Introducción: La obstrucción intestinal es una patología de alta prevalencia e impacto en los servicios de cirugía general a nivel mundial. El manejo de esta entidad puede ser médico o quirúrgico. Cuando se requiere intervención quirúrgica, se busca evitar el desarrollo de isquemia intestinal y resecciones intestinales; durante el postoperatorio, pueden existir complicaciones. El objetivo de este estudio es identificar los factores asociados al desarrollo de complicaciones post operatorias en un grupo de pacientes con obstrucción intestinal mecánica llevados a manejo quirúrgico. Metodología: Estudio analítico tipo casos y controles en un grupo de pacientes con diagnóstico de obstrucción intestinal mecánica llevados a manejo quirúrgico de su patología. Los casos corresponden a los pacientes con complicaciones postoperatorias y los controles aquellos que no presentaron complicaciones. Se identificaron factores asociados a complicación post operatoria mediante modelos estadísticos bivariados y multivariados de regresión logística para factores como edad, sexo, antecedente quirúrgico, presentación clínica, paraclínica y diagnóstico postoperatorio de malignidad, entre otras. Resultados: Se identificaron un total de 138 pacientes (54 casos y 129 controles). Los rangos de edad entre 55-66 años y mayor de 66 años fueron asociados con complicaciones postoperatorias (OR 3,87 IC95% 1,58-9,50 y OR 3,62 IC95% 1,45-9,08 respectivamente). El déficit de base inferior a 5 mEq/litro se relaciona con complicaciones postoperatorias (OR 2,64 IC95% 1.33-5,25) Otras pruebas de laboratorio, características radiológicas, hallazgos de malignidad en el postoperatorio y la evolución de los pacientes no fueron asociados con complicaciones. Conclusiones: Las disminución de las complicaciones durante el manejo quirúrgico de obstrucción intestinal mecánica continúa siendo un reto para la cirugía general. Factores no modificables como edad avanzada y modificables como el equilibrio ácido base deben ser tenidos en cuenta dada su correlación en el desarrollo de complicaciones postoperatorias.

Background: Consistency of performance across tasks that assess syntactic comprehension in aphasia has clinical and theoretical relevance. In this paper we add to the relatively sparse previous work on how sentence comprehension abilities are influenced by the nature of the assessment task. Aims: Our aims are: (1) to compare linguistic performance across sentence-picture matching, enactment, and truth-value judgement tasks; (2) to investigate the impact of pictorial stimuli on syntactic comprehension. Methods Procedures: We tested a group of 10 aphasic speakers (3 with fluent and 7 with non-fluent aphasia) in three tasks (Experiment 1): (i) sentence-picture matching with four pictures, (ii) sentence-picture matching with two pictures, and (iii) enactment. A further task of truth-value judgement was given to a subgroup of those speakers (n=5, Experiment 2). Similar sentence types across all tasks were used and included canonical (actives, subject clefts) and non-canonical (passives, object clefts) sentences. We undertook two types of analyses: (a) we compared canonical and non-canonical sentences in each task; (b) we compared performance between (i) actives and passives, (ii) subject and object clefts in each task. We examined the results of all participants as a group and as case-series. Outcomes Results: Several task effects emerged. Overall, the two-picture sentence-picture matching and enactment tasks were more discriminating than the four-picture condition. Group performance in the truth-value judgement task was similar to two-picture sentence-picture matching and enactment. At the individual level performance across tasks contrasted to some group results. Conclusions: Our findings revealed task effects across participants. We discuss reasons that could explain the diverse profiles of performance and the implications for clinical practice.

Interpretation of utterances affects an interrogator’s determination of human from machine during live Turing tests. Here, we consider transcripts realised as a result of a series of practical Turing tests that were held on 23 June 2012 at Bletchley Park, England. The focus in this paper is to consider the effects of lying and truth-telling on the human judges by the hidden entities, whether human or a machine. Turing test transcripts provide a glimpse into short text communication, the type that occurs in emails: how does the reader determine truth from the content of a stranger’s textual message? Different types of lying in the conversations are explored, and the judge’s attribution of human or machine is investigated in each test.

