The inter-American human rights system has been conceived following the example of the European system under the European Convention on Human Rights (ECHR) before it was modified by Protocol No 11. However, two important differences exist. First, the authority of the European Court of Human Rights (ECtHR) to order reparation has been strictly limited by the principle of subsidiarity. Thus, the ECtHR's main function is to determine whether the ECHR has been violated. Beyond the declaratory effect of its judgments, according to Article 41 ECHR, it may only "afford just satisfaction to the injured party". The powers of the Inter-American Court of Human Rights (IACtHR) were conceived in a much broader fashion in Article 63 of the American Convention on Human Rights (ACHR), giving the Court the authority to order a variety of individual and general measures aimed at obtaining restitutio in integrum. The first main part of this thesis shows how both Courts have developed their reparation practice and examines the advantages and disadvantages of each approach. Secondly, the ECtHR's rather limited reparation powers have, interestingly, been combined with an elaborate implementation system that includes several of the Council of Europe's organs, principally the Committee of Ministers. In the Inter-American System, no dedicated mechanism was implemented to oversee compliance with the IACtHR's judgments. The ACHR limits itself to inviting the Court to point out in its annual reports the cases that have not been complied with and to propose measures to be adopted by the General Assembly of the Organization of American States. The General Assembly, however, hardly ever took action. The IACtHR has therefore filled this gap by developing a proper procedure to oversee compliance with its judgments. Both the European and the American solutions to ensure compliance are presented and compared in the second main part of this thesis. Finally, based on the results of both main parts, a comparative analysis of the reparation practice and the execution results in both human rights systems is being provided, aimed at developing proposals for the improvement of the functioning of either human rights protection system.

Il concetto di inflazione e' stato introdotto nei primi anni ’80 per risolvere alcuni problemi del modello cosmologico standard, quali quello dell’orizzonte e quello della piattezza. Le predizioni dei piu' semplici modelli inflazionari sono in buon accordo con le osservazioni cosmologiche piu'recenti, che confermano sezioni spaziali piatte e uno spettro di fluttuazioni primordiali con statistica vicina a quella gaussiana. I piu' recenti dati di Planck, pur in ottimo accordo con una semplice legge di potenza per lo spettro a scale k > 0.08 Mpc−1 , sembrano indicare possibili devi- azioni a scale maggiori, seppur non a un livello statisticamente significativo a causa della varianza cosmica. Queste deviazioni nello spettro possono essere spiegate da modelli inflazionari che includono una violazione della condizione di lento rotolamento (slow-roll ) e che hanno precise predizioni per lo spettro. Per uno dei primi modelli, caratterizzato da una discontinuita' nella derivata prima del potenziale proposto da Starobinsky, lo spettro ed il bispettro delle fluttuazioni primordiali sono noti analiticamente. In questa tesi estenderemo tale modello a termini cinetici non standard, calcolandone analiticamente il bispettro e confrontando i risultati ottenuti con quanto presente in letteratura. In particolare, l’introduzione di un termine cinetico non standard permettera' di ottenere una velocita' del suono per l’inflatone non banale, che consentira' di estendere i risultati noti, riguardanti il bispettro, per questo modello. Innanzitutto studieremo le correzioni al bispettro noto in letteratura dovute al fatto che in questo caso la velocita' del suono e' una funzione dipendente dal tempo; successivamente, cercheremo di calcolare analiticamente un ulteriore contributo al bispettro proporzionale alla derivata prima della velocita' del suono (che per il modello originale e' nullo).

