This thesis is a study of -Equality of Opportunity in Public Employment : Judicial Perspectives on Backwardness. This study is an attempt to evaluate the concept of backwardness and equality of opportunity in employment and to assess the judicial perspectives in relation to them. The study reveals that the recent review petition of the Constitution Bench did not assess the decision of Chakradhar and its import. The study reveals that the Indian judiciary could successfully locate and apply the above principles. It was-Justice Subba Rao's nascent attempt in Devadasan which marked the starting point of such a jurisprudential enquiry. Later Thomas developed the thoughts by a reading new meaning and content to equality provisions of the Constitution which included the elimination of inequalities as the positive content of Articles 14 and 16(1) and elevated reservation provision to the same status of equality principles under the Constitution. Soshit, Vasanth Kumar and Mandal supplemented further to the jurisprudential contents. In this process, the courts were guided by the theories of John Rawls, David Miller, Ronald Dworkin, Max Weber and Roscoe Pound. Thus there was a slow and steady process of transformation of the reservation provision. From an anti-meritarian, unenforceable and enabling provision, it reached a stage of equally relevant and explanatory part of fundamental right to equality. Mandal viewed it as a part of sharing of State power. Though this can be seen by rereading and re-joining thoughts of judges in this regard, the judicial approach lacks coherence and concerted efforts in evolving a jurisprudential basis for protective discrimination. The deliberations of the framers of the Constitution reveals that there was much confusion and indeterminacy with regard to the concept of Backwardness. The study shows that the judiciary has been keeping intact the framers’ expectation of having a reasonable quantum of reservation, preventing the undeserved sections from enjoying the benefit, avoiding its abuse and evolving a new criteria and rejecting the old ones.

We investigate the depinning transition occurring in dislocation assemblies. In particular, we consider the cases of regularly spaced pileups and low-angle grain boundaries interacting with a disordered stress landscape provided by solute atoms, or by other immobile dislocations present in nonactive slip systems. Using linear elasticity, we compute the stress originated by small deformations of these assemblies and the corresponding energy cost in two and three dimensions. Contrary to the case of isolated dislocation lines, which are usually approximated as elastic strings with an effective line tension, the deformations of a dislocation assembly cannot be described by local elastic interactions with a constant tension or stiffness. A nonlocal elastic kernel results as a consequence of long-range interactions between dislocations. In light of this result, we revise statistical depinning theories of dislocation assemblies and compare the theoretical results with numerical simulations and experimental data.

Aqua complex ions of metals must have existed since the appearance of water on the earth, and the subsequent appearance of life depended on, and may even have resulted from the interaction of metal ions with organic molecules. Studies on the coordinating ability of metal ions with other molecules and anions culminated in the theories of/\lfred Werner. Thereon the progress in the studies of metal complex chemistry was rapid. Many factors, like the utility and economic importance of metal chemistry, the intrinsic interest _in many of the compounds and the intellectual challenge of the structural problems to be solved, have contributed to this rapid progress. X—ray diffraction studies further accelerated the progress. The work cited in this thesis was carried out by the author in the Department of Applied Chemistry during 2001-2004. The primary aim of these investigations was to synthesise and characterize some transition metal complexes of 2-benzoylpyridine N(4)-substituted thiosemicarbazones and to study the antimicrobial activities of the ligands and their metal complexes. The use of catalysts in chemical and refining processes has increased rapidly since 1945, when oil began to replace coal as the most important industrial raw material. Catalysis has a major impact on the quality of human life as well as economic development. The demand for catalysts is still increasing since catalysis is looked up as a solution to eliminate or replace polluting processes. Metal oxides represent one of the most important and widely employed classes of solid catalysts. Much effort has been spent in the preparation, characterization and application of metal oxides. Recently, great interest has been devoted to the cerium dioxide (CeO2) containing materials due to their broad range of applications in various fields, ranging from catalysis to ceramics, fuel cell technologies, gas sensors, solid state electrolytes, ceramic biomaterials, etc., in addition to the classical application of CeO2 as an additive in the so-called three way catalysts (TWC) for automotive exhaust treatment. Moreover, it can promote water gas shift and steam reforming reactions, favours catalytic activity at the interfacial metal-support sites. The solid solutions of ceria with Group IV transitional-metals deserve particular attention for their applicability in various technologically important catalytic processes. Mesoporous CeO2−ZrO2 solid solutions have been reported to be employed in various reactions which include CO oxidation, soot oxidation, water-gas shift reaction, and so on. Inspired by the unique and promising characteristics of ceria based mixed oxides and solid solutions for various applications, we have selected ceria-zirconia oxides for our studies. The focus of the work is the synthesis and investigation of the structural and catalytic properties of modified and pure ceria-zirconia mixed oxide.

