À une époque où l'immigration internationale est de plus en plus difficile et sélective, le statut de réfugié constitue un bien public précieux qui permet à certains non-citoyens l'accès et l'appartenance au pays hôte. Reposant sur le jugement discrétionnaire du décideur, le statut de réfugié n’est accordé qu’aux demandeurs qui établissent une crainte bien fondée de persécution en cas de retour dans leur pays d'origine. Au Canada, le plus important tribunal administratif indépendant, la Commission de l'immigration et du statut de réfugié du Canada (CISR), est chargé d’entendre les demandeurs d'asile et de rendre des décisions de statut de réfugié. Cette thèse cherche à comprendre les disparités dans le taux d’octroi du statut de réfugié entre les décideurs de la CISR qui sont politiquement nommés. Au regard du manque de recherches empiriques sur la manière avec laquelle le Canada alloue les possibilités d’entrée et le statut juridique pour les non-citoyens, il était nécessaire de lever le voile sur le fonctionnement de l’administration sur cette question. En explorant la prise de décision relative aux réfugiés à partir d'une perspective de Street Level Bureaucracy Theory (SLBT) et une méthodologie ethnographique qui combine l'observation directe, les entretiens semi-structurés et l'analyse de documents, l'étude a d'abord cherché à comprendre si la variation dans le taux d’octroi du statut était le résultat de différences dans les pratiques et le raisonnement discrétionnaires du décideur et ensuite à retracer les facteurs organisationnels qui alimentent les différences. Dans la lignée des travaux de SLBT qui documentent la façon dont la situation de travail structure la discrétion et l’importance des perceptions individuelles dans la prise de décision, cette étude met en exergue les différences de fond parmi les décideurs concernant les routines de travail, la conception des demandeurs d’asile, et la meilleure façon de mener leur travail. L’analyse montre comment les décideurs appliquent différentes approches lors des audiences, allant de l’interrogatoire rigide à l’entrevue plus flexible. En dépit des contraintes organisationnelles qui pèsent sur les décideurs pour accroître la cohérence et l’efficacité, l’importance de l’évaluation de la crédibilité ainsi que l’invisibilité de l’espace de décision laissent suffisamment de marge pour l’exercice d’un pouvoir discrétionnaire. Même dans les environnements comme les tribunaux administratifs où la surabondance des règles limite fortement la discrétion, la prise de décision est loin d’être synonyme d’adhésion aux principes de neutralité et hiérarchie. La discrétion est plutôt imbriquée dans le contexte de routines d'interaction, de la situation de travail, de l’adhésion aux règles et du droit. Même dans les organisations qui institutionnalisent et uniformisent la formation et communiquent de façon claire leurs demandes aux décideurs, le caractère discrétionnaire de la décision est par la nature difficile, voire impossible, à contrôler et discipliner. Lorsqu'ils sont confrontés à l'ambiguïté des objectifs et aux exigences qui s’opposent à leur pouvoir discrétionnaire, les décideurs réinterprètent la définition de leur travail et banalisent leurs pratiques. Ils formulent une routine de rencontre qui est acceptable sur le plan organisationnel pour évaluer les demandeurs face à eux. Cette thèse montre comment les demandeurs, leurs témoignages et leurs preuves sont traités d’une manière inégale et comment ces traitements se répercutent sur la décision des réfugiés.

Plusieurs problèmes liés à l'utilisation de substances et méthodes interdites de dopage dans les sports posent de grands défis à la gouvernance antidopage. Afin de lutter contre le dopage, certains pays ont mis en oeuvre des cadres juridiques basés exclusivement sur le droit pénal tandis que d'autres pays ont plutôt misé sur des mécanismes et organismes spécialisés trouvant fondement en droit privé ou sur un régime hybride de droit public et privé. Ces différentes approches réglementaires ont pour conséquence de faire en sorte qu’il est très difficile de lutter efficacement contre le dopage dans les sports, notamment parce que leur exécution requiert un degré de collaboration internationale et une participation concertée des autorités publiques qui est difficile à mettre en place. À l’heure actuelle, on peut par exemple observer que les États n’arrivent pas à contrer efficacement la participation des syndicats et organisations transnationales liés au crime organisé dans le marché du dopage, ni à éliminer des substances et méthodes de dopage interdites par la réglementation. Par ailleurs, la gouvernance antidopage basée sur les règles prescrites par l’Agence mondiale antidopage prévoit des règles et des normes distinctes de dopage distinguant entre deux catégories de personnes, les athlètes et les autres, plaçant ainsi les premiers dans une position désavantageuse. Par exemple, le standard de responsabilité stricte sans faute ou négligence imposé aux athlètes exige moins que la preuve hors de tout doute raisonnable et permet l'utilisation de preuves circonstancielles pour établir la violation des règles antidopages. S'appliquant pour prouver le dopage, ce standard mine le principe de la présomption d'innocence et le principe suivant lequel une personne ne devrait pas se voir imposer une peine sans loi. D’ailleurs, le nouveau Code de 2015 de l’Agence attribuera aux organisations nationales antidopage (ONADs) des pouvoirs d'enquête et de collecte de renseignements et ajoutera de nouvelles catégories de dopage non-analytiques, réduisant encore plus les droits des athlètes. Dans cette thèse, nous discutons plus particulièrement du régime réglementaire de l’Agence et fondé sur le droit privé parce qu’il ne parvient pas à répondre aux besoins actuels de gouvernance mondiale antidopage. Nous préconisons donc l’adoption d’une nouvelle approche de gouvernance antidopage où la nature publique et pénale mondiale du dopage est clairement reconnue. Cette reconnaissance combiné avec un modèle de gouvernance adapté basé sur une approche pluraliste du droit administratif global produira une réglementation et une administration antidopage mieux acceptée chez les athlètes et plus efficace sur le plan des résultats. Le nouveau modèle de gouvernance que nous proposons nécessitera toutefois que tous les acteurs étatiques et non-étatiques ajustent leur cadre de gouvernance en tenant compte de cette nouvelle approche, et ce, afin de confronter les défis actuels et de régler de manière plus satisfaisante les problèmes liés à la gouvernance mondiale du dopage dans les sports.

