Nella prima parte viene ricostruito il concetto di vincolo espropriativo alla luce dell’elaborazione della giurisprudenza della Corte costituzionale e della Corte EDU, giungendo alla conclusione che rientrano in tale concetto le limitazioni al diritto di proprietà che: - derivano da scelte discrezionali dell’Amministrazione non correlate alle caratteristiche oggettive del bene; - superano la normale tollerabilità nel senso che impediscono al proprietario la prosecuzione dell’uso in essere o incidono sul valore di mercato del bene in modo sproporzionato rispetto alle oggettive caratteristiche del bene e all’interesse pubblico perseguito. Ragione di fondo della teoria dei vincoli è censurare l’eccessiva discrezionalità del potere urbanistico, imponendo una maggiore obiettività e controllabilità delle scelte urbanistiche. Dalla teoria dei vincoli consegue altresì che nell’esercizio del potere urbanistico l’Amministrazione, pur potendo differenziare il territorio, deve perseguire l’obiettivo del riequilibrio economico degli interessi incisi dalle sue determinazioni. L’obbligo della corresponsione dell’indennizzo costituisce la prima forma di perequazione urbanistica. Nel terzo e nel quarto capitolo viene analizzata la giurisprudenza civile e amministrativa in tema di vincoli urbanistici, rilevandone la non corrispondenza rispetto all’elaborazione della Corte costituzionale e l’incongruità dei risultati applicativi. Si evidenzia in particolare la necessità del superamento del criterio basato sulla distinzione zonizzazioni-localizzazioni e di considerare conformative unicamente quelle destinazioni realizzabili ad iniziativa privata che in concreto consentano al proprietario di conseguire un’utilità economica proporzionata al valore di mercato del bene. Nel quinto capitolo viene analizzato il rapporto tra teoria dei vincoli e perequazione urbanistica, individuandosi il discrimine tra i due diversi istituti non solo nel consenso, ma anche nella proporzionalità delle reciproche prestazioni negoziali. Attraverso la perequazione non può essere attribuito al proprietario un’utilità inferiore a quella che gli deriverebbe dall’indennità di esproprio.

The question of how far pre-revolutionary Russia was from the ideal of a lawful state has received little academic attention, particularly as relates to the legal regulation of relations between person, society and state within the state administration. Pravilova explored the methods of settling disputes between individuals and the administration, and the emergence of legal controls of the administration, analysed projects for the organisation of administrative justice and studied the particular nature of concepts from Russian administrative justice. The idea of an organisation of special bodies examining complaints by private persons against the actions of officials and state bureaucratic organs first appeared in the early 1860s. In the 1870s-1890s various projects for the reform of administrative justice (reorganisation of the Senate and local administrative institutions) were proposed by the Ministries of Justice and Finance, but none of these was put into practice, largely due to resistance from the bureaucracy. At the same time, however, the rapid development of private enterprise, the activities of the zemstvo and self-government produced new norms and mechanisms for the regulation of authorities and social relations. Despite the lack of institutional conditions, the Senate did consider complaints from private persons against illegal actions by administrative officials, playing a role similar to that of the supreme administrative courts in France and Germany. The spread of concepts of a 'lawful state' aroused support for a system of administrative justice and the establishment of administrative tribunals was seen as a condition of legality and a guarantee of human rights. The government was forced to understand that measures to maintain legality were vital to preserve the stability of the system of state power, but plans for liberal reforms were pushed into the background by constitutional reforms. The idea of guarantees of human rights in relations with the authorities was in contradiction with the idea of the monarchy and it was only when the Provisional Government took power in 1917 that the liberal programme of legal reforms had any chance of being put into practice. A law passed in June 1917 ordained the organisation of local administrative justice bodies, but its implementation was hampered by the war, the shortage of qualified judges and the existing absolute legal illiteracy, and the few administrative courts that were set up were soon abolished by the new Soviet authorities. Pravilova concluded that the establishment of a lawful state in pre-revolutionary Russia was prevented by a number of factors, particularly the autocratic nature of the supreme authority, which was incompatible with the idea of administrative justice as a guarantee of the rights of citizens in their relations with the state.