The classical methods of analysing time series by Box-Jenkins approach assume that the observed series uctuates around changing levels with constant variance. That is, the time series is assumed to be of homoscedastic nature. However, the nancial time series exhibits the presence of heteroscedasticity in the sense that, it possesses non-constant conditional variance given the past observations. So, the analysis of nancial time series, requires the modelling of such variances, which may depend on some time dependent factors or its own past values. This lead to introduction of several classes of models to study the behaviour of nancial time series. See Taylor (1986), Tsay (2005), Rachev et al. (2007). The class of models, used to describe the evolution of conditional variances is referred to as stochastic volatility modelsThe stochastic models available to analyse the conditional variances, are based on either normal or log-normal distributions. One of the objectives of the present study is to explore the possibility of employing some non-Gaussian distributions to model the volatility sequences and then study the behaviour of the resulting return series. This lead us to work on the related problem of statistical inference, which is the main contribution of the thesis

Study on variable stars is an important topic of modern astrophysics. After the invention of powerful telescopes and high resolving powered CCD’s, the variable star data is accumulating in the order of peta-bytes. The huge amount of data need lot of automated methods as well as human experts. This thesis is devoted to the data analysis on variable star’s astronomical time series data and hence belong to the inter-disciplinary topic, Astrostatistics. For an observer on earth, stars that have a change in apparent brightness over time are called variable stars. The variation in brightness may be regular (periodic), quasi periodic (semi-periodic) or irregular manner (aperiodic) and are caused by various reasons. In some cases, the variation is due to some internal thermo-nuclear processes, which are generally known as intrinsic vari- ables and in some other cases, it is due to some external processes, like eclipse or rotation, which are known as extrinsic variables. Intrinsic variables can be further grouped into pulsating variables, eruptive variables and flare stars. Extrinsic variables are grouped into eclipsing binary stars and chromospheri- cal stars. Pulsating variables can again classified into Cepheid, RR Lyrae, RV Tauri, Delta Scuti, Mira etc. The eruptive or cataclysmic variables are novae, supernovae, etc., which rarely occurs and are not periodic phenomena. Most of the other variations are periodic in nature. Variable stars can be observed through many ways such as photometry, spectrophotometry and spectroscopy. The sequence of photometric observa- xiv tions on variable stars produces time series data, which contains time, magni- tude and error. The plot between variable star’s apparent magnitude and time are known as light curve. If the time series data is folded on a period, the plot between apparent magnitude and phase is known as phased light curve. The unique shape of phased light curve is a characteristic of each type of variable star. One way to identify the type of variable star and to classify them is by visually looking at the phased light curve by an expert. For last several years, automated algorithms are used to classify a group of variable stars, with the help of computers. Research on variable stars can be divided into different stages like observa- tion, data reduction, data analysis, modeling and classification. The modeling on variable stars helps to determine the short-term and long-term behaviour and to construct theoretical models (for eg:- Wilson-Devinney model for eclips- ing binaries) and to derive stellar properties like mass, radius, luminosity, tem- perature, internal and external structure, chemical composition and evolution. The classification requires the determination of the basic parameters like pe- riod, amplitude and phase and also some other derived parameters. Out of these, period is the most important parameter since the wrong periods can lead to sparse light curves and misleading information. Time series analysis is a method of applying mathematical and statistical tests to data, to quantify the variation, understand the nature of time-varying phenomena, to gain physical understanding of the system and to predict future behavior of the system. Astronomical time series usually suffer from unevenly spaced time instants, varying error conditions and possibility of big gaps. This is due to daily varying daylight and the weather conditions for ground based observations and observations from space may suffer from the impact of cosmic ray particles. Many large scale astronomical surveys such as MACHO, OGLE, EROS, xv ROTSE, PLANET, Hipparcos, MISAO, NSVS, ASAS, Pan-STARRS, Ke- pler,ESA, Gaia, LSST, CRTS provide variable star’s time series data, even though their primary intention is not variable star observation. Center for Astrostatistics, Pennsylvania State University is established to help the astro- nomical community with the aid of statistical tools for harvesting and analysing archival data. Most of these surveys releases the data to the public for further analysis. There exist many period search algorithms through astronomical time se- ries analysis, which can be classified into parametric (assume some underlying distribution for data) and non-parametric (do not assume any statistical model like Gaussian etc.,) methods. Many of the parametric methods are based on variations of discrete Fourier transforms like Generalised Lomb-Scargle peri- odogram (GLSP) by Zechmeister(2009), Significant Spectrum (SigSpec) by Reegen(2007) etc. Non-parametric methods include Phase Dispersion Minimi- sation (PDM) by Stellingwerf(1978) and Cubic spline method by Akerlof(1994) etc. Even though most of the methods can be brought under automation, any of the method stated above could not fully recover the true periods. The wrong detection of period can be due to several reasons such as power leakage to other frequencies which is due to finite total interval, finite sampling interval and finite amount of data. Another problem is aliasing, which is due to the influence of regular sampling. Also spurious periods appear due to long gaps and power flow to harmonic frequencies is an inherent problem of Fourier methods. Hence obtaining the exact period of variable star from it’s time series data is still a difficult problem, in case of huge databases, when subjected to automation. As Matthew Templeton, AAVSO, states “Variable star data analysis is not always straightforward; large-scale, automated analysis design is non-trivial”. Derekas et al. 2007, Deb et.al. 2010 states “The processing of xvi huge amount of data in these databases is quite challenging, even when looking at seemingly small issues such as period determination and classification”. It will be beneficial for the variable star astronomical community, if basic parameters, such as period, amplitude and phase are obtained more accurately, when huge time series databases are subjected to automation. In the present thesis work, the theories of four popular period search methods are studied, the strength and weakness of these methods are evaluated by applying it on two survey databases and finally a modified form of cubic spline method is intro- duced to confirm the exact period of variable star. For the classification of new variable stars discovered and entering them in the “General Catalogue of Vari- able Stars” or other databases like “Variable Star Index“, the characteristics of the variability has to be quantified in term of variable star parameters.

