Data obtained since 1958 from the continuous plankton recorder show an increasing occurrence of jellyfish in the central North Sea that is positively related to the North Atlantic Oscillation (NAO) and Atlantic inflow to the northern North Sea. Since 1970, jellyfish frequency has been also significantly negatively correlated with mean annual pH, independent of NAO trends. Jellyfish frequency increased in the mid-1980s, coincident with the reported regime shift in the North Sea and tracking trends in phytoplankton color. As models produced under all climate-change scenarios indicate a move toward a positive NAO, and pH of the oceans is predicted to decrease with rising CO2, we suggest that jellyfish frequency will increase over the next 100 yr.

Recent strategies to sustain fish stocks have suggested a move towards an ecosystem based fisheries management (EBFM) approach. While EBFM considers the effect of fishing at the ecosystem level, it generally struggles with climate-driven environmental variability. In this study we show that the position of a fish stock within its distributional range or thermal niche (we use Icelandic and North Sea cod as examples of stocks at the centre and edge of their niche, respectively) will influence the relative importance of fishing and climate on abundance. At the warmer edge of the thermal niche of cod in the North Sea, we show a prominent influence of climate on the cod stock that is mediated through temperature effects on the plankton. In contrast, the influence of climate through its effects on plankton appears much less important at the present centre of the niche around Iceland. Recognising the potentially strong effect of climate on fish stocks, at a time of rapid global climate change, is probably an important prerequisite towards the synthesis of a cod management strategy.

The aim of the present study was to investigate the responses of phase I and II biotransformation enzymes and levels of PAHs in the Mediterranean mussel (Mytilus galloprovincialis, Lamarck, 1819) collected from three sites at different distance from an oil refinery. Phase I enzyme activities as NAD(P)H-cyt c red, NADH ferry red, B(a)PMO and phase II as UDPGT. GST were measured in digestive gland while 16 PAHs (US-EPA) in whole soft tissue. An added value to the data obtained in the present study rely on the RDA analysis which showed close correlations between PAHs levels and phase I enzyme activities in mussels collected in front of the refinery. And again a significant spatial correlation between B(a)P levels and NADPH-cyt c red activities was observed using linear models. No differences among sites for B(a) PMO and phase II GST activities were observed, while the application of UDPGT as biomarkers requires further investigation. (C) 2012 Elsevier Ltd. The construction industry notoriously excels at dispute creation – both in Ireland and world wide. This paper exams mediation in the Irish construction industry based around critical success factors in the competencies and processes required by mediators operating in the construction industry. Through conducting the relevant analysis, it was possible to extract and outline the resulting critical success factors in process and competencies of mediators in the Irish construction industry. This was achieved through a review of the literature, followed by detailed interviews from industry experts to elicit and highlight the core competencies required. To aid in the study, qualitative analysis using mind mapping software was adopted, thus assisting the identification of the key factors. Following analysis, facilitative mediation was identified as best suited for the industry in question; recommendations and experience were key for mediator selection and five and six factors were identified for mediator skills and mediation critical success factors respectively. The results returned are similar to those determined by authors in other countries and provide a good reference point for the development the industry. By following the findings of this report mediators and parties in dispute can improve processes and be more successful in outcomes. In this study the author shows that mediation is an effective and appropriate method of resolving disputes within the Irish construction industry.

Despite previous attempts at codification of international law regarding international responses to natural and human-made disasters, there is currently no binding international legal framework to regulate the provision of humanitarian assistance outside armed conflicts. Nevertheless, since the International Law Commission (ILC) included the protection of persons in the event of disasters on its programme of work in 2006, it has provisionally adopted eleven draft articles that have the potential to create binding obligations on states and humanitarian actors in disaster settings. Draft articles adopted include the definition of ‘a disaster’, the relationship of the draft articles to the international humanitarian law of armed conflict, recognition of the inherent dignity of the human person, and the duty of international cooperation. However, the final form of the draft articles has not been agreed. The Codification Division of the UN Office of Legal Affairs has proposed a framework convention format, which has seen support in the ILC and the UN General Assembly Sixth Committee. The overall aim of this article is to provide an analysis of the potential forms of international regulation open to the ILC and states in the context of humanitarian responses to disasters. However to avoid enchanting the ILC draft articles with unwarranted power, any examination of form requires an understanding of the substantive subject matter of the planned international regulation. The article therefore provides an overview of the international legal regulation of humanitarian assistance following natural and human-made disasters, and the ILC’s work to date on the topic. It then examines two key issues that remain to be addressed by the ILC and representatives of states in the UN General Assembly Sixth Committee. Drawing on the UN Guiding Principles on Internal Displacement, the development and implications of binding and non-binding international texts are examined, followed by an analysis of the suggested framework convention approach identified by the Special Rapporteur as a potential outcome of the ILC work.