El megaemprendimiento toma cuerpo en los estilos de vida de sus habitantes; una metamorfosis sufrida en sus disposiciones y competencias espaciales reorganiza el sentido de sus prácticas y representaciones territoriales. Los habitus (Bourdieu, 1997) se conforman junto a la nueva espacialidad como estructura estructurada por emprendimientos como Nordelta y como estructura estructurante de los nuevos objetos urbanos. Es decir, los habitus no resultan de la impresión mecánica de las estructuras sociales capitalistas sino que se constituyen en un complejo proceso irreducible a las dicotomías entre objetivismo-subjetivismo, acción-estructura, etc. Las disposiciones y competencias espaciales pueden pensarse como la articulación del par dialéctico que presenta Santos (1996) al referirse al espacio geográfico como un conjunto de sistemas de objetos y sistemas de acciones, considerados como el contexto único en el que se realiza la historia.

La empresa social es un modelo organizativo que presenta un interesante potencial para resolver problemáticas sociales. La empresa social ha despertado interés tanto en países industrializados como en economías en vías de desarrollo porque representa un modelo dentro del capitalismo que persigue objetivos sociales mediante la realización de actividades de mercado (compra y venta de productos y/o servicios principalmente). A pesar de sus raíces lejanas en el tiempo se trata de un campo de conocimiento relativamente joven, donde la literatura académica presenta escasez de estudios empíricos. El desarrollo teórico para buscar claridad conceptual ha sido el principal caballo de batalla de los últimos años, y por tanto, se ha prestado poca atención a generar evidencias sobre cómo funcionan las empresas sociales y sobre sus claves de su éxito. Se considera que la mejora en la comprensión de este modelo organizativo pasa por la construcción de herramientas para que académicos y practicantes mejoren su conocimiento sobre los mecanismos internos de las empresas sociales. En este contexto nace la presente tesis doctoral sobre empresa social, que tiene por objetivo la creación de un marco de análisis que permita el estudio de las empresas sociales desde una dimensión organizativa, es decir, que aborde los elementos clave que describen el funcionamiento de este tipo de organizaciones. Para ello, en este trabajo se aborda la construcción del modelo para el análisis organizativo de las empresas sociales a partir del análisis semántico de las 45 principales definiciones de empresa social. A partir de este análisis se identifican dos dimensiones de análisis de la empresa social: -Cuatro principios, comunes a todas las manifestaciones del fenómeno, que recogen la esencia del concepto. -Ocho elementos organizativos específicos de la empresa social que describen la forma en la que cada iniciativa se implementa en un contexto determinado. Es decir, elementos de diseño presentes en diferente medida que dan lugar a tipologías de empresa social diferentes. Estos elementos son: la proposición de valor social, la búsqueda de impacto a largo plazo, la cultura organizativa, la conexión con los beneficiarios, el liderazgo emprendedor y los mecanismos de gobernanza, el ecosistema colaborativo, la estrategia empresarial y la orientación a la autosuficiencia económica. A partir de este marco de análisis, se construyen dos herramientas de diagnóstico que permiten su aplicación al estudio de empresas sociales: una tabla de indicadores para el análisis externo (por parte de un investigador ajeno a la organización) y un cuestionario de diagnóstico para el análisis interno (a través del personal de la empresa social objeto de estudio). Las herramientas intentan dar respuesta a la necesidad de desarrollar constructos para el estudio empírico de las empresas sociales. Para analizar la utilidad del modelo y de las herramientas se llevaron a cabo tres estudios de caso: -La empresa social ACCIONA Microenergía Perú que proporciona energía eléctrica a comunidades rurales aisladas en la región peruana de Cajamarca. -La empresa social Integra-e que propone un mecanismo de inserción socio-laboral en Madrid para jóvenes en riesgo de exclusión a través de la formación en Tecnologías de la Información y la Comunicación (TIC). -Un conjunto de redes de telecentros pertenecientes a la red LAC de la fundación Telecentres.org que proporcionan acceso a servicios de información (Internet entre otros) en diferentes países de Latinoamérica. La aplicación de las herramientas mostró ser útil en los tres estudios de caso para obtener una relación de evidencias con las que analizar la proximidad de una organización al ideal de empresa social. El ejercicio de análisis también resultó interesante como ejercicio reflexivo para las entidades participantes. Los resultados del cuestionario fueron especialmente