In our rejoinder to Don Weatherburn's paper, “Law and Order Blues”, we do not take issue with his advocacy of the need to take crime seriously and to foster a more rational approach to the problems it poses. Where differences do emerge is (1) with his claim that he is willing to do so whilst we (in our different ways) are not; and (2) on the question of what this involves. Of particular concern is the way in which his argument proceeds by a combination of simple misrepresentation of the positions it seeks to disparage, and silence concerning issues of real substance where intellectual debate and exchange would be welcome and useful. Our paper challenges, in turn, the misrepresentation of Indermaur's analysis of trends in violent crime, the misrepresentation of Hogg and Brown's Rethinking Law and Order, the misrepresentation of the findings of some of the research into the effectiveness of punitive policies and the silence on sexual assault in “Law and Order Blues”. We suggest that his silence on sexual assault reflects a more widespread unwillingness to acknowledge the methodological problems that arise in the measurement of crime because such problems severely limit the extent to which confident assertions can be made about prevalence and trends.

Newman and Nelson (2012) describe three ‘dances’ to explain the vacillating psychological states of trauma survivors: the dance of approach and avoidance; the dance of fragmentation and integration; and the dance of resilience and vulnerability. The first pair of seemingly opposite responses describes how survivors at times cope by ‘approaching’ the trauma, for example by gathering information about what happened; whilst at other times, the same person will cope by ‘avoiding’ the trauma by engaging in activities which distract them from the memory of the trauma or having to deal with the consequences of it. The ‘dance’ of fragmentation and integration describes the opposing individual or group experiences encountered after traumas or disasters. Individuals may experience fragmentation, or emotional disconnection, from the trauma as an adaptive means of survival. The ‘dance’ of resilience and vulnerability refers to an individual’s ability to ‘process’ trauma and return to a resilient state in which they re-learn to trust people and the world around them and ‘bounce back’ to a state of being resilient again. This paper will illustrate how an understanding of the three dances can be used to enable survivors of child sexual assault to engage with the media to tell their stories. I will give current examples from six months of journalism research, collaboration and writing of a series of news stories and features which broke an exclusive story simultaneously in The Australian and The Times in London during 2013.

The sentencing of a self-confessed child sex offender and senior Brisbane Anglican priest Canon Barry Greaves in Brisbane District Court last Friday (April 24, 2009) is a significant event for many reasons and for many people. It is a significant event because Greaves was a priest at Boonah in the early 1980s when he committed the offences and because knowledge of his own sex offending against children failed to deter him from seeking and gaining high office in the Anglican Church. He accepted the position of being an Archbishop’s chaplain to Brisbane Archbishop Dr Peter Hollingworth in 1999. He stayed on as an Archbishop’s chaplain to the incoming Archbishop Dr Phillip Aspinall in 2002 and not even the disgrace of the sex scandal in the Brisbane Diocese resulted in a glimmer of guilt that maybe he was not an appropriate person to be providing pastoral care to other victims of sexual assault. Families of victims who were referred to Greaves for pastoral care are now flabbergasted by the double betrayal. “I went looking for comfort and now I discover I was confiding in a f***ing pedophile,” one woman said.