A ampliação dos serviços de saneamento básico é uma questão fundamental para o desenvolvimento econômico e social. Requer, contudo, investimentos vultosos, nem sempre disponíveis, especialmente no setor público. No Brasil, o setor de saneamento é fortemente marcado pela presença de grandes companhias públicas estaduais, criadas no final da década de 1960. No entanto, em um contexto de alteração do paradigma do Estado como produtor direto de bens e serviços para o Estado regulador, alguns municípios incorporaram agentes privados ao setor, celebrando contratos de concessão de serviços de água e esgoto. Para tanto, utilizaram o próprio instrumento contratual como o arcabouço regulatório dos serviços, numa situação de regulação por contrato. Esse trabalho discute a regulação por contrato no setor de saneamento, apresentando, ao final, uma análise do caso de Ribeirão Preto, cidade do interior paulista que, em 1995, concedeu a uma empresa privada os serviços de tratamento e disposição final de esgotos. A dissertação discorre sobre a evolução histórica do setor de saneamento, os principais aspectos regulatórios e os fatores relevantes para a análise de uma iniciativa de regulação por contrato no nível local. Destaca que a regulação por contrato não pode ser resumida aos dispositivos contratuais, envolvendo também a dinâmica entre regulador e regulado, e aponta para o delicado equilíbrio entre segurança e flexibilidade da relação contratual de longo prazo.

O Supremo Tribunal Federal entregou ao ordenamento jurídico brasileiro, em 21 de agosto de 2008, a súmula vinculante nº 13. O referido verbete trata da vedação a nomeações de cônjuge, companheiro ou parente em linha reta, colateral ou por afinidade até o terceiro grau, no âmbito da administração pública direta e indireta, em todas as esferas. Antes da vigência da súmula vinculante nº 13, o nepotismo era praticado de forma nebulosa, tendo em vista a ausência de uma fiscalização eficaz e eficiente. Os Estados e Municípios, através de legislação própria, buscaram o combate a essa prática em momento anterior à edição do verbete, o país carecia de uma regra geral. A partir do início da vigência da súmula vinculante nº 13, o que se verificou, no âmbito da administração pública brasileira, como será demonstrado adiante, foram diversas exonerações de servidores por simples suposição de que determinada situação jurídica configuraria nepotismo, cenário totalmente contrário àquele então proposto.. O STF manifesta-se face aos casos concretos apenas em sede de reclamação. Têm-se, atualmente, uma situação de grave insegurança jurídica, onde servidores públicos não sabem se podem ou não ser nomeados ou se podem continuar exercendo suas funções. O presente exame, pautado no direito comparado e em estudo de casos, analisou algumas situações hipotéticas que, supostamente, configurariam nepotismo, e outras já decididas pela Suprema Corte e propõe uma alteração de natureza legislativa ao instituto das súmulas vinculantes: a criação de incisos a incluídos no corpo do enunciado após cada decisão em sede de reclamação, cujos efeitos não possuem efeito vinculante. Dessa forma, a administração pública direta e indireta poderá aplicar a súmula vinculante nº 13 de forma eficaz, sem interpretações equivocadas, de modo a permitir uma sintonia entre a segurança jurídica e a moralidade.

