Le droit des contrats est reconnu comme étant la charnière juridique des activités économiques. Ceci explique, entre autres, l’engouement des organisations supranationales européennes, nord-américaines et asiatiques pour son harmonisation. L’Afrique de l’OHADA n’est pas restée en marge de ce phénomène juridique notamment avec l’avant-projet d’Acte uniforme sur le droit des contrats. Partant de cet avant-projet, véritable décalque des principes d’UNIDROIT, mais sans s’y limiter, l’auteur pose les jalons d’un cadre de référence africain pour un droit des contrats. Cette construction passe d’abord par l’identification des enjeux posés par ce corpus contractuel à vocation panafricaine. Ces enjeux sont à la fois théoriques et pratiques, économiques, juridiques, et extra-juridiques. Sur la base des enjeux ainsi cernés, l’auteur s’emploie à faire des orientations fondamentales au législateur africain de l’OHADA et aux parties contractantes. Il se base ensuite sur ces orientations pour proposer des amendements aux piliers contractuels contemporains en les rapprochant des spécificités contractuelles africaines précisées. Le cadre de référence ainsi esquissé, est enfin confronté à la pratique des expériences européennes et nord-américaines existantes afin d’en apprécier la pertinence pour le bénéfice du commerce transfrontalier africain.

The influence of partisan politics on public policy is a much debated issue of political science. With respect to foreign policy, often considered as above parties, the question appears even more problematic. This comparison of foreign aid policies in 16 OECD countries develops a structural equation model and uses LISREL analysis to demonstrate that parties do matter, even in international affairs. Social-democratic parties have an effect on a country's level of development assistance. This effect, however, is neither immediate nor direct. First, it appears only in the long run. Second, the relationship between leftist partisan strength and foreign aid works through welfare state institutions and social spending. Our findings indicate how domestic politics shapes foreign conduct. We confirm the empirical relevance of cumulative partisan scores and show how the influence of parties is mediated by other political determinants.

Dans ce mémoire de recherche-création, j’aborde la question du stéréotype en insistant sur le potentiel créatif des figures doxiques et en démontrant leur rapport avec la littérarité et le pouvoir (en terme foucaldien) au moyen d’une création et d’un essai : L’expérience du torse est un court roman (dont la fin est ici absente) qui relate les premiers jours liés à l’affaire Magnotta en jouant avec les conventions du romanesque traditionnel ; l’essai L’expérience du texte démontre pour sa part comment la reprise du stéréotype rassure et crée un univers stable dans le roman Je m’en vais de Jean Échenoz, alors que sa déformation déjoue les attentes du lecteur en dénonçant le préfabriqué et en proposant un dépassement poétique. Autant ma création que mon essai s’appliquent à démontrer que le langage est pouvoir et qu’il agit sur le pouvoir.

Knowledge discovery in databases is the non-trivial process of identifying valid, novel potentially useful and ultimately understandable patterns from data. The term Data mining refers to the process which does the exploratory analysis on the data and builds some model on the data. To infer patterns from data, data mining involves different approaches like association rule mining, classification techniques or clustering techniques. Among the many data mining techniques, clustering plays a major role, since it helps to group the related data for assessing properties and drawing conclusions. Most of the clustering algorithms act on a dataset with uniform format, since the similarity or dissimilarity between the data points is a significant factor in finding out the clusters. If a dataset consists of mixed attributes, i.e. a combination of numerical and categorical variables, a preferred approach is to convert different formats into a uniform format. The research study explores the various techniques to convert the mixed data sets to a numerical equivalent, so as to make it equipped for applying the statistical and similar algorithms. The results of clustering mixed category data after conversion to numeric data type have been demonstrated using a crime data set. The thesis also proposes an extension to the well known algorithm for handling mixed data types, to deal with data sets having only categorical data. The proposed conversion has been validated on a data set corresponding to breast cancer. Moreover, another issue with the clustering process is the visualization of output. Different geometric techniques like scatter plot, or projection plots are available, but none of the techniques display the result projecting the whole database but rather demonstrate attribute-pair wise analysis

