A Constituição de 1988 trouxe em seu espírito e texto a participação social na elaboração e implementação de políticas públicas. Entretanto, a realização desse espírito não acontece sem que emerjam diferentes conflitos entre Estado e sociedade civil nos processos de tomada de decisão. Os conselhos de direitos, como o Conselho Municipal dos Direitos de Crianças e Adolescentes de São Paulo, e os conselhos de políticas sociais são o locus privilegiado da interação da sociedade civil e do Poder Público na definição e no controle das políticas públicas. Ainda, as parcerias entre Estado e organizações da sociedade civil perdem oportunidade e potência por responderem também a essa lógica deficiente da participação social. Isso é o que nos mostra a experiência do Fundo Municipal dos Direitos da Criança e do Adolescente de São Paulo.

This study aimed at analyzing the meanings of Children and Child Rights awarded by the kindergarten children and their educators, parents and teacher. Interest in the subject arose from the participation of the University Extension Project, conducted at the Department of Education, UNESP, Bauru, called The Rights of the Child: ECA in school. Since then, the question arose: to what extent we have visibility of meanings that educators and the child has on the Rights of the Child relating to the specifics of childhood? The research followed the tenets of qualitative research, methodological procedures and adopting the observation in a classroom from kindergarten (K II), semi-structured interview through leisure moments, with the class of aged five years and a questionnaire for family and teacher. The research adopted as reference material, studies of the area of Sociology of Childhood, History of Childhood, Public Policy, Legislation Related to the theme, and an overview of psychogenic to talk about the morality of children. The results showed that parents and caregivers understand childhood as a stage of child development, marked by jokes and fancies, in which the family and the school has an important role in this process. In what concerns the children's rights, there are contradictions in the legal aspects and the situation of children today. The results showed that children's childhood is characterized by recreational activities, and adults are responsible for caring for them. And it comes on the Rights of the Child noted that there is a confusion between rights and duties because they are in a phase of moral heteronomy. The findings indicate the need for wide dissemination on the Statute of Children and Adolescents, especially in preschools in line with families to practice it a new look at childhood, conceiving children as subjects... In this paper I will reflect on the emergence of the distinct figure of the child asylum seeker which has entered public and political debates in Switzerland within the last 2 years. It is a figure that is identified through certain attributes such as youth, trauma, lostness or need for protection, and it is a figure that is imbued with certain rights (namely children’s rights). While this has helped young people to receive special treatment, the question arises what the repercussions are for those who do not fit within these categories. What, for example, happens, when different notions of youth, childhood and adolescence clash and disrupt ideals of innocence and childhood? And given that negative public discourses are largely focussed on the apparent danger and uncontrollability of male, single asylum seekers, what happens when categories mix and mingle? In this paper I will shed light on the interplay of institutional expectations of what constitutes a 'proper' child refugee and the ways young people themselves play with, test and contest these norms.

El presente artículo, así como la tesis doctoral de la que forma parte, pretende ser un aporte en la reflexión sobre los imperativos que implican para el Trabajo Social la intervención con familias o más específicamente, mujeres cuestionadas en su rol materno. La violencia en todas sus formas, y en especial aquella provocada por la expulsión del sistema social, es el denominador común de esas mujeres; maternidades en contexto de exclusión, donde la insatisfacción de los Derechos Humanos entra en tensión con los discursos que postulan, más paradójica que paradigmáticamente, los Derechos del Niño.

The purpose of this article is to investigate in which ways multi-level actor cooperation advances national and local implementation processes of human rights norms in weak-state contexts. Examining the cases of women’s rights in Bosnia and Herzegovina and children’s rights in Bangladesh, we comparatively point to some advantages and disadvantages cooperative relations between international organisations, national governments and local NGOs can entail. Whereas these multi-level actor constellations (MACs) usually initiate norm implementation processes reliably and compensate governmental deficits, they are not always sustainable in the long run. If international organisations withdraw support from temporary missions or policy projects, local NGOs are not able to perpetuate implementation activities if state capacities have not been strengthened by MACs. Our aim is to highlight functions of local agency within multi-level cooperation and to critically raise sustainability issues in human rights implementation to supplement norm research in International Relations.

This paper provides an introduction to issues surrounding the participation rights of young people in research and the implications of their growing involvement in research as well as providing a discourse on the ethical implications related to consent. The unique contribution of this paper is that it considers children’s rights in respect to the increasing opportunities for young people to take part in evaluation research. The aim of this paper, therefore, is to acknowledge the growing involvement for young people in research and the implications of ensuring that their rights of participation are respected. Secondly we will consider the children’s rights legislation and our obligations as researchers to implement this. Finally we will explore consent as an issue in its own right as well as the practicalities of accessing participants. This paper will postulate that any research about young people should involve and prioritise at all stages of the research process; including participation in decision-making. We conclude by identifying five key principles, which we believe can help to facilitate the fulfilment of post-primary pupils’ ability to consent to participate in trials and evaluative research.