While countries managed to rapidly rise and recover economically, Brazilian social indicators have advanced at short pace in the last decades. Although millions of Brazilians have recently left poverty, Brazil still has a long way to go regarding its socioeconomic development. Circa one fifth of the population is still considered functionally illiterate, basic education has one of the poorest performances in the world, the country has no top-level universities nor produces technology or patents at relevant levels. This paper, at first, analyses how the interaction between government and private agents influenced Brazil’s industrial and economic development, identifying the existence of bonds based on the exchange of private interests that at great extension kept public policies from reaching goals of national interest – the so called crony capitalism. Secondly, the paper verifies how development policies based on the promotion of innovative companies and segments of the industry may positively impact broad socioeconomic development. The paper delves specifically into the cooperation between universities and industry as a development tool. Enterprises and universities, guided by their endogenous interests, may be combined for the structuring of a national innovation system. While universities are fundamentally interested in promoting knowledge accumulation, enterprises are willing to invest financial capital in universities in exchange for the economic exploitation of products developed within the academic environment and direct access to its human capital. Lastly, the paper identifies the legal and cultural barriers and advances of this mechanism in Brazil. It verifies that, notwithstanding the institutional advance promoted by the Law of Innovation to the university-enterprise cooperation in Brazil, the law wasn’t entirely capable of eliminating the legal uncertainty of this relationship and capturing in an efficient way the interests of the agents involved. Recently, federal law n. 12.863/2013 officially offered universities the option of bypassing problems related to public law by regulating support foundations, which conceives greater certainty and simplicity to the cooperation. There are, however, remaining uncertainties regarding the norms to be edited by the executive power, as well as conflicts of interest linked to the property rights over patents resulting from this kind of cooperation. The paper verifies, moreover, the existence of ideological resistance to this tool within universities, in such a way that it is unlikely that those relationships develop in a systematic way throughout the country without further engagement from the government and its executive and legislative bodies.

Com a promulgação da Lei 11.107/2005 que regulamentou o artigo 241 da Constituição Federal, também conhecida como a Lei dos Consórcios, os mesmos passaram a ter um marco regulatório que proporcionou maior segurança jurídica e permitiu a expansão deste tipo de arranjo para diversas áreas além daquelas já utilizadas, bem como foi estruturada uma arquitetura de gestão para os mesmos. Com isso, a expectativa era de que a cooperação e a ação coordenada entre os entes federados seriam ampliadas. Assim, este estudo apresenta um panorama deste período de dez anos para os Consórcios, iniciando com a histórico da Lei desde sua fase de projeto até a sua promulgação. Nesta análise foi identificado que a Lei promulgada é resultado da mescla de dois projetos apresentados sobre o tema, um de origem do Poder Legislativo e outro do Poder Executivo, sendo que este último teve forte influência sobre o primeiro. Ainda, a promulgação da Lei foi fruto de um acordo entre estes dois poderes. Para que se identificasse a realidade dos Consórcios, o presente trabalho buscou no Federalismo e na Municipalização o pano de fundo como referencial teórico para a discussão do tema de associativismo entre entes públicos. Também se verificou a produção acadêmica existente no Brasil sobre os Consórcios Públicos que, a despeito de ainda ser pequena, relata diversas soluções já implementadas pelo país afora bem como os desafios que os Consórcios enfrentam para o efetivo atingimentos dos seus objetivos. Ainda, foi realizado um levantamento da tipologia dos Consórcios existentes no Brasil, cuja base de dados foi a pesquisa realizada pela organização não governamental Observatório dos Consórcios Públicos e do Federalismo em 2012, para se identificar a distribuição dos mesmos pelo país, dada a inexistência de levantamentos por entes oficiais sobre a existências de Consórcios no Brasil. Por fim, é apresentada uma perspectiva para os consórcios sobre quatro diferentes contextos, todos com vistas a estimular este tipo de arranjo para que eles se tornem fortes ferramentas catalizadoras do associativismo e da cooperação entre entes públicos e promovam efetivamente a geração de valor público.

