This report examines recent updates to the regulation and enforcement of intellectual property (IP) rights in Korea and China, in particular patent rights including invention, utility, and design rights. This paper also discusses some features and issues of the actual IP enforcement situation in those countries in comparison with Japan.

In arid countries worldwide, social conflicts between irrigation-based human development and the conservation of aquatic ecosystems are widespread and attract many public debates. This research focuses on the analysis of water and agricultural policies aimed at conserving groundwater resources and maintaining rurallivelihoods in a basin in Spain's central arid region. Intensive groundwater mining for irrigation has caused overexploitation of the basin's large aquifer, the degradation of reputed wetlands and has given rise to notable social conflicts over the years. With the aim of tackling the multifaceted socio-ecological interactions of complex water systems, the methodology used in this study consists in a novel integration into a common platform of an economic optimization model and a hydrology model WEAP (Water Evaluation And Planning system). This robust tool is used to analyze the spatial and temporal effects of different water and agricultural policies under different climate scenarios. It permits the prediction of different climate and policy outcomes across farm types (water stress impacts and adaptation), at basin's level (aquifer recovery), and along the policies’ implementation horizon (short and long run). Results show that the region's current quota-based water policies may contribute to reduce water consumption in the farms but will not be able to recover the aquifer and will inflict income losses to the rural communities. This situation would worsen in case of drought. Economies of scale and technology are evidenced as larger farms with cropping diversification and those equipped with modern irrigation will better adapt to water stress conditions. However, the long-term sustainability of the aquifer and the maintenance of rurallivelihoods will be attained only if additional policy measures are put in place such as the control of illegal abstractions and the establishing of a water bank. Within the policy domain, the research contributes to the new sustainable development strategy of the EU by concluding that, in water-scarce regions, effective integration of water and agricultural policies is essential for achieving the water protection objectives of the EU policies. Therefore, the design and enforcement of well-balanced region-specific polices is a major task faced by policy makers for achieving successful water management that will ensure nature protection and human development at tolerable social costs. From a methodological perspective, this research initiative contributes to better address hydrological questions as well as economic and social issues in complex water and human systems. Its integrated vision provides a valuable illustration to inform water policy and management decisions within contexts of water-related conflicts worldwide.

The geochemical fingerprint of sediment retrieved from the banks of the River Manzanares as it passes through the City of Madrid is presented here. The river collects the effluent water from several Waste Water Treatment (WWT) plants in and around the city, such that, at low flows, up to 60% of the flow has been treated. A total of 18 bank-sediment cores were collected along the course of the river, down to its confluence with the Jarama river, to the south–east of Madrid. Trace and major elements in each sample were extracted following a double protocol: (a) “Total” digestion with HNO3, HClO4 and HF; (b) “Weak” digestion with sodium acetate buffered to pH=5 with acetic acid, under constant stirring. The digests thus obtained were subsequently analysed by ICP-AES, except for Hg which was extracted with aqua regia and sodium chloride-hydroxylamine sulfate, and analysed by Cold Vapour-AAS. X-ray diffraction was additionally employed to determine the mineralogical composition of the samples. Uni- and multivariate analyses of the chemical data reveal the influence of Madrid on the geochemistry of Manzanares' sediments, clearly manifested by a marked increase in the concentration of typically “urban” elements Ag, Cr, Cu, Pb and Zn, downstream of the intersection of the river with the city's perimeter. The highest concentrations of these elements appear to be associated with illegal or accidental dumping of waste materials, and with the uncontrolled incorporation of untreated urban runoff to the river. The natural matrix of the sediment is characterised by fairly constant concentrations of Ce, La and Y, whereas changes in the lithology intersected by the river cause corresponding variations in Ca–Mg and Al–Na contents. In the final stretch of the river, the presence of carbonate materials seems to exert a strong geochemical control on the amount of Zn and, to a lesser extent, Cu immobilised in the sediments. This fact suggests that a variable but significant proportion of both elements may be susceptible to reincorporation in the aqueous phase under realistic environmental conditions.

La tecnología ha cambiado el mundo, pero las consecuencias de estos cambios en la sociedad no siempre se han pronosticado bien. Las Tecnologías de la Información transformaron el método de producción industrial. La nueva industria produce ideas y conceptos, no objetos. Este cambio ha dado como resultado una sociedad dualizada, ha desaparecido gran parte de la clase media y han aumentado las diferencias entre la clase alta y la baja. Las exigencias educativas de los nuevos puestos de trabajo innovadores son superiores a los de la industria tradicional, pero inferiores en los puestos de trabajo de producción. Además, el número de puestos de trabajo disponibles de este tipo es menor que en la industria tradicional, se necesita menos mano de obra, los procesos se pueden automatizar, las tareas mecánicas se aprenden en poco tiempo y son trabajos temporales, cuyo número dependerá de la demanda global. Para que el proceso de innovación funcione, las empresas se reúnen en las zonas financieras de grandes ciudades, como Nueva York o Londres, que fueron las primeras con acceso a las redes de telecomunicación. De esta manera se producen sinergias que contribuyen a mejorar el proceso innovador global. Estas ideas y conceptos que cambian el mundo necesitan de este entorno de producción, que no puede ser replicado, y son tan importantes que su acceso está restringido para la mayor parte del mundo por distintos mecanismos de control. El despliegue de las redes de telecomunicaciones inalámbricas ha sido enorme en los últimos años. El cliente busca llamar desde cualquier lugar y llevar un acceso a Internet en teléfono móvil. Para conseguirlo, las operadoras de telefonía móvil necesitan poner antenas de telefonía móvil en las ciudades, pero la instalación cerca de edificios no está siendo fácil. Pocos quieren tener una antena cerca por los problemas de salud de las personas que padecen los que ya viven o trabajan cerca de una. Los efectos del electromagnetismo en los seres humanos no están claros y provocan desconfianza hacia las antenas. La digitalización de los contenidos, que ha sido necesaria para transmitir contenido en Internet, permite que cualquier persona con un ordenador y una conexión a Internet pueda publicar un disco, una película o un libro. Pero esa persona también puede copiar los originales y enviarlos a cualquier lugar del mundo sin el permiso del autor. Con el fin de controlar la copia no autorizada, los derechos de autor se están usando para cambiar leyes e incluir sistemas de censura en Internet. Estos sistemas permiten a los autores