In Shelby County v. Holder the Supreme Court invalidated key provisions of the Voting Rights Act of 1965 based on Congress’s failure to justify the formula used to determine which jurisdictions would be subject to the Act’s pre-clearance requirement of submitting all changes to voting procedures to the Justice Department for prior approval. This short essay explores one problematic feature of the Court’s analysis: its refusal to consider the legislative record as adequate because it was created to justify the coverage formula after the fact, rather than to facilitate deliberation on the coverage formula before a decision had been made. This reasoning essentially imports from administrative law a rule called the Chenery principle, and as this essay explains, it does so without justification. The differences between administrative and legislative decision making processes compel different treatment by the courts, and treating legislative records like administrative ones, in essence, asks of Congress something it is institutionally ill-equipped to perform. It sets Congress up to fail.

"In Mexico, the first two days of November are set aside each year for the commemoration of the dead. This fete, called All Saints' Day and All Souls' Day, is observed throughout the world; however, in Mexico, it is celebrated in a manner peculiar to that country and to the various localities within that country . This holiday is sanctioned by both government and church; and is celebrated by practically all Mexicans, whether they be Catholic, pagan, relilious or irreligious. These are the two days when that contrast which is the essence of Mexico becomes obvious: the "triste~alegria" (sad-happiness). During these days , art objects are abundant and arresting ; and religious ceremonies, rites and fiestas blossom forth! Urban and folk arts, in every field, find full expression at this time. The religious, social, political, and artistic manifestations of the holiday are not only stimulating in themselves, but are exciting as subjects for painting, drawings, prints, and any other form of artistic expression!"

There has been little discussion of Julia Margaret Cameron’s Idylls of the King photographs over the past decade. My goal with this paper is to bring her Idylls of the King series back into discussion and address its success and relevance in both art history and literature. Scholars Helmut Gernsheim and Marylu Hill have questioned photography as a means to capture the imaginative content of Tennyson’s Arthurian stories and they declared Cameron’s photographs a failure. I argue that her theatrical style, use of props and costumes, obvious posing of her models, and nod to Victorian tableaux vivants capture the true essence of Tennyson’s epic. Her use of the Pre-Raphaelite female muse to portray the Arthurian characters of Elaine, Guinevere, and Vivien places her photographs in direct correlation with Pre-Raphaelite painting as well as popular literature. Her depictions of Tennyson’s epic poem are highly successful and I believe she achieved her personal goal of ennobling photography to the level of High Art.

Interpretar el concepto de ‘turismo’ como la colonización de un espacio nos ayuda a entender el fenómeno del hábitat turístico, así como la relación que guardan los turistas y veraneantes con el nuevo territorio conquistado. Desde esa óptica resulta oportuno estudiar estas transformaciones del paisaje a partir de las tipologías residenciales más habituales que las produjeron, especialmente en la segunda mitad del siglo XX. Para ello se analizarán dos modelos de arquitectura turística: los bloques aislados de apartamentos, vinculados directamente con la reinterpretación del movimiento moderno (1945-1975), y los conjuntos de viviendas unifamiliares adosadas, más relacionados con las derivas de la condición posmoderna (1975-2005). Y proponemos ilustrar ambos casos en la costa sur valenciana (desde Alicante hasta Torrevieja) atendiendo a la producción de un arquitecto que dedicó tiempo y esfuerzos a mejorar soluciones y alternativas: se trata de Antonio Serrano Brú. En este estudio podremos encontrar algunas claves que nos permitan, en el futuro, un turismo que haga compatibles las preferencias vacacionales del hombre contemporáneo con la conservación de la esencia de nuestro hábitat natural y antropizado.

Los medios online representan actualmente una gran apuesta para la publicidad. Desde la planificación de medios publicitarios, los nuevos medios ofrecen otros caminos para llegar al público, pero añaden mayor complejidad. La capacidad comunicativa de los medios online y el mayor consumo de esos medios por parte de la población abre el debate de la necesidad de replantear el enfoque de la planificación de medios, digamos, tradicional, cuya estructura y procesos de trabajo se desarrollaron cuando los medios eran offline. Así, este artículo proporciona una panorámica general de la influencia de los nuevos medios en la planificación. Para ello, en primer lugar, describe el escenario actual, analizando la penetración y las inversiones publicitarias en Internet. Además, expone los principales soportes online según su proximidad a la concepción de la planificación de medios offline. En segundo lugar, aborda los retos actuales en la medición de los nuevos medios como síntoma del impulso del cambio de modelo. Finalmente, el artículo termina exponiendo algunas tendencias que se presentan como motores de cambio. Sin embargo, tras este análisis se advierte que tales aspectos no modificarían la esencia de la planificación de medios, por lo que cabe cuestionarse si se puede hablar de crisis, o si los nuevos medios están mostrando la necesidad de que la investigación y planificación se comprometa con este nuevo escenario.

A semiotic theory of systems derived from language would have the purpose of classifying all the systems of linguistic expression: philosophy, ideology, myth, poetry, art, as much as the dream, lapsus, and free association in a pluridimensional matrix that will interact with many diversified fields. In each one of these discourses it is necessary to consider a plurality of questions, the essence of which will only be comprehensible by the totality; it will be necessary to ask, in the first place, what will be the purpose of this language, what function does it fulfill and for which reason has it been constructed. The concept of World vision (WV) is introduced and its relation with Generalized Collective Conscience (GCC) and Particularized Collective Conscience. Culture implies a particular WV. Culture creates GCC. The semantic field is a structure that formalizes the units of a certain culture constituting a portion of the vision of the Reality that owns this culture. An ecological case is explained.