Não é de hoje que o país assiste à descoberta de incontáveis casos de desvios de recursos públicos ou mesmo à má gestão de contratos de obra pública que ocasionam, além de grave prejuízo ao Erário, danos à sociedade, muitas vezes desprovida da utilidade que seria proporcionada pelo pactuado. Essas condutas normalmente são ensejadas por projetos de engenharia que podem ser considerados meras peças de ficção, pois não representam o esforço correto para a execução do bem que se deseja construir. A Lei nº 8.666/93 permite a licitação com base em projeto básico, o que, segundo a atual onda de pensamento brasileira, seja da doutrina, dos órgãos de controle, do Poder Legislativo e até mesmo da mídia, é, de fato, um sério problema a ser enfrentado, pois a sua contratação dá margem a aditivos, entendidos como os grandes vilões das obras públicas. Por isso, o Tribunal de Contas da União vem decidindo no sentido de fortemente restringir a possibilidade de alteração contratual e, além disso, tem capitaneado projetos no Congresso Nacional que visam praticamente à extinção da empreitada por preço unitário, espécie contratual na qual o risco do projeto, ainda sem as definições necessárias, acaba por ser assumido pela Administração contratante, responsável pela elaboração, e não pelo seu executor. Contudo, no caso de obras complexas de infraestrutura, deve-se perquirir se essa postura, que pretende acabar com a margem decisória do gestor público quanto à extensão da incompletude do projeto básico - e, portanto, do objeto do contrato -, merece ser repensada, não com vistas a possibilitar os recorrentes danos, mas no caminho de uma melhor programação das ações estatais. Isso porque nessas hipóteses, a busca por todas as informações necessárias para a confecção do projeto a ser ao final executado, no momento da elaboração do edital, ou é muito custosa ou simplesmente não é possível. Assim, seria mais eficiente a contratação integrada, prevista na Lei do Regime Diferenciado de Contratação, na qual o risco do projeto pode se alocado ao contratado. Ocorre que, como existem restrições, nem sempre é viável esse caminho. Nessa ordem de ideias, deve-se encontrar uma solução para que o tradicional contrato de obra pública supere os seus graves problemas de incentivos. A proposta do presente trabalho é a introdução de um procedimento de tomada de decisão transparente, que confira segurança jurídica e amplo conhecimento da sociedade, além de livre acesso aos órgãos de controle, a partir de critérios não apenas jurídicos, mas econômicos e técnicos.

O presente trabalho apresenta um estudo sobre a recente Lei n. 12.846/13, em especial sobre o instituto do acordo de leniência, buscando estabelecer um marco para a celebração desses ajustes tendo em vista os direitos e garantias estabelecidos pela Constituição da República Federativa do Brasil de 1988. Inicialmente, aborda-se as intensas mudanças promovidas no Estado moderno e no direito sancionador de forma geral, questiona-se, em seguida, a existência de um núcleo comum entre o direito penal e o direito administrativo sancionador. Busca-se, por fim, propor soluções para maximizar a eficácia do sistema de controle e sanção da Lei n. 12.846/13, tendo em vista a necessidade de se harmonizar a Regulação Pública com a segurança jurídica e os direitos constitucionais da pessoa jurídica investigada, em especial quando ela celebra o acordo de leniência.

“A Narratological Analysis of D. M. Thomas’s The White Hotel (1981)” originated within a seminar on British Postmodernist Literature during the first Master’s Degree in “British and North-American Culture and Literature” (2001-04) at the Universidade da Madeira set up by the Department of English and German Studies. This dissertation seeks to present a narratological analysis of Thomas’s novel. The White Hotel stands as a paradigmatic example of the kind of literature that has dominated the British literary scene in the past three decades, commonly referred to as postmodernist fiction, owing to its formal craftsmanship (multiplicity of narrative voices and perspectives, mixing of differing genres and text types, inclusion of embedded narratives) alongside the handling of what are deemed as postmodernist topoi (the distinction between truth and lies, history and fantasy, fact and fiction, the questioning of the nature of aesthetic representation, the role the author and the reader hold in the narrative process, the instability of the linguistic sign, the notion of originality and the moral responsibility the author has towards his/her work), The narratological approach carried out in this research reveals that Thomas’s text constitutes an aesthetic endeavour to challenge the teleological drive that is inherent in any narrative, i. e., the inevitable progression towards a reassuring end. Hence, the subversion of narrative telling, which is a recurrent feature in Thomas’s remaining literary output, mirrors the contemporary distrust in totalising, hierarchised and allencompassing narratives. In its handling of historical events, namely of the Holocaust, The White Hotel invites us to reassess the most profound beliefs we were taught to take for granted: progress, reality and truth. In their place the novel proposes a more flexible conception of both the world and art, especially of literary fiction. In other terms, the world appears as a brutal chaotic place the subject is forced to adjust to. Accordingly, the literary work is deemed hybrid, fragmented and open. So as to put forth the above-mentioned issues, this research work is structured in three main chapters. The initial chapter – “What is Postmodernism?” – advances a scrutiny not only of the seminal but also of more recent studies on postmodernist literary criticism. Following this, in Chapter II – “Postmodernist British Fiction” – a brief overview of postmodernist British fiction is carried out, focusing on the fictional works that, in my opinion, are fundamental for the periodising of British postmodernism. In addition, I felt the need to include a section – “D. M. Thomas as a Postmodernist Novelist” – in which the author’s remaining literary output is briefly examined. Finally, Chapter III – “A Narratological Analysis of The White Hotel” – proposes a narratological analysis of the novel according to the particular Genettian analytical model. To conclude, my dissertation constitutes an approach to D. M. Thomas’s The White Hotel as a text whose very existence is substantiated in the foregrounding of the contingency of all discourses, meeting the postmodernist precepts of openness and subversion of any narrative that claims to be true, globalising and all-inclusive.