eliminar el contenido ilegal, pero también pueden ser usados para censurar cualquier tipo de información. El control de la información es poder y usarlo de una manera o de otra afecta a todo el planeta. El problema no es la tecnología, que es solo una herramienta, es la forma que tienen los gobiernos y las grandes empresas de usarlo. Technology has changed the world, but the consequences of these changes in society have not always been well predicted. The Information Technology transformed the industrial production method. The new industry produces ideas and concepts, not objects. This change has resulted in a society dualized, most of the middle class has disappeared and the differences between high and low class have increased. The educational requirements of new innovative jobs are higher than the ones of the traditional industry, but lower in production jobs. Moreover, the number of available jobs of this type is lower than in the traditional industry, it takes less manpower, processes can be automated, mechanical tasks are learned in a short time and jobs are temporary, whose number depends on global demand. For the innovation process works, companies meet in the business districts of large cities, like New York or London, which were the first with access to telecommunications networks. This will produce synergies that improve the overall innovation process. These ideas and concepts that change the world need this production environment, which cannot be replicated, and are so important that their access is restricted to most of the world by different control mechanisms. The deploy of wireless telecommunications networks has been enormous in recent years. The client seeks to call from anywhere and to bring Internet access in his mobile phone. To achieve this, mobile operators need to put cell towers in cities, but the installation near buildings is not being easy. Just a few want to have an antenna closely because of the health problems suffered by people who already live or work near one. The effects of electromagnetism in humans are unclear and cause distrust of antennas. The digitization of content, which has been necessary to transmit Internet content, allows anyone with a computer and an Internet connection to be able to publish an album, a movie or a book. But that person can also copy the originals and send them anywhere in the world without the author's permission. In order to control the unauthorized copying, copyright is being used to change laws and include Internet censorship systems. These systems allow authors to eliminate illegal content, but may also be used to censor any information. The control of knowledge is power and using it in one way or another affects the whole planet. The problem is not technology, which is just a tool, but the way that governments and large corporations use it.

Uno de los retos a los que se enfrenta la humanidad es la demanda de una sociedad con casi cero residuos: la búsqueda de una economía más eficiente en el uso de los recursos teniendo en cuenta el cambio climático y un abastecimiento sostenible de materias primas que permitan satisfacer las necesidades de una población mundial cada vez mayor, dentro de los límites sostenibles de los recursos naturales del planeta. Abordar este desafío implica la recuperación y reciclaje de materiales para reducir consumos de materias primas y, para ello, debe promoverse la innovación en la prevención y gestión de residuos, como estrategia hacia un desarrollo urbano sostenible. Los envases y embalajes forman parte de la cultura actual, relacionándose con el grado de desarrollo de países y regiones; el sector de la construcción no es ajeno a la problemática y genera un importante volumen de embalajes en las obras que no se gestionan de forma adecuada. El modelo de gestión de Residuos de Construcción Demolición (RCD) actual es poco eficaz, ya que los vertederos siguen recibiendo grandes cantidades de residuos valorizables. La normativa ha conseguido minimizar las prácticas ilegales, pero se comprueba que la gestión actual de los RCD en obra deja en manos de las plantas de tratamiento la misión de separar los residuos según su naturaleza y los datos aportados por las distintas plantas no permiten afirmar el grado de alcance de dicho objetivo, ni el destino de los mismos. Los envases y embalajes son un tipo de residuos que por su naturaleza suponen una fuente de recursos valorizables y por ello están presentes en directivas y leyes, dirigidas fundamentalmente al sector de la alimentación. En el ámbito de la construcción, hasta la fecha, no se habían tratado de forma específica, motivo que justifica este trabajo. Esta Tesis Doctoral tiene como objetivo principal mejorar la gestión de residuos de embalajes procedentes de materiales de construcción. Para ello se estudia un importante conjunto de obras de edificación residencial colectiva de 1173 viviendas, análisis que llevará a conocer los patrones de producción de los Residuos de Envases y Embalajes en Construcción (REEC) e identificar los productos o materiales responsables de su generación. La monitorización realizada, permitirá diseñar estrategias específicas que minimicen la generación de estos residuos y optimicen su valorización. Se ha podido comprobar que el tratamiento particularizado de los REEC puede mejorar los resultados de la gestión del conjunto de RCD, debido a que, al no mezclarse, se elimina un importante agente contaminador de los residuos inertes. Las obras analizadas alcanzan un nivel de segregación in situ muy bajo, y los capítulos de cerramientos e instalaciones suman más del 50% del global de REEC. Particularizando en cada tipo de material, el cartón predomina en los trabajos de electricidad, el plástico en las particiones y la madera en fachadas. Se evalúa la opción del eco-­‐rediseño para uno de los embalajes predominantes, y se identifican estrategias para minimizar su impacto. Se comprueba que el ahorro en la gestión de RCD en caso de impulsar la segregación in situ no es muy significativo en las obras estudiadas, si bien se demuestra que la viabilidad económica es el factor más importante para motivar a las empresas constructoras. Las Administraciones Públicas deberían incentivar la gestión responsable, estableciendo medidas de control en las plantas de tratamiento e implementando en sus obras medidas de gestión de RCD ejemplares para el mercado. Una adecuada planificación de la obra, y formación específica para el personal son medidas que facilitan la segregación in situ y mejoran los resultados. Los promotores, mediante su relación contractual con el resto de agentes, tienen la capacidad de establecer objetivos de reducción, planificación y gestión sostenible de los REEC. Por último, se propone un sistema de gestión de REEC, integrable dentro del Sistema de Gestión de la empresa constructora, que permite evitar que residuos valorizables tales como los envases y embalajes se envíen a vertedero, guiando al sector hacia un futuro más respetuoso, alineado con el desarrollo sostenible. ABSTRACT One of the challenges humanity faces is the demand of an almost zero waste society: the search for a more efficient economy in the use of resources, taking into account climate change and a sustainable supply of raw materials, that meet the needs of an increasing world population within the sustainable limits of the planet's natural resources. Addressing this challenge involves the recovery and recycling of materials to reduce consumption of raw materials, so innovation must therefore be promoted in the prevention and management of waste, as a strategy towards a sustainable urban development. Packaging is part of our current culture and is related to the degree of development of countries and regions; the construction sector is no stranger to this problem and generates