The Ph.D. dissertation analyses the reasons for which political actors (governments, legislatures and political parties) decide consciously to give away a source of power by increasing the political significance of the courts. It focuses on a single case of particular significance: the passage of the Constitutional Reform Act 2005 in the United Kingdom. This Act has deeply changed the governance and the organization of the English judicial system, has provided a much clearer separation of powers and a stronger independence of the judiciary from the executive and the legislative. What’s more, this strengthening of the judicial independence has been decided in a period in which the political role of the English judges was evidently increasing. I argue that the reform can be interpreted as a «paradigm shift» (Hall 1993), that has changed the way in which the judicial power is considered. The most diffused conceptions in the sub-system of the English judicial policies are shifted, and a new paradigm has become dominant. The new paradigm includes: (i) stronger separation of powers, (ii) collective (as well as individual) conception of the independence of the judiciary, (iii) reduction of the political accountability of the judges, (iv) formalization of the guarantees of judicial independence, (v) principle-driven (instead of pragmatic) approach to the reforms, and (vi) transformation of a non-codified constitution in a codified one. Judicialization through political decisions represent an important, but not fully explored, field of research. The literature, in particular, has focused on factors unable to explain the English case: the competitiveness of the party system (Ramseyer 1994), the political uncertainty at the time of constitutional design (Ginsburg 2003), the cultural divisions within the polity (Hirschl 2004), federal institutions and division of powers (Shapiro 2002). All these contributes link the decision to enhance the political relevance of the judges to some kind of diffusion of political power. In the contemporary England, characterized by a relative high concentration of power in the government, the reasons for such a reform should be located elsewhere. I argue that the Constitutional Reform Act 2005 can be interpreted as a result of three different kinds of reasons: (i) the social and demographical transformations of the English judiciary, which have made inefficient most of the precedent mechanism of governance, (ii) the role played by the judges in the policy process and (iii) the cognitive and normative influences originated from the European context, as a consequence of the membership of the United Kingdom to the European Union and the Council of Europe. My thesis is that only a full analysis of all these three aspects can explain the decision to reform the judicial system and the content of the Constitutional Reform Act 2005. Only the cultural influences come from the European legal complex, above all, can explain the paradigm shift previously described.

Volunteering rates in Switzerland vary substantially across language regions. In this article, we investigate the cultural roots of this variation by presenting and empirically testing two different conceptualizations of how linguistic culture is related to individual volunteering. Whereas the first perspective perceives the individual as belonging to a particular language community and its norms and values as crucial for individual volunteering, the other sees the linguistic culture mainly as an important context in which an individual lives and which therefore influences individual volunteering. Empirically, we base our analysis on new survey data from 60 Swiss communes and apply a Bayesian multi-level analysis in order to disentangle the linguistic group from contextual effects. Our analysis supports the view that cultural patterns of civic self-organization can indeed explain regional volunteering behaviour in Switzerland. Whereas the propensity to volunteer is generally highest in German-speaking Switzerland, our findings reveal that it is the group of French speakers that exhibits the highest propensity to volunteer when controlling for language region.

Research in prehistoric sites of lakes and bogs around the Alps started more than 150 years ago. In 2004 Switzerland took the initiative to propose an international UNESCO world heritage nomination, which was successful in 2011. Six countries – Austria, France, Germany, Italy, Slovenia and Switzerland – joined forces to obtain the precious label for an invisible cultural heritage of outstanding universal value. Archaeological sites under water or in bogs are of special importance because objects made of organic material like wood, bark, plant fibres and others survive in this milieu for hundred or thousands of years. The alpine pile-dwelling sites offer a highly precise dating possibility by using dendrochronology. All in all these sites have a high scientific potential but run also risks of long term conservation. Beside the scientific chances there are risks to consider: public access is difficult and a major challenge. New ideas are demanded to keep alive public interest.

