La conformación de un estado unitario

La progresiva centralización y consiguiente constitución en nuestro país de un Estado unitario, aparece en primer término por desconstitucionalización progresiva, consistente en el vaciamiento de la forma “federal” o, si se quiere, de la “unión federativa” de nuestra Constitución, y su reemplazo por el unicato, o sea, el triunfo del mando unitario y centralizado. Nuestra configuración estadual se fundó sobre una tradición bifronte, como bien advirtió Alberdi en los capítulos XVII a XX de Las Bases, al reseñar los precedentes en uno u otro de dichos sentidos, así como los luctuosos enfrentamientos y guerras civiles en que ninguno había podido primar en forma definitiva sobre el otro, concluyendo que no era posible ni un régimen unitario ni uno federal puros, y de ahí su fórmula mixta de unión federativa, como solución para el intríngulis que planteaban las tradiciones encontradas de unidad y de localismo, con miras a un futuro de grandeza por construir...

Conflitos temporais entre os processos legislativos ordinário e orçamentário

Analisa a interdependência, com ênfase no aspecto temporal, entre o processo legislativo ordinário, bicameral, produtor de normas permanentes, com prazos impróprios, em que se avalia o mérito e o processo orçamentário, congressual, prazos constitucionais, expedito e conciso. São usados como exemplos o PL 7749/10, que fixa o subsídio dos Ministros do Supremo Tribunal Federal por ato administrativo autorizado na LDO, e o entendimento comum de considerar-se como lacuna da Proposta Orçamentária da União para 2011, PL 59/10-CN, Lei 12.381/11, conforme Nota Técnica CONOF/CD nº 13/2010, a ausência de valores referentes a proposições em tramitação no processo legislativo bicameral, produtor de cogência normativa sob a forma de despesas obrigatórias continuadas.

Transparência do orçamento público brasileiro : exame dos documentos orçamentários da União e uma proposta de estrutura para o Orçamento-Cidadão

Sugere medidas para o aperfeiçoamento da transparência do sistema orçamentário federal brasileiro. A partir de pesquisa exploratória busca relacionar o instituto do orçamento público aos conceitos de planejamento, participação popular, controle social, cidadania, accountability e democracia - relações que fundamentam a defesa da transparência orçamentária. Examina se são emitidos dez documentos orçamentários e avalia seus conteúdos. São eles: Declaração Pré-Orçamentária, Proposta de Orçamento do Executivo, Orçamento, Relatórios Mensais, Relatório Semestral, Relatório Anual, Relatório do Auditor, Relatório Pré-Eleitoral, Relatório Plurianual e Orçamento-Cidadão.

O novo pacto federativo: porque a apresentação de uma emenda possibilitou uma discussão na redefinição da Federação Brasileira

Estudo de caso que analisa a aprovação da emenda de plenário nº 387 de 2010, chamada de emenda Ibsen Pinheiro/Humberto Souto, que pretendeu redistribuir as riquezas advindas dos royalties do petróleo, a partir do estabelecimento de critérios de maior equalização como o da distribuição via Fundo de Participação de Estados e Municípios (FPE/FPM). A partir do entendimento segundo o qual tal aprovação se deu por causa da fragmentação (derrocada) do pacto federativo, dado a centralização histórica do processo de arrecadação tributária nas mãos da União, posição alcançada e motivada, diga-se de passagem, pela abdicação de Estados e Municípios do papel de principal arrecadador, se tornando atores secundários. O estudo argumenta que a principal dificuldade enfrentada pelos entes subnacionais é de ordem econômica e os desenhos constitucionais desde a promulgação da Constituição republicana de 1891, não foi capaz de dirimir tal situação. E mesmo com a promulgação da Constituição de 1988, chamada de a mais descentralizadora, uma melhor distribuição de recursos falhou em suas tentativas.

Essex Adult Community Learning: PTLLS for distance and blended learning

Funded by the LSIS Excellence and Improvement Fund, Essex Adult Community Learning has produced a distance/blended learning resource on CD-Rom for tutors in the post-16 sector to achieve the City & Guilds PTLLS (7303 Preparing to Teach in the Lifelong Learning Sector) at Level 4. The aim of the resource is to improve teaching and learning by providing a flexible way to access initial teacher training where candidates may otherwise find it difficult or impossible to attend a taught course. It is also intended to increase tutors' own e-learning skills.

Essex ACL - Broadening horizons with blended learning - technology toolkit for foreign language tutors

As part of an LSIS Regional Response Fund project, Essex Adult Community Learning (ACL) has created a toolkit. The toolkit provides training for foreign language tutors in producing digital resources which combine audio, video, text and communication activities. The toolkit which is now an integral part of a blended learning language course, has also developed tutors' skills in using technology for teaching and learning. The main aim has also been to provide an alternative and flexible method of delivery, especially where funding cuts have impacted on the cost of running taught courses.