Die Dissertation geht von der Überlegung aus, dass ein Wandel im deutschen Bildungssystem aufgrund kinderrechtlicher und demokratischer Überlegungen eine essenzielle Zukunftsaufgabe ist. Dies geschieht im Besonderen vor dem Hintergrund kinderrechtlicher Forderungen, wie sie beispielsweise aus dem Status Deutschlands als Mitgliedsland der UN-Kinderrechtskonvention und des UN-Übereinkommens über die Rechte von Menschen mit Behinderung entstehen: Die Korrelation zwischen Herkunft und Bildungserfolg sowie die noch konzeptionell ungenügend entwickelten Ansätze zur Inklusion werden als bestimmend für die Diskussion erkannt. Die Arbeit vertritt die These, dass Lehrende eine zentrale Rolle in einem notwendigen Prozess der Umwandlung des deutschen Bildungssystems spielen können und nimmt in emanzipatorischer Absicht die Lehrenden als Zielgruppe in den Blick. Aufgrund der Struktur der Lehrendenausbildung wird zudem dafür argumentiert, entsprechende Veränderungen im Sinne ihrer Nachhaltigkeit und flächendeckenden Relevanz in der Lehrendenausbildung des ersten universitären Ausbildungsabschnittes zu verankern. Als Instrument, welches die Kriterien von Nachhaltigkeit und umfassender Relevanz erfüllt, werden die Standards für die Lehrerbildung im Bereich Bildungswissenschaften benannt und theoretisch unterfüttert. Grundsätzlich spannt sich der Blickwinkel der Arbeit zwischen der Betrachtung der Struktur des Bildungssystems, des Wissens und Könnens von Lehrenden und Lernenden im Sinne der Kompetenzorientierung sowie der Haltung auf, welche Lehrende einnehmen. Dabei wird aufgezeigt, dass sich diese Faktoren wechselseitig auf vielfache Art und Weise beeinflussen. Auf der Basis dieser Überlegungen wird zunächst das deutsche Bildungssystem in seinen Strukturen beschrieben und die Lehrenden und Lernenden als Teilnehmende am Bildungsgeschehen skizziert. Ein exkursiver Vergleich dreier aufgrund kinderrechtlicher Parameter ausgewählter europäischer Bildungssysteme eruiert zudem, inwiefern die aufgezeigten Bestimmungsgrößen Struktur, Wissen/Können und Haltung Einfluss auf kinderrechtliche Verfasstheit des Bildungssystems nehmen, wobei die Grundprinzipien der UN-Kinderrechtskonvention hier als Messinstrument dienen. Davon ausgehend, erscheint pädagogische Haltung als eine wesentliche Einflussgröße, die im weiteren Verlauf der Arbeit im Sinne der kritischen Pädagogik zu einer Konzeption Pädagogischer Verantwortung verdichtet wird. Vor diesem Hintergrund erfolgt eine Betrachtung aktueller Problematiken im deutschen Bildungssystem, die sich an den in den Standards für die Lehrerbildung identifizierten Ausbildungsschwerpunkten orientiert und erneut die Prinzipien und rechtlichen Vorgaben der UN-Kinderrechtskonvention als Maßstab wählt. Auf der Grundlage dieser umfassenden Diskussion werden in einem sich anschließenden Analyseschritt Annotationen vorgenommen, die die Formulierungen der 11 Standards für die Lehrerbildung inhaltlich erweitern und ergänzen. In Verbindung mit einer Pädagogischen Verantwortung, die sich der Ausbildung kritischer Mündigkeit verpflichtet, werden die annotierten Standards als eine Möglichkeit der kinderrechtlichen (Selbst-)Evaluation von Lehrenden sowie als Instrument einer kinderrechtliche Gesichtspunkte fokussierenden Lehrendenbildung verstanden und dargestellt.

O presente artigo parte da questão “quais as vivências e a participação das crianças pequenas e quais as representações sociais dos adultos e crianças relativamente às crianças pequenas?”, em contexto de Centro de Acolhimento Temporário (CAT). Trata-se de uma investigação de natureza qualitativa, nomeadamente com uma natureza etnográfica, em que se procurou colocar em diálogo duas áreas de conhecimento: a educação de infância e a sociologia da infância. As técnicas de investigação utilizadas foram as entrevistas-conversa, com as crianças mais crescidas; o questionário e o focus group, com os adultos; e a observação, com os bebés. Conclui-se que os bebés (0 aos 2 anos) que se encontram em dois CAT parecem permanecer realmente numa invisibilidade social, não lhes sendo totalmente garantido o direito à participação. Isto deve-se ao facto de não existir um modelo pedagógico (participativo) praticado neste contexto com estas crianças e permanecerem representações e imagens sobre as crianças assentes numa perspetiva de passividade, incompetência e incapacidade.

