A tese analisa as mudanças da política de compras e contratações da administração pública federal brasileira descrevendo de forma sistemática os seis casos nos quais as regras e procedimentos sofrem alteração substancial, na forma de leis gerais ou estatutos: a centralização das compras no período Vargas, em dois momentos decisivos (1931 e 1940); a revisão das regras de licitação pelo Decreto-lei n. 200, no contexto da reforma administrativa do governo Castello Branco; a edição de um estatuto das licitações (o Decreto-lei n 2.300) no governo Sarney; a aprovação no Legislativo de uma lei de licitações voltada para o combate à corrupção e ao direcionamento dos contratos públicos (Lei 8.666); a tentativa frustrada de uma nova lei alinhada com a reforma gerencial do primeiro governo Fernando Henrique Cardoso e a criação do pregão como nova modalidade de licitação, em 2000. A pesquisa focaliza o processo político de formulação dos problemas, especificação de soluções e tomada de decisão, com base no modelo de John Kingdon, desdobrando a análise em fluxos do processo político, dos problemas emergentes e das soluções, em cada contexto histórico específico. Os seis casos são descritos por meio de narrativas estruturadas e comparados a partir das categorias do modelo teórico para elucidar como se desenvolveu o processo de mudança, quais os atores relevantes, idéias, modelos e eventos políticos que explicam suas circunstâncias e resultado.

Este trabalho analisa a utilização do estágio probatório no Brasil para avaliar se houve mudanças na sua utilização a partir das reformas empreendidas na década de 1990. A literatura indica a inoperância desta avaliação segundo as mesmas dificuldades apresentadas em outros instrumentos da política de recursos humanos do Estado, tais como a seleção por meio do concurso público e a implementação de sistemas de avaliação de desempenho. A pesquisa delineou o histórico da utilização do estágio probatório no Brasil, identificou os aspectos que o constituem e, por meio de três estudos de caso, avaliou a utilização do estágio probatório em três carreiras do governo do Estado de São Paulo nas quais se buscou entender se houve mudanças na sua utilização após as alterações estabelecidas pela emenda constitucional nº 19, de 1998. O estudo indicou que o estágio probatório se fez presente e foi reforçado pelas normas gerais relacionadas aos servidores públicos, mas nunca houve um movimento para torná-lo uma avaliação efetiva, o que o manteve a margem das discussões da seleção por mérito, que enfatizava a importância do concurso público; e desvalorizado pela extensão do direito à estabilidade a todos os funcionários independentemente do ingresso por concurso ou de um processo de avaliação efetivo. Além disso, este incorporou as dificuldades da implementação de avaliações de desempenho no setor público brasileiro. No entanto, os três casos avaliados demonstraram incorporar mudanças incrementais na utilização do estágio probatório após 1998, com características distintas de acordo com as carreiras correspondentes e a política pública desenvolvida pelas Secretarias, não sendo possível afirmar sua inoperância.

O objetivo desta pesquisa foi identificar a percepção dos empregados sobre a relação da legislação de compras com o desempenho da Embrapa Semiárido com base no critério de eficiência após a implantação do Pregão como uma nova modalidade licitatória. Foram realizadas pesquisas bibliográfica, documental, de campo, e para assegurar a validade das informações foi utilizada uma triangulação de técnicas de coleta de dados de análise documental, observação direta e entrevistas semiabertas, realizadas com empregados que atuam ou atuaram no Setor de Compras a mais de 10 anos e que fossem pregoeiros, e pesquisadores da Unidade, também com mais de 10 anos de experiência, que tivessem projetos aprovados com orçamento do Tesouro Nacional, com execução nos períodos anteriores e após à implantação do Pregão. De acordo com a documentação analisada e na ótica dos empregados do Setor, foi identificado que após a implantação do Pregão, a unidade tem conseguido economia de recursos nas contratações em média de 20% abaixo do valor de referência estabelecido nos Editais, o que poderia indicar eficiência. Entretanto, ficou evidente que o índice de erro nos processos passou a ser muito maior em relação aos processos realizados antes do pregão, e que apesar de tal modalidade ser apontada como benéfica, tem-se a impressão de que está sendo utilizada de maneira inadequada generalizadamente para toda e qualquer contratação sem uma análise prévia da modalidade licitatória mais adequada. Nessa mesma linha, no tocante aos relatórios de pesquisa e à opinião dos pesquisadores, foi evidenciado que tem havido perdas orçamentárias por não entrega de processos feitos em fim de ano, implicando em não cumprimento de metas, etapas ou tarefas dos experimentos, bem como, muitos atrasos nas entregas, e desperdícios de recursos por conta de aquisições de má qualidade que não servem para o trabalho de pesquisa. Por fim, a título de contribuição, este estudo apontou que a legislação de compras públicas atual influencia diretamente no desempenho da Embrapa Semiárido, e não atende às suas necessidades enquanto instituição de pesquisa, indicando que a instituição não pode seguir as mesmas regras, normas e legislação dos processos de aquisições dos demais órgãos da administração pública, e precisa de um novo aparato legal, que lhe proporcione maior flexibilidade para tocar seus projetos e cumprir sua missão institucional

