A fundamentação metafísica do direito a que nos propomos a esclarecer na filosofia de Kant assume não somente uma análise de temas jurídicos. Temos uma questão filosófica de fundo a tratar: a justiça é possível? Tal indagação não é o tema do texto, mas o que está pressuposto. A análise kantiana, de certo modo, assume metafisicamente a possibilidade da justiça a partir do conceito de liberdade. Mas, com base na liberdade, demonstra a possibilidade da justiça na ética e no direito. A dissertação é composta por três capítulos. No primeiro capítulo, partindo da reconstrução inicial do conceito de liberdade na Crítica da Razão Pura, descrevemos a construção do conceito cosmológico de liberdade transcendental a partir do terceiro conflito antinômico e de sua solução na Dialética Transcendental. Feito isso, descrevemos o conceito de liberdade no capítulo do Cânon da Razão Pura e discutimos o problema de como compatibilizar liberdade transcendental e liberdade prática. No segundo capítulo, fazemos uma análise da distinção entre a legislação moral e a legislação jurídica das ações humanas partindo da análise da liberdade prática interna (moral) e distinguindo-a da liberdade prática externa (ou jurídica). Nesse contexto, desenvolvemos os pressupostos de uma metafísica do direito, tomando como ponto de partida o conceito de liberdade e o imperativo categórico como princípio da autonomia da vontade, base normativa para a lei universal do direito. No terceiro capítulo, a partir da relação entre ética e direito, reconstruímos o conceito de Direito e esclarecemos o fundamento da legitimidade da coerção a partir do princípio normativo de coexistência das liberdades individuais. Analisamos também os aspectos fundamentais do direito que derivam deste princípio, tal como os conceitos de Contrato Originário, Estado, Lei, Coerção,bem como a proposta kantiana de uma paz universal com base numa legislação internacional. No fim, discutimos o aspecto metafísico presente no fundamento do Direito

This work s objective is to make a literal interpretation of Kant s Aesthetic transcendental, the first pilaster of sustentation of the epistemology of Kant and to interpret it at Strawson s light. It contains the doctrine of sensitivity responsible for the intuitions, which rests on the concepts of space and time, and, with this, the tematização of two important questions. For Kant s philosophy in its epistemologic source what s the importance of the concepts of and time? How these concepts of space and time inscribe themselves with such statute as an investigatory task of metaphysics? The specification of the concepts of space and time as ingredients of the theories treated and enrolled in this work are segmented of the Aesthetic transcendental of Kant, and interpreted under Strawson s light. The research is divided in two chapter; first, constituted of two parts, the first part presents an introduction to the Aesthetic transcendental of Kant, to show the doctrine of the sensitivity which is part of with its forms space and time, authentic forms of the intuition. The second chapter, is constituted of four parts, that deal with the interpretation of the austere model of Strawson and related with Kant s transcendental Aesthetic. The conclusion of our work, about the declared objection of Strawson in its austere interpretation that refuses the idea of space and time, even keeping its a priori character, cannot be accepted. The apriority, the intuitivity and the ideality are theories non-separable in a coherent boarding of space and time of Kant s model of epistemology

We indicate the idea of nexus or conexio, thought of as intelligible connection with the intelligent, the foundation on which the reason why you can understand and name, even if inadequately, what the intellect sees incomprehensible and unnameably. Thus, it opens a way for our research: we will take the idea of nexus as fundamental to the interpretation of the divine names and the "metaphysics of the unnameably" and we show how the divine names, mainly in possest, mirrored in the Trinity, relatedness of the principle and therefore also the nexus. For that you need to think some preliminary questions: we will place Nicholas of Cusa in the tradition of medieval Christian Neoplatonism, we resume some discussions on the problem of naming and the philosophy of language in his thinking, we will reflect such thinking is molded from active dialogue with the tradition and how it is your speculation is founded upon the dynamic and dialectical relationship between philosophy and theology to be thought of in our text using the relationship between faith and understandig (intellectus). After introductory clarify these issues we will come to consider introductory understanding of the Trinitarian Beginning and speculation about the nexus taking as its starting point from where the De venatione sapientiae nexus or conexio is designed as a hunting field of wisdom and the First Book of De docta ignorantia where the maximum is now thought of as one and triune. From the Second Book of the same work and the Idiota. De mente we will show in what sense the universe and men, as imago dei, imitate the eternal Trinity. Finally, we will resume the notion of the scientia aenigmatica of De beryllo and some information that will clarify that Nicholas assumes the divine names as enigmas. Finally, we will try to show that the enigmatic or symbolic names also mirror the triune Beginning principle. So, before we return some traces of this aspect in some divine names and texts of the "late period" and then conclude with that which in itself already indicates the nexus and therefore the trinity: possest

