In the post-Enlightenment period, Anglo-American criminal law has been applied with increased force, and an ever expanding scope, to collective actors like corporations and other organizations. Recent scholarship has focused on developing “truly organizational” bases of liability that break with the conventional approach of imputing individual conduct to an organization and instead analyze culpable conduct and intent in a way that reflects the distinct and independent capacity of organizations to pursue their interests or goals collaboratively. In 2004, Canada enacted amendments inspired by these ideas in the hope they would lead to more effective criminal enforcement against organizations. Twelve years later, however, the promise of Bill C-45 is largely unfulfilled. In this thesis, I explore how much of this failure of law reform to deliver transformational change is attributable to an individualist bias that permeates how we think about what it means to be responsible and how this then shapes the responsibility ascription process. Using an analytical framework that combines criminal law theory with selected aspects of rational-structural theory and organization culture, I suggest that a promising way forward may lie in reframing the essential qualities required to be a subject of the criminal law in a way that captures the unique attributes that make organizations different from individuals. The resulting organizational concept of responsible agency allows for an integration of organizational reality into how we assess organizational culpability while keeping the ambit of criminal liability within the limits of what is practicable and fair. This better aligns with the spirit of Bill C-45: to impose criminal liability in a way that takes organizations – and their crimes – seriously.

Avec l’adoption le 4 octobre 2011 par l’Assemblée nationale du Québec du projet de loi 89 intitulé «Loi modifiant la Loi sur la qualité de l’environnement afin d’en renforcer le respect», le législateur est venu renforcer le régime de droit pénal en augmentant la sévérité des peines pour les infractions à Loi sur la qualité de l’environnement. Il a aussi élargi les pouvoirs d’intervention du ministre en lien avec les autorisations qu’il émet. Cependant, la principale réforme apportée par le projet de loi 89 qui touche aux mécanismes même de protection de l’environnement, est la création de toute pièce d’un régime de sanctions dites administratives pécuniaires, parallèlement au régime de sanctions déjà existantes. La première interrogation, soulevée à l’égard des sanctions administratives pécuniaires, et la plus fondamentale, était celle de savoir si le contrevenant devait bénéficier des protections constitutionnelles énoncées à l’article 11 de la Charte canadienne des droits et libertés, tel un inculpé face à une procédure pénale. Puisque nous concluons que ces sanctions relèvent uniquement du droit administratif, nous avons cherché à déterminer quel serait le contenu du devoir d’agir équitablement de l’Administration lors du processus d’émission et de contestation de la sanction administrative pécuniaire.

En assurance de dommages, l’article 2474 C.c.Q. prévoit la possibilité pour l’assureur d’être légalement subrogé dans les droits de l’assuré contre l’auteur du préjudice, à concurrence des indemnités qu’il a payées. L’assureur ne pourra jamais être subrogé contre les personnes faisant partie de la maison de l’assuré. Dans un premier temps, le présent mémoire fait un survol historique du droit à la subrogation de l’assureur en vertu du Code civil. Depuis la codification de 1865, les principes relatifs à la subrogation de l’assureur ne sont pas demeurés statiques. Ils firent l’objet de plusieurs modifications législatives et de nombreuses controverses et développements jurisprudentiels. Dans un deuxième temps, un portrait global de l’état actuel du droit est dressé en ce qui concerne l’article 2474 C.c.Q., tant sur le plan des composantes du droit à la subrogation que de ses aspects procéduraux.

Although some radioecological studies have been accomplished in Brazilian soils supplying useful information to optimization of emergency planning actions in rural areas and to the management of soils contaminated by 137Cs, 60Co and 90Sr, few studies were made with transuranic elements in tropical agricultural areas. The different scenarios found in Brazilian agricultural environments enhance the importance of studying the biogeochemical behavior of radionuclides in representative soils. The objective of this work was to determine the mobility of 241Am in 3 different Brazilian agricultural soils evaluating migration with depth and Kd values for 241Am and the effect of organic amendments on this behavior. A strong effect of organic amendments on mobility of americium could be observed. The values of Kd obtained in all studied tropical soils were however smaller than those found in European soils and from those recommended by IAEA to be used as default values in the absence of regional data. This result reinforces the vulnerability of some tropical soils to a contamination, emphasizing the need to use of regional values.

