En la presente investigación sobre la interculturalidad de la libertad y la pena privativa de la libertad, existieron dificultades, por una parte, no encontramos literatura sea occidental o andina que se hayan preocupado por este diálogo; y, por otra, existen trabajos que ven a las dos filosofías en fase descriptiva. Por lo cual nuestro objetivo, en los dos primeros capítulos, fue efectuar una descripción y construcción, qué es y cómo se entiende la libertad y la pena en cada una de estas filosofías o culturas; nos encontramos con abundante construcción occidental frente a la escasa entrega de la construcción andina, es una de las dificultades, en consecuencia, los argumentos que se pudieron entregar se sustentan en las interpretaciones de los autores en su mayoría indígenas como Ilaquiche, Tibán, Llasag y en Catherine Walsh, Esther Sánchez Botero, Elisa Cruz y Joseph Estermann quienes justifican la existencia de la comunidad, del derecho indígena, los derechos colectivos, administración de justicia. Hacen un enunciado de una interculturalidad crítica, pero no profundizan como construir la misma. Una vez descritos los temas, en el tercer capítulo, fue realizar el diálogo, en todas las fuentes consultadas ninguna explicaba cómo hacerlo, excepto el maestro Boaventura de Sousa Santos con su hermenéutica diatópica. Con sus explicaciones y ejemplos propuestos, se hizo un esfuerzo que todavía no llena las expectativas, pero constituye en una breve aproximación al debate que significa el repensar nuestra forma de vivir, entender e interpretar el mundo en el cual vivimos con la existencia de varias culturas. La investigación sobre el tema propuesto llena un vacío de los tantos existentes en el campo de la bibliografía jurídica constitucional de nuestro país, y por lo pronto las líneas trazadas colaboran con el debate y la construcción de la interculturalidad.

Este estudio trata sobre el descubrimiento de la verdad, a partir de la prueba, como instrumento fundamental para lograr convicción en la mente de una autoridad administrativa o judicial. Para ello, revisa su importancia en el tiempo de Antíloco y Menelao, en el juicio de Sócrates y la resolución de pleitos entre el Estado y los ciudadanos romanos respecto de sus tributos en épocas antiguas, hasta la adopción del Modelo del Código Tributario para América Latina, pues, ya en nuestros días, estudiosos de la materia tributario sostienen al menos dos teorías: 1. que el tema de la prueba en materia tributario es escaso y se debe acudir a los elementos normativos de esta prueba regulados en el propio Código Tributario para la sede contenciosa, y 2. que en materia administrativa tributaria se debe acudir a todos los medios probatorios determinados por la ley en sentido general. La autora se detiene en el estudio de la aplicación de los elementos de la prueba civil en materia administrativa tributaria, al tiempo que compara el tratamiento de las mismas reglas en vía contenciosa, así como las garantías y principios constitucionales que la atraviesan. Finalmente, explica qué se comprende por procedimiento administrativo tributario, cuáles son los medios de prueba aplicables, a quién le corresponde probar y qué sistema es viable para la valoración de la prueba en materia tributaria.

El presente trabajo se centra en el análisis de los conflictos que giraron en torno a las operaciones de compra de esclavos en el nororiente neogranadino durante el siglo XVIII. Legalizaciones aplazadas, ventas desautorizadas, pagos pendientes, esclavos hipotecados y confusiones sobre el estado real del esclavo comercializado fueron situaciones que desataron enconadas disputas y pleitos judiciales que terminaron algunas veces con la declaratoria de redhibitoria, es decir, la anulación del contrato de venta y la devolución del esclavo. En vista de estos antecedentes, y con un ánimo preventivo, los negociantes se aseguraron de fijar en las escrituras de compraventa ciertas garantías o aclaraciones para no verse involucrados en tales litigios.

Nutrient cycles link agricultural systems to their societies and surroundings; inputs of nitrogen and phosphorus in particular are essential for high crop yields, but downstream and downwind losses of these same nutrients diminish environmental quality and human well-being. Agricultural nutrient balances differ substantially with economic development, from inputs that are inadequate to maintain soil fertility in parts of many developing countries, particularly those of sub-Saharan Africa, to excessive and environmentally damaging surpluses in many developed and rapidly growing economies. National and/or regional policies contribute to patterns of nutrient use and their environmental consequences in all of these situations. Solutions to the nutrient challenges that face global agriculture can be informed by analyses of trajectories of change within, as well as across, agricultural systems.