Durante años, el Distrito Federal no contempló en su modelo de ciudad el espacio público como una prioridad. La base para crear el espacio público es el suelo y en el Distrito Federal este es un grave problema, pues nos enfrentamos a un suelo privatizado al cual no se le da tratamiento de bien público y existen grandes inequidades en la distribución del espacio público en la ciudad. No obstante, ya se reconoció en el gobierno del D.F. la importancia del problema, aunque es indispensable concretar esa preocupación en proyectos específicos y aún más desarrollar algunos instrumentos para poder ejecutar las obras necesarias. ¿Qué es espacio público? ¿Qué grupos sociales afecta? ¿Para qué función urbana? Son preguntas claves que se constituyen en el núcleo de la formulación de la política. Es necesario redimensionar el problema a partir de la definición misma de un modelo de ciudad, dándole a la problemática una perspectiva territorial que le permita cumplir la función social, establecer una normatividad clara y vigente, una política de suelo transformadora y conservacionista, dotar con instrumentos financieros viables y asumir un liderazgo capaz de sobrepasar los intereses particulares.---Building a city within the big city: Mexico City’s challengerFor years Distrito Federal in Mexico not covered by the model of city public space as a priority. The basis for creating public space is the ground and in Distrito Federal this is a serious problem. We face a privatized land which no treatment is given public good. There are great inequities in the distribution of public space in the city. Already City Government recognized the importance of the problem although it is essential to landing that concern specific projects, but more so to develop some tools to execute the necessary works. What public space? Which social groups affected? What urban function? There are key questions that are in the trunk of policy formulation. Doing nothing does not seem the best option given the scale of the problem, and therefore it becomes necessary to resize the problem from the very definition of a city model giving the issue a territorial perspective to discharge social function, the establishment providing a clear and current land policy processing and preservation, financial instruments, and a leadership capable of overcoming special interests. The theory of reciprocity is predicated on the assumption that people are willing to reward nice or kind acts and to punish unkind ones. This assumption raises the question as to how to define kindness. In this paper we offer a new definition of kindness that we call “blame-freeness.” Put most simply, blame-freeness states that in judging whether player i has been kind or unkind to player j in a social situation, player j would have to put himself in the strategic position of player i, while retaining his preferences, and ask if he would have acted in a manner that was worse than i did under identical circumstances. If j would have acted in a more unkind manner than i acted, then we say that j does not blame i for his behavior. If, however, j would have been nicer than i was, then we say that “j blames i” for his actions (i’s actions were blameworthy). We consider this notion a natural, intuitive and empirically relevant way to explain the motives of people engaged in reciprocal behavior. After developing the conceptual framework, we then test this concept in a laboratory experiment involving tournaments and find significant support for the theory.

In this paper I investigate the optimal level of decentralization of tasks for the provision of a local public good. I enrich the well-known trade-off between internalization of spillovers (that favors centralization) and accountability (that favors decentralization) by considering that public goods are produced through multiple tasks. This adds an additional institutional setting, partial decentralization, to the classical choice between full decentralization and full centralization. The main results are that partial decentralization is optimal when both the variance of exogenous shocks to electorate’s utility is large and the electorate expects high performance from politicians. I also show that the optimal institutional setting depends on the degree of substitutability / complementarity between tasks. In particular, I show that a large degree of substitutability between tasks makes favoritism more likely, which increases the desirability of partial decentralization as a safeguard against favoritism.