This work deals with the relationship between medicine and philosophy, which has existed since Antiquity, and will also be discussed here from Kant s perspective. It presents the historical context formed by reciprocal influences of common notions regarding health/disease, balance/justice, and just measure, which are present in the medical discourse as much as in the philosophical one. It considers that Hippocratic medicine emerges from concerns about dietetics, thus creating the link between philosophy and medicine, which is important for our analysis on Kant s contributions to Hippocratic legacy. Taking into account these considerations, the work distinguishes between two aspects which are associated within the dietetics presented by Kant in his work The conflict of the faculties, studied here in the light of his Doctrine of virtue, particularly the duties to oneself in regard the care of one s body and the teleological conception. In this sense, the work indicates the role of Kantian thinking not only to enrich medical dietetics, by lending to it moral value, but also to enrich philosophy by highlighting its therapeutic effects

The thesis presents interpretations of Augustine of Hippo with regard to the first three chapters of genesis, the first book of the Bible. These interpretation are found in the works Literal Commentary on Genesis, concerning Genesis Against the Manicheans, Literal Commentary on Genesis, Unfinished, Books Xi-XIII of the Confessions, as well a brief exposition in Books XI-XIV of the City of God. Exposition of these Augustinian Commentaries seeks to demonstrate various interpretations made by author in one group of texts revealing a hermeneutics centered in the interpreter and not in established interpretive rules. In sequence there is described succinctly the evolution of textual hermeneutics during the modern period up to the reflections conducted by Martin Heidegger in the first half of the twenties. Based in Heidegger s existential commentaries on the Pauline Epistles (Galatians and I-II Thessalonians) and on the tenth Book of the Confessions, there is shown a return to a interpreter-based hermeneutics, such as practiced by Augustine. The concern manifested by Heidegger with regard to given bases foundations, existent in Dasein, foundations which can influence self-comprehension, constitute themselves in possibilities of explication as much for Augustinian interpretive variations, as for the existential approach applied by Heidegger to the Pauline epistles and Augustine s text

The ontological investigation of sense, from German philosopher Gottlob Frege s point of view, has, as its foundation, the understanding of reference, representation, thought and sense s categories. According to Frege s writings, On Sense and Reference, and Thoughts Logical Investigations, sense carries itself the solution for the problem of identity s relation. Sense gives us the knowledge s increment that identity doesn t give. But still there is a problem: the definition of sense's nature. Sense couldn t have its nature strictly defined because, in this case, it would be reduced to reference s category and thus, sense would be identified with the own extra-linguistic object, and this is a misconception. But Frege said that thought must be considered as the sense of the sentence. So, with this close relationship between sense and thought, a new goal in this investigation is putt in focus: thought. To Frege, thought is not a simple subjective performance of thinking, it is not a subjective representation, but it is an objective content that is real, eternal, and that exists by itself in a third realm . Thought exists in a realm beyond the world of subjective representations and beyond the world of sensible perception. From this point, the present investigation went back to Plato s World of Ideas. So, the platonic thinking was included in this debate about the metaphysic of the third realm in Frege, trying to clarify the original concepts of knowledge, reality and truth. To achieve this objective, the following dialogues had been included in our research: Theaetetus, Republic and Phaedo. And the following fregean questions had been brought to Plato's scope: how happens the new knowledge? What is the third realm s reality? What is the relation between truth and thought? Doing that we could see as much some of the platonic origins of Frege's approach, as some differences between this two philosophers