Se hacen breves reflexiones sobre la poesía religiosa argentina, a partir de la aún escasa bibliografía sobre el tema, y se aportan nuevos datos, con la idea de que, a partir de ellos, otros críticos literarios o historiadores de la cultura puedan ampliar la delimitación de su corpus y perfeccionar la sistematización y la interpretación de la misma. Dentro de este contexto, se analiza un libro de reciente aparición: “Intensidad secreta", de Mariana Genoud de Fourcade, obra que se inscribe dentro de esta temática.

La dictadura militar chilena (1973-1989) llevó a acabo una revolución neoliberal de tal nivel que refundó a la sociedad en general. Una parte importante de ella fue arrasada en su rol opositor, borrando a las organizaciones políticas para poder lograr una hegemonía social que le permitiera asentar sus raíces. Por ello los espacios artísticos y culturales dentro del arte -específicamente las peñas folklóricas- ayudaron a la articulación entre los individuos dispersos, sobre todo entre los jóvenes disidentes. Las peñas fueron evolucionando en su desarrollo, implicando a diferentes instancias culturales. Fue un lugar de agrupamiento para entorno al arte y como expresión de la politica. Ellas fueron un producto de la cultura y un elemento importante a la hora de promover la empatía, la solidaridad y la organización social. Las peñas permitieron la reactivación y reunificación del movimiento popular chileno. Se convirtieron en el cauce de un movimiento alternativo de difusión, de expresión, de política y de subjetividades, en paralelo a las disposiciones culturales del régimen de facto. La cultura se transformó en el mayor y en el más diverso de los espacios de desarrollo y expresión democrática que tuvieron los grupos opositores durante la dictadura militar, sobre todo para los jóvenes militantes

During Leg 125, two serpentinite seamounts were drilled in the Mariana and Izu-Ogasawara forearcs. Together with abundant serpentinized peridotites, low-grade metamorphic rocks were recovered from both seamounts. The metamorphic rocks obtained from Hole 778A on Conical Seamount on the Mariana forearc contain common blueschist facies minerals, lawsonite, aragonite, blue amphibole, and sodic pyroxene. Approximate metamorphic conditions of these rocks are 150° to 250° C and 5 to 6 kb. These rocks are considered to have been uplifted by diapirism of serpentinite from a deeper portion within the subduction zone. This discovery presents direct evidence that blueschist facies metamorphism actually takes place within a subduction zone and provides new insight about trench-forearc tectonics. The diagnostic mineral assemblage of the metamorphic rocks from Holes 783A and 784A on Torishima Forearc Seamount, in the Izu-Ogasawara region, is actinolite + prehnite + epidote, with a subassemblage of chlorite + quartz + albite + H2O, which is typical of low-pressure type, prehnite-actinolite facies of Liou et al. (1985). This metamorphism may represent ocean-floor metamorphism within trapped oceanic crust or in-situ metamorphism that occurred at depths beneath the island-arc.

Geophysical surveys of the Mariana forearc, in an area equidistant from the Mariana Trench and the active Mariana Island Arc, revealed a 40-m-deep graben about 13 km northwest of Conical Seamount, a serpentine mud volcano. The graben and its bounding horst blocks are part of a fault zone that strikes northwest-southeast beneath Conical Seamount. One horst block was drilled during Leg 125 of the Ocean Drilling Program (Site 781). Three lithologic units were recovered at Site 781: an upper sedimentary unit, a middle basalt unit, and a lower sedimentary unit. The upper unit, between 0 and 72 mbsf, consists of upper Pliocene to Holocene diatomaceous and radiolarian-bearing silty clay that grades down into vitric silty clay and vitric clayey silt. The middle unit is a Pleistocene vesicular, porphyritic basalt, the top of which corresponds to a high-amplitude reflection on the reflection profiles. The lower unit is a middle to upper (and possibly some lower) Pliocene vitric silty clay and vitric clayey silt similar to the lower part of the upper unit. The thickness of the basalt unit can only be estimated to be between 13 and 25 m because of poor core recovery (28% to 55%). The absence of internal flow structures and the presence of an upper glassy chilled zone and a lower, fine-grained margin suggest that the basalt unit is either a single lava flow or a near-surface sill. The basalt consists of plagioclase phenocrysts with subordinate augite and olivine phenocrysts and of plagioclase-augite-olivine glomerocrysts in a groundmass of plagioclase, augite, olivine, and glass. The basalt is an island arc tholeiite enriched in large-ion-lithophile elements relative to high-field-strength elements, similar to the submarine lavas of the southern arc seamounts. In contrast, volcanic rocks from the active volcanoes on Pagan and Agrigan islands, 100 km to the west of the drill site, are calc-alkaline. The basalt layer, the youngest in-situ igneous layer reported from the Izu-Bonin and Mariana forearcs, is enigmatic because of its location more than 100 km from the active volcanic arc. The sediment layers above and below the basalt unit are late Pliocene in age (about 2.5 Ma) and normally magnetized. The basalt has schlierenlike structures, reverse magnetization, and a K-Ar age of 1.68±0.37 Ma. Thus, the basalt layer is probably a sill fed by magma intruded along a fault zone bounding the horst and graben in the forearc. The geochemistry of the basalt is consistent with a magma source similar to that of the active island arc and from a mantle source above the subducting Pacific plate.