interesantes en los telecentros de la Fundación Telecentre.org ya que al ser un estudio multicaso se pudo realizar un rico análisis estadístico sobre el funcionamiento de los telecentros y su desempeño. El estudio permitió identificar relaciones interesantes entre los ocho elementos de diseño del modelo propuesto y el desempeño de la organización. En particular, se detectó que para todos los casos estudiados: -La dimensión económica es la componente del desempeño que mayor desafíos plantea. -La existencia de una alta correlación entre el desempeño y siete de los ocho elementos organizativos del modelo. -La importancia de la cultura organizativa como elemento que explica el desempeño global de la organización y la satisfacción de los empleados. El campo de la empresa social presenta importantes retos de futuro, como la claridad conceptual, el desarrollo de estudios empíricos y la medida de su impacto social. El conocimiento de las claves organizativas puede ayudar a diseñar empresas sociales más robustas o a que organizaciones con fines sociales que no se basan en mecanismos de mercado consideren la posibilidad de incorporar éstos en su estrategia. ABSTRACT Social enterprise is an organizational model with a strong potential to help solving social problems. Recently, interest for the model has risen in both industrialized and developing countries because it is organized to achieve altruistic or social goals through market activities (mainly sales of products and services). Despite its historic roots, it is a relatively young field of research, where academic literature has little empirical data to accompany the theoretical development of social enterprise. Conceptual clarification has been the main challenge during the recent years, and there has been little attention given to generate evidence on how social enterprises operate and their keys to success. Progress in empirical study involves the construction of tools for researchers, in order to increase understanding of the internal mechanisms of social enterprises. This thesis aims to create a conceptual framework to study social enterprises from an organizational point of view, by analyzing the key elements that explain the operation and organization of this organizational model. The framework for the organizational analysis of social enterprises was built supported by the semantic analysis of 45 main definitions of social enterprise. The framework is divided into two dimensions: -There are four principles which capture the essence of the social enterprise concept, and are present in the manifestations of cases. -There are eight design elements which help analyze the characteristics of each particular social enterprise initiative: the social value proposition, social impact orientation, organizational culture, links to beneficiaries, entrepreneurial leadership, collaborative ecosystem, entrepreneurial strategy and orientation to economic self-sufficiency. Two diagnostic tools were developed to apply the framework to case studies: a scoreboard of indicators (to be used by the researcher during external analysis of the organization) and a questionnaire (to be answered by the social enterprise staff). The dissertation undertakes the study of three case studies: -ACCIONA Microenergia Peru, a social enterprise that provides electricity to isolated rural communities in the Peruvian region of Cajamarca. -Integra-e, a social enterprise located in Madrid that promotes socioprofessional integration of young people through training in ICT. -A sample of telecenters of the LAC network that provide access to information services (such as Internet) in Latin America. Applying the tools proved to be useful in all three cases, because it helped to obtain evidence to compare the proximity of an organization to an ideal type of social enterprise. In all the cases studied, the economic sustainability proved to be the biggest challenge for the organizations. The application of the questionnaire to the telecenters was especially informative because it was a multicase study which provided a rich statistical analysis on the performance of call centers. The study identified unique relationships between the model elements and the organziation performance. A statistical analysis shows a high correlation between performance and seven organizational elements described in the model. The organizational culture seems to be an important factor in explaining the overall organizational performance and employee satisfaction. The field of social enterprise has significant future challenges -such as conceptual clarity, the development of empirical studies and social impact assessment. A deep understanding of key organizational aspects of social enterprises can help in the design of more robust organizations and to bring success to social-purpose organizations.