In this master s thesis I intend to carry out an interpretation of Michel Foucault s thought that points out the relations and theoretical, conceptual and thematic consequences with sociology in his work and theoretical propositions. For my argumentation and analysis I take as a base a specific part of his thought: the problem of domination in modern societies in the genealogic texts in the decade of 1970. It s about to identify how Foucault does his analysis of the relations of domination and the use of the power with the objective to suggest and point out his contribution to sociological analysis of domination. I will discuss the foucaultian program of the study of domination from four units of analysis: person constitution, knowledge, power and truth. The structure and division of the chapters will follow the specific and detailed study of each of those units of analysis, prioritizing their theoretical sense and consequences to the sociology. Thus, in the first chapter, I will highlight a little more the relations of affinity and the convergences between Foucault and the sociology in a way to offer more elements to justify the general objectives that this work intends to achieve. In the second chapter, I will analyze the subject of domination in Foucault s thought, discussing his basic presuppositions and its intrinsic relation with the heart of the foucaultian philosophical project, the person constitution. In turn, in the third and fourth chapter, I will discuss the interdependence between knowledge and power as an essential and opaque dimension of the ways of modern domination. The following study aims to verify in which hypothesis res judicata, when it comes of an unconstitutional decision, shall not prevail over Constitution. It displayed the characteristics of formal and material constitutional systems. It debated the concepts of existence, validity and efficacy of juridical rules and acts. It dissertated about the idea of Constitution s superiority and about the birth of the judicial review of constitutionality. It focused some contemporary models of this judicial review and its historical evolution in Brazil, showing its effects towards the current Constitution. It sustained that the decision given by Supremo Tribunal Federal during abstract control of rules must bind even legislative bodies, preventing them to produce the same rules previously declared unconstitutional. It held up that all parts of the decision of Supremo Tribunal Federal oblige, even the juridical arguments employed, in both diffused and concentrated reviews. It showed that, despite these models of review live together in Brazil, our constitutional system preferred the concentrated one, considering one only court over the other constitutional organs. It discussed about res judicata with the purpose of clarifying its juridical nature, its objective and subjective limits and its regulation in collective demands. It explained that the material res judicata is an effect of a decision which cannot be reviewed, which makes the law s will free of discussion, binding the contendants and avoiding that other courts, judging future demands about the same object, may decide differently. It showed how the regulation of res judicata in collective demands, in respect oh their subjective limits, is useful to demonstrate that it is not the material law who must adapt itself to res judicata as traditionally thought, but res judicata, as a warranty of juridical certainty and security, who must be shaped from the debated rule. It presented to view the main doctrinal conceptions about res judicata s review in the hypothesis of unconstitutional judgement. It concluded that the decisions forged by unconstitutional rules or interpretations reputed not compatible to the Constitution by Supremo Tribunal Federal, in spite of it can make res judicata, may be reviewed beyond the term to file a recissory claim, since while the debated law is still valid, no matter if its decision was before or after the res judicata. At the end, it asserted that, when it is not legally authorized, the judicial review of res judicata is not admissible, after the term to file a recissory claim, under the argument that there was no direct violation to the constitutional principle or rule