This paper studies the effects of generic drug’s entry on bidding behavior of drug suppliers in procurement auctions for pharmaceuticals, and the consequences on procurer’s price paid for drugs. Using an unique data set on procurement auctions for off-patent drugs organized by Brazilian public bodies, we surprisingly find no statistically difference between bids and prices paid for generic and branded drugs. On the other hand, some branded drug suppliers leave auctions in which there exists a supplier of generics, whereas the remaining ones lower their bidding price. These findings explain why we find that the presence of any supplier of generic drugs in a procurement auction reduces the price paid for pharmaceuticals by 7 percent. To overcome potential estimation bias due to generic’s entry endogeneity, we exploit variation in the number of days between drug’s patent expiration date and the tendering session. The two-stage estimations document the same pattern as the generalized least square estimations find. This evidence indicates that generic competition affects branded supplier’s behavior in public procurement auctions differently from other markets.

A partir da década de 2000, no contexto das reformas de gestão do Estado, os estados brasileiros iniciaram um processo contínuo de aperfeiçoamento gerencial nas compras, em decorrência da necessidade de racionalizar os processos e o uso dos recursos financeiros visando melhorar a qualidade do seu gasto e atender às prerrogativas da Lei de Responsabilidade Fiscal. A possibilidade de reduzir os preços pela economia de escala, monitorar melhor os processos de contratação, padronizar os itens adquiridos e gerir com mais eficiência suas atividades de compras e contratações, levou alguns estados a optarem por centralizar, em maior ou menor grau, suas compras em um órgão gerenciador. No entanto, em outros estados predominou a ideia de centralizar apenas a normatização e a padronização dos procedimentos ou no máximo o controle de alguns processos, mantendo a execução das compras, descentralizada. Este trabalho teve por objetivo identificar os fatores que influenciaram o Estado do Rio de Janeiro a manter suas compras descentralizadas, a despeito de possíveis ganhos com a centralização.Metodologicamente, a pesquisa teve uma abordagem qualitativa, que levou à interpretação de elementos detectados na pesquisa de campo, alinhando-os ao material teórico pesquisado. Os meios de investigação foram o estudo de caso, a pesquisa bibliográfica e a investigação documental. Os instrumentos utilizados na pesquisa de campo foram a observação e as entrevistas. Concluiu-seque a não adoção de uma política de centralização das compras pelos estados após a década de 2000, como ocorreu no caso do Rio de Janeiro, se explica pelo seu alto índice populacional, pela sua dimensão econômica e, principalmente, pelas características descentralizadoras das reformas de gestão implantadas a partir de 2007. Aparentemente, esta opção pela descentralização acabou não trazendo maiores perdas em termos de escala, transparência e controle.

The study aims to identify the factors that influence the behavior intention to adopt an academic Information System (SIE), in an environment of mandatory use, applied in the procurement process at the Federal University of Pará (UFPA). For this, it was used a model of innovation adoption and technology acceptance (TAM), focused in attitudes and intentions regarding the behavior intention. The research was conducted a quantitative survey, through survey in a sample of 96 administrative staff of the researched institution. For data analysis, it was used structural equation modeling (SEM), using the partial least squares method (Partial Least Square PLS-PM). As to results, the constructs attitude and subjective norms were confirmed as strong predictors of behavioral intention in a pre-adoption stage. Despite the use of SIE is required, the perceived voluntariness also predicts the behavior intention. Regarding attitude, classical variables of TAM, like as ease of use and perceived usefulness, appear as the main influence of attitude towards the system. It is hoped that the results of this study may provide subsidies for more efficient management of the process of implementing systems and information technologies, particularly in public universities