It is defined as the intentional use of physical force or power, threatened or actual, against another person, against oneself, or against a group or community, that results in injury, death or deprivation.1 In this study we focus on exposure to the interpersonal type of violence, which includes acts of family violence and community violence. A genética forense tem grande importância na geração de provas em casos de violência sexual, paternidade criminal, identificação de cadáveres e investigação de evidências de locais de crime. A análise de STRs apresenta grande poder de discriminação, mas é uma metodologia multi-etapas, trabalhosa, cara e em muitos casos a análise genética é prejudicada pela baixa quantidade e qualidade das evidências coletadas. Este estudo teve como objetivo desenvolver e caracterizar uma metodologia de triagem de amostras forenses através da análise de perfis de dissociação em alta resolução (HRM) de regiões do DNA mitocondrial, o qual está presente em maior número de cópias e mais resistente a degradação. Para tanto, foram extraídos DNAs de 68 doadores. Estas amostras foram sequenciadas e analisadas por HRM para sete alvos no DNA mitocondrial. Também foram realizados ensaios para determinar a influência do método de extração, da concentração e nível de degradação do DNA no perfil de HRM obtido para uma amostra. Os resultados demonstraram a capacidade da técnica de excluir indivíduos com sequências diferentes da referência comparativa em cinco regiões amplificadas. Podem ser analisadas em conjunto, amostras de DNA com variação de concentração de até a ordem de 100 vezes e extraídas por diferentes metodologias. Condições de degradação de material genético não prejudicaram a obtenção de perfis de dissociação em alta resolução. A sensibilidade da técnica foi aprimorada com a análise de produtos de amplificação de tamanho reduzido. A fim de otimizar o ensaio foi testada a análise de HRM em reações de PCR duplex. Um dos pares de amplificação forneceu perfis de HRM compatíveis com resultados obtidos de reações com amplificação de apenas um dos alvos. Através da análise conjunta das cinco regiões, esta metodologia visa a identificação de indivíduos não relacionados com as referências comparativas, diminuindo o número de amostras a serem analisadas por STRs, reduzindo gastos e aumentando a eficiência da rotina de laboratórios de genética forense.

This chapter examines the nature and extent of violence experienced by women in Ireland during the Irish War of Independence (1919-1921) at the hands of both the Crown forces and the Irish Republican Army. It argues that targetted killings of women by either side was rare. The most common forms of such violence can be categorised as physical, gendered (cutting of hair) and psychological (intimidation and the killing of male relatives). It argues that there was a difference between gendered and sexual crime, the latter of which appears to have been very uncommon. A considerable part of the chapter uses theoretical literature on violence against women in conflict zones to explain why sexual violence was uncommon, arguing that neither side had much to gain from its employment, that the Crown forces were aware of the damage it could do to Britain's international reputation and that the terror tactics adopted by the Crown forces were sufficient to achieve their ends without resorting to rape. In regard to the IRA, the absence of any evidence of rape or sexual assault being perpetrated could be attributable to their Catholicism, reliance on support from the community, the efforts of the first Dáil to achieve foreign recognition of the Republic and the role of Cumann na mBan women in the guerrilla conflict. The historiography of women in the Irish revolution is also analysed.

This study ascertained the extent to which abuse and neglect are identified and recorded by mental health services. A comprehensive audit of 250 randomly selected files from four community mental health centres in Auckland, New Zealand was conducted, using similar methodology to that of a 1997 audit in the same city so as to permit comparisons. Significant increases, compared to the 1997 audit, were found in the rates of child sexual and physical abuse, and adulthood sexual assault (but not adulthood physical assault) identified in the files. Identification of physical and emotional neglect, however, was poor. Male service users were asked less often than females; and male staff enquired less often than female staff. People with a diagnosis indicative of psychosis, such as ‘schizophrenia’, tended to be asked less often and had significantly lower rates of abuse/neglect identified. Despite the overall improvement, mental health services are still missing significant amounts of childhood and adulthood adversities, especially neglect. All services need clear policies that all service users be asked about both abuse and neglect, whatever their gender or diagnosis, and that staff receive training that address the barriers to asking and to responding therapeutically to disclosures.