How the degree of publicness of goods affect violent conflict? Based on the theoretical model in Esteban and Ray (2001) we find that the effect of the degree of publicness depends on the group size. When the group is small (large), the degree of publicness increases (decreases) the likelihood of conflict. This opens an empirical question that we tackle using microdata from the Colombian conflict at the municipality level. We use three goods with different publicness degree to identify the sign of the effect of publicness on conflict. These goods are coca crops (private good), road density (public good subject to congestion) and average education quality (a purer public good). After dealing with endogeneity issues using an IV approach, we find that the degree of publicness reduces the likelihood of both paramilitary and guerrilla attacks. Moreover, coca production exacerbates conflict and the provision of both public goods mitigates conflict. These results are robust to size, geographical, and welfare controls. Policies that improve public goods provision will help to fight the onset of conflict.

We study the role of natural resource windfalls in explaining the efficiency of public expenditures. Using a rich dataset of expenditures and public good provision for 1,836 municipalities in Peru for period 2001-2010, we estimate a non-monotonic relationship between the efficiency of public good provision and the level of natural resource transfers. Local governments that were extremely favored by the boom of mineral prices were more efficient in using fiscal windfalls whereas those benefited with modest transfers were more inefficient. These results can be explained by the increase in political competition associated with the boom. However, the fact that increases in efficiency were related to reductions in public good provision casts doubts about the beneficial effects of political competition in promoting efficiency.

Aquesta tesi utilitza l'anàlisi econòmica per a estudiar les hisendes locals, especialment els aspectes relacionats amb la provisió i finançament dels béns i serveis públics locals. Les hisendes locals, tant a Catalunya com a la resta d'Espanya, pateixen diversos problemes. Dos són especialment rellevants per a aquesta tesi. El primer és la reduïda dimensió dels municipis, l'altre la seva insuficient dotació financera. A la tesi es tracten aquestes dues qüestions en cinc capítols. Primer s'introdueix la problemàtica, exposant-ne els antecedents, la situació actual i la metodologia per al seu anàlisi. A continuació s'aborda la relació entre la grandària dels municipis i la seva capacitat per a proveir béns i serveis públics. De manera recurrent es produeixen debats sobre els problemes que pateixen els municipis petits. El problema més evident d'aquests municipis és el dèficit de serveis públics. Es sol argumentar que els municipis petits pateixen aquests dèficits en la provisió de serveis públics a causa de la manca d'un nombre crític d'habitants. Normalment es presenta la consolidació municipal com a solució a aquest problema. En aquest treball analitzem les diferents vessants de la qüestió dels dèficits de serveis municipals. Es continua analitzant com influeix sobre el sector privat la incapacitat per part dels municipis de prestar la quantitat i/o qualitat correcta de béns i serveis públics. Sembla clar que l'atractiu d'un hotel per als seus clients depèn tant dels serveis que ofereix com de l'entorn en què es troba. Com s'ha dit sovint "un hotel de quatre estrelles necessita un entorn de quatre estrelles". Aquests atributs que configuren l'entorn són complementaris a l'oferta privada dels serveis hotelers i són essencials a l'hora de definir les opcions de comercialització, ja que sembla raonable que diferències en les dotacions de serveis públics, capital natural i imatge de la localitat generaran diferències en els preus d'hotels que altrament són idèntics. A la següent etapa s'estudia la situació financera a la qual s'enfronten els municipis a l'hora de proveir els béns i serveis públics, especialment en el cas de les localitats amb forta implantació de l'activitat turística. L'objectiu d'aquest estudi és doble. Primer, realitzar una anàlisi i un diagnòstic del finançament als municipis turístics i, segon, discutir diferents vies de millora. En una primera part s'exposa el marc que cal tenir en compte a l'hora de considerar les qüestions de provisió de serveis públics i els consegüents aspectes pressupostaris. Després es presenta un model estilitzat de provisió de béns públics i d'estructura pressupostària que explicita, amb la intenció de portar a terme l'anàlisi economètrica, les interrelacions rellevants entre provisió de serveis públics, ingressos fiscals i despeses. Tot seguit es presenten les dades que han de servir per a una anàlisi empírica que té dues vessants. Primer, estudiar si realment els municipis amb un fort pes de l'activitat turística presenten diferències en l'àmbit pressupostari i, segon, concretar quantificar en què consisteixen i de què depenen les diferències. El sisè apartat tracta la complementarietat entre béns i serveis públics des d'un marc normatiu, posant de manifest els aspectes que ha de tenir en compte un municipi turístic en les qüestions de provisió i finançament dels béns públics i que fan que tingui un comportament diferent d'un municipi no turístic. El penúltim apartat del treball inclou la discussió i l'avaluació d'algunes propostes correctores dels problemes detectats a l'anàlisi estadística i economètrica. El treball conclou amb un resum de les principals conclusions. La tesi conclou amb una discussió dels resultats obtinguts.