a significant amount of packaging waste in the site works, which nowadays is not managed properly. The current Construction Demolition Waste (CDW) management model is ineffective, since landfills continue to receive large amounts of recoverable waste. The legislation has managed to minimize illegal practices, but it has been observed that the current management of CDW in the analysed works leaves the mission of separating waste according to their nature to the plants, and data provided by the latter does not allow for checking the scope of this objective, nor the destiny of the waste. Packaging is a type of waste which, by its nature, represents a source of recoverable resources and is therefore present in directives and laws, focused primarily on the food industry. It has not been specifically treated to date in the construction field, hence the reason that justifies this work. This Thesis aims to improve the management of packaging waste from construction materials. An important set of residential building works with 1173 dwellings is analysed, which leads to knowledge on the production patterns of packaging waste (PW) in the construction industry, and the identification of the products responsible for its generation. The monitorization also allows for the design of specific strategies which minimise the generation of waste and optimize recovery. It has been found that the individualized treatment of PW can improve the results of the management of the whole CDW since, when not mixed, a major pollutant of inert waste is removed. The analysed works reached a very low segregation level and the façades and building services phases account for more than 50% of the overall PW. Focusing on each type of material, cardboard predominates electricity works, plastic on partitions and wood on façades. Eco-­‐redesign is evaluated for one of the predominant packages, and strategies are identified to minimise their impact are . There is evidence that the savings in the CDW management in case of promoting segregation on site are not very significant at the studied works, although economic feasibility is the most important factor to motivate the construction companies. Public Administrations should encourage responsible management, establishing control measures in treatment plants and implementing CDW management exemplary measures on their work sites for the market. A proper planning of the works and specific training for the personnel are measures that facilitate in situ segregation and improve outcomes. The developers, through their contractual relationship with the other agents, have the ability to set reduction targets, planning and sustainable management of PW. Finally, a management system for PW is proposed, integrated within the Management System of the construction company, which aims to avoid that recoverable waste such as packaging is sent to landfill, leading the industry towards a more environmentally friendly future, aligned with sustainable development.

En la Comunidad de Madrid el modelo de ocupación del territorio en las dos últimas décadas ha obedecido a factores de oferta del mercado y no a las necesidades de la población, ello provoca un consumo de suelo y de recursos que conducen a una sobrexplotación insostenible. Las metrópolis globales están experimentando rápidas e intensas transformaciones, basadas en los paradigmas emergentes de la globalización, la gobernanza, la metropolizacion y la dispersión de las actividades en el territorio y a través de ellos se abordan los planes de Londres, París y las tentativas de Madrid. La globalización provoca la pérdida de soberanía de las administraciones publicas y la competitividad entre las ciudades globales en Europa, Londres, Paris y Madrid, son centros de poder, de concentración y crecimiento donde se produce la dualización del espacio y donde la desigualdad participa de la restructuración urbana, concentración de pobreza frente a espacios de la nueva clase emergente en donde dominan los sectores de servicios y las tecnologías de la información. Frente al desarrollo urbano neoliberal de regulación a través del mercado y basada en criterios de eficiencia de la Nueva Gestión Pública, se vislumbra la posibilidad de que la sociedad se administre a si misma por medio de acciones voluntarias y responsables que promuevan los intereses colectivos mediante el reconocimiento de su propia identidad, introduciendo el concepto de gobernanza. Frente, a la explotación del territorio por parte de la sociedad extractiva que genera corrupcion, se propone un modelo de cooperación público-privada basado en la confianza mutua, un marco regulador estable, la transparencia y la información a cuyo flujo más homogéneo contribuirán sin duda las TICs. En todo este proceso, las regiones metropolitanas en Europa se erigen como motores del crecimiento, donde los límites administrativos son superados, en un territorio cada vez más extendido y donde los gobiernos locales tienen que organizarse mediante un proceso de cooperación en la provisión de servicios que ayuden a evitar los desequilibrios territoriales. El fenómeno de la dispersión urbana en desarrollos de baja densidad, los centros comerciales periféricos, la expulsión hacia la periferia de las actividades de menor valor añadido y la concentración de funciones directivas en el centro, conducen a una fragmentación del territorio en islas dependientes del automóvil y a procesos de exclusión social por la huida de las rentas altas y la expulsión de las rentas bajas de los centros urbanos. Se crean fragmentos monofuncionales y discontinuos, apoyados en las autovías, lugares carentes de identidad y generadores de despilfarro de recursos y una falta de sostenibilidad ambiental, económica y social. El estudio de la cultura de la planificación en Europa ayuda a comprender los diferentes enfoques en la ordenación del territorio y el proceso de convergencia entre las diferentes regiones. Los documentos de la UE se basan en la necesidad de la competitividad para el crecimiento europeo y la cohesión social y en relación al territorio en los desarrollos policéntricos, la resolución del dualismo campo-ciudad, el acceso equilibrado a las infraestructuras, la gestión prudente de la naturaleza, el patrimonio y el fomento de la identidad. Se proponen dos niveles de estudio uno actual, los últimos planes de Londres y Paris y el otro la evolución de las tentativas de planes en la Región madrileña siempre en relación a los paradigmas emergentes señalados y su reflejo en los documentos. El Plan de Londres es estratégico, con una visión a largo plazo, donde se confiere un gran interés al proceso, al papel del alcalde como líder y su adaptación a las circunstancias cambiantes, sujeto a las incertidumbres de una ciudad global. El desarrollo del mismo se concibe a través de la colaboración y cooperación entre las administraciones y actores. La estructura del documento es flexible, establece orientaciones y guías indicativas, para la redacción de los planes locales, no siendo las mismas vinculantes y con escasa representación grafica. El Plan de París es más un plan físico, similar al de otros centros europeos, trabaja sobre los sectores y sobre los territorios, con información extensa, con características de “Plan Latino” por la fuerza de la expresión gráfica, pero al mismo tiempo contiene una visión estratégica. Es vinculante en sus determinaciones y normativas, se plantea fomentar, pero también prohibir. Ambos planes tratan la competitividad internacional de sus centros urbanos, la igualdad social, la inclusión de todos los grupos sociales y la vivienda como una cuestión de dignidad humana. Londres plantea la gobernanza como cooperación entre sector público-privado y la necesaria cooperación con las regiones limítrofes, en París las relaciones están