Affrontare il tema del conferimento di azienda, così come esaminare ogni aspetto inerente, più in generale, l'azienda, può apparire estremamente arduo e complicato, stante il rischio di ripetere, in modo quasi scontato, "cose già dette" nel corso degli anni, prendendo le mosse da contributi noti ed arcinoti, soprattutto con riferimento alla disciplina dell'imprenditore commerciale, ossia alla prima tematica che viene presa in considerazione da parte del neofita del diritto commerciale. Tuttavia, a ben vedere, l'esaustività e completezza di tali studi non impedisce di affrontare, nell'attualità, alcuni aspetti che, anche grazie ai continui interventi del legislatore, presentano elementi degni di approfondimento. In tale ottica, quindi, è stato impostato il presente lavoro di ricerca. Così, ad un primo capitolo prevalentemente compilativo e volto ad individuare, nell'ordinamento giuridico, tutte le disposizioni che possono assumere rilevanza nell'inquadramento della disciplina del conferimento di azienda, nonchè le nozioni base di tale operazione, ne seguono altri due che si caratterizzano, rispettivamente: a) l'uno (il secondo capitolo), quale concreta individuazione delle modalità di esecuzione dell'operazione di conferimento di azienda, dalla decisione di procedere in tal senso, alla concreta esecuzione dell'apporto; b) l'altro (il terzo capitolo), quale esame di alcuni aspetti problematici che emergono a seguito dell'esecuzione dell'apporto, sia con riferimento agli effetti prodotti nei rapporti ricompresi nell'oggetto dell'apporto, sia con riferimento al ruolo dei diversi soggetti che, direttamente e/o indirettamente, ne subiscono i riflessi. In entrambi i capitoli (due e tre), peraltro, si affrontano non solo aspetti connessi alla disciplina dell'impresa ancora in bonis, ma anche, data l'attualità degli interventi operati dal legislatore nell'ambito della risoluzione della crisi dell'impresa, le questioni inerenti l'utilizzo di tale operazione quale forma di liquidazione dell'attivo. Si chiude l'elaborato con alcune riflessioni inerenti le forme di reazione agli abusi che, sovente, caratterizzano l'apporto dell'azienda.

Among hyperbranched polymers, polyglycerol is one of the most promising and commonly used macromolecules due to its biocompatibility and versatility. However, the synthesis of high molecular weight polyglycerols still involves many intricacies and has only been understood to a limited extent. Furthermore, only few complex structures like star or block copolymers incorporating polyglycerol have been realized so far. Particularly biocompatible block copolymers are considered promising candidates for biomedical applications.rnThe scope of this thesis was the enhancement of the synthetic process leading to polyglycerol derivatives which implies improved molecular weight control for a broad molecular weight range as well as the assembly of more complex structures like amphiphilic block copolymers. Further insight into the relation between reaction solvent, degree of deprotonation during the ring-opening multibranching polymerization of glycidol and the characteristics of the obtained polymers were achieved within the scope of this work. Based on these results, a novel concept for the preparation of hyperbranched polyglycerols with molecular weights up to 20,000 g/mol was developed, applying a two step synthesis pathway. Starting from a partially deprotonated TMP core, low molecular weight hb-PGs were prepared using the known synthetic protocol that has been established since the late 1990ies. In a subsequent reaction sequence, these well defined polymers were used as hyperbranched macroinitiator cores in order to obtain high molecular weight hb-PGs with remarkably low polydispersity (Mw/Mn < 1.8). Molecular weight control was shown to be excellent and undesired low molecular weight side products were absent. Furthermore, the technique of continuous spin fractionation has been discovered as an efficient method for polyglycerol work-up to remove quantitatively residual monomer- and oligomer traces from hb-PG compositions to result in samples with significantly reduced polydispersities. Based on these results the synthesis of amphiphilic block copolymers containing hydrophilic hyperbranched polyglycerol blocks and linear, apolar poly(propylene oxide) blocks has been significantly improved and augmented to hb-PG-b-l-PPO-b-hb-PG ABA block copolymers. The influence of different polyglycerol-based amphiphiles on the fibril formation was studied by Thioflavin T Fluorescence showing remarkable increasing lag times which is promising in order to enhance the stability of this protein. In addition the first synthesis of poly(glyceryl glycerols) (PGG), introducing a new solketyl glycidyl ether monomer (IGG) was shown. It was furthermore demonstrated that core-functional carbosilane wedges allow application in block copolymer synthesis. Bisglycidolized amine functional polymers were successfully employed as macroinitiators for glycidol polymerization. This resulted in the first example of amphiphilic hyperbranched-hyperbranched polymer structures. Finally, it has been shown that the previously reported synthetic pathway to carboxylated hyperbranched polyglycerol polyelectrolytes can also be applied for the amphiphilic linear-hyperbranched block copolymers. These novel biocompatible and highly amphiphilic polyelectrolytes offer great potential for further investigations. rnrn

WE STUDIED THE EMOTIONAL RESPONSES BY MUSICIANS to familiar classical music excerpts both when the music was sounded, and when it was imagined.We used continuous response methodology to record response profiles for the dimensions of valence and arousal simultaneously and then on the single dimension of emotionality. The response profiles were compared using cross-correlation analysis, and an analysis of responses to musical feature turning points, which isolate instances of change in musical features thought to influence valence and arousal responses. We found strong similarity between the use of an emotionality arousal scale across the stimuli, regardless of condition (imagined or sounded). A majority of participants were able to create emotional response profiles while imagining the music, which were similar in timing to the response profiles created while listening to the sounded music.We conclude that similar mechanisms may be involved in the processing of emotion in music when the music is sounded and when imagined.

Simulations of climate over the Last Millennium (850–1850 CE) have been incorporated into the third phase of the Paleoclimate Modelling Intercomparison Project (PMIP3). The drivers of climate over this period are chiefly orbital, solar, volcanic, changes in land use/land cover and some variation in greenhouse gas levels. While some of these effects can be easily defined, the reconstructions of solar, volcanic and land use-related forcing are more uncertain. We describe here the approach taken in defining the scenarios used in PMIP3, document the forcing reconstructions and discuss likely implications.

We update the forcings for the PMIP3 experiments for the Last Millennium to include new assessments of historical land use changes and discuss new suggestions for calibrating solar activity proxies to total solar irradiance.