One of the interesting consequences of Einstein's General Theory of Relativity is the black hole solutions. Until the observation made by Hawking in 1970s, it was believed that black holes are perfectly black. The General Theory of Relativity says that black holes are objects which absorb both matter and radiation crossing the event horizon. The event horizon is a surface through which even light is not able to escape. It acts as a one sided membrane that allows the passage of particles only in one direction i.e. towards the center of black holes. All the particles that are absorbed by black hole increases the mass of the black hole and thus the size of event horizon also increases. Hawking showed in 1970s that when applying quantum mechanical laws to black holes they are not perfectly black but they can emit radiation. Thus the black hole can have temperature known as Hawking temperature. In the thesis we have studied some aspects of black holes in f(R) theory of gravity and Einstein's General Theory of Relativity. The scattering of scalar field in this background space time studied in the first chapter shows that the extended black hole will scatter scalar waves and have a scattering cross section and applying tunneling mechanism we have obtained the Hawking temperature of this black hole. In the following chapter we have investigated the quasinormal properties of the extended black hole. We have studied the electromagnetic and scalar perturbations in this space-time and find that the black hole frequencies are complex and show exponential damping indicating the black hole is stable against the perturbations. In the present study we show that not only the black holes exist in modified gravities but also they have similar properties of black hole space times in General Theory of Relativity. 2 + 1 black holes or three dimensional black holes are simplified examples of more complicated four dimensional black holes. Thus these models of black holes are known as toy models of black holes in four dimensional black holes in General theory of Relativity. We have studied some properties of these types of black holes in Einstein model (General Theory of Relativity). A three dimensional black hole known as MSW is taken for our study. The thermodynamics and spectroscopy of MSW black hole are studied and obtained the area spectrum which is equispaced and different thermo dynamical properties are studied. The Dirac perturbation of this three dimensional black hole is studied and the resulting quasinormal spectrum of this three dimensional black hole is obtained. The different quasinormal frequencies are tabulated in tables and these values show an exponential damping of oscillations indicating the black hole is stable against the mass less Dirac perturbation. In General Theory of Relativity almost all solutions contain singularities. The cosmological solution and different black hole solutions of Einstein's field equation contain singularities. The regular black hole solutions are those which are solutions of Einstein's equation and have no singularity at the origin. These solutions possess event horizon but have no central singularity. Such a solution was first put forward by Bardeen. Hayward proposed a similar regular black hole solution. We have studied the thermodynamics and spectroscopy of Hay-ward regular black holes. We have also obtained the different thermodynamic properties and the area spectrum. The area spectrum is a function of the horizon radius. The entropy-heat capacity curve has a discontinuity at some value of entropy showing a phase transition.