Otley College: An Online toolkit for tutorials in rural- based FE – meeting new funding needs

As part of an LSIS Regional Response Fund project, Otley College has developed an online toolkit for one-to-one tutorials, based on research undertaken with practitioners and learners. The toolkit has been developed to meet the needs of students and tutors, and attempts to fulfil the requirement for tutorials within a new straightened funding agreement.

Proceedings fo the Seventeenth Annual Sea Turtle Symposium, 4-8 March 1997, Orlando, Florida, U.S.A.

The 17th Annual Sea Turtle Symposium was held at the Delta Orlando Resort in Orlando, Florida U.S.A. from March 4-8, 1997. The symposium was hosted by Florida Atlantic University, Mote Marine Laboratory, University of Central Florida, University of Florida, Florida Atlantic University and the Comité Nacional para la Conservación y Protección de las Totugas Marinas. The 17th was the largest symposium to date. A total of 720 participants registered, including sea turtle biologists, students, regulatory personnel, managers, and volunteers representing 38 countries. In addition to the United States, participants represented Australia, Austria, the Bahamas, Bonaire, Bermuda, Brazil, Canada, Colombia, Costa Rica, Croatia, Cuba, Cyprus, Dominican Republic, Ecuador, England, Guatemala, Greece, Honduras, India, Italy, Japan, Madagascar, Malaysia, Mexico, The Netherlands, Nicaragua, Peru, Philippines, Republic of Seychelles, Scotland, Spain, Sri Lanka, Switzerland, Taiwan, Turkey, Uruguay, and Venezuela. In addition to the 79 oral, 2 video, and 120 poster presentations, 3 workshops were offered: Selina Heppell (Duke University Marine Laboratory) provided “Population Modeling,” Mike Walsh and Sam Dover (Sea World-Orlando) conducted “Marine Turtle Veterinary Medicine” and “Conservation on Nesting Beaches” was offered by Blair Witherington and David Arnold (Florida Department of Environmental Protection). On the first evening, P.C.H. Pritchard delivered a thoughtful retrospect on Archie Carr that showed many sides of a complex man who studied and wrote about sea turtles. It was a presentation that none of us will forget. The members considered a number of resolutions at the Thursday business meeting and passed six. Five of these resolutions are presented in the Commentaries and Reviews section of Chelonian Conservation and Biology 2(3):442-444 (1997). The symposium was fortunate to have many fine presentations competing for the Archie Carr Best Student Presentations awards. The best oral presentation award went to Amanda Southwood (University of British Columbia) for “Heart rates and dive behavior of the leatherback sea turtle during the internesting interval.” The two runners-up were Richard Reina (Australian National University) for “Regulation of salt gland activity in Chelonia mydas” and Singo Minamikawa (Kyoto University) for “The influence that artificial specific gravity change gives to diving behavior of loggerhead turtles”. The winner of this year’s best poster competition was Mark Roberts (University of South Florida) for his poster entitled “Global population structure of green sea Turtles (Chelonia mydas) using microsatellite analysis of male mediated gene flow.” The two runners-up were Larisa Avens (University of North Carolina-Chapel Hill) for “Equilibrium responses to rotational displacements by hatchling sea turtles: maintaining a migratory heading in a turbulent ocean” and Annette Broderick (University of Glasgow) for “Female size, not length, is a correlate of reproductive output.” The symposium was very fortunate to receive a matching monetary and subscription gift from Anders J. G. Rhodin of the Chelonian Research Foundation. These enabled us to more adequately reward the fine work of students. The winners of the best paper and best poster awards received $400 plus a subscription to Chelonian Conservation and Biology. Each runner up received $100. The symposium owes a great debt to countless volunteers who helped make the meeting a success. Those volunteers include: Jamie Serino, Alan Bolton, and Karen Bjorndal, along with the UF students provided audio visual help, John Keinath chaired the student awards committee, Mike Salmon chaired the Program Commiteee, Sheryan Epperly and Joanne Braun compiled the Proceedings, Edwin Drane served as treasurer and provided much logistical help, Jane Provancha coordinated volunteers, Thelma Richardson conducted registration, Vicki Wiese coordinated food and beverage services, Jamie Serino and Erik Marin coordinated entertainment, Kenneth Dodd oversaw student travel awards, Traci Guynup, Tina Brown, Jerris Foote, Dan Hamilton, Richie Moretti, and Vicki Wiese served on the time and place committee, Blair Witherington created the trivia quiz, Tom McFarland donated the symposium logo, Deborah Crouse chaired the resolutions committee, Pamela Plotkin chaired the nominations committee, Sally Krebs, Susan Schenk, and Larry Wood conducted the silent auction, and Beverly and Tom McFarland coordinated all 26 vendors. Many individuals from outside the United States were able to attend the 17th Annual Sea Turtle Symposium thanks to the tireless work of Karen Eckert, Marydele Donnelly, and Jack Frazier in soliciting travel assistance for a number of international participants. We are indebted to those donating money to the internationals’ housing fund (Flo Vetter Memorial Fund, Marinelife Center of Juno Beach, Roger Mellgren, and Jane Provancha). We raise much of our money for international travel from the auction; thanks go to auctioneer Bob Shoop, who kept our auction fastpaced and entertaining, and made sure the bidding was high. The Annual Sea Turtle Symposium is unequaled in its emphasis on international participation. Through international participation we all learn a great deal more about the biology of sea turtles and the conservation issues that sea turtles face in distant waters. Additionally, those attending the symposium come away with a tremendous wealth of knowledge, professional contacts, and new friendships. The Annual Sea Turtle Symposium is a meeting in which pretenses are dropped, good science is presented, and friendly, open communication is the rule. The camaraderie that typifies these meetings ultimately translates into understanding and cooperation. These aspects, combined, have gone and will go a long way toward helping to protect marine turtles and toward aiding their recovery on a global scale. (PDF contains 342 pages)