Major and trace element analyses are presented for 110 samples from the DSDP Leg 60 basement cores drilled along a transect across the Mariana Trough, arc, fore-arc, and Trench at about 18°N. The igneous rocks forming breccias at Site 453 in the west Mariana Trough include plutonic cumulates and basalts with calc-alkaline affinities. Basalts recovered from Sites 454 and 456 in the Mariana Trough include types with compositions similar to normal MORB and types with calc-alkaline affinities within a single hole. At Site 454 the basalts show a complete compositional transition between normal MORB and calc-alkaline basalts. These basalts may be the result of mixing of the two magma types in small sub-crustal magma reservoirs or assimilation of calc-alkaline, arc-derived vitric tuffs by normal MORB magmas during eruption or intrusion. A basaltic andesite clast in the breccia recovered from Site 457 on the active Mariana arc and samples dredged from a seamount in the Mariana arc are calc-alkaline and similar in composition to the basalts recovered from the Mariana Trough and West Mariana Ridge. Primitive island arc tholeiites were recovered from all four sites (Sites 458-461) drilled on the fore-arc and arc-side wall of the trench. These basalts form a coherent compositional group distinct from the Mariana arc, West Mariana arc, and Mariana Trough calc-alkaline lavas, indicating temporal (and perhaps spatial?) chemical variations in the arc magmas erupted along the transect. Much of the 209 meters of basement cored at Site 458 consists of endiopside- and bronzite-bearing, Mg-rich andesites with compositions related to boninites. These andesites have the very low Ti, Zr, Ti/Zr, P, and rare-earthelement contents characteristic of boninites, although they are slightly light-rare-earth-depleted and have lower MgO, Cr, Ni, and higher CaO and Al2O3 contents than those reported for typical boninites. The large variations in chemistry observed in the lavas recovered from this transect suggest that diverse mantle source compositions and complex petrogenetic process are involved in forming crustal rocks at this intra-oceanic active plate margin.

