Discute-se sobre o tempo buscando entendê-lo a partir dos referenciais que o tomam como elaboração subjetiva, ou seja, como não possuindo qualquer realidade fora do sujeito. Entende-se que, na história da Filosofia, esta reflexão inicia-se com a filosofia de Sto. Agostinho e tem seu ápice no pensamento moderno, sobretudo em Hume e Kant. O tempo seria uma construção ou elaboração do espírito, sem existência fora dele (Sto. Agostinho) ou uma apreensão empírica regular de relações causais de antes e depois (Hume) ou uma intuição pura do espírito (Kant). Pretende-se, com esta análise, evidenciar uma forma clássica de conceber o tempo como elaboração realizada pelo sujeito (subjetiva).

In recent years, issues involving public safety have gained more prominence in scientific debates, the media, and common sense, because undoubtedly the feeling of fear and insecurity caused by the increase in violence overall, has spread like construction element of social representations, both in individual levels, as well as collectively. Violence is a social phenomenon existing in human manifestations, from the older societies, ie it was present in all historical periods, but in different ways in the subjective and objective, having had the task of being the central element in modeling process for the formation of individual behavior, both in older societies as in modern society. However, it has a peculiar feature of acquiring new contours to the extent that the individual and collective behaviors are modified in relation individual-violence. Resistência de genótipos de tomateiro ao ácaro rajado

Avaliou-se a resistência de genótipos de tomateiro selvagens [Lycopersicon pennellii (LA 716), L. hirsutum var. glabratum (PI 126449, PI 134417), L. hirsutum (PI 127826, PI 127827), L. peruvianum (CGO 6707), L. peruvianum var. dentatum (WYR 2020, LA 111), L. peruvianum var. glandulosum (LA 1113-1, LA 1113-2)] e comerciais [(L. esculentum) Gem Pride, Santa Clara, e híbridos Bruna VFN, Carmem, Fortaleza, Débora Plus VFN] ao ácaro rajado (Tetranychus urticae). O número médio de ovos, fases imaturas (larvas, protoninfas e deutoninfas) e adultos por folíolo foi contado; o índice de preferência para oviposição (IPO) foi calculado. O delineamento experimental foi blocos ao acaso, com 6 repetições. Os genótipos LA 716, PI 126449, PI 134417, PI 127827, PI 127826 e Gem Pride apresentaram não-preferência para oviposição do ácaro rajado, sendo deterrentes quanto à classificação do IPO, enquanto os genótipos LA 111, WYR 2020, LA 1113-2 e LA1113-1 foram os mais preferidos para a oviposição e foram considerados como estimulantes pelo IPO.

Rejeição e voto em eleição contemporânea: um estudo de caso da eleição à prefeitura do município de Natal/RN (2012)

Given the importance that political science and social sciences give studies of voting behavior, this study sought to fill this academic discussion another important element that makes up this complex set. From the campaign trail to City Christmas in 2012 work has been undertaken analysis of rejection in the first and second rounds of this election. For this analysis we used two sources of data: quantitative research, conducted by Search Consult the first and second rounds of elections, and the use of focus group technique, performed in the second round of elections. Knowing the various factors that may affect the voting decision, but also the dynamism that pervades a political dispute, seek, with this work, contribute to the deepening of the rejection of studies, aiming to bring subsidies presenting information to better explain the behavior studies election. The results showed that there is a less expressive, the chamda strong rejection. We speak of that rejection based on a political, historical and ideological. The reason for the weak presence of strong rejection seems to be little involvement of voters with politics and, consequently, low knowledge about politics and politicians. We observe, however, evidence of rejection volatile. We refer here to a kind of rejection that develops during the election process depending on the preference of the voter and according to the circumstances of the campaign. The data also lead us to conclude that television is as an instrument for the dissemination of ideas that can contribute in shaping the opinion of viewers. Os antagonismos da integração sul-americana na ordem jurídica brasileira