México es de los pocos países en el mundo que ha realizado dos grandes programas para la construcción de autopistas en colaboración con el sector privado. El primero, fue realizado entre 1989 y 1994, con resultados adversos por el mal diseño del esquema de concesiones; y, el segundo con mejores resultados, en operación desde 2003 mediante nuevos modelos de asociación público-privada (APP). El objetivo de la presente investigación es estudiar los modelos de asociación público-privada empleados en México para la provisión de infraestructura carretera, realizando el análisis y la evaluación de la distribución de riesgos entre el sector público y privado en cada uno de los modelos con el propósito de establecer una propuesta de reasignación de riesgos para disminuir el costo global y la incertidumbre de los proyectos. En la primera parte se describe el estado actual del conocimiento de las asociaciones público-privadas para desarrollar proyectos de infraestructura, incluyendo los antecedentes, la definición y las tipologías de los esquemas APP, así como la práctica internacional de programas como el modelo británico Private Finance Initiative (PFI), resultados de proyectos en la Unión Europea y programas APP en otros países. También, se destaca la participación del sector privado en el financiamiento de la infraestructura del transporte de México en la década de 1990. En los capítulos centrales se aborda el estudio de los modelos APP que se han utilizado en el país en la construcción de la red de carreteras de alta capacidad. Se presentan las características y los resultados del programa de autopistas 1989-94, así como el rescate financiero y las medidas de reestructuración de los proyectos concesionados, aspectos que obligaron a las autoridades mexicanas a cambiar la normatividad para la aprobación de los proyectos según su rentabilidad, modificar la legislación de caminos y diseñar nuevos esquemas de colaboración entre el gobierno y el sector privado. Los nuevos modelos APP vigentes desde 2003 son: nuevo modelo de concesiones para desarrollar autopistas de peaje, modelo de proyectos de prestación de servicios (peaje sombra) para modernizar carreteras existentes y modelo de aprovechamiento de activos para concesionar autopistas de peaje en operación a cambio de un pago. De estos modelos se realizaron estudios de caso en los que se determinan medidas de desempeño operativo (niveles de tráfico, costos y plazos de construcción) y rentabilidad financiera (tasa interna de retorno y valor presente neto). En la última parte se efectúa la identificación, análisis y evaluación de los riesgos que afectaron los costos, el tiempo de ejecución y la rentabilidad de los proyectos de ambos programas. Entre los factores de riesgo analizados se encontró que los más importantes fueron: las condiciones macroeconómicas del país (inflación, producto interno bruto, tipo de cambio y tasa de interés), deficiencias en la planificación de los proyectos (diseño, derecho de vía, tarifas, permisos y estimación del tránsito) y aportaciones públicas en forma de obra. Mexico is one of the few countries in the world that has developed two major programs for highway construction in collaboration with the private sector. The first one was carried out between 1989 and 1994 with adverse outcomes due to the wrong design of concession schemes; and, the second one, in operation since 2003, through new public-private partnership models (PPPs). The objective of this research is to study public-private partnership models used in Mexico for road infrastructure provision, performing the analysis and evaluation of risk’s distribution between the public and the private sector in each model in order to draw up a proposal for risk’s allocation to reduce the total cost and the uncertainty of projects. The first part describes the current state of knowledge in public-private partnership to develop infrastructure projects, including the history, definition and types of PPP models, as well as international practice of programs such as the British Private Finance Initiative (PFI) model, results in the European Union and PPP programs in other countries. Also, it stands out the private sector participation in financing of Mexico’s transport infrastructure in 1990s. The next chapters present the study of public-private partnerships models that have been used in the country in the construction of the high capacity road network. Characteristics and outcomes of the highway program 1989-94 are presented, as well as the financial bailout and restructuring measures of the concession projects, aspects that forced the Mexican authorities to change projects regulations, improve road’s legislation and design new schemes of cooperation between the Government and the private sector. The new PPP models since 2003 are: concession model to develop toll highways, private service contracts model (shadow toll) to modernize existing roads and highway assets model for the concession of toll roads in operation in exchange for a payment. These models were analyzed using case studies in which measures of operational performance (levels of traffic, costs and construction schedules) and financial profitability (internal rate of return and net present value) are determined. In the last part, the analysis and assessment of risks that affect costs, execution time and profitability of the projects are carried out, for both programs. Among the risk factors analyzed, the following ones were found to be the most important: country macroeconomic conditions (inflation, gross domestic product, exchange rate and interest rate), deficiencies in projects planning (design, right of way, tolls, permits and traffic estimation) and public contributions in the form of construction works.