A presente dissertação teve como objetivos contextualizar e analisar as perspectivas da educação salesiana a partir do documento das Linhas Orientadoras da Missão Educativa do Instituto das Filhas de Maria Auxiliadora, tendo em vista aprofundar o contexto histórico e sociocultural da fundação do Instituto das Filhas de Maria Auxiliadora e do desenvolvimento da missão educativa salesiana, com a finalidade de atuar no campo da educação, indicar os fundamentos interdisciplinares que compreendem os fundamentos teóricos para a prática educativa em relação aos aspectos sociológicos, antropológicos, teológicos e pedagógicos, além de algumas experiências práticas da educação salesiana. A pesquisa considera a contextualização da sua prática educativa a partir de diversas contribuições teóricas realizadas em torno da história do Instituto e dos conhecimentos interdisciplinares que integram seus propósitos e seus projetos educativos. Com a perspectiva de analisar as orientações e conteúdos do documento é utilizada a técnica da análise documental que permite interpretar o seu significado, analisar e indicar algumas perspectivas de educação salesiana presentes no documento e que envolvem os seus princípios, propósitos e as suas ações em relação à educação. Por meio da observação participante alguns aspectos práticos das perspectivas da educação salesiana foram demonstrados. Portanto, a investigação permite o mapeamento das perspectivas fundamentais da educação salesiana a partir das Linhas Orientadoras e a possibilidade de aprofundar a significatividade das perspectivas de referência para a prática educativa conforme são indicadas no documento: as dimensões cultural, evangelizadora, social e comunicativa da educação, que são os elementos e princípios fundamentais do Sistema Educativo Salesiano. A concepção de educação salesiana que se constrói a partir de uma visão interdisciplinar, complexa e dimensional, com uma perspectiva de uma estratégia projetual. Os seus princípios integram alguns valores que são considerados como fundamentais para a realização de uma educação integral: a comunidade educativa, o trabalho educativo realizado em equipe, a espiritualidade juvenil, a preventividade e a pedagogia do ambiente. Sobretudo, os núcleos centrais indicados pelo documento orientam as comunidades para a realização de um pensamento projetual, considerando as diversas dimensões da educação, com uma especial abertura para uma contínua projeção das suas intenções e da sua prática educativa. Enfim, encontramos algumas contribuições para a educação a partir do pensamento pedagógico e prático da educação salesiana, especialmente em relação à proposta de pensar a educação de forma complexa e multidimensional.

A globalizálódó világgazdaságban a vezető bortermelő országok egyre jelentősebb borkereskedelmet bonyolítanak le egymás között. Míg Európában a fogyasztók egyre kevesebb bort vásárolnak, addig Amerikában és Ázsiában a bor iránti kereslet folyamatosan bővül: a borkereskedelem földrajzi átrendeződése zajlik. A kulturális hasonlóság és a földrajzi távolság kereskedelemre gyakorolt hatását gyakran a kereskedelemelméletek gravitációs modelljével elemzik. E tanulmány azt vizsgálja, hogy a fő borexportáló országok közötti földrajzi távolság, kulturális hasonlóság és szabadkereskedelem milyen hatással van a nemzetközi borkereskedelemre, annak költségeire. A regressziós becslés eredményei alátámasztják, hogy a borkereskedelem költségei alacsonyabbak, ha a kereskedelmi partnerek kulturálisan hasonlók, földrajzilag közel helyezkednek el egymáshoz, vagy van tengeri kikötőjük, tagjai a WTO-nak, illetve ha kötöttek egymással regionális kereskedelmi megállapodást. Ezenkívül megállapítható, hogy az angolszász, a latin-amerikai és az európai kulturális klaszterek elsősorban egymással kereskednek. A kutatás számos kulturális változó alkalmazásával és több ökonometriai modell, illetve becslési eljárás nagymintás tesztelésével gazdagítja a szakirodalmat. ____ In a globalizing world, major wine-producing countries export considerable quantities to the global wine market and turn over a notable trade, but in what happens European wine regions differ markedly from the New World. Here major wine producers suffered a remarkable fall in domestic wine consumption in recent decades, while New World wine producers increased their production potential and generated new foreign demand. The changes have been joined by geographical relocation of wine consumption and exports. The gravity equation can be derived from demand-side or supply-side theory-consistent estimation methods that suggest relationships between the size of the economies, geographical distances, cultural similarities, and size of their trade. The paper analyses the effects of cultural and geographical proximity, free trade, and linguistic similarity on bilateral trade in the main wine-producing countries, using a cross-section gravity model for 2012. The results suggest that larger countries export more wine, while transport costs rise in line with geographical distance and are higher for landlocked trading partners. Wine export costs are lower if trading partners are culturally similar, share a dominant religion, or are both WTO members with regional trade agreements. Anglo-Saxon, Germanic, Latin American and Latin European countries mainly trade wines within their groups. The paper looks to extend the number of trading partners, investigate the effect of language clusters, and confirm that the results are robust by different econometric methodologies.
