In July 2006, a mandatory observer program was implemented to characterize the commercial reef fish fishery operating in the U.S. Gulf of Mexico. The primary gear types assessed included bottom longline and vertical line (bandit and handline). A total of 73,205 fish (183 taxa) were observed in the longline fishery. Most (66%) were red grouper, Epinephelus morio, and yellowedge grouper, E. flavolimbatus. In the vertical line fishery, 89,015 fish (178 taxa) were observed of which most (60%) were red snapper, Lutjanus campechanus, and vermilion snapper, Rhomboplites aurorubens. Based on surface observations of discarded under-sized target and unwanted species, the majority of fish were released alive; minimum assumed mortality was 23% for the vertical line and 24% for the bottom longline fishery. Of the individuals released alive in the longline fishery, 42% had visual signs of barotrauma stress (air bladder expansion/and or eyes protruding). In the vertical line fishery, 35% of the fish were released in a stressed state. Red grouper and red snapper size composition by depth and gear type were determined. Catch-per-unit-effort for dominant species in both fisheries, illustrated spatial differences in distribution between the eastern and western Gulf. Hot Spot Analyses for red grouper and red snapper identified areas with significant clustering of high or low CPUE values.

Size distribution within re- ported landings is an important aspect of northern Gulf of Mexico penaeid shrimp stock assessments. It reflects shrimp population characteristics such as numerical abundance of various sizes, age structure, and vital rates (e.g. recruitment, growth, and mortality), as well as effects of fishing, fishing power, fishing practices, sampling, size-grading, etc. The usual measure of shrimp size in archived landings data is count (C) the number of shrimp tails (abdomen or edible portion) per pound (0.4536 kg). Shrimp are marketed and landings reported in pounds within tail count categories. Statistically, these count categories are count class intervals or bins with upper and lower limits expressed in C. Count categories vary in width, overlap, and frequency of occurrence within the landings. The upper and lower limits of most count class intervals can be transformed to lower and upper limits (respectively) of class intervals expressed in pounds per shrimp tail, w, the reciprocal of C (i.e. w = 1/C). Age based stock assessments have relied on various algorithms to estimate numbers of shrimp from pounds landed within count categories. These algorithms required un- derlying explicit or implicit assumptions about the distribution of C or w. However, no attempts were made to assess the actual distribution of C or w. Therefore, validity of the algorithms and assumptions could not be determined. When different algorithms were applied to landings within the same size categories, they produced different estimates of numbers of shrimp. This paper demonstrates a method of simulating the distribution of w in reported biological year landings of shrimp. We used, as examples, landings of brown shrimp, Farfantepenaeus aztecus, from the northern Gulf of Mexico fishery in biological years 1986–2006. Brown shrimp biological year, Ti, is defined as beginning on 1 May of the same calendar year as Ti and ending on 30 April of the next calendar year, where subscript i is the place marker for biological year. Biological year landings encompass most if not all of the brown shrimp life cycle and life span. Simulated distributions of w reflect all factors influencing sizes of brown shrimp in the landings within a given biological year. Our method does not require a priori assumptions about the parent distributions of w or C, and it takes into account the variability in width, overlap, and frequency of occurrence of count categories within the landings. Simulated biological year distributions of w can be transformed to equivalent distributions of C. Our method may be useful in future testing of previously applied algorithms and development of new estimators based on statistical estimation theory and the underlying distribution of w or C. We also examine some applications of biological year distributions of w, and additional variables derived from them.

Bycatch in U.S. fisheries has become an increasingly important issue to both fisheries managers and the public, owing to the wide range of marine resources that can be involved. From 2002 to 2006, the Commercial Shark Fishery Observer Program (CSFOP) and the Shark Bottom Longline Observer Program (SBLOP) collected data on catch and bycatch caught on randomly selected vessels of the U.S. Atlantic shark bottom longline fishery. Three subregions (eastern Gulf of Mexico, South Atlantic, Mid-Atlantic Bight), five years (2002–06), four hook types (small, medium, large, and other), seven depth ranges (<50 m to >300 m), and eight broad taxonomic categories (e.g. Selachimorpha, Batoidea, Serranidae, etc.) were used in the analyses. Results indicated that the majority of bycatch (number) was caught in the eastern Gulf of Mexico and that the Selachimorpha taxon category made up over 90% of the total bycatch. The factors year followed by depth were the most common significant factors affecting bycatch.