The economic regional integration is a phenomenon observed in numerous occasions inside the global economic reality. Regarding the mentioned constitutional disposition s realization, the Brazilian State celebrated, specially, the 1980 s Montevideo Treaty, creating the Latin-American Integration Association, and the 1991 s Asuncion Treaty, performing the duty to establish a common market, in sub regional level, with Argentina, Paraguay and Uruguay, called Mercado Comum do Sul. However, due to an addiction to a wrong comprehension of State s Sovereignty Principle, the Constitution imposes to the international rules an incorporation process, without providing any privilege to those ones regarding the integration constitutional disposition s realization, whether original or derived. The Brazilian s Supreme Court, as matter of fact, affirmed that it is not possible, facing the actual constitutional order, to grant any character of preference. Also in the controversies solution mechanism, responsible for the law s execution in case of its noncompliance, where found malfunctions, most notably the system s open character and its excessive procedural flexibility, in addiction to restricting the access of individuals. It follows from these findings, then, the lack of legal certainty provided by the Mercosul s legal system, considering its effects both international and within the Brazilian state. Among the possible solutions to reduce or eliminate the problem are using the practice of the so-called executive agreements in the Mercosul s original rules incorporation to the Brazilian state, the creation of a Mercosul s court of law and/or a constitutional reform

A Dimensão objetiva dos direitos fundamentais: conceito e sistematização

This paper is about the objective dimension of fundamental rights, aiming to present a concept well-designed for this dimension, and establish a systematic teaching of the subject, presenting the developments of this dimension of fundamental rights. The objective dimension of fundamental rights arises related to the idea of linking the state of fundamental rights, transforming these rights as the foundation and purpose of the state. It is distinguished from that perspective of the subjective dimension of fundamental rights, which includes the fundamental rights in an individual-state relationship. Under the subjective prism, rights are seen as limits required by the individual, the state intervention in the lives of individuals. A new dimension goes beyond the perspective of the rights of the individual as a mere resistance in the face of the state, assigning those rights also an active mission, which generates a series of legal repercussions. These developments or "effectiveness" the objective dimension are studied. The first consists of Binding Effectiveness, and demonstrated a new respect for fundamental rights within the state structure, which creates concepts such as "linkage of state functions fundamental rights" and "state s duty to protect". There is also the Radiant Effectiveness in which are examined topics such as the "constitutionalization of Law" and the "application of fundamental rights to particular relationships". Studies are still Procedure Effectiveness, in the case of "objectification of the mechanisms of protection of fundamental rights" and "opening of the processes of state protection of fundamental rights to public participation"

Nacionalização do trabalho e constituição: análise das regras de nacionalização do trabalho à luz do princípio da isonomia

There is a clear relationship between citizenship and labor market. While foreign nationals are equal in dignity and rights in the laws governing the employment of this labor force. Motivated by reasons of state security or political direction, such laws to a greater or lesser degree, create establish a system of worker protection in the face of the foreign national. These rules have a direct impact on economic regulation, as they can affect the supply of skilled labor or not, articulating with the economic order envisaged by the 1988 Constitution. The Constitution adopts several principles in its economic order, so that the issues involving the rules of the nationalization of all work must be considered in a systematic way, one can not choose a pleasure interpreter. The nationalization of the work rules are not unique to Brazil, similar rules exist in several countries of South America and Africa. In Europe they already existed, but lost out on the basis of treaties setting up the European Union, although other mechanisms are used for the purpose of protecting the citizens of the member states, making policies equal treatment legislation symbolic. The nationalization of the work rules governing the relationship between nationality and the labor market and are in a legal category, which has a function to fulfill in the Brazilian legal system. Not all rules nationalization violate the principle of equality, as it is possible, depending on the circumstance indeed adopt a criterion that implies differentiation between nationals and foreigners. Liberdade de expressão artística: concepções filosóficas, fundamentalidade constitucional e política da pluralidade