O relatório final de estágio inclui uma apreciação das aprendizagens realizadas nas práticas de ensino supervisionadas do mestrado em Educação Pré-Escolar e Ensino do 1.º CEB e o estudo desenvolvido no contexto de estágio que procurou fazer face a dois objetivos centrais: caraterizar o estilo do adulto e as interações que são estabelecidas com as crianças, no período do recreio, e analisá-las em termos de adequação aos Direitos das Crianças. Para dar resposta a estes objetivos aliámo-nos aos autores de referência, à legislação em vigor e a uma investigação realizada em contexto escolar. Em termos empíricos, o estudo teve um caráter qualitativo, com recurso à observação durante o recreio utilizando a Escala de Empenhamento do Adulto. Recorreu-se, também, a uma observação com registo de incidentes críticos. Os resultados obtidos através da Escala de Empenhamento do Adulto encontram-se abaixo do que seria adequado, ou seja, não se atinge o valor mínimo de qualidade (3,5). Os direitos mais vezes postos em causa foram: “A criança tem o direito de exprimir livremente a sua opinião sobre questões que lhe digam respeito e de ver essa opinião tomada em consideração” (Artigo 12.º) e “A criança tem direito ao repouso, a tempos livres e a participar em atividades culturais e artísticas” (Artigo 31.º). Com base nos baixos níveis nas dimensões sensibilidade, estimulação e autonomia e na análise de situações registadas que representam violações dos Direitos das Crianças, concluiu-se existir urgência na formação das equipas educativas no âmbito dos Direitos das Crianças e da importância do recreio para as crianças. A própria organização do espaço e dos materiais, assim como da dinâmica do recreio, são discutidos em termos de promoção de aprendizagens e de concretização dos direitos.

El presente estudio describe los cambios en la políticas públicas de niñez en Colombia entre 1991 y 2014, mediante el análisis tanto de las narrativas y contranarrativas de política gestadas en este periodo de tiempo, como de los factores que propiciaron la conformación de una red de política pública y el posterior desarrollo de diversos modos de interacción entre los grupos de actores identificados. Parte esta investigación de situar antecedentes y factores relevantes que permiten contrastar, por un lado, contenidos y perspectivas entre diferentes periodos de tiempo, y por otro lado, el número, tipo, y dinámica de relaciones entre los diversos actores involucrados en este campo antes de 1991, y posterior a este año hasta 2014. En síntesis, a través de los hallazgos y análisis realizados se busca no solo plantear qué se transformó entre 1991 y 2014 respecto a la construcción de la niñez como referente de políticas públicas, sino también, cómo se gestó esta transformación, con el fin de proveer elementos que permitan comprender principalmente los énfasis y las variaciones que han tenido las políticas públicas de niñez en el país, pero también, algunas continuidades por periodos más específicos de tiempo.

Until the middle of the XVIII Century, children were considered as miniature adults, but with Jean Jacob Rousseau the study of the development of the human being was started and the foundation was set up for the new science of Paidology (the study of children), wich focuses on the different intellectual and physical conflicts which children face, and also for other sciencies such as Paidofilaxis, Pueroculture and Pediatrics. The Society of Nations, created, in 1919, the Consultancy for the Trafficking of Women and the Protection of Children, and in Geneva, the International Union for Aid was founded in 1920. In Argentina, the First American Congress for Children was organized in 1916, and others followed. The first Declaration of Childrens Right was proclaimed in 1924 and then followed the first Ten Commandments of Childrens Rights. In Costa Rica in 1929, a project was presented for the Constitutional Congress to establish an institution for the protection of children, wich was duly enacted into law in 1930 with the name of National Institution for the Protection of Children (Patronato Nacional de la Infancia, PANI) whose duty was to oversee the welfare of minors and their physical, intellectual, moral and emotional development. In 1930, the first Declaration of the Rights for Costarrican Children was proclaimed. The creation of the PANI, the declaration of Childrens Rights, and the enactment of a Code for Infants (1932), constitute the three events that signal Costa Rica as one of the pioneers countries in Latin American and the World, in the protectionof children and mothers. At the end of the article, some of the crucial events that have happened during the decades that PANI has been working in the country are analized.

This paper examines the children and young people's participation and protagonism rights based on the Conferences on Children and Adolescents Rights' experience in Brazil, based on childhood sociology. Conferences' documents were consulted on the Brazilian government websites. These study findings revealed that young people's participation has increased in the last conferences. However, it is necessary to promote a systematic and genuine participation through democratic relations construction in all development contexts where childrenand adolescent live in order to modify their life and society participative practices.