Fishery observers collected data from 307 tows during 96 trips aboard skimmer trawl vessels in Louisiana’s coastal waters from September 2004 through June 2005 to estimate catch rates of target and nontarget species, including sea turtles (Cheloniidae and Dermochelyidae), by area and season during commercial shrimping operations. About 16,965.7 kg of total catch were recorded during 517.0 hours of fishing operations. Based on weight extrapolations from species composition samples, penaeid shrimp (Penaeidae) dominated the catch at 66%, followed by finfish at 19%, nonpenaeid shrimp crustaceans at 7%, discarded penaeid shrimp at 6%, and debris at 3%. Noncrustacean invertebrates comprised less than 1%. Catch rates in kilograms per hour by category was 21.6 for penaeid shrimp, 6.2 for finfish, 2.2 for nonpenaeid crustaceans, 1.8 for discarded penaeid shrimp, and 0.9 for debris. White shrimp, Litopenaeus setiferus, other penaeid shrimp, and Gulf menhaden, Brevoortia patronus, were the top three dominant species by weight. Seasonally, a higher catch rate was observed from May through August 2005 for penaeid shrimp as compared with the September through December 2004 period. Conversely, the September through December 2004 period experienced a higher catch rate for finfish than during May through August 2005. No sea turtle interactions were documented.

O princípio do dano, assim como elaborado por John Stuart Mill em On Liberty, é tido como elemento fundamental à afirmação do liberalismo a partir do século XIX e seu desenvolvimento rumo ao século XX. Diante das nascentes democracias européias foi afirmado como um princípio absoluto de proteção à liberdade individual contra a imposição da moralidade pela opinião pública e pelo Estado. Mill partilhava o apreço de Tocqueville pela democracia sem deixar de temer a tirania das maiorias. Inicialmente, investiga-se o lugar do princípio do dano na filosofia política milliana e as fragilidades apontadas por seus críticos. Em um segundo momento, analisa-se sua influência na defesa das liberdades civis na Inglaterra da década de 1950, especificamente com a edição do Relatório Wolfenden que defendeu a descriminalização de práticas homossexuais, bem como o debate que se lhe seguiu sobre os limites do Direito protagonizado por H.L.A. Hart. Na última parte, o objeto do estudo é o princípio do dano agora inserido em uma doutrina liberal-perfeccionista, assim como formulada por Joseph Raz em A Moralidade da Liberdade. O objetivo final é revelar a existência de incoerências internas no princípio do dano, tanto em sua versão original como nas que lhe sucederam, de modo a impedir a fixação de uma espaço imune ao Direito e à imposição da moralidade. No entanto, visto da perspectiva adequada, o fracasso na elaboração de tal princípio deve ser relativizado, eis que no seu devir o princípio do dano serviu à reflexão acerca dos limites da coerção legítima, bem como ao aprimoramento de conceitos relevantes à filosofia política como moralismo legal, paternalismo e perfeccionismo jurídicos.

Operational modifications based on recreational angler activity patterns can be successfully formulated to increase creel survey efficiency without a significant loss of information. This study was conducted to estimate the amount of Texas marine sport-boat angler interview and retained fish data (bay and Gulf) that would be missed both coastwide and within each bay system if surveys were terminated early when no angler interviews were conducted by a specified time. Using this method, <3 percent of the total interviews and retained fish would be missed coastwide by terminating surveys at 1400 hours on weekends and 1600 hours on weekdays throughout the survey year. This would result in the early termination of 14 percent of the weekend surveys and 23 percent of the weekday surveys, thus allowing an annual redirection of 440 work-hours and $6,063 in operating expenses.