The first part of the study has focused on the trends in area, production and productivity comparing the state’s performance with of national level performance. Also an attempt was made to understand the trends in commodity price over the years especially in the post liberalization period from the early 1990s. Plantation commodities occupy an important share in the country’s export basket and thereby earning foreign exchange to the national exchequer. Taking into consideration the competitive dimension of natural rubber, cardamom and pepper in the export market was analyzed to see penetration of these commodities in the world market.The second part of the study has tried to understand the plantation workers livelihood by understand the employment generation in the sector. Livelihood assets of plantation workers were analyzed to understand the nature of ownership of various assets. Understanding the poor quality and ownership of various livelihood assets and their relative deprivation the study also tried to understand the income-expenditure patterns and the nature of indebtedness among workers and the factors responsible for deprivation and thereby social exclusion.Area, Production and productivity trends of rubber, pepper and cardamom show a mixed picture. Area, Production trends are impacted greatly by the commodity price of the plantation crops.High correlation exists between commodity price and area and production trends of plantation crops in the state.In terms of Natural Rubber, Kerala experienced a steady growth over the years in terms of area production and productivity as the price of rubber has increasedIn terms of black pepper, the state witnessed a deceleration in growth.In the case of cardamom the area of cultivation declined whereas production increasedProductivity of natural rubber, pepper and cardamom has increased substantially over the yearsEmployment pattern in rubber and spices sub-sector has been analyzed by looking in to the commodity prices so as to see the changes in employment pattern over the years. The study has helped to understand that commodity price and employment generation in plantations are interconnected to such an extent that a fall in the commodity price have greater reverberations on the employment pattern in plantations.Livelihood analysis both in the small and large holdings show that workers belonging to rubber (large and small rubber) plantations have shown better possession of livelihood assets when compared to spices plantation workers as 16.2 percent of the spices sub-sector workers claimed about ownership of house which is considered to be an important and primary livelihood asset.In the case of natural assets like accessibility, availability and duration of water for drinking and other household purposes, the situation of workers in spices plantation still remain poor as around 80 percent of workers depending on public well public taps and canals as source of drinking water.Evaluating financial assets also give clear indication that the road to secure financial assets still remains a distant dream for the workers in plantation sectorEvaluating income and expenditure trends pinpoints to the fact that disparity in terms of income exist among the plantation workersWhile observing the employment though wage levels have improved because of improvement in commodity price of plantation crops, significant improvements are not visible in their livelihood and they remain excluded compared to other sections of the society.

During recent years, quantum information processing and the study of N−qubit quantum systems have attracted a lot of interest, both in theory and experiment. Apart from the promise of performing efficient quantum information protocols, such as quantum key distribution, teleportation or quantum computation, however, these investigations also revealed a great deal of difficulties which still need to be resolved in practise. Quantum information protocols rely on the application of unitary and non–unitary quantum operations that act on a given set of quantum mechanical two-state systems (qubits) to form (entangled) states, in which the information is encoded. The overall system of qubits is often referred to as a quantum register. Today the entanglement in a quantum register is known as the key resource for many protocols of quantum computation and quantum information theory. However, despite the successful demonstration of several protocols, such as teleportation or quantum key distribution, there are still many open questions of how entanglement affects the efficiency of quantum algorithms or how it can be protected against noisy environments. To facilitate the simulation of such N−qubit quantum systems and the analysis of their entanglement properties, we have developed the Feynman program. The program package provides all necessary tools in order to define and to deal with quantum registers, quantum gates and quantum operations. Using an interactive and easily extendible design within the framework of the computer algebra system Maple, the Feynman program is a powerful toolbox not only for teaching the basic and more advanced concepts of quantum information but also for studying their physical realization in the future. To this end, the Feynman program implements a selection of algebraic separability criteria for bipartite and multipartite mixed states as well as the most frequently used entanglement measures from the literature. Additionally, the program supports the work with quantum operations and their associated (Jamiolkowski) dual states. Based on the implementation of several popular decoherence models, we provide tools especially for the quantitative analysis of quantum operations. As an application of the developed tools we further present two case studies in which the entanglement of two atomic processes is investigated. In particular, we have studied the change of the electron-ion spin entanglement in atomic photoionization and the photon-photon polarization entanglement in the two-photon decay of hydrogen. The results show that both processes are, in principle, suitable for the creation and control of entanglement. Apart from process-specific parameters like initial atom polarization, it is mainly the process geometry which offers a simple and effective instrument to adjust the final state entanglement. Finally, for the case of the two-photon decay of hydrogenlike systems, we study the difference between nonlocal quantum correlations, as given by the violation of the Bell inequality and the concurrence as a true entanglement measure.

El Acuerdo de Asociación que se negocia con la Unión Europea representa una gran oportunidad para Colombia, de ampliar sus relaciones comerciales con el bloque europeo, puntualmente, el intercambio comercial y los flujos de inversión extranjera. No obstante, se pueden presentar problemas para Colombia, específicamente en el tema de Compras Públicas, debido a las grandes asimetrías competitivas entre el sector empresarial colombiano y el europeo.