I Big Data hanno forgiato nuove tecnologie che migliorano la qualità della vita utilizzando la combinazione di rappresentazioni eterogenee di dati in varie discipline. Occorre, quindi, un sistema realtime in grado di computare i dati in tempo reale. Tale sistema viene denominato speed layer, come si evince dal nome si è pensato a garantire che i nuovi dati siano restituiti dalle query funcions con la rapidità in cui essi arrivano. Il lavoro di tesi verte sulla realizzazione di un’architettura che si rifaccia allo Speed Layer della Lambda Architecture e che sia in grado di ricevere dati metereologici pubblicati su una coda MQTT, elaborarli in tempo reale e memorizzarli in un database per renderli disponibili ai Data Scientist. L’ambiente di programmazione utilizzato è JAVA, il progetto è stato installato sulla piattaforma Hortonworks che si basa sul framework Hadoop e sul sistema di computazione Storm, che permette di lavorare con flussi di dati illimitati, effettuando l’elaborazione in tempo reale. A differenza dei tradizionali approcci di stream-processing con reti di code e workers, Storm è fault-tolerance e scalabile. Gli sforzi dedicati al suo sviluppo da parte della Apache Software Foundation, il crescente utilizzo in ambito di produzione di importanti aziende, il supporto da parte delle compagnie di cloud hosting sono segnali che questa tecnologia prenderà sempre più piede come soluzione per la gestione di computazioni distribuite orientate agli eventi. Per poter memorizzare e analizzare queste moli di dati, che da sempre hanno costituito una problematica non superabile con i database tradizionali, è stato utilizzato un database non relazionale: HBase.

In the field of computer assisted orthopedic surgery (CAOS) the anterior pelvic plane (APP) is a common concept to determine the pelvic orientation by digitizing distinct pelvic landmarks. As percutaneous palpation is - especially for obese patients - known to be error-prone, B-mode ultrasound (US) imaging could provide an alternative means. Several concepts of using ultrasound imaging to determine the APP landmarks have been introduced. In this paper we present a novel technique, which uses local patch statistical shape models (SSMs) and a hierarchical speed of sound compensation strategy for an accurate determination of the APP. These patches are independently matched and instantiated with respect to associated point clouds derived from the acquired ultrasound images. Potential inaccuracies due to the assumption of a constant speed of sound are compensated by an extended reconstruction scheme. We validated our method with in-vitro studies using a plastic bone covered with a soft-tissue simulation phantom and with a preliminary cadaver trial.

In many cases, it is not possible to call the motorists to account for their considerable excess in speeding, because they deny being the driver on the speed-check photograph. An anthropological comparison of facial features using a photo-to-photo comparison can be very difficult depending on the quality of the photographs. One difficulty of that analysis method is that the comparison photographs of the presumed driver are taken with a different camera or camera lens and from a different angle than for the speed-check photo. To take a comparison photograph with exactly the same camera setup is almost impossible. Therefore, only an imprecise comparison of the individual facial features is possible. The geometry and position of each facial feature, for example the distances between the eyes or the positions of the ears, etc., cannot be taken into consideration. We applied a new method using 3D laser scanning, optical surface digitalization, and photogrammetric calculation of the speed-check photo, which enables a geometric comparison. Thus, the influence of the focal length and the distortion of the objective lens are eliminated and the precise position and the viewing direction of the speed-check camera are calculated. Even in cases of low-quality images or when the face of the driver is partly hidden, good results are delivered using this method. This new method, Geometric Comparison, is evaluated and validated in a prepared study which is described in this article.

Acousto-optic modulators are widely used for rapid switching and shuttering of laser beams. In many applications, the concomitant frequency shift is undesirable and must be compensated for elsewhere in the system. Here we present a simple method of achieving rapid laser power switching without an accompanying laser frequency shift. The demonstrated acousto-optic shutter achieves a switching time of around 25 ns, an extinction ratio of 46 dB, and efficiency comparable to a conventional double-pass acousto-optical modulator configuration. High-speed imaging directly correlates the propagation of a particular shear band with mechanical measurements during uniaxial compression of a bulk metallic glass. Imaging shows shear occurs simultaneously over the entire shear plane, and load data, synced and time-stamped to the same clock as the camera, reveal that shear sliding is coincident with the load drop of each serration. Digital image correlation agrees with these results. These data demonstrate that shear band sliding occurs with velocities on the order of millimeters per second. Fracture occurs much more rapidly than the shear banding events, thereby readily leading to melting on fracture surfaces.