The western Pacific subtropical high (WPSH) is closely related to Asian climate. Previous examination of changes in the WPSH found a westward extension since the late 1970s, which has contributed to the inter-decadal transition of East Asian climate. The reason for the westward extension is unknown, however. The present study suggests that this significant change of WPSH is partly due to the atmosphere's response to the observed Indian Ocean-western Pacific (IWP) warming. Coordinated by a European Union's Sixth Framework Programme, Understanding the Dynamics of the Coupled Climate System (DYNAMITE), five AGCMs were forced by identical idealized sea surface temperature patterns representative of the IWP warming and cooling. The results of these numerical experiments suggest that the negative heating in the central and eastern tropical Pacific and increased convective heating in the equatorial Indian Ocean/ Maritime Continent associated with IWP warming are in favor of the westward extension of WPSH. The SST changes in IWP influences the Walker circulation, with a subsequent reduction of convections in the tropical central and eastern Pacific, which then forces an ENSO/Gill-type response that modulates the WPSH. The monsoon diabatic heating mechanism proposed by Rodwell and Hoskins plays a secondary reinforcing role in the westward extension of WPSH. The low-level equatorial flank of WPSH is interpreted as a Kelvin response to monsoon condensational heating, while the intensified poleward flow along the western flank of WPSH is in accord with Sverdrup vorticity balance. The IWP warming has led to an expansion of the South Asian high in the upper troposphere, as seen in the reanalysis.

Ancient DNA (aDNA) research has long depended on the power of PCR to amplify trace amounts of surviving genetic material from preserved specimens. While PCR permits specific loci to be targeted and amplified, in many ways it can be intrinsically unsuited to damaged and degraded aDNA templates. PCR amplification of aDNA can produce highly-skewed distributions with significant contributions from miscoding lesion damage and non-authentic sequence artefacts. As traditional PCR-based approaches have been unable to fully resolve the molecular nature of aDNA damage over many years, we have developed a novel single primer extension (SPEX)-based approach to generate more accurate sequence information. SPEX targets selected template strands at defined loci and can generate a quantifiable redundancy of coverage; providing new insights into the molecular nature of aDNA damage and fragmentation. SPEX sequence data reveals inherent limitations in both traditional and metagenomic PCR-based approaches to aDNA, which can make current damage analyses and correct genotyping of ancient specimens problematic. In contrast to previous aDNA studies, SPEX provides strong quantitative evidence that C U-type base modifications are the sole cause of authentic endogenous damage-derived miscoding lesions. This new approach could allow ancient specimens to be genotyped with unprecedented accuracy.

A series of fourteen novel pyrrole monomers substituted at the 3-position with aliphatic and aromatic crown-ether moieties have been synthesised in good yield and characterised extensively. Several of these compounds were electropolymerised successfully in acetonitrile, using both potentiostatic and galvanostatic modes and the electrochemical properties of those systems were studied via cyclic voltammetry in aqueous and organic media. Novel crown-ether substituted polypyrrole derivatives revealed reversible redox couples in LiClO4/CH3CN (0.1 M). The morphology of these novel crown-ether substituted polypyrrole derivatives was characterised by scanning electron microscopy. These polymers exhibited an open porous structure and half the charge was required when compared to polypyrrole to afford films of equal thickness. The mass change during polymerisation was followed by electrochemical quartz crystal microbalance measurement, and the rate of polymer growth was found to be nonlinear when compared to polypyrrole. Using the technique of liquid crystal templating a rotating disc electrode (RDE) was modified with a high surface area mesoporous platinum film. The surface area of the electrode was characterised by acid voltammetry, and found to be very high (ca. 86 cm(2)). Acid characterisation of the electrode produced distorted voltammograms was interpreted as being due to the extremely large surface area which produced a combination of effects such as localised pH change within the pore environment and also ohmic drop effects. Acid voltammetry in the presence of two different types of surfactant, namely Tween 20 and Triton X-100, suggested antifouling properties associated with the mesoporous deposit. Further analysis of the modified electrode using a redox couple in solution showed typical RDE behaviour although extra capacitive currents were observed due to the large surface area of the electrode. The phenomenon of underpotential deposition was exploited for the purpose of anodic stripping voltammetry and results were compared with data collected for microelectrodes. Underpotential deposition of metal ions at the mesoporous RDE was found to be similar to that at conventional platinum electrodes and mesoporous microelectrodes although the rate of surface coverage was found to be slower at a mesoporous RDE. It was found that a mesoporous RDE forms a suitable system for quantification of silver ions in solution.