más institucionalizadas resaltando la colaboración vertical entre administraciones. Ambos plantean la densificación de nodos servidos por transporte público, modos blandos y el uso los TODs y la preservación de la infraestructura verde jerarquizada, la potenciación de la red azul y la mejora del paisaje de las periferias. En las “tentativas” de planes territoriales de Madrid se constata que estuvieron sujetas a los ciclos económicos. El primer Documento las DOT del año 1984, no planteaba crecimiento, ni económico ni demográfico, a medio plazo y por ello no proponía una modificación del modelo radio concéntrico. Se trataba de un Plan rígido volcado en la recuperación del medio rural, de la ciudad, el dimensionamiento de los crecimientos en función de las dotaciones e infraestructuras existentes. Aboga por la intervención de la administración pública y la promoción del pequeño comercio. Destaca el desequilibrio social en función de la renta, la marginación de determinados grupos sociales, el desequilibrio residencia/empleo y la excesiva densidad. Incide en la necesidad de viviendas para los más desfavorecidos mediante el alquiler, la promoción suelo público y la promoción del ferrocarril para dar accesibilidad al espacio central. Aboga por el equipamiento de proximidad y de pequeño tamaño, el tratamiento paisajístico de los límites urbanos de los núcleos y el control de las actividades ilegales señalando orientaciones para el planeamiento urbano. Las Estrategias (1989) contienen una visión: la modificación del modelo territorial, mediante la intervención pública a través de proyectos. Plantea la reestructuración económica del territorio, la reconversión del aparato productivo, la deslocalización de actividades de escaso valor añadido y una mayor ubicuidad de la actividad económica. Incide en la difusión de la centralidad hacia el territorio del sur, equilibrándolo con el norte, tratando de recomponer empleo y residencia, integrando al desarrollo económico las periferias entre sí y con el centro. Las actuaciones de transporte consolidarían las actuaciones, modificando el modelo radio concéntrico facilitando la movilidad mediante la red de cercanías y la intermodalidad. El plan se basaba en el liderazgo del Consejero, no integrando sectores como el medio ambiente, ni estableciendo un documento de seguimiento de las actuaciones que evaluara los efectos de las políticas y su aportación al equilibrio territorial, a través de los proyectos realizados. El Documento Preparatorio de las Bases (1995), es más de un compendio o plan de planes, recoge análisis y propuestas de los documentos anteriores y de planes sectoriales de otros departamentos. Presenta una doble estructura: un plan físico integrador clásico, que abarca los sectores y territorios, y recoge las Estrategias previas añadiendo puntos fuertes, como el malestar urbano y la rehabilitación el centro. Plantea la consecución del equilibrio ambiental mediante el crecimiento de las ciudades existentes, la vertebración territorial basada en la movilidad y en la potenciación de nuevas centralidades, la mejora de la habitabilidad y rehabilitación integral del Centro Urbano de Madrid, y la modernización del tejido productivo existente. No existe una idea-fuerza que aglutine todo el documento, parte del reconocimiento de un modelo existente concentrado y congestivo, un centro urbano dual y dos periferias al este y sur con un declive urbano y obsolescencia productiva y al oeste y norte con una dispersión que amenaza al equilibrio medioambiental. Señala como aspectos relevantes, la creciente polarización y segregación social, la deslocalización industrial, la aparición de las actividades de servicios a las empresas instaladas en las áreas metropolitanas, y la dispersión de las actividades económicas en el territorio por la banalización del uso del automóvil. Se plantea el reto de hacer ciudad de la extensión suburbana y su conexión con el sistema metropolitano, mediante una red de ciudades integrada y complementaria, en búsqueda de un mayor equilibrio y solidaridad territorial. Las Bases del PRET (1997) tenían como propósito iniciar el proceso de concertación en que debe basarse la elaboración del Plan. Parte de la ciudad mediterránea compacta, y diversa, y de la necesidad de que las actividades económicas, los servicios y la residencia estén en proximidad, resolviéndolo mediante una potente red de transporte público que permitiese una accesibilidad integrada al territorio. El flujo de residencia hacia la periferia, con un modelo ajeno de vivienda unifamiliar y la concentración del empleo en el centro producen desequilibrio territorial. Madrid manifiesta siempre apostó por la densificación del espacio central urbanizado, produciendo su congestión, frente al desarrollo de nuevos suelos que permitieran su expansión territorial. Precisa que es necesario preservar los valores de centralidad de Madrid, como generador de riqueza, canalizando toda aquella demanda de centralidad, hacia espacios más periféricos. El problema de la vivienda no lo ve solo como social, sino como económico, debido a la pérdida de empleos que supone su paralización. Observa ya los crecimientos residenciales en el borde de la region por el menor valor del suelo. Plantea como la política de oferta ha dado lugar a un modelo de crecimiento fragmentado, desequilibrado, desestructurado, con fuertes déficits dotacionales y de equipamiento, que inciden en la segregación espacial de las rentas, agravando el proceso de falta de identidad morfológica y de desarraigo de los valores urbanos. El plan señalaba que la presión sobre el territorio creaba su densificación por las limitaciones de espacio, Incidía en limitar el peso de la intervención pública, no planteando propuestas de cooperación público-privado. La mayor incoherencia estriba en que los objetivos eran innovadores y coinciden en su mayoría con las propuestas estudiadas de Londres o Paris, pero se intentan implementar a través de un cambio hacia un modelo reticulado homogéneo, expansivo sobre el territorio, que supone un consumo de suelo y de infraestructuras para solucionar un problema inexistente, la gestión de la densidad. Durante las dos últimas décadas en ausencia de un plan regional, la postura neoliberal fue la de un exclusivo control de legalidad del planeamiento, los municipios entraron en un proceso de competencia para aprovechar las iniciales ventajas económicas de los crecimientos detectados, que proporcionaban una base económica “sólida” a unos municipios con escasos recursos en sus presupuestos municipales. La legislación se modifica a requerimiento de grupos interesados, no existiendo un marco estable. Se pierde la figura del plan no solo a nivel regional, si no en los sectores y el planeamiento municipal donde los municipios tiende a basarse en modificaciones puntuales con la subsiguiente pérdida del modelo urbanístico. La protección ambiental se estructura mediante un extenso nivel de figuras, con diversidad de competencias que impide su efectiva protección y control. Este proceso produce un despilfarro en la ocupación del suelo, apoyada en las infraestructuras viarias, y un crecimiento disperso y de baja densidad, cada vez más periférico, produciéndose una segmentación social por dualización del espacio en función de niveles de renta. Al amparo del boom inmobiliario, se produce una falta de política social de vivienda pública, más basada en la dinamización del mercado con producción de viviendas para rentas medias que en políticas de alquiler para determinados grupos concentrándose estas en los barrios desfavorecidos y en la periferia sur. Se produce un incremento de la vivienda unifamiliar, muchas veces amparada en políticas públicas, la misma se localiza en el oeste principalmente, en espacios de valor como el entorno del Guadarrama o