In the past two decades numerous programs have emerged to treat individuals with developmental disabilities who have sexual offending behaviours. There has, however been very few studies that systematically examine the effectiveness of long term treatment with this population. The present research examines the therapeutic outcomes of a multi-modal behaviour approach with six individuals with intellectual disabilities previously charged with sexual assault. The participants also exhibited severe behavioural challenges that included verbal aggression, physical aggression, destruction and self-injury. These six participants (5 males, 1 female) were admitted to a Long Term Residential Treatment Program (LTRTP), due to the severity of their behaviours and due to their lack of treatment success in other programs. Individualized treatment plans focused on the reduction of maladaptive behaviours and the enhancing of skills such as positive coping strategies, socio-sexual knowledge, life skills, recreation and leisure skills. The treatment program also included psychiatric, psychological, medical, behavioural and educational interventions. The participants remained in the Long Term Residential Treatment Program (LTRTP) program from 181 to 932 days (average of 1.5 years). Pre and post treatment evaluations were conducted using the following tools: frequency of target behaviours, Psychopathology Inventory for Mentally Retarded Adults (PIMRA), Emotional Problems Scale (EPS), Socio-Sexual Knowledge and Attitudes Assessment Tool (SSKAAT-R) and Quality of Life Questionnaire (QOL-Q). Recidivism rates and the need for re-hospitalization were also noted for each participant. By offering high levels of individualized interventions, all six participants showed a 37 % rate of reduction in maladaptive behaviours with zero to low rates of inappropriate sexualbehaviour, there were no psychiatric hospitalizations, and there was no recidivism for 5 of 6 participants. In addition, medication was reduced. Mental health scores on the PIMRA were reduced across all participants by 25 % and scores on the Quality of Life Questionnaire increased for all participants by an average of 72 %. These findings add to and build upon the existing literature on long term treatment benefits for individuals with a intellectual disability who sexually offend. By utilizing an individualized and multimodal treatment approach to reduce severe behavioural challenges, not only can the maladaptive behaviours be reduced, but adaptive behaviours can be increased, mental health concerns can be managed, and overall quality of life can be improved.

Six lefthanded artist-educators were interviewed to attempt to discover any patterns t6 their perceptions and experiences. Artists have their own culture and priorities. According to the literature, lefthanded people appear more likely to suffer from dyslexia, allergies, asthma and other auto-immune diseases as well as machinery and equipment injuries. Patterns emerging suggested that lefthanded people indeed suffer more from dyslexia. More startling was the distinct possibility that many artists have traumatic childhood histories. This would commonly include negative school experiences, and for a significant number sexual assault, perceived or actual abandonment by parents, and/or consistently low selfesteem. The researcher discovered possible reasons why creative people frequently have problems at school, why they tend to be rebellious and anti-establishment oriented, how many of them perceive societal rules, and why they are more likely to be lefthanded. These characteristics all have significant implications for art school administrators.

Cette étude porte sur la distance parcourue pour commettre un crime à Gatineau en 2006. Peu d’études canadiennes récentes ont porté sur le sujet. De plus, il existe un vide de connaissances sur la mobilité des délinquants dans les petites villes et les banlieues. La présente recherche vise à comparer trois mesures de distance différentes, à vérifier si la distance parcourue varie en fonction du type de crime et à voir si les variables de temps (jour de la semaine, moment de la journée et saison) de même que certaines caractéristiques des suspects (âge, sexe et lieu de résidence) ont un impact sur la distance parcourue. Pour chaque crime, l’adresse du suspect et le lieu du crime ont été géocodées pour ensuite calculer la distance entre les deux points. Il ressort de l’analyse de la forme des courbes de distances que seules les agressions sexuelles présentent une zone tampon. Les résultats des analyses statistiques indiquent que les jeunes sont plus mobiles que les suspects plus âgés et que les hommes parcourent une distance plus élevée que les femmes. Étonnement, la distance parcourue ne diffère pas significativement selon la saison et le moment de la journée. Enfin, comparativement aux autres criminels, les délinquants qui ont commis un vol qualifié sont ceux qui ont parcouru les plus grandes distances.