Outsourcing has emerged as one of the new ways of guiding the work. For its advantages and be consistent with the paradigms of managerial reform, outsourcing also started to be used in the Public Administration. However, taking into account the particularities of the latter, some issues are relevant when outsourcing concluded with the State. Gains notoriety, for example, the step of monitoring these contracts, to the extent that, from this activity, we can avoid the negative effects of outsourcing like the fact that the state will pay for labor and wage liens that are obligation of the company providing the services. This study aims to understand the perception that this process is under the Federal University of Rio Grande do Norte, from the point of view of different stakeholders, also explaining the motivations that these agents have to perform the supervisory process. As a theoretical basis was used the Agency Theory, which reinforces the supervisory activities as a necessary means to minimize moral hazard and adverse selection, seeking to understand not only the different motivations tax contracts to properly perform their duties, but also analyze other phenomena arising from this contractual relationship. To achieve the proposed objectives, were taken a literature review and a presentation of how to organize the management and oversight of contracts in UFRN. The methodological procedures included questionnaires and interviews with those involved in the process. After analyzing the results obtained in the survey instruments , and also based on the laws, regulations and instructions governing the procurement process within the UFRN, it was concluded that the process of overseeing the outsourcing of labor contracts in UFRN is not fully institutionalized, some points should be strengthened in order to have the consolidation of this process, highlighting the need for training of UFRN servers that act as tax, the knowledge that the contractual penalties are applied effectively, the need that there is a supervisor of tax of contractors and also the realization of the rotation system of outsourced employees

The aim of this article is to discuss whether public procurement policy can promote innovation by firms located in developing countries. The literature on technological learning is used to create a typology for assessing the impact of public procurement in developing countries from the standpoint of innovation. Petrobras, a Brazilian state-owned enterprise, was chosen as a case study. Petrobras is a global leader in the field of deepwater oil production technology and so offers an interesting opportunity to investigate whether government procurement in developing countries is used to promote the capability of domestic firms to develop innovations. The article presents the findings of a field survey on P-51, a platform that was ordered by the Brazilian state-owned enterprise and began producing in 2009. The case study is based on information collected from interviews with managers of Petrobras, EPC contractors and some of the firms subcontracted to work on P-51.

No-bid contracting is a highly prevalent practice in public procurement of technology services. Alt-hough no-bid contracting is a substantial problem since it reduces competition and welfare, the litera-ture lacks theoretical explanations and empirical tests for why public organizations award no-bid con-tracts. In this paper, we propose three theoretical explanations for no-bid contracting, drawing on transaction cost economics, organizational learning, and institutional theory. We also present how we test these explanations using a comprehensive sample of public procurement transactions. We expect to contribute theoretical explanations for no-bid contracting and practical implications for policy-makers.