Recent economic data points to the seeds of an economic recovery in the European Union. However, significant risks remain and bold policies are still needed. There are three central risks. Competitiveness adjustment is incomplete, casting doubt on the sustainability of public debt. Banking remains unstable and fragmented along national lines, resulting in unfavorable financial conditions, which further erode growth, job creation and competitiveness. Rising unemployment, especially among the young, is inequitable, unjust and politically risky. Germany has a central role to play in addressing these risks. The new German government should work on three priorities: Domestic economic policy should be more supportive of growth and adjustment, with higher public investment, a greater role for high-value added services, and more supportive immigration policy. Germany should support a meaningful banking union with a centralised resolution mechanism requiring a transfer of sovereignty to Europe for all countries including Germany. The establishment of a private investment initiative combined with a European Youth Education Fund and labour market reforms should be promoted. Building on these priorities, a significant deepening of the euro area is needed, with a genuine transfer of sovereignty, stronger institutions and democratically legitimate decision-making structures in areas of common policy.

Over the past ten to twenty years, Belarus has seen a steep rise in the number of local dollar millionaires. This has somewhat undermined the myth of an egalitarian model of society promoted through the Belarusian state propaganda. There is a small group of businessmen among the top earners who, in exchange for their political loyalty and their consent to share profits with those in power, have enjoyed a number of privileges that allow them to safely conduct business in an environment typically hostile to private enterprise. The favourable conditions under which they are operating have enabled them not only to accumulate substantial capital, but also to invest it abroad. However, since such businesses are seen as providing a financial safety net for the regime, in 2011 and 2012 some of their directors received an EU travel ban, while their companies were subjected to economic sanctions by Brussels. At the same time, fearing that Belarus’s big business could become powerful enough to influence the country’s political scene (as has been the case in Russia and Ukraine), Alexander Lukashenka has actively prevented such players from becoming too independent. Consequently, Belarus has so far not developed its own elite class of oligarchs who would be able to actively influence government policy. The current informal agreement between the government in Minsk and big business has proved stable and is unlikely to change in the near future. Nonetheless, a reordering of state power giving Belarus’s big business significant political influence would be possible should Mr Lukashenka lose power in the next presidential election.

The contemporary understanding of public sector risk management entails a broadening of the traditional bureaucratic approach to risk beyond the boundaries of purely financial risks. However, evidence suggests that in reality public sector risk management does not always match the rhetoric. This paper focuses on the apparent inadequacy of any risk framework in the current Prudential Borrowing Framework (PBF) guidance in relation to that which was developed under Public Private Partnerships and Private Finance Initiative (PFI). Our analysis shows that the PBF and its associated indicators for local authorities adopt a narrow financial approach and fail to account for the full range of potential risks associated with capital projects. The PBF does not provide a framework for local authorities to consider long-term risk and fails to encourage understanding of the generic nature of risk. The introduction of the PBF appears to represent a retrograde step from PPP/PFI as regards risk and risk management.

The role of technology management in achieving improved manufacturing performance has been receiving increased attention as enterprises are becoming more exposed to competition from around the world. In the modern market for manufactured goods the demand is now for more product variety, better quality, shorter delivery and greater flexibility, while the financial and environmental cost of resources has become an urgent concern to manufacturing managers. This issue of the International Journal of Technology Management addresses the question of how the diffusion, implementation and management of technology can improve the performance of manufacturing industries. The authors come from a large number of different countries and their contributions cover a wide range of topics within this general theme. Some papers are conceptual, others report on research carried out in a range of different industries including steel production, iron founding, electronics, robotics, machinery, precision engineering, metal working and motor manufacture. In some cases they describe situations in specific countries. Several are based on presentations made at the UK Operations Management Association's Sixth International Conference held at Aston University at which the conference theme was 'Achieving Competitive Edge: Getting Ahead Through Technology and People'. The first two papers deal with questions of advanced manufacturing technology implementation and management. Firstly Beatty describes a three year longitudinal field study carried out in ten Canadian manufacturing companies using CADICAM and CIM systems. Her findings relate to speed of implementation, choice of system type, the role of individuals in implementation, organization and job design. This is followed by a paper by Bessant in which he argues that a more a strategic approach should be taken towards the management of technology in the 1990s and beyond. Also considered in this paper are the capabilities necessary in order to deploy advanced manufacturing technology as a strategic resource and the way such capabilities might be developed