Science has been developed from the rational-empirical methods, having as a consequence, the representation of existing phenomena without understanding the root causes. The question which currently has is the sense of the being, and in a simplified way, one can say that the dogmatic religion lead to misinterpretations, the empirical sciences contain the exact rational representations of phenomena. Thus, Science has been able to get rid of the dogmatic religion. The project for the sciences of being looks to return to reality its essential foundations; under the plan of theory of systems necessarily involves a search for the meaning of Reality.

Nowadays, online media represent a great choice for advertising. From de advertising media planning, new media give new ways to reach the consumers, but they also add more complexity. The communication capacity of online media and the greater use of that media by part of the users open up the debate about the necessity of rethinking the approach of the ‘traditional’ advertising media planning, which structure and work processes were developed when media were offline. So, this article gives a panoramic view about the influence of new media in advertising media planning. To do this, in first place, describes the current scenario, analyzing the penetration and advertising expenditure in Internet. Also, it shows the main online media according to their proximity to the offline advertising media planning conception. In second place, this article addresses the current challenges at measuring new media as a symptom of the impulse at the change of model. Finally, the article ends up showing some trends that are presented as drivers of change. However, after this analysis, comes up the point that those aspects would not change the essence of advertising media planning, so it is questionable if we can speak of a crisis or, instead, if new media are showing the necessity that media planning have to be involved with this new scenario.

Cultural heritage sites all over the world are at risk due to aggressive urban expansion, development, wars and general obsolescence. Not all objects are recorded in detail although they may have social and historical significance. For example more emphasis is placed on the recording of castles and palaces than on crofters’ cottages or tenement blocks, although their history can be just as rich. This paper will investigate the historic fabric of Aberdeen through the use of digital scanning, supported by a range of media including old photographs and paintings. Dissemination of social heritage through visualisations will be explored and how this can aid the understanding of space within the city or specific area. Focus will be given to the major statues/monuments within the context of the city centre, exploring their importance in their environment. In addition studying why many have been re-located away from their original site, the reasons why, and how we have perhaps lost some of the social and historical importance of why that monument was first located there. It will be argued that Digital Media could be utilised for much more than re-creation and re-presentation of physical entities. Digital scanning, in association with visualisation tools, is used to capture the essence of both the cultural heritage and the society that created or used the sites in association with visualisation tools and in some way re-enacting the original importance placed upon the monument in its original location, through adoption of BIM Heritage.

A essência do Arbutus unedo: caraterização morfológica e genética do medronheiro de Castelo de Paiva

O medronheiro é um arbusto da região mediterrânica que pode ser encontrada por todo o país. Ao contrário do que verifica na região sul do país, no concelho de Castelo de Paiva é atribuída uma reduzida importância económica a esta espécie. Com o intuito de preservar e potenciar a produção desta espécie e contribuir para a dinamização da economia do concelho, procedeu-se à caracterização morfológica e genética de uma amostra da população de medronheiros de Castelo de Paiva. A caracterização morfológica e genética foi realizada para um total de 10 genótipos. Para tal recolheram-se 70 folhas aleatoriamente em cada árvore. Em 40 folhas mediu-se o comprimento, largura, comprimento do pedúnculo, peso fresco, peso seco e determinou-se a área foliar. Dos caracteres morfológicos analisados, aqueles que se revelaram mais úteis na distinção dos vários genótipos foram: comprimento do pedúnculo, peso fresco e peso seco. As restantes 30 folhas foram utilizadas para a caracterização genética. Esta caracterização foi realizada recorrendo a um marcador de DNA, ISSR. Os 5 primeiros exemplaresutilizados na técnica de ISSR demonstraram-se polimórficos. Os resultados da caracterização genética sugerem que a variabilidade genética na população é média a alta.

Using the photographic image as a drawing tool we end up uncovering a universe with two dimensions: the technical and the affective. To rescue the technical essence of Photo Painting, to artistically draw with light, is to go through the History of Portrait and to discover the real meaningful existence of the photographic image -since its beginning until its use changed within society. To go back to the origins of the practical techniques is to find a unique language inside this particular universe. The purpose of this dissertation is to work images not only as mere copies or mirrors of reality but as sanctuaries. To do so, I worked on finding meaningful elements within those images to add or subtract other elements. Meaning, by going through the affective element and interacting with it, I was able to find out which practical techniques I would be able to use without hurting or even diminishing other people’s memories. The premise is to provide clues in the investigation in order to make this the first step in a continued research.

The present essay presents the content of the landmarks that punctuate the long dialogue between verbal language and musical language during the 19th century, by means of examples taken from the critical and theoretical writings of Hector Berlioz, Robert Schumann and Richard Wagner. In the search for the dramatic essence of music, such dialogue took different forms: the possibility of verbal language being translated by musical language, the pre-existence of a musical-poetic idea in any musical composition, eventually contributing to the appearance of program music, and finally, the principles presiding over Wagner’s Gesamtkunstwerk. Special emphasis is given to Richard Wagner’s Parisian article De l’Ouverture (1841), as well as to the impact on Søren Kierkegaard.

Process philosophies focus on becoming and often have recourse to the musical metaphor. Becoming is whole and indivisible. Bergson’s notion of durée coincides with the Whiteheadian notion of process. Becoming is duration. Every being is temporal; its very essence is temporality. The unveiling of each being is durational and has its own particular temporality; every creature’s individualization is in accordance with its own particular way of enduring. A melody is also whole and indivisible; its very meaning relates to its whole, undivided temporality. A note of music is nothing at an instant; the wholeness of its being thoroughly defines it.
