A formação do Brasil pela legislação: análise e crítica da utopia burocrática colonial

A presente dissertação procura estabelecer uma problematização do paradigma estatalizante na historiografia sobre o Brasil colonial, a partir dos limites reais do Estado na implementação do projeto civilizatório para o Brasil expresso na iniciativa legal da metrópole. Confronta o conceito construído de Estado moderno e as políticas que presidiram a expansão ultramarina e a colonização brasileira.

POLUIÇÃO: INCOMPATIBILIDADES ENTRE CONCEITOS LEGAL E TÉCNICO

Este artigo apresenta o método, critérios e resultados obtidos a partir da comparação de conceitos legal e técnico do termo poluição. Objetivou constatar se tal conceito está sendo redigido de forma clara ou de forma imprecisa e verificar a existência de eventuais incompatibilidades entre eles. Foram consultadas diferentes fontes para selecionar os conceitos, tais como: livros, artigos, legislação, decisões judiciais, dicionários, glossários, mídias eletrônicas, internet. O método científico utilizado foi o método comparativo. Foi estabelecido o elemento constituinte essencial do conceito poluição, a partir daquilo que lhe era essencial, principal, necessário, universal, geral, comum. A comparação resultou em três possibilidades de classificação: 1. reprodução literal do conceito legal; 2. a essência do conceito técnico está em consonância com a essência do conceito legal; 3. a essência do conceito técnico não está em consonância com a essência do conceito legal (com as devidas justificativas). Com o desenvolvimento da pesquisa foi possível constatar e apontar a existência de incompatibilidades entre os conceitos legal e técnico. O artigo procura discutir a situação de trabalho da mulher na área rural, a partir do levantamento de questões ligadas á prática trabalhista, à sindicalização da mulher e ao seu nível de consciência diante dos direitos e das suas condições de vida.

Web colaborativa: inovação na criação, proteção e uso legal de informação

In the contemporary world, the Internet enables the development of a Collaborative Web where the decentralization and sharing of information and knowledge generate new cultural configurations of increasing representation in informational flows. In this environment, collaboration and remix practices are covered by a legislation established for another context, and an imbalance is created between what is provided by the technology and what is established by Copyright. Therefore, it is necessary to address, under the perspective of the third time in Information Science, contemporary issues concerning creation, recreation, use, reuse, sharing and dissemination of intellectual content under the legislation which regulates them. This article seeks to highlight the dilemma that contemporaneity is experiencing and how important is for both society as a whole and specially the professional of Information Science to know the legal conditions for the processes of generating, processing, using, recovering and, especially, re-using information on the Web at a larger scale. The Creative Commons licenses are emerging alternatives that offer individuals options to become not only users but also holders and creators of intellectual content under legal conditions.

A importância da reserva legal para a preservação da fauna e flora existentes nas propriedades rurais de Botucatu

The main objective of this study was elaborating a diagnosis of technical conditions of Legal Reserves situation on the rural properties in Botucatu. In addition, considering the characteristics of fauna and flora and the economic aspects of these areas, it was presented alternatives to encourage the correct implantation and the effective preservation of the Legal Reserves. Because these areas contribute to the maintenance of local biodiversity and to availability of environmental services essential for all living creatures. In this study it was observed the presence of native vegetation in 13% of the rural properties’ areas in Botucatu, it is therefore necessary the recovery (reforestation) of 7% of all the rural properties’ areas, to be achieved the 20% of native vegetation (minimum area to be preserved as Legal Reserve, as disposed in Federal Law nº 12.651/12) on rural properties. A viable and significant alternative for recovery these areas, reinforced by the new forestry law, is the practice of sustainable management, that must be carried in harmony with conventional farming practices existing in the remaining areas of rural properties

A intervenção do estado na vida familiar: um estudo da legislação a respeito

Atualmente, a criança e o adolescente são alvo de muitas discussões acerca de seu papel na sociedade e suas responsabilidades. O Estatuto da criança e do adolescente define os direitos dos menores e tem como objetivo garantir a proteção dos mesmos. As crianças sofriam junto com os adultos à falta de controle, mas com a criação de leis a sociedade passar a exercer um maior controle sobre o indivíduo. Diante do progresso da sociedade e todas as transformações que ocorrem neste mundo globalizado essa pesquisa, visa analisar a intervenção do Estado através destas leis e averiguar se elas assumem um papel importante nas famílias

A antropogeomorfologia na bacia do Córrego do Cavalheiro - Analândia/SP: uma avaliação da dinâmica do uso da terra e sua adequabilidade a legislação ambiental e a capacidade de uso

The assessment of land use dynamic can be an instrument for analysis in anthropogeomorphology, which would allow one to verify the human geomorphological actions and its various implications in changing the original morphology for the creation of a human morphology. This study aimed to consider the land use dynamics and its interference in the morphology of Cavalheiro Stream Basin. From this assessment, to understand the implications of land use in the creation of a human morphology, as well as to analyze if the current use is in accordance with the legal restrictions placed by ongoing environmental legislation and with the ability to land use. The chosen of this studied area was due to assumptions raised by Pinton (2007) for changes in the dynamic of rainwater erosion of this area caused by human actions, specially the cultivation of sugar cane in morphologies that are unfit for it. The search took as methodological support the principles that concern the General Systems Theory, trying to see the watershed as an open system. The geomorphological data, of land use and of legal restrictions to the use and occupation of land, were collected from different cartographic techniques. Besides, it was developed a sketch map of land use capacity by adapting the technique proposed by Lepsch (1983). This way, the data obtained in this survey are considered capable to provide subsidies for the identification of changes in original morphology of the Cavalheiro Stream Basin and the genesis of a human morphology, as well as conflicts and adjustments of current land use in environmental system and on the legal restrictions outlined in the ongoing environmental legislation, contributing to a proper environmental planning with the characteristics of the physical environmental system of this basin
