish within trophic groups consumed prey from multiple trophic levels—euphausiids being the most widely consumed. Comparison of diets between years showed that most variation occurred with changes in the contribution of euphausiids and brachyuran larvae to nekton diets. The importance of euphausiids and other crustacean prey to nekton indicates that omnivory is an important characteristic of the NCC food web; however it may change during periods of lower or higher upwelling and ecosystem production.

Minimizing bycatch of seabirds is a major goal of the U.S. National Marine Fisheries Service. In Alaska waters, the bycatch (i.e., inadvertent catches) of seabirds has been an incidental result of demersal groundfish longline fishery operations. Notably, the endangered short-tailed albatross (Phoebastria albatrus) has been taken in this groundfish fishery. Bycatch rates of seabirds from individual vessels may be of particular interest because vessels with high bycatch rates may not be functioning effectively with seabird avoidance gears, and there may be a need for suggestions on how to use these avoidance gears more effectively. Therefore, bycatch estimates are usually made on an individual vessel basis and then summed to obtain the total estimate for the entire fleet.

Between 1995 and 2002, we surveyed fish assemblages at seven oil platforms off southern and central California using the manned research submersible Delta. At each platform, there is a large horizontal beam situated at or near the sea floor. In some instances, shells and sediment have buried this beam and in other instances it is partially or completely exposed. We found that fish species responded in various ways to the amount of exposure of the beam. A few species, such as blackeye goby (Rhinogobiops nicholsii), greenstriped rockfish (Sebastes elongatus), and pink seaperch (Zalembius rosaceus) tended to avoid the beam. However, many species that typically associate with natural rocky outcrops, such as bocaccio (S. paucispinis), cowcod (S. levis), copper (S. caurinus), greenblotched (S. rosenblatti), pinkrose (S. simulator) and vermilion (S. miniatus) rockfishes, were found most often where the beam was exposed. In particular, a group of species (e.g., bocaccio, cowcod, blue (Sebastes mystinus), and vermilion rockfishes) called here the “sheltering habitat” guild, lived primarily where the beam was exposed and formed a crevice. This work demonstrates that the presence of sheltering sites is important in determining the species composition of man-made reefs and, likely, natural reefs. This research also indicates that adding structures that form sheltering sites in and around decommissioned platforms will likely lead to higher densities of many species typical of hard and complex structure.

Priors are existing information or beliefs that are needed in Bayesian analysis. Informative priors are important in obtaining the Bayesian posterior distributions for estimated parameters in stock assessment. In the case of the steepness parameter (h), the need for an informative prior is particularly important because it determines the stock-recruitment relationships in the model. However, specifications of the priors for the h parameter are often subjective. We used a simple population model to derive h priors based on life history considerations. The model was based on the evolutionary principle that persistence of any species, given its life history (i.e., natural mortality rate) and its exposure to recruitment variability, requires a minimum recruitment compensation that enables the species to rebound consistently from low critical abundances (Nc). Using the model, we derived the prior probability distributions of the h parameter for fish species that have a range of natural mortality, recruitment variabilities, and Nt values.

The parameters of the length-weight relationship of the form W = aLb are presented for 51 species of commercially important marine fishes and shellfishes caught along the southern coast of Karnataka, India. Samples from commercial (trawl, purse seines, gill nets) and artisanal gears were taken during August 1999 to May 2001. The ‘b’ value ranged between 1.942 and 3.616 with a mean of 2.80, standard deviation of 0.32, and mode of 3.

Length-weight relationships and condition factors are presented for Indian major carp Catla catla, Labeo rohita, L. calbasu and Cirrhinus mrigala (Cyprinidae) in a reservoir of Bangladesh (Kaptai Lake).

O objetivo da tese é investigar a constituição da interioridade a partir de uma abordagem externalista. Os processos pelos quais o autoconhecimento é constituído são considerados como estando associados ao desenvolvimento da perspectiva da primeira pessoa. Adotar uma perspectiva de primeira pessoa é tornar-se capaz de fazer referência a si mesmo e conhecer seus próprios estados mentais e corporais. A autoconsciência e o autoconhecimento foram tradicionalmente subsumidos à idéia de Descartes da autoridade da primeira pessoa. Segundo a tese cartesiana, teríamos acesso privilegiado e não-empírico aos nossos estados mentais que se expressaria por meio de um conhecimento. A tese central do externalismo afirma, ao contrário, que o conteúdo dos estados mentais é constituído, em parte, pelas relações com o ambiente. A adoção da tese externalista coloca em dúvida a suposição cartesiana de que temos acesso privilegiado aos conteúdos de nossos pensamentos, restringindo, assim, a autoridade da primeira pessoa. O externalismo perceptivo de Davidson, por exemplo, oferece uma solução ternária eu-intérprete-mundo para as origens do autoconhecimento. A tese de Davidson é apresentada como reconciliando o autoconhecimento e as idéias centrais do externalismo. São apresentados dois modelos da gênese externa do eu:1) os modelos ecológicos que propõem um desenvolvimento do sentido de eu como uma função das interações do eu com o ambiente; 2) o modelo psicológico de Winnicott que propõe a emergência do sentido de eu a partir de uma relação ternária entre o eu, os outros e os objetos transicionais. Defendemos a tese de que o modelo psicológico de Winnicott é o mais adequado para descrever a conceitualização epistemológica de Davidson das origens externalistas do autoconhecimento.

This study summarizes previously published and updated empirical relations for the estimation of production/biomass ratios in benthic invertebrates; of natural mortality in benthic invertebrates and finfish; and of respiration from production and vice versa in animal populations. AMS-EXCEL spreadsheet containing these equations is available from the author via Email. They are also included in the Ecopath with Ecosim software.