The concept of formativity, coined by Luigi Pareyson, is a key to the development of countless contemporary aesthetic studies. The aim of this dissertation is to present a deep understanding of the notion of Formativity and Interpretation, as evidenciated by the title Formativity and Interpretation: the aesthetical philosophy of Luigi Pareyson. The work Aesthetics - Theory of Formativity, first published in 1954, is considered a mark in the rebirth of aesthetics. In this dissertation, the concept of Formativity is examined as a component applicable to every human action, and not limited to pre-determined practices, nor referred to the application of preexisting. I ve performed an investigation of the triple concept of doing-inventing-interpreting, which simultaneously grounds Formativity. In the first section, Pareyson s Aesthetical Propaedeutic is presented; in the second, the Theory of Formativity: the aesthetical character of the whole human experience is analysed; and in the third chapter, The Aesthetical of Form and the Metaphysics of Figuration is related to the formativity character of the knowledge. Through this analysis, I ve intended to evidence how human operability can be understood as search and trial, figuration and invention, in the search for success. In this sense, this thesis seeks to present an interpretation of the idea of work-form, speculating the inexorability of invention and interpretation in an attempt to establish a new bottom line for the studies Pareyson s Aesthetics in Brazil

This thesis endorses the interpretation that in Plato`s Republic the argument made by Thrasymachus in which justice is the convenience of the most powerful one is implicitly accepted by Socrates. Although Thrasymachus´ discussion does not show any similarity with the argument of Socrates, it proposes a sarcastic and ironic comment on political life. Socrates accepts this comment to develop a more refined notion of the category of the most powerful ones. While Thrasymachus assumes that the convenience of the most powerful ones includes the power to subordinate all and everything to their individual pleasures, Socrates admits that the most powerful ones are defined only by their characteristic of being able to hold power in perpetuity. In this context, the main theme of The Republic is that the harmony between the functional classes of the city is convenient for perpetual power. For preservation of harmony, the functional class of the most powerful considers the convenience of forsaking a possible monopoly on pleasure towards a redistribution that promotes harmony, which also makes it convenient for the other classes. Thus, we can explicitly say that the most powerful ones believe in a sense of justice as convenience for everyone, but implicitly believe only in the argument that justice is what is convenient for themselves. Since convenience is what promotes harmony between functional classes, it becomes convenient to Socrates to believe that the understanding justice that the most powerful ones have is not publicly disclosed. The notion that all the speculation of the dialogue between the characters cannot be true, but, at best, only plausible and convenient is also part of the central argument in The Republic. Socrates needs to modify the nature of the functional classes through a targeted program of sexual reproduction and a program of ideological indoctrination so that the proposal to promote harmony through the elements of the city, declaring that justice is in favor of the weakest becomes a more plausible and convenient speech. To make the new system more plausible, Socrates develops a metaphysics based on the mathematical notion of harmony, such metaphysics serving the official rhetoric of the political regime presented by Socrates

Ce travail veut montrer que le scepticisme n‟est pas q‟un des principaux défis pour la philosophie moderne jusqu‟a la déflagration da la Reforme Protestante, la redecouverte et la traduction des textes de Sexte Empirique. La reception de ce scepticisme n‟est q‟un des principaux facteurs qui determinent le noveau fondament da la philosophie moderne avec base dans la subjectivité. Dans ce contexte d‟un nouveau fondament de la philosophie sous la base de la subjectivité, Hegel aborde le problème du scepticisme. La pensé developpé par Hegel dans période de Jena (1801-1807), principalement dans l‟écrit de la Differance parmi les philosophies de Fichte e Schelling, et dans les articles du Journal Critic de Philosophie, Relation du scepticisme avec la philosophie et Foi et Savoir, part du dialogue avec la philosophie d‟idealisme allemand, qui est le point plus haut du subjectivisme dans la philosophie developpé à partir du retour du scepticisme. Hegel essaye à travès l‟interpretation et la superation du scepticisme, établir une nouvelle base pour la philosophie. Alors, le scepticisme, dans cette période de la philosophie d‟Hegel, a la function d‟être la negativité propre à la authentique philosophie qui anéante le point de vue des les philosophies de la subjectivité. Cette manière comme Hegel intégre la scepticisme à sa philosophie, a son point plus haut dans la Phénoménologie de l Esprit. La figure du scepticisme parfait présenté dans l‟introduction de la Phénoménologie de l Esprit a la function de faire le passage du point de vue des philosophies de la subjectivité au point de vue espéculatif da la raison

Unfortunately, the Brazilian politics has been characterized by lack of ethics. In a few exceptions, our representatives often behave in the exercise of power as if they were there to care for their own interests and not public affairs. Despite the dissatisfaction that the situation seems to trigger to society, the electorate does not get to transform their anger into effective gesture in order to withdraw from the public setting people who can not fulfill their mandate at the polls. Instead, the re-election of bad politicians has become commonplace fact. In this study, we proposed to discuss the matter in light of traditional philosophical theories, by selecting exponents of ethical thought from the Ancient Period to the Modern. We put special emphasis on behalf of amorality in Florentine thinker's ideas, to Machiavelli s political doctrine.