Using the technique of liquid crystal templating a series of high surface area mesoporous platinum microelectrodes was fabricated. The underpotential deposition of metal ions at such electrodes was found to be similar to that at conventional platinum electrodes. The phenomena of underpotential deposition, in combination with the intrinsic properties of mesoporous microelectrodes (i.e. a high surface area and efficient mass transport) was exploited for the purpose of anodic stripping voltammetry. In particular the underpotential deposition of Ag+, Pb2+ and Cu2+ ions was investigated and it was found that mesoporous microelectrodes were able to quantify the concentration of ions in solution down to the ppb range. The overall behaviour of the mesoporous electrodes was found to be superior to that of conventional microelectrodes and the effects of interference by surfactants were minimal.

In this study was analyzed the effect of crop year and harvesting time on the fatty acid composition of cv. Picual virgin olive oil. The study was carried out during the fruit ripening period for three crop seasons. The mean fatty acid composition of Picual oils was determined. The oils contained palmitic acid (11.9%), oleic acid (79.3%), and linoleic acid (2.95%). The content of palmitic acid and saturated fatty acids decreased during fruit ripening while oleic and linoleic acids increased. The amount of stearic and linolenic acids decreased. The amount of saturated acids, palmitic and stearic, and the polyunsaturated acids linoleic and linolenic was dependent on the time of harvest, whereas the amount of oleic acid varied with the crop year. The differences observed between crop years for both palmitic and linoleic acid may be explained by the differences in the temperature during oil biosynthesis and by the amount of summer rainfall for oleic acid content. A significant relationship was observed between the MUFA/PUFA ratio and the oxidative stability measured by the Rancimat method.

Olive fruits of three of the most important Spanish and Italian cultivars, 'Picual', `Hojiblanca' and 'Frantoio', were harvested at bi-weekly periods during three crop seasons to study their development and ripening process. Fresh and dry weights and ripening index were determined for fruit, while dry matter, oil and moisture contents were determined in both fruit and pulp (flesh). Fruit growth rate and oil accumulation were calculated. Each olive cultivar showed a different ripening pattern, 'Hojiblanca' being the last one to maturate. Fruit weight increased, decreasing its growth rate from the middle of November. Dry matter and moisture contents decreased during ripening in pulp and fruit, 'Hojiblanca' showing the highest values for both. Oil content, when expressed on a fresh weight basis, increased in all cultivars, although for the last time period showed variations due to climatic conditions. During ripening, oil content on a dry weight basis increased in fruit, but oil biosynthesis in flesh ceased from November. Olive fruits presented lower oil and higher dry matter contents in the year of lowest rainfall. Therefore fruit harvesting should be carried out from the middle of November in order to obtain the highest oil yield and avoid natural fruit drop. (C) 2004 Society of Chemical Industry.

The effect of fruit ripeness on the antioxidant content of 'Hojiblanca' virgin olive oils was studied. Seasonal changes were monitored at bi-weekly intervals for three consecutive crop years. Phenolic content, tocopherol composition, bitterness index, carotenoid and chlorophyllic pigments and oxidative stability were analysed. In general, the antioxidants and the related parameters decreased as olive fruit ripened. The phenolics and bitterness, closely related parameters, did not present significant differences among years. Although in general, the tocopherols decreased during olive ripening gamma-tocopherol increased. Differences between crop years were found only for total tocopherols and alpha-tocopherol, which showed higher content in low rainfall year oils. The pigment content decreased during ripening, chlorophyll changing faster. For low rainfall years, the level of pigments was higher, reaching significant differences between yields. Significant differences among years were found for oil oxidative stability; higher values were obtained for drought years. A highly significant prediction model for oxidative stability has been obtained. (C) 2004 Elsevier Ltd. All rights reserved.