M/V CONNECTED Coral Reef Restoration Monitoring Report, Monitoring Events 2004-2005. Florida Keys National Marine Sanctuary Monroe County, Florida

This document presents the results of the monitoring of a repaired coral reef injured by the M/V Connected vessel grounding incident of March 27, 2001. This grounding occurred in Florida state waters within the boundaries of the Florida Keys National Marine Sanctuary (FKNMS). The National Oceanic and Atmospheric Administration (NOAA) and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, (“State of Florida” or “state”) are the co-trustees for the natural resources within the FKNMS and, thus, are responsible for mediating the restoration of the damaged marine resources and monitoring the outcome of the restoration actions. The restoration monitoring program tracks patterns of biological recovery, determines the success of restoration measures, and assesses the resiliency to environmental and anthropogenic disturbances of the site over time. The monitoring program at the Connected site was to have included an assessment of the structural stability of installed restoration modules and biological condition of reattached corals performed on the following schedule: immediately (i.e., baseline), 1, 3, and 6 years after restoration and following a catastrophic event. Restoration of this site was completed on July 20, 2001. Due to unavoidable delays in the settlement of the case, the “baseline” monitoring event for this site occurred in July 2004. The catastrophic monitoring event occurred on August 31, 2004, some 2 ½ weeks after the passage of Hurricane Charley which passed nearby, almost directly over the Dry Tortugas. In September 2005, the year one monitoring event occurred shortly after the passage of Hurricane Katrina, some 70 km to the NW. This report presents the results of all three monitoring events. M/V WAVE WALKER Coral reef restoration baseline monitoring report – 2004 Florida Keys National Marine Sanctuary, Monroe County, Florida

This document presents the results of baseline monitoring of a repaired coral reef injured by the M/V Wave Walker vessel grounding incident of January 19, 2001. This grounding occurred in Florida state waters within the boundaries of the Florida Keys National Marine Sanctuary (FKNMS). The National Oceanic and Atmospheric Administration (NOAA) and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, (“State of Florida” or “state”) are the co-trustees for the natural resources within the FKNMS. This report documents the efficacy of the restoration effort, the condition of the restored reef area two year and four months post-effort, and provides a picture of surrounding reference areas, so as to provide a basis for future comparisons by which to evaluate the long-term success of the restoration. Die EU-Förderung der Fisch verarbeitenden Industrie und das EU-Datenerhebungsprogramm

A considerable amount of national EU funds for supporting fisheries has been transferred to the German fish processing in-dustry. The recently ratified European Fisheries Fund (EFF) again provides a significant sum. Yet the EU is lacking a data pool of sufficient precision, which is required as a basis to develop apt EU regulations in the future. Regulation No. 1639/2001 of the EU Commission commits the member states to collect these data. In this paper specifics of the data to be collected and the collection procedure are presented and linked to the CFP and to characteristics of the German fish processing industry.

Modern aquaculture practices for increased fish production in Nigeria

Various modern aquaculture practices applied in fish production especially in Asia are reviewed. The vast Nigerian aquatic medium of numerous water bodies like rivers, streams, lakes reservoirs, flood plains, irrigation canals, coastal swamps offer great potentials for aquaculture production, if optimally utilized. Constraints to modernization of aquaculture in Nigeria among other factors are: 1) a serious shortage of trained manpower; 2) lack of knowledge on profitability of aquaculture as an industry; 3) limited availability of fund (or capital); 4) non-recognition of indigenous trained aquaculture personnel; 5) inadequate data base on the biology and ecological requirements of endemic fish species with aquaculture potentials; 6) insufficient data on production and management techniques; and 7) lack of rational aquaculture development planning. Recommendations are made towards combating these constraints