The right to artistic expression, freedom granted in the western democratic constitutionalism, is a fundamental right that cyclically, compared to other cohesive rights of expression, has been forgotten and put in an irrelevant juridical-dogmatic position. The first reason for this behaviour that disesteems artistic freedom is the valorisation of rationalism and scientificism in the modern society, subordinating academic researches to utilitarianism, relegating the purpose of feelings and spirituality on men s elocution, therefore, we investigate, guided by philosophy, the attribution of art on human formation, due to its capacity in harmonising reason and emotion. After that, we affirm the fundamental right to artistic expression s autonomy in the 1988 valid constitutional order, after a comparative explanation of freedom in the Fundamental Laws of United States, Portugal, Spain and Germany; and the construction historic-constitutional of the same right in the Brazilian Constitutions. In this desiderate, the theoric mark chosen is the Liberal Theory of the fundamental rights, guiding the exam through jusfundamental dimensions: juridical-subjective and juridical-objective. Whilst the first, classical function of resistance, delimitates the protection area of the artistic expression right from its specific content, titularity and its constitutional and subconstitutional limits, the other one establishes it as cultural good of the Social Order, defining to the State its rendering duties of protection, formation and cultural promotion. We do not admit artistic communication, granted without legal reserve, to be transposed of restrictions that belong to other fundamental rights and, when its exercise collides with another fundamental right or juridical-constitutional good, the justification to a possible state intervention that tangentiates its protection area goes, necessarily, through the perquisition of the artist s animus, the used method, the many viable interpretations and, at last, the correct application of the proportionality criteria. The cultural public politics analysis, nevertheless, observes the pluralism principle of democratic substratum, developer of the cultural dialogue and opposed to patterns determined by the mass cultural industry. All powers are attached, on the scope of its typical attributions, to materialise public politics that have the cultural artistic good as its aim, due to the constant rule contained in §1, art. 5º of the Federal Constitution. However, the access and the incentive laws to culture must be constantly supervised by the constitutional parameter of fundamental right to equality

Respostas funcionais de diferentes tamanhos de Tilápia do Nilo; Oreochromis niloticus; predando zooplâncton

The Nile tilapia, Oreochromis niloticus, is an important omnivorous fish in the reservoirs of the semi-arid region of Brazil. Throughout its growth tilapia s feeding behavior changes from a visual predator of zooplankton to a filter-feeder, collecting suspended particulate matter, including planktonic organisms, through pumping. This feature results in different impacts of tilapia on plankton community as the fish grows. Aiming to quantify the functional response of different sizes of Nile tilapia on zooplankton experiments in microcosms scale in the laboratory and in mesocosm scale in the field were carried out. The data were fitted to four different models of functional response. The best fits were obtained for nonlinear models in laboratory experiments. While the experiments in mesocosms were the best settings for responses of type I (juvenile and adult tilapia) and type III (fry). The Manly's alpha index was used to evaluate the feeding selectivity of tilapia on the three main groups of the zooplankton in the experiments in mesocosms. The results show that: (i) rotifers were the preferred prey of fingerlings,(ii) copepods were rejected by fry and juvenile tilapia and (iii) adult fish fed non-selectively on copepods, cladocerans and rotifers. The functional response models obtained in this research can be applied to population models and help in modeling the dynamics of interactions between Nile tilapia and the planktonic communities in the reservoirs of the semi-arid

Protozoa may be an important alternative food source for Calanoida copepods in these environments. Aiming to quantify the feeding preferences of N. cearensis by ciliates in the presence of cyanobacteria, in vitro experiments were conducted, using mixed cultures in different concentrations of total food for copepod. Two ciliates species (Paramecium sp. and Cyclidium sp.) and a cyanobacteria toxic strain (Microcystis aeruginosa) were offered as food. Previous experiments were done to identify the copepod s maximum ingestion rate through the use of a type II functional response model when each prey is offered separately. High maximum ingestion rate were found when those protists were offered as prey. N. cearensis showed significant preference for protozoal prey over the cyanobacterium tested both in low (corresponding 95.15% of the diet) and in high food concentration treatments (about 91.56% of the diet), preferring the bigger ciliate in lower concentrations (67.52% of the diet). The meaningful involvement of heterotrophic organisms in the zooplankton diet emphasis the microbial loop participation in the energy transition from copepods to higher trophic levels. This data contributes to understand the stability of existing trophic interactions in reservoirs subjected to eutrophication and assists trophic cascade studies in these environments