Dans ce mémoire, nous nous interrogeons sur de nouvelles règles de preuve du Code criminel pour déterminer si elles ont complètement éliminé le phénomène de victimisation des plaignantes dans les procédures en matière d'agression sexuelle. Nous émettons l'hypothèse qu'elles n'ont pas éliminé le traitement inéquitable des victimes dans le procès pénal et que ce traitement inéquitable nuit autant à la recherche de la vérité qu'au respect des droits des plaignantes. Nous examinons d'abord les droits constitutionnels respectifs de la plaignante et de l'accusé dans le procès en matière de crimes sexuels et leur interaction avec des règles qui portent sur la réputation et l'état de santé des deux protagonistes dans de telles affaires. Nous observons que ces règles de preuve offriraient une symétrie apparente au sujet du traitement de la mauvaise réputation de l'accusé et de la réputation sexuelle et la santé mentale de la victime dans la procédure. Cette symétrie serait toutefois imparfaite, inappropriée ou biaisée par le caractère adversaire du procès et la priorité accordée aux droits constitutionnels de l'inculpé et ce, parfois même au détriment de la vérité et de la justice. Enfin, nous proposons des modifications aux règles actuelles de preuve et de procédure en matière d'agression sexuelle pour favoriser une meilleure recherche de la vérité et un respect accru des droits constitutionnels des victimes

La présente étude vise à vérifier auprès d’un échantillon québécois d’adolescents agresseurs sexuels quels sont les caractéristiques personnelles et familiales avant le traitement et les caractéristiques thérapeutiques en cours de traitement associées à la récidive violente et générale. Cent quarante (140) délinquants sexuels juvéniles ayant commis au moins une infraction sexuelle à l’égard d’un enfant et ayant participé à un programme de traitement spécialisé ont fait l’objet de cette recherche. L’âge moyen des participants était de 15 ans (σ=1,5). Les données concernant la récidive ont été recueillies suite à une période de suivi moyenne de cinq ans et proviennent de sources officielles des dossiers de la Chambre de la Jeunesse ainsi que du Système d’empreintes digitales de la GRC. Au total, 37 % (n=52) des sujets ont commis à nouveau des infractions criminelles dont 3% des délits sexuels, 11% des délits violents et 23% des infractions générales. Les résultats de l’étude indiquent que certaines caractéristiques personnelles avant le traitement sont associées à la récidive violente et générale. Ainsi, les émotions négatives comme stratégies d’adaptation en situation de stress augmentent les risques de récidive violente alors que la tendance à démontrer plus de symptômes liés à un traumatisme et l’obtention d’un score élevé à l’échelle d’estime de soi de la compétence athlétique augmentent les risques de récidive générale. Aucune caractéristique en cours de traitement ne permet de prédire la récidive violente et générale. Certaines de ces caractéristiques sont toutefois associées à une diminution du risque de ces deux types de récidive. En somme, les conclusions de cette étude montrent qu’une forte proportion d’adolescents auteurs d’abus sexuels poursuivra une carrière criminelle générale plutôt que de se spécialiser en délinquance sexuelle.

Ce mémoire consiste en une reproduction et une extension du Modèle Confluent de l’Agression Sexuelle (MCAS) de Neil Malamuth. Le MCAS est un des seuls modèles développementaux de l’agression sexuelle d’hommes sur des femmes adultes à avoir été validé empiriquement. Dans ce modèle, deux trajectoires (la promiscuité sexuelle et la masculinité hostile) convergent et mènent à l’agression sexuelle. Pour la première fois, ce modèle est appliqué séparément à quatre paramètres de la carrière criminelle sexuelle (gravité, fréquence, précocité, spécialisation) au sein d’un échantillon d’agresseurs sexuels de femmes adultes judiciarisés (n=180). Les quatre modèles qui en résultent s’ajustent bien aux données. Tous les liens postulés dans le MCAS sont validés dans ce mémoire, à une exception. En effet, contrairement aux résultats obtenus par Malamuth, une seule des deux trajectoires du modèle présente un lien significatif avec chacun des paramètres de la carrière criminelle sexuelle à l’étude. La trajectoire de la promiscuité sexuelle est liée à la précocité et à la non-spécialisation (lien négatif avec la spécialisation) alors que la trajectoire de la masculinité hostile est associée à la gravité et à la fréquence. Ces résultats sont congruents avec une approche typologique des agresseurs sexuels de femmes adultes. Chacune des deux trajectoires du MCAS englobe des caractéristiques spécifiques à certains types de violeurs (opportunistes, colériques, sadiques) qui, pour leur part, se distinguent quant aux paramètres de leur carrière criminelle sexuelle.