La philosophie de Gaston Bachelard se fonde sur une tension ontologique, qui comprend tant la Science que la poétique, et au cours de cette recherche, se développe par la compréhension de la possibilité d envisager une ontologie de la couleur, expression de Bachelard ci tée en «Le Droit de Rêver». Nous suivons, donc, face au dialogue ent re la science et la poésie tout en établissant des paramèt res afin d élucider, d un côté, la couleur conceptuelle de la science qui ne matise pas seulement les objets par le biais de l expérience chimico-physique, mais établit aussi dans la relat ion ent re l observateur et l objet une compréhension de l existence de la couleur invisible, celle qui habite l imagination créatrice et apparaît comme un type d ontologie de la couleur. Dans ce sens, la couleur est une image qui naît dans la conscience de l homme, comme un produit direct de l âme dans son actualité même. Ainsi, la couleur serait dans l imagination créative une image autogène desti tuée de substantialité

This study presents a study on Plato's Phaedrus , with the purpose of discussing the possibility of interpreting this dialogue as a discussion on the greek notion of paideia.. We believe to find evidence to support this claim both in the cultural background of the dialogue and in its text. As background evidence, we point to the fact that Rhetoric had become the major disciplined studied in Athens in Plato's time, largely because democratic instituitions favored its practice. As text evidence, we point out that the story of the Phaedrus can be read as the story of how Socrates leads Phaedrus's soul toward philosophy. Therefore, we believe that Plato's main goal with this dialogue is to discuss Rhetoric and present the philosophical perspective on the possibility of an art of speechmaking. In order to achieve this, Plato presents an analyses of current Rhetoric, explains his conception of dialectic, and debate the relation between extemporaneous and written speech. We believe that all those elements serve the larger purpose of providing the background to discuss the cultural education of the Athenians

Cette thèse a pour objectif principal examiner comment les Mênon, Platon listes l'anámnesis avec les autres théories qui sont abordés dans ce dialogue et, par conséquent, essayer de comprendre ce que c'est. Cette recherche vise dans un premier temps situées dans d'autres dialogues de Platon la survenance du terme anamnésis à veifique les points qui relient ces oeuvres à clarifier la compréhension d'un plus approprié dans le Mênon. Jetez-y aussi, quels sont les éléments de la platonicienne théorie de la connaissance sera reliant le dialogue afin de prouver que le Mênon, qui est la question centrale areté, garde un conflit dans la sophistique et la philosophie. Ce choc entre ce qui se passe papapep indirectement par l'intermédiaire de son Mênon enseigné, et Socrates qui conteste la thèse de l'éthique et le relativisme épistémologique. Nous voyons aussi, de quelle manière le dialogue est donnée de prendre une voie d'accès au savoir qui est configuré comme sûrs, à savoir anámnésis. L'interrogatoire de Mênon depuis le début dans les appels d'enquêter éristique cet intérêt, que lorsqu'ils sont confrontés à des intérêts les amènerait à l'état aporétique initial et qui est progressivement remplacé par l'aporie fondamental de connaissance, ce n'est point pour aporie la compréhension de anámnesis. En prenant la dialectique comme méthode d'enquête dans le dialogue, il est nécessaire de la part de Socrates et Mênon, de quitter le didaskein et en profiter pour mathésis que la construction des connaissances. Il ouvre de manière un des principaux enjeux dans ce travail examine si le anámnesis permettre l'accès aux moyens et si elle a un statut similaire à mnéme. À un moment où Socrate explique dans le dialogue qui est le anámnesis par monstration monstration fait avec esclave de Mênon il est l'utilisation d'éléments mythiques que, selon notre analyse, permettre à comprendre le sens de dialogue les connaissances qui montre l'opportunité d'apprendre, qui est la anámnesis