Considerando la estrecha relación opinión pública y democracia, en esta disertación se lleva a cabo un análisis socio-histórico de la construcción del campo de la televisión en Colombia, por ser el medio que mayor alcance tiene. Buscando generar un diagnóstico de la influencia actual de los dos mayores medios masivos de Colombia, RCN TV y Caracol TV sobre la opinión pública y la democracia, durante la última década. Con este propósito, se articulan la teoría de los campos y los habitus de Pierre Bourdieu con el Modelo de la Propaganda de Hermann y Chomsky, para poder determinar la cada vez más estrecha relación entre los poderes político y económico, con la producción del contenido audiovisual, especialmente informativo y de opinión. Encontrando, pruebas documentales y patrones de comportamiento que demuestran como las lógicas de las estructuras corporativas han logrado consolidar y sostener un oligopolio mediático nacional para su absoluto beneficio, no solamente en detrimento de la democracia, sino también, violando la constitución.

Objetivo: generar el redimensionamiento del programa académico de campo, promoción de la salud y prevención de la enfermedad con énfasis en salud pública en la Universidad del Rosario, con el fin de considerar los retos actuales de formación de recurso humano y el contexto nacional e internacional. Método: revisión documental. Resultados: los objetos de estudio y enfoques praxiológicos de las ciencias de la salud se han transformado a lo largo de la historia, generando un impacto en la formación de recurso humano. De esta manera, disciplinas como la fisioterapia, cuyo objeto de estudio es el movimiento corporal humano, reconocen la importancia de ampliar su marco disciplinar, considerando conceptos como las capacidades, libertades, oportunidades, participación y, por lo tanto, calidad de vida y desarrollo humano, con la meta de reorientar sus acciones desde enfoques biologicistas y reduccionistas hacia enfoques históricosociales, integrales y complejos, que permitan a los fisioterapeutas en formación desarrollar capacidades, destrezas y competencias para su desempeño en áreas de la salud pública. Conclusiones: desde las ciencias de salud se requiere la transformación en la formación de recurso humano, para afrontar la problemática de la salud pública de una manera global y transectorial, desarrollando competencias ciudadanas, abogacía, participación y responsabilidad social en los estudiantes. Introducción: En 1979, con la monitorización del uso rutinario de los relajantes neuromusculares, se determinó incidencia en la relajación neuromuscular residual del 45%, con múltiples complicaciones respiratorias que incrementan la estancia hospitalaria. No es conocida la eficacia y seguridad del manejo del vecuronio y su reversión con el uso del sugammadex dentro del manejo rutinario de anestesia. Métodos: Revisión sistemática de artículos sobre el comportamiento del sugammadex cuando se realiza reversión para el efecto del vecuronio, por ser la primera droga que ha demostrado eficacia y seguridad frente a relajantes musculares no despolarizantes esteroideos, que ayuda a prevenir bloqueo residual en el posoperatorio. Resultados: Búsqueda en las bases de datos de EMBASE, EBSCO y MEDLINE y Pubmed (desde enero 2000-diciembre 2012), con palabras MeSH, sugammadex, vecuronium, binding reversal agents, neuromuscular blocking agents; artículos en idioma inglés de estudios clínicos controlados en pacientes humanos adultos en los cuales el sugammadex fue comparado con placebo u otro medicamento. Se aprecia disminución del tiempo de recuperación de la relajación neuromuscular en el bloqueo moderado con un rango de 1,5 a 2,3min con el sugammadex vs 18,9 a 66,2min con la neostigmine y en un bloqueo profundo desde 35,5-68,4min, con dosis de 0,5mgrs/kg de sugammadex hasta 1,4-1,7min con 8mgrs/kg. Discusión: Resultados favorables en el suministro de dosis mayores a 2mgrs/kg en pacientes que presentaban bloqueo neuromuscular moderado y mayores de 4mgrs/kg en bloqueo neuromuscular profundo. Existe necesidad de nuevos estudios clínicos que soporten estos hallazgos. Conclusión: La evidencia sugiere que sí existe una adecuada reversión de la relajación neuromuscular del vecuronio con el uso de sugammadex a 2mgrs/kg, con disminución importante del tiempo y mayor recuperación del paciente sin presencia de relajación residual.

En el actual contexto de globalización y con el comienzo de la era de la información, cada vez más Estados han buscado proyectar una imagen favorable con el objetivo de atraer atención y crear una reputación que permitan cumplir objetivos de política exterior y fomentar el desarrollo económico, logrando de esta manera un posicionamiento en el sistema internacional mediante estrategias novedosas, que incluyen elementos tanto diplomáticos, políticos, económicos, como comerciales y culturales. Para Japón, Nation Branding y la diplomacia pública han sido dos de las principales herramientas para lograr este reposicionamiento internacional, resaltando atractivos como las tradiciones culturales, el turismo, los incentivos para negocios, y trabajando en conjunto entre el gobierno nacional, el sector privado y la sociedad civil para crear relaciones entre el país y gobiernos y sociedades a nivel internacional.