Rotary blood pumps (RBPs) running at a constant speed are routinely used for the mechanical support of the heart in various clinical applications, from short-term use in heart-lung machines to long-term support of a failing heart. Their operating range is delineated by suction and regurgitation events, leaving limited control on the cardiac workload. This study investigates whether different ratios of systolic/diastolic support are advantageous over a constant-speed operation.

This thesis examines two panel data sets of 48 states from 1981 to 2009 and utilizes ordinary least squares (OLS) and fixed effects models to explore the relationship between rural Interstate speed limits and fatality rates and whether rural Interstate speed limits affect non-Interstate safety. Models provide evidence that rural Interstate speed limits higher than 55 MPH lead to higher fatality rates on rural Interstates though this effect is somewhat tempered by reductions in fatality rates for roads other than rural Interstates. These results provide some but not unanimous support for the traffic diversion hypothesis that rural Interstate speed limit increases lead to decreases in fatality rates of other roads. To the author’s knowledge, this paper is the first econometric study to differentiate between the effects of 70 MPH speed limits and speed limits above 70 MPH on fatality rates using a multi-state data set. Considering both rural Interstates and other roads, rural Interstate speed limit increases above 55 MPH are responsible for 39,700 net fatalities, 4.1 percent of total fatalities from 1987, the year limits were first raised, to 2009.

The group presents an analysis of the development of the Czech society and economy during the 1990s. They believe that the Czech neo-liberal strategy of transformation led to a partial and uneven modernisation and that this strategy is unable to provide a firm basis for a complex process of modernisation. The increasing developmental problems encountered during 1996-1999 can be seen as empirical evidence of the inadequacy of the neo-liberal transformation strategy. These problems are connected to institutional shortcomings due to the excessive speed of privatisation, its form with certain important Czech innovations (particularly the voucher method and an attempt to resuscitate the Czech national capital) and with the overlooking of the importance of the legal framework and its enforcement. The overly hasty privatisation has created a type of 'recombinant property' which lacks the economic order necessary to stimulate efficiency in an atmosphere of prevailing social justice. A second reason for the present difficulties is the long-term lag behind the civilisation and cultural standards typical of the advanced European countries. The first steps of the Czech transformation concentrated mainly on changes in the institutions important for the distribution of power and wealth and largely neglected the necessity of deep-reaching modernisation of Czech society and the economy. The neo-liberal strategy created conditions conducive to predatory and speculative behaviour at the expense of creative behaviour. Inherited principles of egalitarianism combined with undeserved economic privileges survived and were reinforced by important new developments in the same direction. This situation hinders the assertion of meritocratic motivations. The group advocates the development and implementation of a complex strategy of modernisation based on deliberate reforms, institutional changes and restructuring on the basis of strategic planning, and structural and regional policies which stress the role of cultivation of the institutional order and of the most important factors of economic growth and development.

BACKGROUND: New equipment and techniques in winter sports, such as carving skis and snowboards, have brought up new trauma patterns into the spectrum of leisure trauma. The injuries resemble high-energy trauma known from road crashes. The aim of the present study was to assess the incidence of acute traumatic descending aortic rupture in recreational skiing-crashes. MATERIAL: Between January 1995 and December 2004, 22 patients were admitted to our hospital for aortic rupture. Four patients had skiing crashes (18.2%). Mean age was 31 years, all patients were male. In two cases, aortic rupture was associated with fractures of the upper and lower extremities. One patient additionally had a cerebral contusion with an initial Glasgow Coma Scale score of 13. In two patients, isolated aortic rupture was diagnosed. RESULTS: Two patients were treated by graft interposition, and one by endograft. One patient arrived under mechanical resuscitation without blood pressure. He died at admission. He had been observed for 5 hours in another hospital, complaining of severe intrascapular back pain, before transport to our trauma unit for unknown bleeding. In the other three cases, treatment was successful. CONCLUSION: Rescue services and paramedics should be aware of this new type of injury. Acute aortic rupture has to be considered as possible injury in high velocity skiing crashes.