The independence of the United States and the revolutions that emerged in Europe in the eighteenth century led to the birth of the written constitution, with a mission to limit the power of the State and to ensure fundamental rights to citizens. Thus, the Constitution has become the norm and ultimate founding of the State. Because of this superiority felt the need to protect her, emerging from that constitutional jurisdiction, taking control of constitutionality of provisions his main instrument. In Brazil, the constitutionality control began with the Constitution of 1891, when "imported" the American model, which is named after incidental diffuse model of judicial review. Indeed, allowed that any judge or court could declare the unconstitutionality of the law or normative act in a concrete case. However, the Brazilian Constituent did not bring the U.S. Institute of stare decisis, by which the precedents of higher courts eventually link the below. Because of this lack, each tribunal Brazilian freely decide about the constitutionality of a rule, so that the decision took effect only between the parties to the dispute. This prompted the emergence of conflicting decisions between judicantes organs, which ultimately undermine legal certainty and the image of the judiciary. As a solution to the problem, was incorporated from the 1934 Constitution to rule that the Senate would suspend the law declared unconstitutional by the Supreme Court. With the introduction of abstract control of constitutionality, since 1965, the Supreme Court went on to also have the power to declare the invalidity of the provision unconstitutional, effectively against all without the need for the participation of the Senate. However, it remained the view that in case the Supreme Court declared the unconstitutionality of the fuzzy control law by the Senate would continue with the competence to suspend the law unconstitutional, thus the decision of the Praetorium Exalted restricted parties. The 1988 Constitution strengthened the abstract control expanding legitimized the Declaratory Action of Unconstitutionality and creating new mechanisms of abstract control. Adding to this, the Constitutional Amendment. No. 45/2004 brought the requirement of general repercussion and created the Office of Binding Precedent, both to be applied by the Supreme Court judgments in individual cases, thus causing an approximation between the control abstract and concrete constitutional. Saw themselves so that the Supreme Court, to be the guardian of the Constitution, its action should be directed to the trial of issues of public interest. In this new reality, it becomes more necessary the participation of the Senate to the law declared unconstitutional in fuzzy control by the Supreme Court can reach everyone, because such an interpretation has become obsolete. So, to adapt it to this reality, such a rule must be read in the sense that the Senate give publicity to the law declared unconstitutional by the Supreme Court, since mutated constitutional

A batch of eighty-four coupons of low carbon steel were investigated at laboratory conditions under a corrosive, cavitative-corrosive (CO2) and corrosive-erosive (SiO2 + CO2) in an aqueous salt solution and two levels of temperature. The following measurements were made on Vickers (HV0,05, HV0,10, HV0,20) Microhardness tests at three levels of subsurface layer. A turbulent flow collided on the cylindrical sample, with and without mechanical stirring and gas bubbling, with and without fluid contamination by solid particles of SiO2, at two temperatures. Surface Roughness and Waviness, under two conditions "as received, after machining" and "after worn out", as well as gravimetric and electrochemical parameter were measured on the two opposite generatrices of each cylindrical sample, on the flow upstream (0°) and downstream (180°) by Profilometry, Mass Variation and Linear Polarization Resistance (LPR). The results of the Microhardness and Surface Texture of all coupons were subjected to statistical comparison, using the software Statgraphics® Centurion XVI, 95% statistical certainty, and significant differences were observed in some arrays of measurements. The corrosive wear rate measured by LPR and mass variation shown to be sensitive to the presence of bubbles and hydrodynamic fluctuations inside the cell, considering the temperature and contamination of corrosive fluid by solid particles. The main results of visual inspection relative to some topologies of the surface damages involving different mechanisms that were seen to give explanation for some fluctuations in wear rates of the steel experimentally investigated