Introduction: The Texas Occupational Safety & Health Surveillance System (TOSHSS) was created to collect, analyze and interpret occupational injury and illness data in order to decrease the impact of occupational injuries within the state of Texas. This process evaluation was performed midway through the 4-year grant to assess the efficiency and effectiveness of the surveillance system’s planning and implementation activities1. ^ Methods: Two evaluation guidelines published by the Centers for Disease Control and Prevention (CDC) were used as the theoretical models for this process evaluation. The Framework for Program Evaluation in Public Health was used to examine the planning and design of TOSHSS using logic models. The Framework for Evaluating Public Health Surveillance Systems was used to examine the implementation of approximately 60 surveillance activities, including uses of the data obtained from the surveillance system. ^ Results/Discussion: TOSHSS planning activities omitted the creation of a scientific advisory committee and specific activities designed to maintain contacts with stakeholders; and proposed activities should be reassessed and aligned with ongoing performance measurement criteria, including the role of collaborators in helping the surveillance system achieve each proposed activity. TOSHSS implementation activities are substantially meeting expectations and received an overall score of 61% for all activities being performed. TOSHSS is considered a surveillance system that is simple, flexible, acceptable, fairly stable, timely, moderately useful, with good data quality and a PVP of 86%. ^ Conclusions: Through the third year of TOSHSS implementation, the surveillance system is has made a considerable contribution to the collection of occupational injury and illness information within the state of Texas. Implementation of the nine recommendations provided under this process evaluation is expected to increase the overall usefulness of the surveillance system and assist TDSHS in reducing occupational fatalities, injuries, and diseases within the state of Texas. ^ 1 Disclaimer: The Texas Occupational Safety and Health Surveillance System is supported by Grant/Cooperative Agreement Number (U60 OH008473-01A1). A retrospective cohort study was designed to evaluate the compliance of vaccination dose schedules and vaccination effectiveness at 12 months of age among a total of 226 high-risk infants born to HBsAg-positive pregnant women who participated in the HBV Perinatal Vaccination Program in Houston, Texas, 1991-1993.^ The seroprevalence of HBsAg-positivity was 0.5% among pregnant women who attended prenatal clinics in Houston, Texas, 1991-1993. The Asian women had the highest seroprevalence rate (5.9%), followed by black (1.9%), white (0.7%), and Hispanic women (0.3%). The seroprevalence of HBsAg increased with age (p =.02); the highest seroprevalence rate found among the $>$40 group (5.4%), followed by the 20-40 age group, and the $<$20 age. A steady increase was observed in the number of infants, from 45 in 1991, to 103 in 1993. The majority of these infants were black (58.0%), followed by Hispanic (28.8%), Asian (8.4%), and white infants (4.0%). Significant increases were observed from 1991 to 1993 in the number of infants who initiated vaccination (86.7% to 98.1%, p =.02) and in those infants who were post-tested at 12 months of age (24.4% to 44.7%, p =.04). During the same period an increase was also observed in the number of infants who completed the vaccination dose schedules (62.2% to 72.8%, p =.37). The compliance rates were not statistically significant regarding gender, race or ethnicity, health service area, medical referral source, and residential geographic areas. About 56.0% of the reasons cited for non-compliance among the 144 infants who neither completed the vaccination dose schedules nor received the 12-month post-test were "moved," and "no response/not at home." A total of 82 infants completed the vaccination dose schedules and were post-tested at 12 months of age for anti-HBs-positivity, and 96.3% of these infants seroconverted. A race-specific statistically significant seroconversion difference was found among infants who received all vaccination doses and were post-tested at 12 months of age (100% for the black and the white, 96.3% for the Hispanic, and 80.0% for the Asians infants, p =.05).^ From a public health perspective, the HBV Perinatal Vaccination Program improved during its first three years (1991-1993). It was effective in preventing perinatal HBV infection in almost 97.0% of infants who were vaccinated and post-tested. To increase the efficiency and efficacy of the program, the following recommendations are proposed: (1) Increase the vaccination compliance rate by educating and improving the tracking, communication and coordination channels with those individuals involved in the process and by increasing staff resources. (2) Reduce the post-test vaccination non-compliance by post-testing infants simultaneously with third vaccination dose at 6 months of age, and only post-test those infants who are anti-HBs-negative at 9-12 months of age. The new European Standard EN 301 549 “Accessibility requirements suitable for public procurement of ICT products and services in Europe” is the response by CEN, CENELEC and ETSI to the European Commission’s Mandate 376. Today, ICT products and services are converging, and the boundaries between product categories are being constantly blurred. For that reason EN 301 549 has been drafted using a feature-based approach, instead of being based on product categories. The result is a standard that can be applied to any ICT product and service, by identifying applicable requirements depending on the features of the ICT. This demonstration presents ongoing work at the research group CETTICO of the Technical University of Madrid. CETTICO is developing a workgroup-based support tool where teams of people can annotate the result of performing a conformity assessment of a given ICT product or service according to the requirements of the EN. One of the functions of the tool is creating evaluation projects. During that task the user defines the features of the corresponding ICT product or service by answering questions presented by the tool. As a result of this process, the tool will create a list of applicable requirements and recommendations.

The Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) of 1980, and the Superfund Amendments and Reauthorization Act (SARA) of 1986 strengthen roles of the community in the CERCLA process. Many layers of bureaucracy and the complexity of regulations make the implementation and enforcement of environmental policy a burdensome process. Local government, the public and private corporations have a critical role in the CERCLA decision-making process by implementing a comprehensive public participation process. This paper examines a case study in which a local Colorado health department implemented a successful public participation process in order to positively affect the remediation decision-making process.