within the firm. These two papers, which deal largely with the implementation of hardware, are supplemented by Samson and Sohal's contribution in which they argue that a much wider perspective should be adopted based on a new approach to manufacturing strategy formulation. Technology transfer is the topic of the following two papers. Pohlen again takes the case of advanced manufacturing technology and reports on his research which considers the factors contributing to successful realisation of AMT transfer. The paper by Lee then provides a more detailed account of technology transfer in the foundry industry. Using a case study based on a firm which has implemented a number of transferred innovations a model is illustrated in which the 'performance gap' can be identified and closed. The diffusion of technology is addressed in the next two papers. In the first of these, by Lowe and Sim, the managerial technologies of 'Just in Time' and 'Manufacturing Resource Planning' (or MRP 11) are examined. A study is described from which a number of factors are found to influence the adoption process including, rate of diffusion and size. Dahlin then considers the case of a specific item of hardware technology, the industrial robot. Her paper reviews the history of robot diffusion since the early 1960s and then tries to predict how the industry will develop in the future. The following two papers deal with the future of manufacturing in a more general sense. The future implementation of advanced manufacturing technology is the subject explored by de Haan and Peters who describe the results of their Dutch Delphi forecasting study conducted among a panel of experts including scientists, consultants, users and suppliers of AMT. Busby and Fan then consider a type of organisational model, 'the extended manufacturing enterprise', which would represent a distinct alternative pure market-led and command structures by exploiting the shared knowledge of suppliers and customers. The three country-based papers consider some strategic issues relating manufacturing technology. In a paper based on investigations conducted in China He, Liff and Steward report their findings from strategy analyses carried out in the steel and watch industries with a view to assessing technology needs and organizational change requirements. This is followed by Tang and Nam's paper which examines the case of machinery industry in Korea and its emerging importance as a key sector in the Korean economy. In his paper which focuses on Venezuela, Ernst then considers the particular problem of how this country can address the problem of falling oil revenues. He sees manufacturing as being an important contributor to Venezuela's future economy and proposes a means whereby government and private enterprise can co-operate in development of the manufacturing sector. The last six papers all deal with specific topics relating to the management manufacturing. Firstly Youssef looks at the question of manufacturing flexibility, introducing and testing a conceptual model that relates computer based technologies flexibility. Dangerfield's paper which follows is based on research conducted in the steel industry. He considers the question of scale and proposes a modelling approach determining the plant configuration necessary to meet market demand. Engstrom presents the results of a detailed investigation into the need for reorganising material flow where group assembly of products has been adopted. Sherwood, Guerrier and Dale then report the findings of a study into the effectiveness of Quality Circle implementation. Stillwagon and Burns, consider how manufacturing competitiveness can be improved individual firms by describing how the application of 'human performance engineering' can be used to motivate individual performance as well as to integrate organizational goals. Finally Sohal, Lewis and Samson describe, using a case study example, how just-in-time control can be applied within the context of computer numerically controlled flexible machining lines. The papers in this issue of the International Journal of Technology Management cover a wide range of topics relating to the general question of improving manufacturing performance through the dissemination, implementation and management of technology. Although they differ markedly in content and approach, they have the collective aim addressing the concepts, principles and practices which provide a better understanding the technology of manufacturing and assist in achieving and maintaining a competitive edge.

The text analyzes the impact of the economic crisis in some critical aspects of the National Health System: outcomes, health expenditure, remuneration policy and privatization through Private Public Partnership models. Some health outcomes related to social inequalities are worrying. Reducing public health spending has increased the fragility of the health system, reduced wage income of workers in the sector and increased heterogeneity between regions. Finally, the evidence indicates that privatization does not mean more efficiency and better governance. Deep reforms are needed to strengthen the National Health System.

Commodification of the public healthcare system has been a growing process in recent decades, especially in universal healthcare systems and in high-income countries like Spain.  There are substantial differences in the healthcare systems of each autonomous region of Spain, among which Catalonia is characterized by having a mixed healthcare system with complex partnerships and interactions between the public and private healthcare sectors.  Using a narrative review approach, this article addresses various aspects of the Catalan healthcare system, characterizing the privatization and commodification of health processes in Catalonia from a historical perspective with particular attention to recent legislative changes and austerity measures.  The article approximates, the eventual effects that commodification and austerity measures will have on the health of the population and on the structure, accessibility, effectiveness, equity and quality of healthcare services.
