Structuralism is a theory of U.S. constitutional adjudication according to which courts should seek to improve the decision-making process of the political branches of government so as to render it more democratic.1 In words of John Hart Ely, courts should exercise their judicial-review powers as a ‘representation-reinforcing’ mechanism.2 Structuralism advocates that courts must eliminate the elements of the political decision-making process that are at odds with the structure set out by the authors of the U.S. Constitution. The advantage of this approach, U.S. scholars posit, lies in the fact that it does not require courts to second-guess the policy decisions adopted by the political branches of government. Instead, they limit themselves to enforcing the constitutional structure within which those decisions must be adopted. Of course, this theory of constitutional adjudication, like all theories, has its shortcomings. For example, detractors of structuralism argue that it is difficult, if not impossible, to draw the dividing line between ‘substantive’ and ‘structural’ matters.3 In particular, they claim that, when identifying the ‘structure’ set out by the authors of the U.S. Constitution, courts necessarily base their determinations not on purely structural principles, but on a set of substantive values, evaluating concepts such as democracy, liberty and equality. 4 Without claiming that structuralism should be embraced by the ECJ as the leading theory of judicial review, the purpose of my contribution is to explore how recent case-law reveals that the ECJ has also striven to develop guiding principles which aim to improve the way in which the political institutions of the EU adopt their decisions. In those cases, the ECJ decided not to second-guess the appropriateness of the policy choices made by the EU legislator. Instead, it preferred to examine whether, in reaching an outcome, the EU political institutions had followed the procedural steps mandated by the authors of the Treaties. Stated simply, I argue that judicial deference in relation to ‘substantive outcomes’ has been counterbalanced by a strict ‘process review’. To that effect, I would like to discuss three recent rulings of the ECJ, delivered after the entry into force of the Treaty of Lisbon, where an EU policy measure was challenged indirectly, i.e. via the preliminary reference procedure, namely Vodafone, Volker und Markus Schecke and Test-Achats.5 Whilst in the former case the ECJ ruled that the questions raised by the referring court disclosed no factor of such a kind as to affect the validity of the challenged act, in the latter cases the challenged provisions of an EU act were declared invalid.

How has the integration of trade policy and negotiating authority in Europe affected the external bargaining capabilities of the European Community (EC)? This paper analyzes the bargaining constraints and opportunities for the EC created by the obligation to negotiate as a single entity. The nature of demands in external~ the voting rules at the EC level, and the amount of autonomy exercised by EC negotiators contribute to explaining, this paper argues, whether the EC gains some external bargaining clout from its internal divisions and whether the final international agreement reflects the position of the median or the extreme countries in the Community. The Uruguay Round agricultural negotiations illustrate the consequences of the EC's institutional structure on its external bargaining capabilities. Negotiations between the EC and the U.S. were deadlocked for six years because the wide gap among the positions of the member states at the start of the Uruguay Round had prevented the EC from making sufficient concessions. The combination of a weakened unanimity rule and greater autonomy seized by Commission negotiators after the May 1992 reform of the Common Agricultural Policy made possible the conclusion of an EC-U.S. agricultural agreement. Although the majority of member states supported the Blair House agreement, the reinstating of the veto power in the EC and the tighter member states' control over the Commission eventually resulted in a renegotiation of the U.S.-EC agreement tilted in favor of France, the most recalcitrant country.

Apatite (U-Th-Sm)/He (AHe) thermochronology is increasingly used for reconstructing geodynamic processes of the upper crust and the surface. Results of AHe thermochronology, however, are often in conflict with apatite fission track (AFT) thermochronology, yielding an inverted age-relationship with AHe dates older than AFT dates of the same samples. This effect is mainly explained by radiation damage of apatite, either impeding He diffusion or causing non-thermal annealing of fission tracks. So far, systematic age inversions have only been described for old and slowly cooled terranes, whereas for young and rapidly cooled samples 'too old' AHe dates are usually explained by the presence of undetected U and/or Th-rich micro-inclusions. We report apatite (U-Th-Sm)/He results for rapidly cooled volcanogenic samples deposited in a deep ocean environment with a relatively simple post-depositional thermal history. Robust age constraints are provided independently through sample biostratigraphy. All studied apatites have low U contents (< 5 ppm on average). While AFT dates are largely in agreement with deposition ages, most AHe dates are too old. For leg 43, where deposition age of sampled sediment is 26.5-29.5 Ma, alpha-corrected average AHe dates are up to 45 Ma, indicating overestimations of AHe dates up to 50%. This is explained by He implantation from surrounding host U-Th rich sedimentary components and it is shown that AHe dates can be "corrected" by mechanically abrading the outer part of grains. We recommend that particularly for low U-Th-apatites the possibility of He implantation should be carefully checked before considering the degree to which the alpha-ejection correction should be applied.

New U-series isotope data for lavas from the East Scotia backarc spreading center span a large range in (230Th/232Th) and (238U/232Th). Most of the backarc lavas have (238U/230Th) < 1, similar to the composition of mid-oceanic-ridge basalts (MORB). Lavas from two segments have (238U/230Th) > 1 and are enriched in fluid-mobile elements, implying a recent addition of a U-rich slab-derived component. The data from one segment suggest an influence from an aqueous fluid from altered MORB, whereas samples from the other slab-influenced segment show addition of a sediment melt. The slab-influenced samples form a distinct trend in the equiline diagram between aqueous fluid and sediment melt that is suggested to be a mixing line rather than an isochron.

On Vermilion Sea Expedition two research vessels among which the R/V Spencer F. Baird conducted a geological and geophysical exploration of the Gulf of California from February to May, 1959. Support was obtained from the Office of Naval Research and the Bureau of Ships of the U. S. Navy and from a grant of the American Petroleum Institute. Study of the canyons was one feature of the first part of the expedition. Submarine canyon studies were directed by Francis P. Shepard, Professor of Submarine Geology, aboard the research vessel Spencer F. Baird. The expedition found that the narrow channel between Angel de la Guarda Island, toward the head of the Gulf, and the peninsula is scoured almost free of sediments by strong currents. On the other side of Angel de la Guarda Island, between it and the mainland, one of the dredge hauls brought up a manganese nodule. It came from a depth of approximately 1500 feet. This is the shallowest water in which the nodules have been found. Studies have been under way some time on the feasibility of mining such nodules from the sea floor. They contain cobalt, nickel, copper and other valuable metals. The radioactivity of bottom sediments has been but little investigated. Data published by Joly, Pettersson, Piggot and Iimori refer to determinations of radium, contained mainly in oceanic deep-water sediments in red clays, radiolarian, globigerina oozes, blue muds and manganese concretions. The determinations have shown the manganese concretions to be richest as regards content of radium (up to 10-8 per cent); red clays and radiolarian ooze also possess a rather high content of radium. Other types of sediments are less rich in radium.