La liberté de religion, souvent reconnue comme étant la « première liberté » dans de nombreuses traditions juridiques, reflète également les différentes conceptions de la place de l’individu et de la communauté dans la société. Notre étude analysera les modèles constitutionnels canadien, américain et européen de liberté de religion et conscience. Dans un premier chapitre, nous examinerons les conceptions théoriques de la religion dans les sciences sociales ainsi les approches juridiques afin de mieux cerner comment la religion est conçue et de plus, comprendre les diverses influences sur sa conceptualisation. Dans un second et troisième chapitre, nous tenterons d’une part, de qualifier la relation entre la liberté de conscience et la liberté de religion au Canada en nous livrant à une analyse approfondie des deux libertés et d’autre part, d’identifier les questions qui demeurent irrésolues. Dans le chapitre final, nous observerons comment la liberté de conscience a été interprétée dans les contextes américain et dans l’Union Européenne, par le biais de la Cour Européenne des droits de l’Homme. Notre hypothèse est que l’on peut arriver à une meilleure compréhension de la relation entre les libertés de conscience et religion en clarifiant les conceptions théoriques de la religion et de la conscience en droit constitutionnel comparé.

In this study, we review the literature on the creation and diffusion of innovation in the private sectors (industry and services) in developing countries. In particular, we collect evidence on what are the barriers to innovation creation and diffusion and the channels of innovation diffusion to and within developing countries. We find that innovation in developing countries is about creation or adoption of new ideas and technologies; but the capacity for innovation is embedded in and constituted by dynamics between geographical, socio-economic, political and legal subsystems. We contextualize the findings from the review in the current theoretical framework of diffusion of innovations, and we emphasize how the institutional context typical of developing countries impacts the diffusion itself.

Antalya Gulf is situated in the Levantine Sea, the second biggest and most eastern basin in the Mediterranean Sea. This area is an ultra-oligotrophic basin, strongly affected by anthropogenic inputs, in particular in the fishing areas. For this characteristic, in the Levantine Sea, there is a strong pressure on the natural resources and benthic assemblages. Furthermore, many alien species enter from Suez Canal and are well established in the area. All these pressures are leading to a degradation of the Levantine Sea. For this reason it is important to have tools to study and monitoring the functioning of the marine ecosystem. Benthic organisms are superior to many other biological groups for their response to environmental stresses. The variability of benthic assemblages on a site can reflect, in an integrative mode, the entire functioning of the marine ecosystem. In this study, that wants to analyze the spatial and temporal distribution of the benthic macrofaunal assemblages of Antalya Gulf, 90 benthic species divided in 8 taxa (Annelida, Cnidaria, Echinodermata, Echiura, Mollusca, Porifera, Sipunculida and Tunicata) were found. All the analyses conducted on the entire benthic class and later on Mollusca and Echinodermata separately highlighted the importance of depth on structuring benthic community.

Past sea surface temperature (SST) evolution in the Alboran Sea (western Mediterranean) during the last 50,000 years has been inferred from the study of C37 alkenones in International Marine Global Change Studies MD952043 core. This record has a time resolution of ~200 years allowing the study of millennial-scale and even shorter climatic changes. The observed SST curve displays characteristic sequences of extremely rapid warming and cooling events along the glacial period. Comparison of this Alboran record with delta18O from Greenland ice (Greenland Ice Sheet Project 2 core) shows a strong parallelism between these SST oscillations and the Dansgaard-Oeschger events. Five prominent cooling episodes standing out in the SST profile are accompanied by an anomalous high abundance of Neogloboquadrina pachyderma sinistral which is confined to the duration of these cold intervals. These features and the isotopic record reflect drastic changes in the surface hydrography of the Alboran Sea in association with Heinrich events Hl-5.

Biogeochemical cycle of methane in the Barents Sea was studied using isotope geochemistry to determine rates of microbial methane oxidation. It was established that microbiological processes (glucose consumption, 14CO2 assimilation, sulfate reduction, and slow methane oxidation) in oxidized surface and weakly reduced sediments are marked by only insignificant change in SO4 concentration and absence of notable increase of total alkalinity and N/NH4 downward sediment cores. Microbial methane productivity was 0.111x10**6 mol/day. Taking into account volume of the water column, microbial methane consumption therein can be as much as 1.8x10**6 mol/day.

This paper presents the results of a Secchi depth data mining study for the North Sea - Baltic Sea region. 40,829 measurements of Secchi depth were compiled from the area as a result of this study. 4.3% of the observations were found in the international data centers [ICES Oceanographic Data Center in Denmark and the World Ocean Data Center A (WDC-A) in the USA], while 95.7% of the data was provided by individuals and ocean research institutions from the surrounding North Sea and Baltic Sea countries. Inquiries made at the World Ocean Data Center B (WDC-B) in Russia suggested that there could be significant additional holdings in that archive but, unfortunately, no data could be made available. The earliest Secchi depth measurement retrieved in this study dates back to 1902 for the Baltic Sea, while the bulk of the measurements were gathered after 1970. The spatial distribution of Secchi depth measurements in the North Sea is very uneven with surprisingly large sampling gaps in the Western North Sea. Quarterly and annual Secchi depth maps with a 0.5° x 0.5° spatial resolution are provided for the transition area between the North Sea and the Baltic Sea (4°E-16°E, 53°N-60°N).