con viviendas más baratas por la popularización de la tipología en la frontera de la Región. El territorio se especializa a modo de islas monofuncionales, las actividades financieras y de servicios avanzados a las empresas se localizan en el norte y oeste próximo, se pierde actividad industrial que se dispersa más al sur, muchas veces fuera de la región. Se incrementan los grandes centros comerciales colgados de las autovías y sin población en su entorno. Todo este proceso ha provocado una pérdida de utilización del transporte público y un aumento significativo del uso del vehículo privado. En la dos últimas décadas se ha producido en la región de Madrid desequilibrio territorial y segmentación social, falta de implicación de la sociedad en el territorio, dispersión del crecimiento y un incremento de los costes ambientales, sociales y económicos, situación, que solo, a través del uso racional del territorio se puede reconducir, apoyado en una planificación integrada sensible y participativa. ABSTRACT In Madrid the model of land occupation in the past two decades has been driven by market supply factors rather than the needs of the population. This results in a consumption of land and resources that leads to unsustainable overexploitation. Addressing this issue must be done through sensitive and participatory integrated planning. Global cities are experiencing rapid and intense change based on the emerging paradigms of globalization, governance, metropolization and the dispersion of activities in the territory. Through this context, a closer look will be taken at the London and Paris plans as well as the tentative plans of Madrid. Globalization causes the loss of state sovereignty and the competitiveness among global cities in Europe; London, Paris and Madrid. These are centres of power, concentration and growth where the duality of space is produced, and where inequality plays a part in urban restructuration. There are concentrated areas of poverty versus areas with a new emerging class where the services sector and information technologies are dominant. The introduction of ICTs contributes to a more homogeneous flow of information leading, us to the concept of governance. Against neoliberal urban development based on free market regulations and efficiency criteria as established by the “New Public Management”, emerge new ways where society administers itself through voluntary and responsible actions to promote collective interests by recognizing their own identity. A new model of public-private partnerships surfaces that is based on mutual trust, transparency, information and a stable regulatory framework in light of territorial exploitation by the “extractive society” that generates corruption. Throughout this process, European metropolitan regions become motors of growth where administrative boundaries are overcome in an ever expanding territory where government is organized through cooperative processes to provide services that protect against regional imbalances. Urban sprawl or low-density development as seen in peripheral shopping centres, the off-shoring of low added-value activities to the periphery, and the concentration of business and top management functions in the centre, leads to a fragmentation of the territory in automobile dependent islands and a process of social exclusion brought on by the disappearance of high incomes. Another effect is the elimination of low income populations from urban centres. In consequence, discontinuous expansions and mono-functional places that lack identity materialize supported by a highway network and high resource consumption. Studying the culture of urban planning in Europe provides better insight into different approaches to spatial planning and the process of convergence between different regions. EU documents are based on the need of competitiveness for European growth and social cohesion. In relation to polycentric development territory they are based on a necessity to solve the dualism between field and city, balanced access to infrastructures, prudent management of nature and solidifying heritage and identity Two levels of study unfold, the first being the current plans of London and Île-de-France and the second being the evolution of tentative plans for the Madrid region as related to emerging paradigms and how this is reflected in documents. The London Plan is strategic with a long-term vision that focuses on operation, the role of the mayor as a pivotal leader, and the adaptability to changing circumstances brought on by the uncertainties of a global city. Its development is conceived through collaboration and cooperation between governments and stakeholders. The document structure is flexible, providing guidance and indicative guidelines on how to draft local plans so they are not binding, and it contains scarce graphic representation. The Plan of Paris takes on a more physical form and is similar to plans of other European centres. It emphasizes sectors and territories, using extensive information, and is more characteristic of a “Latin Plan” as seen in its detailed graphic expression. However, it also contains a strategic vision. Binding in its determinations and policy, it proposes advancement but also prohibition. Both plans address the international competitiveness of urban centres, social equality, inclusion of all social groups and housing as issues of human dignity. London raises governance and cooperation between public and private sector and the need for cooperation with neighbouring regions. In Paris, the relations are more institutionalized highlighting vertical collaboration between administrations. Both propose nodes of densification served by public transportation, soft modes and the use of TOD, the preservation of a hierarchical green infrastructure, and enhancing the landscape in urban peripheries. The tentative territorial plans for the Madrid region provide evidence that they were subject to economic cycles. The first document of master guidelines (1984) does not address either economic or demographic growth in the mid term and therefore does not propose the modification of the radio-concentric model. It is a rigid plan focused on rural and urban recovery and the dimensioning of growth that depends on endowments and infrastructures. It advocates government intervention and promotes small business. The plan emphasizes social imbalance in terms of income, marginalization of certain social groups, the imbalance of residence/employment and excessive density. It stresses the need for social rent housing for the underprivileged, promotes public land, and the supports rail accessibility to the central area. It backs facilities of proximity and small size, enhancing the landscaping of city borders, controlling illegal activities and draws out guidelines for urban planning. The strategies (1989) contain a vision: Changing the territorial model through public intervention by means of projects. They bring to light economic restructuring of territory, the reconversion of the productive apparatus, relocation of low value-added activities, and greater ubiquity of economic activity. They also propose the diffusion of centrality towards southern territories, balancing it with the north in an attempt to reset employment and residence that integrates peripheral economic development both in the periphery and the centre. Transport would consolidate the project, changing the radius-concentric model and facilitating mobility through a commuter and inter-modality network. The plan derives itself from the leadership of the minister and does not integrate sectors such as environment. It also does not incorporate the existence of a written document that monitors performance to evaluate the effects of policies and their contribution to the territorial