Vida e morte no direito brasileiro : uma reflexão sobre a relação entre dogmática jurídica e estrutura dos tribunais a partir da decisão da ADPF n. 54

This paper analyzes the Brazilian Supreme Court (STF) Decision (ADPF n. 54) in which the court, by majority of votes, stated that the termination of the pregnancy of an anencephalic fetus does not constitute a crime of abortion. The paper analyzes the arguments used by the judges in their opinions to show that they agree on the conclusion, but strongly disagree on their reasons, with the result that the court remains deeply divided on the legal concept of life. The paper then points to the fact that the possibility of different majority positions regarding the decision and the arguments that justify it is not accidental, but the result of the court’s structure, which does not guarantee the collective rationality of the court’s decisions.

O primeiro debate do segundo turno entre os candidatos à Presidência, realizado ontem (14) à noite, foi marcado por denúncias de corrupção de ambas as partes e por discussões em torno de programas sociais, seguidas por questões ligadas à economia. Os temas comportamentais, como aborto, drogas e homofobia, que marcaram os debates no primeiro turno, ficaram em segundo plano, marcando uma importante diferença entre a agenda pública debatida antes de 5 de outubro pelos candidatos e a agenda que se coloca para a etapa final da campanha.

Questões morais e direitos de minorias têm peso crescente no debate público

Questões morais como direito ao aborto e legalização de drogas, assim como direitos de minorias – como casamento gay, criminalização da homofobia e racismo – vêm adquirindo peso crescente no debate público. Esses foram alguns dos temas mais discutidos nas redes sociais no último mês, com mais de 338 mil menções. Além de dividirem a opinião de parcelas da sociedade, tais temas são usados por candidatos aos legislativos estaduais e nacional como sinalização aos eleitores de valores ou opiniões. Os eleitores utilizam essas sinalizações como “atalho” para escolher seus políticos e também situá-los no espectro político entre esquerda e direita.

The contemporary conjuncture based on the capitalistic knowledge converges to the corporal consciousness that makes us see, feel, taste and hear, be in/to pieces. To this end, the body must be the great pedagogue that is able to be viewed not as a tapestry seen by the right view, as the logical knowledge sees, but seen by the opposite side in its singular, irregular, discontinuous weavings

Abortamento na adolescência: um estudo epidemiológico

O presente trabalho foi desenvolvido no Hospital Maternidade Santa Izabel da cidade de Bauru, São Paulo, Brasil, e teve como objetivo investigar o abortamento na adolescência e compará-lo com o das mulheres adultas. Os indicadores buscaram traçar o perfil epidemiológico das mulheres internadas, por meio de dados coletados em prontuários, entre aquelas com diagnóstico de aborto, independente da forma clínica, entre os anos de 2000 a 2003. O total de abortamentos registrados foi de 2.286, sendo 459 (20,08%) na faixa etária da adolescência e a forma completa foi significativamente maior nas adolescentes quando comparada às das mulheres adultas; segundo o ano de análise, constatou-se decréscimo de ocorrência entre as adolescentes, com maior incidência em 2000 (30,50%), seguida dos anos de 2001 (25,05%), 2002 (23,53%) e 2003 (20,92%), sendo que as adolescentes apresentaram tendência a permanecer dois ou mais dias hospitalizadas. Enfatiza-se a implementação de políticas e programas direcionados à saúde sexual e reprodutiva e suas co-morbidades.

Análise qualitativa do conteúdo ministrado na disciplina de bioética nas faculdades de odontologia brasileiras

The study consists on a qualitative analysis of content ministered by Bioethical discipline on Brazilian Dental Schools. Data collect occurred by semi-structured questioners send by e-mail and correspondence. It was used content analysis by categorical analysis technique, according to Bardin. Among 182 Schools, just 57 (31.3%) shows Bioethical Discipline. It was observed that the discipline is ministered on the first or last year of course generally. Principal subjects broached are bioethical dilemma (76.3%) with polemics questions and others actual like abortion, clone, organs transplant, attendance of patient porter of HIV and bioethical historic (65.8%), bioethical fundaments, principles and models (57.9%). 84.4% researched professors, said that bioethical discipline awake interesting on students because it actual and it's face to patient-professional relation too. It was possible to conclude that bioethical discipline treat in its content some actual and polemic themes that influence dental surgeon formation because promote him conscience and responsibility of him role front attention at oral health, and so, this discipline should be implanted, specifically in the first year of all Dentistry graduation courses.

Experimentos em bovinos com as favas de Enterolobium contortisiliquum e E. timbouva para verificar propriedades fotossensibilizantes e/ou abortivas

Em função de históricos obtidos, no presente estudo tentou-se reproduzir, em bovinos, fotossensibilização e/ou aborto com as favas de Enterolobium spp (Leg. Mimosoi-deae). As favas de E. contortisiliquum e E. timbouva (tamboril ou timbaúba), de diversas procedências, inclusive as colhidas durante dois surtos de intoxicação caracterizados por fotossensiblilização e aborto, foram administradas em doses únicas e repetidas, a bovinos jovens e a vacas em gestação. em todos os experimentos realizados, a resposta à ingestão das favas independentemente da procedência, sempre foi caracterizada por diarréia e diminuição do apetite, passageiras. Também ficou evidente que os animais mostram menor sensibilidade, à medida que ingerem as favas seguidamente. Os experimentos não revelaram possíveis fatores envolvidos ou eventuais condições necessárias para que as favas de Enterolobium contortisiliquum e E. timbouva causem fotossen-siblização e/ou aborto.

Cervicovaginal aerobic microflora of women with spontaneous abortion or preterm delivery in Araraquara-Brazil

Rotina bacteriológica do conteúdo vaginal e cervical de 22 mulheres com histórico de aborto recente ou ruptura precoce das membranas foi realizada. Chlamydia trachomatis, Streptococcus pyogenes, Streptococcus agalactiae, Candida sp e Gardnerella vaginalis foram isolados em 54,5% (12) das pacientes. Apesar de Ureaplasma urealyticum ter sido frequentemente encontrado (45,5%), somente em 5 das 22 mulheres foi o único microrganismo presente nos materiais analisados. Esses resultados chamam a atenção para a importância de investigação quantitativa bem como qualitativa da microbiota genital em gestantes, tendo em vista ter consequências na gestação.