Abstract: The objectives of this study were to evaluate the combined effects of soil bioticand abiotic factors on the incidence of Fusarium corn stalk rot, during four annual incorporations of two typesofsewagesludge intosoil ina 5-years field assay under tropical conditions and topredict the effectsof these variables on the disease. For each type of sewage sludge, the following treatments were included: control with mineral fertilization recommended for corn; control without fertilization; sewage sludge based on the nitrogen concentration that provided the same amount of nitrogen as in the mineral fertilizer treatment; and sewage sludge that provided two, four and eight times the nitrogen concentration recommended for corn. Increasing dosages of both types of sewage sludge incorporated into soil resulted in increased corn stalk rot incidence, being negatively correlated with corn yield. A global analysis highlighted the effect of the year of the experiment, followed by the sewage sludge dosages. The type of sewage sludge did not affect the disease incidence. Amultiple logistic model using a stepwise procedure was fitted based on the selection of a model that included the three explanatory parameters for disease incidence: electrical conductivity, magnesium and Fusarium population. In the selected model, the probability of higher disease incidence increased with an increase of these three explanatory parameters. When the explanatory parameters were compared, electrical conductivity presented a dominant effect and was the main variable to predict the probability distribution curves of Fusarium corn stalk rot, after sewage sludge application into the soil.

Polychlorinated biphenyls (PCBs) are chemicals largely employed in the industry, banned at the end of the last century yet still persistent in the environment. Bioremediation, namely exploiting bacteria to reduce PCBs’ toxicity, is receiving attention as a promising approach to remediate polluted site in situ. Natural bioremediation is constrained by several factors as the low amount of the required growth substrates (e.g. electron donors, oxygen) and the scarcity of bacteria able to metabolize PCBs. In this regard, use of biodegradable polymers or applied potentials have been demonstrated effective in priming bioremediation of freshwater environments (e.g. river sediments) polluted by chlorinated solvents or PCBs. Yet, little is known regarding the application in marine sediments, where the abundance of anaerobic competitors (i.e. sulfate reducing bacteria) and the different sediment’s features might affect the bioremediation. In this study, polyhydroxyalkanoates (PHAs) and Microbial Electrochemical Technologies (METs) were applied for the first time to prime bioremediation of PCBs polluted marine sediments. The influence of PHAs was studied on the main anaerobic metabolisms and on the microbial community of the heavily polluted sediments coming from the Pialassa della Baiona, a micro-tidal coastal lagoon in Ravenna, and from Mar Piccolo, the marine basin aside Taranto. The impact of METs was deepened by monitoring the physical-chemical parameters and the main anaerobic metabolisms of the sediments coming from Ravenna. The effectiveness of biostimulating with PHAs depended on the features of the treated site, possibly due to the availability of the amendments and to the competition of the indigenous microbial communities. The bioelectrochemical stimulation inhibited the bioremediation process. In both cases, the presence of an inoculated bacterial community was required to perform bioremediation. The collected results led to a comprehensive analysis of the available literature, questioning what could be the further approaches for an effective in situ bioremediation.

In order to increase fertility of agricultural soils, in the framework of circular economy, the use of soil amendments such as biochar, compost, and mixtures of the two, has been implemented in recent years. Although it has been demonstrated that their use can improve the physico-chemical characteristics of soil and plant yield, few studies investigated the effect of these amendments on the soil fauna, and consequently the biological quality of soils. This study aimed to provide information on soil fauna, in particular microarthropods , in plots of an experimental vineyard treated with different soil amendments (biochar, compost, and CB mix, i.e. a mixture of biochar and compost) compared to untreated plots. What emerged from this study is that taxa abundances are significantly increased in compost-treated soil samples compared to untreated and CB mix ones. The value of the QBS-ar index obtained in soil samples treated with CB mix is lower than in samples treated with compost, biochar, and untreated, although the difference was not statistically significant. The physico-chemical soil characteristics are, in general, significantly more favorable in samples treated with CB mix than in the control, although the soil fauna seems to be partially negatively influenced by the treatment with CB mix. In fact, the number of taxa, in particular the number of taxa most adapted to edaphic life, are significantly negatively affected by the application of the CB mix. Concluding, improved physico-chemical characteristics induced by soil amendments do not always correspond to a positive response of the soil fauna, at least with respect to the QBS-ar approach.