balance. The Preparatory Document of the Bases, (1995) is more a compendium, or plan of plans, that compiles analysis and proposals from previous documents and sectorial plans from other departments. It has a dual structure: An integrating physical plan covering the sectors and territories that includes the previous strategies while adding some strengths. One such point is the urban discomfort and the rehabilitation of the centre. It also poses the achievement of environmental balance through the growth of existing cities, the territorial linking based on mobility, strengthening new centres, improving the liveability and comprehensive rehabilitation of downtown Madrid, and the modernization of the existing production network. There is no one powerful idea that binds this document. This is due to the recognition of an existing concentrate and congestive model, a dual urban centre, two eastern and southern suburbs suffering from urban decay, and an obsolescent productive north and west whose dispersion threatens the environmental balance. Relevant aspects the document highlights are increasing polarization and social segregation, industrial relocation, the emergence of service activities to centralized companies in metropolitan areas and the dispersion of economic activities in the territory by the trivialization of car use. It proposes making the city from the suburban sprawl and its connection to the metropolitan system through a network of integrated and complementary cities in search of a better balance and territorial solidarity. The Bases of PRET (1997) aims to start the consultation process that must underpin the development of the plan. It stems from a compact and diverse Mediterranean city along with the need for economic activities, services and residences that are close. To resolve the issue, it presents a powerful network of public transport that allows integrated accessibility to the territory. The flow of residence to the periphery based on a foreign model of detached housing and an employment concentration in the centre produces territorial imbalance. Madrid always opted for the densification of the central space, producing its congestion, against the development of new land that would allow its territorial expansion. The document states that the necessity to preserve the values of the housing problem is not only viewed as social, but also economic due to the loss of jobs resulting from their paralysis. It notes the residential growth in the regional border due to the low price of land and argues that the policy of supply has led to a fragmented model of growth that is unbalanced, unstructured, with strong infrastructure and facility deficits that affect the spatial segregation of income and aggravate the lack of morphological identity, uprooting urban values. The pressure on the territory caused its densification due to space limitation; the proposed grid model causes land consumption and infrastructure to solve a non-problem, density. Focusing on limiting the weight of public intervention, it does not raise proposals for public-private cooperation. The biggest discrepancy is that the targets were innovative and mostly align with the proposals in London and Paris. However, it proposes to be implemented through a shift towards a uniform gridded model that is expansive over territory. During the last two decades, due to the absence of a regional plan, a neoliberal stance held exclusive control of the legality of urban planning. The municipalities entered a competition process to take advantage of initial economic benefits of such growth. This provided a “solid” economic base for some municipalities with limited resources in their municipal budgets. The law was amended without a legal stable framework at the request of stakeholders. The character of the plan is lost not only regionally, but also in the sectors and municipal planning. This tends to be based on specific changes with the loss of an urban model. Environmental protection is organized through an extensive number of protection figures with diverse competencies that prevent its effective protection. This process squanders the use of the land, backed by increasing road infrastructure, dispersed occupations with low-density growth causing a social segmentation due to space duality based on income levels. During the housing boom, there is a reduction in social public housing policy mostly due to a boost in the market of housing production for average incomes than in rental policies for needy social groups that focus on disadvantaged neighbourhoods and southern suburbs. As a result, there is an increase in single-family housing, often protected by public policy. This is located primarily in the west in areas of high environmental value such as Guadarrama. There is also cheaper housing due to the popularization of typology in the border region. There, territory works as a mono-functional islands. Financial activities and advanced services for companies are located to the north and west where industrial activity is lost as it migrates south, often outside the region. The number of large shopping centres hanging off the highway infrastructure with little to no surrounding population increases. This process leads to the loss of dependency on public transport and a significant increase in the use of private vehicles. The absence of regional planning has produced more imbalance, more social segmentation, more dispersed growth and a lot of environmental, social and economic costs that can only be redirected through rational territorial.

Throughout the development and maturation of the American democratic experience, religiously inspired conduct has contributed significantly to democratically progressive political concerns such as the abolition of slavery and campaigns for civil rights, but also the encouragement and perpetuation pf anti-democratic practices such as the institution of slavery and policies of racial segregation. It may be rarely admitted, but there is no essential conceptual affinity between conduct proper to democratic political association. It may, therefore, be useful in our own political circumstances to try to determine boundaries for conduct that expresses and satisfies compatibly both religious and democratic commitments. Perhaps most Americans do recognize – if not in their own cases, at least in reference to the beliefs and actions of others – that religiously inspired conduct is neither thereby justified morally or legally nor absolved from further critical appraisal. Certainly, the history of American legal practice shows that religious belief or inspiration does not serve as acceptable legal defense for conduct charged as criminal infraction. The U.S. Constitution contains only two references to religion: the non-establishment clause prohibits governmental institutionalization of religious beliefs or liberty rights – is limited in scope and application both by other constitutional rights of individuals and by constitutionally authorized powers of government. As the U.S.S.C. has repeatedly held, individual constitutional features must be understood in a manner that harmonizes all stated and implied constitutional features, not by unbridled abstractions of selected phrases. Under the American legal system, there is no absolute or unlimited right to free exercise of religion: not everything done publicly under religious inspiration is legally permissible; what is otherwise illegal conduct is not legalized by religious inspiration. In important respects, general features of the legal boundaries concerning religiously inspired conduct in public life are reasonably clear; nevertheless, broader issues concerning further moral or ethical constraints upon religiously inspired conduct remain unresolved and rarely addressed explicitly.