Die traditionellen Empathiekonzepte (z. B. Rogers, Kohut), die in der Psychotherapie bis heute maßgebend sind, werden einer gründlichen Überprüfung unterzogen. Dabei ergeben sich drei wesentliche Kritikpunkte: (1) Empathische Vorgänge in der Psychotherapie werden als einseitige Prozesse verstanden; der Therapeut fühlt sich in die Klientin ein, nicht auch umgekehrt. (2) Empathie wird in Cartesianischer Tradition schwerpunktmäßig als kognitive Leistung gesehen; ein körperloser Geist vergegenwärtigt sich die mentalen Inhalte eines anderen. (3) Das traditionelle Empathieverständnis ist individualistisch: Therapeutin und Klient halten sich demnach scheinbar im luftleeren Raum auf. Es sieht so aus, als existiere kein Kontext, der sie umgibt. So einseitig, wie ihre Beziehung gedacht wird, so abgetrennt, wie ihr Körper von ihrem Geist zu sein scheint, so unverbunden sind sie scheinbar mit dem Rest der Welt. Aus diesen drei Kritikpunkten folgt die Notwendigkeit, den Empathiebegriff der Psychotherapie zu erweitern, d. h. (a) Empathie als gegenseitigen Prozess der Beteiligten zu begreifen, (b) ihre tiefe Verwurzelung in der Leiblichkeit des Menschen zu berücksichtigen und (c) ihre Einbettung in die Dynamiken einer gemeinsamen Situation im Rahmen eines kulturellen Kontextes einzubeziehen. Mit Rückgriff auf neuere Untersuchungsergebnisse aus der Entwicklungspsychologie (z. B. Emde, Hobson, Meltzoff, Stern, Trevarthen), der Sozial- und Emotionspsychologie (z. B. Chartrand, Ekman, Goleman, Hatfield, Holodynski), der sozialen Neurowissenschaften (z. B. Damasio, Gallese, Iacoboni, LeDoux, Rizzolatti), aber auch mit Hilfe der Erkenntnisse aus der klassischen (Husserl, Merleau- Ponty, Edith Stein) und der Neuen Phänomenologie (Schmitz) sowie aus symbolischem Interaktionismus (Mead) und aus der kulturhistorischen Schule (Vygotskij) werden diese drei bislang wenig beleuchteten Dimensionen der Empathie betrachtet. ad a) Die Gegenseitigkeit empathischer Vorgänge in der Psychotherapie wird anhand des entwicklungspsychologischen Konzepts des social referencing erläutert und untersucht: Kleinkinder, die in eine unbekannte bzw. unsichere Situation geraten (z. B. im Experiment mit der "visuellen Klippe"), orientieren sich an den nonverbalen Signalen ihrer Bezugspersonen, um diese Situation zu bewältigen. Dabei erfasst die Mutter die Situation des Kindes, versucht ihm ihre Stellungnahme zu seiner Situation zu übermitteln, und das Kind begreift die Reaktion der Mutter als Stellungnahme zu seiner Situation. ad b) Die Körperlichkeit bzw. Leiblichkeit der Einfühlung manifestiert sich in vielfältigen Formen, wie sie von der Psychologie, der Phänomenologie und den Neurowissenschaften erforscht werden. Das kulturübergreifende Erkennen des Gesichtsausdrucks von Basisemotionen ist hier ebenso zu nennen wie die Verhaltensweisen des motor mimicry, bei dem Menschen Körperhaltungen und – bewegungen ihrer Bezugspersonen unwillkürlich imitieren; des Weiteren das unmittelbare Verstehen von Gesten sowie die Phänomene der „Einleibung“, bei denen die körperliche Situation des Anderen (z. B. eines stürzenden Radfahrers, den man beobachtet) am eigenen Leib mitgefühlt wird; und außerdem die Entdeckung der „Spiegelneurone“ und anderer neuronaler Strukturen, durch die Wahrgenommenes direkt in analoge motorische Aktivität übersetzt wird. ad c) Intersubjektivitätstheoretische Überlegungen, Konzepte wie „dyadisch erweiterter Bewusstseinszustand“ (Tronick) und „gemeinsame Situation“ (Gurwitsch, Schmitz) verweisen auf die Bedeutung überindividueller, ‚emergenter’ Dimensionen, die für die Verständigung zwischen Menschen wichtig sind. In many real world contexts individuals find themselves in situations where they have to decide between options of behaviour that serve a collective purpose or behaviours which satisfy one’s private interests, ignoring the collective. In some cases the underlying social dilemma (Dawes, 1980) is solved and we observe collective action (Olson, 1965). In others social mobilisation is unsuccessful. The central topic of social dilemma research is the identification and understanding of mechanisms which yield to the observed cooperation and therefore resolve the social dilemma. It is the purpose of this thesis to contribute this research field for the case of public good dilemmas. To do so, existing work that is relevant to this problem domain is reviewed and a set of mandatory requirements is derived which guide theory and method development of the thesis. In particular, the thesis focusses on dynamic processes of social mobilisation which can foster or inhibit collective action. The basic understanding is that success or failure of the required process of social mobilisation is determined by heterogeneous individual preferences of the members of a providing group, the social structure in which the acting individuals are contained, and the embedding of the individuals in economic, political, biophysical, or other external contexts. To account for these aspects and for the involved dynamics the methodical approach of the thesis is computer simulation, in particular agent-based modelling and simulation of social systems. Particularly conductive are agent models which ground the simulation of human behaviour in suitable psychological theories of action. The thesis develops the action theory HAPPenInGS (Heterogeneous Agents Providing Public Goods) and demonstrates its embedding into different agent-based simulations. The thesis substantiates the particular added value of the methodical approach: Starting out from a theory of individual behaviour, in simulations the emergence of collective patterns of behaviour becomes observable. In addition, the underlying collective dynamics may be scrutinised and assessed by scenario analysis. The results of such experiments reveal insights on processes of social mobilisation which go beyond classical empirical approaches and yield policy recommendations on promising intervention measures in particular.