Vivemos uma época de empolgante dialética entre o público e o privado. Para alguns, são conceitos basicamente e ontologicmente antagónicos, que (quase sempre) forçosamente se excluem, ou só de má vontade convivem um com o outro. Por outros tantos o público está a ganhar terreno excessivo à autonomia privada, numa era de «big brother» vivenciado, que não teríamos querido nem imaginado possível. Mas em contraste, há quem peça a convocação do Estado, para áreas das quais, neste nosso mundo ocidental, havia sido proscrito. A banca será o melhor exemplo, mas está longe de ser o único. A harmonia entre os públicos (o bem público, o serviço público, o interesse público) e os privados (com a sua iniciativa, criatividade, visão e ambição) devem coexistir numa harmonia que se quer perfeita. A segurança privada demonstra que isso é não só possível, como é desejável e essencial. Assim, cada um cumpra o seu papel.

La política de desarrollo tecnológico y derivada de esta, el papel que se pretende asignar a la universidad, se sustenta en un conjunto de ideas e interpretaciones erradas sobre la articulación entre ciencia, investigación y aplicaciones tecnológicas; ideas que han ido adquiriendo, aun en el medio académico, el estatus de sabiduría convencional de tal manera que, aceptadas como verdades, tienden a legitimar la acción de las instituciones y agencias gubernamentales. Este artículo analiza la propensión de ver a la universidad como la fuente de conocimiento e información directamente aplicable para la producción de bienes y servicios comerciales y cuestiona la perspectiva de considerar a la universidad simplemente como un agente de la esfera económica. El trabajo sostiene que el papel de la investigación universitaria consiste básicamente en un insumo para la enseñanza y que el bien público que provee la universidad es la creación de un sentido nacional de cultura, una forma de identidad y cohesión social.

One of the recurring themes in any discussion concerning the application of genetic transformation technology is the role of Intellectual Property Rights (IPR). This term covers both the content of patents and the confidential expertise, usually related to methodology and referred to as “Trade Secrets”. This review will explain the concepts behind patent protection, and will discuss the wide-ranging scope of existing patents that cover all aspects of transgenic technology, from selectable markers and novel promoters to methods of gene introduction. Although few of these patents have any significant commercial value, there are a small number of key patents that may restrict the “freedom to operate” of any company seeking to exploit the methods. Over the last twenty years, these restrictions have forced extensive cross-licensing between ag-biotech companies and have been one of the driving forces behind the consolidation of these companies. Although such issues are often considered to be of little interest to the academic scientist working in the public sector, they are of great importance in any debate about the role of “public-good breeding” and of the relationship between the public and private sectors.

This paper has two principal aims: first, to unravel some of the arguments mobilized in the controversial privatization debate, and second, to review the scale and nature of private sector provision of water and sanitation in Africa, Asia and Latin America. Despite being vigorously promoted in the policy arena and having been implemented in several countries in the South in the 1990s, privatization has achieved neither the scale nor benefits anticipated. In particular, the paper is pessimistic about the role that privatization can play in achieving the Millennium Development Goals of halving the number of people without access to water and sanitation by 2015. This is not because of some inherent contradiction between private profits and the public good, but because neither publicly nor privately operated utilities are well suited to serving the majority of low-income households with inadequate water and sanitation, and because many of the barriers to service provision in poor settlements can persist whether water and sanitation utilities are publicly or privately operated. This is not to say that well-governed localities should not choose to involve private companies in water and sanitation provision, but it does imply that there is no justification for international agencies and agreements to actively promote greater private sector participation on the grounds that it can significantly reduce deficiencies in water and sanitation services in the South.

Disease in farm animals has significant economic impacts on livestock production and incurs substantial costs for societies. Impacts affect not only livestock farms and the livestock industries but also sectors outside of farming. Important negative externalities of livestock disease include impacts on the health of other producers’ livestock, on human health, and on animal welfare. Good disease risk management/biosecurity and good animal welfare are public goods. Not taking account of these externality and public good aspects can lead to a misallocation of resources for livestock disease control. In such instances, there may be a strong case for government or other authority to intervene to ensure a better use of resources. There are a number of policy instruments that can be implemented for this purpose. One potential instrument is a Farm Animal Health and Welfare Stewardship Scheme funded under Pillar II of the CAP. A number of countries have public–private partnership cost-sharing schemes that aim to share appropriately both responsibilities and costs of epidemic livestock disease. There is a strong future agenda for appropriate intervention by governments in the management of livestock disease risks, including responsibility and cost sharing for livestock disease control, within the European Union and elsewhere.