Using a reverse transcription-coupled PCR, we demonstrated that both brain and spleen type cannabinoid receptor (CB1-R and CB2-R, respectively) mRNAs are expressed in the preimplantation mouse embryo. The CB1-R mRNA expression was coincident with the activation of the embryonic genome late in the two-cell stage, whereas the CB2-R mRNA was present from the one-cell through the blastocyst stages. The major psychoactive component of marijuana (-)-delta-9-tetrahydrocannabinol [(-)-THC] inhibited forskolin-stimulated cAMP generation in the blastocyst, and this inhibition was prevented by pertussis toxin. However, the inactive cannabinoid cannabidiol (CBD) failed to influence this response. These results suggest that cannabinoid receptors in the embryo are coupled to inhibitory guanine nucleotide binding proteins. Further, the oviduct and uterus exhibited the enzymatic capacity to synthesize the putative endogenous cannabinoid ligand arachidonylethanolamide (anandamide). Synthetic and natural cannabinoid agonists [WIN 55,212-2, CP 55,940, (-)-THC, and anandamide], but not CBD or arachidonic acid, arrested the development of two-cell embryos primarily between the four-cell and eight-cell stages in vitro in a dose-dependent manner. Anandamide also interfered with the development of eight-cell embryos to blastocysts in culture. The autoradiographic studies readily detected binding of [3H]anandamide in embryos at all stages of development. Positive signals were present in one-cell embryos and all blastomeres of two-cell through four-cell embryos. However, most of the binding sites in eight-cell embryos and morulae were present in the outer cells. In the blastocyst, these signals were primarily localized in the mural trophectoderm with low levels of signals in the polar trophectoderm, while little or no signals were noted in inner cell mass cells.These results establish that the preimplantation mouse embryo is a target for cannabinoid ligands. Consequently, many of the adverse effects of cannabinoids observed during pregnancy could be mediated via these cannabinoid receptors. Although the physiological significance of the cannabinoid ligand-receptor signaling in normal preimplantation embryo development is not yet clear, the regulation of embryonic cAMP and/or Ca2+ levels via this signaling pathway may be important for normal embryonic development and/or implantation.

Using RNA (Northern) blot hybridization and reverse transcription-PCR, we demonstrate that the brain-type cannabinoid receptor (CB1-R) mRNA, but not the spleen-type cannabinoid receptor (CB2-R) mRNA, is expressed in the mouse uterus and that this organ has the capacity to synthesize the putative endogenous cannabinoid ligand, anandamide (arachidonylethanolamide). The psychoactive cannabinoid component of marijuana--delta 9-tetrahydrocannabinol (THC)--or anandamide, but not the inactive and nonpsychoactive cannabidiol (CBD), inhibited forskolin-stimulated cyclic AMP formation in the mouse uterus, which was prevented by pertussis toxin pretreatment. These results suggest that uterine CB1-R is coupled to inhibitory guanine nucleotide-binding protein and is biologically active. Autoradiographic studies identified ligand binding sites ([3H]anandamide) in the uterine epithelium and stromal cells, suggesting that these cells are perhaps the targets for cannabinoid action. Scatchard analysis of the binding of [3H]WIN 55212-2, another cannabinoid receptor ligand, showed a single class of high-affinity binding sites in the endometrium with an apparent Kd of 2.4 nM and Bmax of 5.4 x 10(9) molecules per mg of protein. The gene encoding lactoferrin is an estrogen-responsive gene in the mouse uterus that was rapidly and transiently up-regulated by THC, but not by CBD, in ovariectomized mice in the absence of ovarian steroids. This effect, unlike that of 17 beta-estradiol (E2), was not influenced by a pure antiestrogen, ICI 182780, suggesting that the THC-induced uterine lactoferrin gene expression does not involve estrogen receptors. We propose that the uterus is a new target for cannabinoid ligand-receptor signaling.

A capacidade adaptativa às enchentes diz respeito à capacidade inerente de indivíduos ou de um sistema de se ajustar aos efeitos desse evento e lidar com ele, de modo a moderar seus danos potenciais. A cidade de São Paulo é particularmente vulnerável às enchentes devido ao seu histórico de uso e ocupação do solo. O objetivo deste trabalho é analisar a capacidade adaptativa a partir da realidade local de moradores do Jardim Pantanal, localizado na zona leste do município de São Paulo às várzeas do rio Tietê, a fim de propor ações que possam contribuir na construção dessa capacidade. A pesquisa foi desenvolvida por meio de levantamento documental e bibliográfico, entrevistas semiestruturadas, análise das transcrições, codificação, e categorização dos dados. As capacidades adaptativas genérica e específica nos níveis organizacionais individual e de sistema são baixas, e entre os determinantes da capacidade adaptativa às enchentes os recursos financeiros, a vulnerabilidade urbana e as estratégias de enfrentamento foram considerados os mais importantes, em nível individual. A falta de recursos, a irregularidade de rendimentos e a ausência de diversificação na fonte de renda limitam as opções disponíveis de moradia em áreas regulares e dificultam a mobilização de recursos para a adoção de medidas preventivas e de recuperação pós-evento. A vulnerabilidade urbana expressa-se pela ocupação em área irregular, onde não são realizados investimentos em medidas de infraestrutura por parte dos moradores, que poderiam reduzir a exposição aos impactos das enchentes, pois não se sabe até quando poderão permanecer na área. As estratégias de enfrentamento demonstram ter caráter apenas reativo sem qualquer planejamento, sendo decididas e tomadas reativamente quando a água sobe. Tendo em vista os aspectos observados, a construção da capacidade adaptativa às enchentes no Jardim Pantanal requer: a) entrosamento entre as medidas de adaptação autônomas (do indivíduo) e as planejadas (do sistema); b) ações de adaptação antecipatórias, mais do que responsivas; e c) medidas de adaptação de curto e longo prazos que considerem as vulnerabilidades que surgiram durante o período de adaptação.