Computational theories of action have generally understood the organized nature of human activity through the construction and execution of plans. By consigning the phenomena of contingency and improvisation to peripheral roles, this view has led to impractical technical proposals. As an alternative, I suggest that contingency is a central feature of everyday activity and that improvisation is the central kind of human activity. I also offer a computational model of certain aspects of everyday routine activity based on an account of improvised activity called running arguments and an account of representation for situated agents called deictic representation .

En Colombia, después de casi dos décadas de la creación del régimen de cuentas privadas, se implementó una reforma donde se pasa de un sistema con un unico fondo a uno multifondos. Este tipo de reformas se vienen implementando en diferentes paises europeos y de Latino America. A la luz de las teorías clásicas dicha reforma trae mejoras en el bienestar de los individuos; sin embargo, la literatura sobre las nuevas teorías del comportamiento sugiere que los individuos no siempre toman decisiones que están de acuerdo con los supuestos de las teorías clásicas. Este trabajo estudia esta reforma en Colombia bajo algunas de las teorías del comportamiento financiero. Se encuentra que aún cuando el afiliado se quede en la opción default , o actúe con aversión a la pérdida, va a obtener valores en sus cuentas privadas mayores a las que obtendría con un sistema de un único fondo.

Este trabajo realizado como requisito de grado del programa de Filosofía de la Universidad Colegio Mayor de Nuestra Señora del Rosario, aborda el tema de la educación moral en la infancia a partir del análisis y discusión de algunas teorías de la moral. También hace un acercamiento a la literatura infantil en lo relativo a la función que se le puede atribuir como recurso o herramienta para la formación moral. De este modo, el trabajo se estructura siguiendo una argumentación que primero pretende esclarecer los conceptos que se vinculan con el tema de la educación moral como los son el de socialización, el de infancia, el de desarrollo, el mismo concepto de educación moral, y otros que permiten identificar y problematizar esta cuestión en relación con los niños y las particularidades de su comportamiento, sus procesos cognitivos y el modo en que se dan sus relaciones sociales. Por ello el trabajo recoge aportes de la sociología y de la psicología que complementan el tema, que es observado aquí, principalmente, desde la filosofía moral. Estos conceptos ayudan a estructurar el problema que se plantea relativo a la manera cómo se construye lo moral en la infancia. A partir de ellos se desarrolla el resto del texto, primero, con el análisis crítico que se hace en el capítulo dos a la teoría racionalista de la moral, la cual se pone en discusión con los planteamientos de algunas teorías de los sentimientos morales y del desarrollo emocional. Luego, en el capítulo tres se examina la teoría de las virtudes de Aristóteles, destacando la mayor capacidad que tiene de comprender comportamientos morales no racionales, como los de la infancia, que se relacionan con lo que desde la sociología se entiende como el entorno social en el que se desarrolla la moral individual. Finalmente, en el capítulo cuatro, se examina la literatura infantil como un recurso que sirve para la formación moral en los niños, debido a los procesos cognitivos y sociales, que esta literatura favorece. En este capítulo se retoman las cuestiones tratadas a lo largo del trabajo acerca de lo moral y la formación en la infancia para ponerlas en relación con ejemplos de la literatura infantil tomados de los Cuentos de los Hermanos Grimm que permiten identificar algunos elementos que vinculan la lectura de estos cuentos con los procesos de formación moral.