O envolvimento de adolescentes com a prática de atos infracionais, no Brasil, ocupa espaço significativo no debate público. No entanto, tal debate carece de profundidade, pois pouco se relaciona ao conhecimento cientificamente produzido sobre o fenômeno. De acordo com a literatura acadêmica especializada no tema, um melhor conhecimento dos fatores associados à pratica de atos infracionais permitiria não só auxiliar na proposição de políticas públicas voltadas à prevenção deste problema, mas também no desenvolvimento de formas mais eficientes de intervenção, baseadas nas necessidades específicas apresentadas pelos adolescentes em conflito com a lei. Em meio aos diferentes fatores que devem ser pesquisados, no presente trabalho focalizam-se especificamente aqueles subentendidos sob o conceito de Normas e de Rotina, no referencial da Teoria da Regulação Social e Pessoal da Conduta, cujo autor principal é Marc Le Blanc. Divide-se assim o presente trabalho em dois estudos. O Estudo 1 trata de regulação normativa que opera por meio do mecanismo de socialização, e se refere à internalização, pelo adolescente, das normas sociais de conduta tidas como convencionais, o que promoveria um nível de constrangimento interno capaz de atuar como barreira ao envolvimento em atividades delituosas. Nesse sentido, maior adesão às normas, menos atitudes favoráveis ao comportamento divergente, mais atitudes de respeito a figuras de autoridade, maior percepção de risco de apreensão e menor utilização de técnicas de neutralização das barreiras psicológicas à emissão do comportamento indicariam um maior índice de constrangimento interno e, portanto, uma probabilidade reduzida de se engajar persistentemente em atividades divergentes/infracionais. O objetivo geral deste Estudo foi caracterizar a regulação da conduta em adolescentes pelas normas, no contexto sociocultural brasileiro. Utilizou-se o questionário de Normas proposto por Le Blanc, um questionário de caracterização sociodemográfica e a Entrevista de Delinquência Autorrevelada. Os dados foram coletados junto a 48 adolescentes Infratores e a 102 Escolares. Os resultados reforçam a importância do aspecto normativo para o melhor entendimento acerca dos fatores que explicam a conduta divergente em adolescentes. No Estudo 2 focalizou-se as atividades de rotina que podem se associar ao comportamento delituoso por meio do mecanismo de aprendizagem, na medida em que as diversas atividades nas quais o adolescente investe seu tempo constituem-se em contexto onde o comportamento divergente/infracional pode ser adquirido e reforçado. De acordo com a literatura, as atividades sem objetivos específicos, acompanhadas por pares de idade e que ocorrem na ausência de alguma figura de autoridade são aquelas que melhor explicam o comportamento delituoso de um adolescente. O objetivo geral deste Estudo foi caracterizar a regulação da conduta pela rotina em adolescentes, no contexto sociocultural brasileiro. Foram utilizados 3 instrumentos: o questionário de Rotina proposto por Le Blanc, um questionário de caracterização sociodemográfica e a Entrevista de Delinquência Autorrevelada. As análises foram feitas com base nas respostas de 102 adolescentes recrutados em escolas públicas. Os resultados comprovam a relevância das Atividades de Rotina como fator explicativo para o comportamento delituoso, com ênfase para os efeitos provocados pelos Pares, pela Família e pela frequentação de Lugares destinados aos adultos. Em síntese, ambos estudos reforçam a importância dos sistemas de regulação estudados e colocam em pauta a necessidade de outros trabalhos, que possam avançar nas questões apontadas dentro da Regulação pela Rotina e pelas Normas.

O estudo refere-se à verificação da admissibilidade e da conveniência da exclusão facultativa de acionista controlador em sociedade anônima. O tema não é propriamente novo no Brasil. Intenciona-se, no entanto, construir a hipótese a partir de fundamento legal diferente. A Lei 6.404/76 (LSA) apenas destina a exclusão para casos de acionista remisso (artigo 107, II), permanecendo silente com relação ao inadimplemento de deveres de colaboração e lealdade (em conjunto, deveres de cooperação). Nesse contexto, a doutrina e a jurisprudência brasileiras tendem a admitir a hipótese de exclusão em tais casos por aplicação do artigo 1.030 do Código Civil, destinado a regular a matéria no âmbito das sociedades simples. Para tanto, aproximam a companhia fechada das sociedades de pessoas a fim de justificar, dada a alegada omissão da lei especial a esse respeito, o tratamento por analogia. A partir do estudo sistemático da LSA, que compreende, entre outros, o entendimento do princípio da circulação de ações e da extensão dos deveres de boa-fé entre os sócios, pretende-se admitir a hipótese com base na própria lógica acionária, em razão da eventual relevância do relacionamento societário para a consecução do fim social. Em tais companhias, o adimplemento dos deveres de cooperação torna-se tão imprescindível quanto o adimplemento do dever de conferimento para o alcance do escopo comum. Em decorrência desse raciocínio, a exclusão torna-se admissível na ocorrência de inadimplemento de qualquer dever social que inviabilize, real ou potencialmente, o preenchimento do fim social. A identificação de eventual affectio societatis entre os acionistas, portanto, passa a ser irrelevante. Admitir a hipótese no que se refere a acionista controlador se revela ainda importante instrumento de limitação do exercício ilegítimo do poder de controle e não se confunde com a sanção de perdas e danos prevista na LSA por abuso de poder de controle. Por fim, será analisada a conveniência da exclusão do controlador, em razão de sua relevância pessoal para a consecução da atividade, a participação societária por ele detida e da possibilidade de dissolver-se parcialmente a sociedade, com a saída do acionista minoritário descontente.

This short essay – taken from a keynote address given at the University of Denver’s Marijuana at the Crossroads Conference – describes the dynamics of marijuana law and policy in the United States with a particular eye toward the federalism implications of marijuana legalization in the states. The essay discusses the history of marijuana regulation in the United States, sets forth a number of possible scenarios going forward, and makes a few, tentative predictions about the future.

Paddlefish populations have begun to decline throughout their historic range but are still found in 22 states in the southeastern and midwestern United States. This capstone project investigates problems facing paddlefish management including, pollution, habitat loss, poaching, and the illegal caviar trade. A combination of four management options is beneficial for the species by increasing public knowledge and awareness of what paddlefish require for survival, allowing paddlefish to be used as a natural resource. After comparing a typical state paddlefish management plan and the plan developed and used in Missouri, it is apparent that a national paddlefish management plan template is necessary for affected states. A plan provides direction for effectively maintaining paddlefish stocks, according to state specific management goals.

Illegal dumping and improper disposal of pollutants in urban areas can contribute significant pollutant loads to the municipal separate storm sewer system (MS4) and natural environments. Illicit discharges to the MS4 can pose a significant risk to human and environmental health. The Clean Water Act requires that municipalities implement a legal mechanism and plan to detect and eliminate illicit discharges to the MS4. The methodology for program creation included the analysis of other municipal illicit discharge programs, review of state and federal guidance publications, and the review of illicit discharge case-studies. This paper describes a systematic approach applied to the creation and implementation of a legal ordinance and program manual designed for the purpose of illicit discharge detection and elimination (IDDE).
