La investigación tuvo como objeto analizar la posibilidad de que las entidades financieras accedan al concurso preventivo. Para esto se analizó la ley de entidades financieras y la ley de concursos y quiebras, así como sus sucesivas reformas teniendo en cuenta la jurisprudencia reciente, donde se advirtieron discrepancias, lo que motivó la presente investigación.

El presente trabajo titulado “Fideicomiso Inmobiliario en Argentina" trata de esta figura que sin lugar a dudas puede ser de extrema utilidad en la situación política y económica que está transitando actualmente nuestro país. En la República Argentina, como consecuencia de la inestabilidad económica y la falta de confianza en las entidades financieras la figura del Fideicomiso ha tomado gran protagonismo. El análisis de la realidad en la generación de negocios en el mercado argentino ha dado lugar a nuevas tendencias en el uso de este modelo que va más allá de las típicas funciones de administración, garantía, inversión y financiamiento. Puntualmente la industria de la construcción ha adquirido en estos últimos años un nivel de desarrollo muy importante motivado por diferentes factores, entre ellos, la existencia de un déficit habitacional estructural, la inseguridad que lleva a que cada vez se prefieran más edificios, barrios cerrados o complejos logrando así que se centre la construcción en este tipo de viviendas, la escasez de inversiones alternativas atractivas, el escenario inflacionario actual que motiva a los ahorristas a buscar resguardo en activos fijos como ladrillos o tierra. Todos estos factores configuran un escenario propicio para el desarrollo de esta institución en la actividad inmobiliaria.

El objetivo principal del trabajo es desarrollar un análisis pormenorizado del fideicomiso inmobiliario. Se tratan aspectos sobre los diversos tipos de fideicomisos existentes y para qué sirven, los aspectos legales, contables y financieros, así como también se informa sobre la comercialización de productos que se encuentran sujetos a dicha figura (edificios, condominios, clubes de campo, etc.).

Data on concentrations and distribution of particulate matter in the Caspian Sea obtained during surveys in 1981-1983 with use of modified filtering units have shown that over the major part of the sea concentration of particulate matter does dot exceed 1-2 mg/l. Only in the northern Caspian and in coastal regions concentrations correspond to values measured earlier. Total amount of particulate matter in the Caspian Sea is about of 90 million ton, 19.6% in the Northern Caspian, 28.1% in the Middle Caspian, and 52.3% in the Southern Caspian. Contents of carbon in particulate matter of the Central Caspian reach 30-40%, and over a significant part of the sea - 20%. A correlation has been found between areas of increased carbon contents in particulate matter and in bottom sediments. An important role of biofiltration in enrichment of particulates in organic matter has been noted. From data on carbon contents and an estimate of particulate matter input biogenic portion in particulate matter exceeds 50% for the whole sea.

The opaque mineralogy and the contents and isotope compositions of sulfur in serpentinized peridotites from the MARK (Mid-Atlantic Ridge, Kane Fracture Zone) area were examined to understand the conditions of serpentinization and evaluate this process as a sink for seawater sulfur. The serpentinites contain a sulfur-rich secondary mineral assemblage and have high sulfur contents (up to 1 wt.%) and elevated d34S_sulfide (3.7 to 12.7?). Geochemical reaction modeling indicates that seawater-peridotite interaction at 300 to 400°C alone cannot account for both the high sulfur contents and high d34S_sulfide. These require a multistage reaction with leaching of sulfide from subjacent gabbro during higher temperature (~400°C) reactions with seawater and subsequent deposition of sulfide during serpentinization of peridotite at ~300°C. Serpentinization produces highly reducing conditions and significant amounts of H2 and results in the partial reduction of seawater carbonate to methane. The latter is documented by formation of carbonate veins enriched in 13C (up to 4.5?) at temperatures above 250°C. Although different processes produce variable sulfur isotope effects in other oceanic serpentinites, sulfur is consistently added to abyssal peridotites during serpentinization. Data for serpentinites drilled and dredged from oceanic crust and from ophiolites indicate that oceanic peridotites are a sink for up to 0.4 to 6.0 mln ton seawater S per year. This is comparable to sulfur exchange that occurs in hydrothermal systems in mafic oceanic crust at midocean ridges and on ridge flanks and amounts to 2 to 30% of the riverine sulfate source and sedimentary sulfide sink in the oceans. The high concentrations and modified isotope compositions of sulfur in serpentinites could be important for mantle metasomatism during subduction of crust generated at slow spreading rates.

The contributions of total organic carbon and nitrogen to elemental cycling in the surface layer of the Sargasso Sea are evaluated using a 5-yr time-series data set (1994-1998). Surface-layer total organic carbon (TOC) and total organic nitrogen (TON) concentrations ranged from 60 to 70 µM C and 4 to 5.5 µM N seasonally, resulting in a mean C : N molar ratio of 14.4±2.2. The highest surface concentrations varied little during individual summer periods, indicating that net TOC production ceased during the highly oligotrophic summer season. Winter overturn and mixing of the water column were both the cause of concentration reductions and the trigger for net TOC production each year following nutrient entrainment and subsequent new production. The net production of TOC varied with the maximum in the winter mixed-layer depth (MLD), with greater mixing supporting the greatest net production of TOC. In winter 1995, the TOC stock increased by 1.4 mol C/m**2 in response to maximum mixing depths of 260 m. In subsequent years experiencing shallower maxima in MLD (<220 m), TOC stocks increased <0.7 mol C/m**2. Overturn of the water column served to export TOC to depth (>100 m), with the amount exported dependent on the depth of mixing (total export ranged from 0.4 to 1.4 mol C/m**2/yr). The exported TOC was comprised both of material resident in the surface layer during late summer (resident TOC) and material newly produced during the spring bloom period (fresh TOC). Export of resident TOC ranged from 0.5 to 0.8 mol C/m**2/yr, covarying with the maximum winter MLD. Export of fresh TOC varied from nil to 0.8 mol C/m**2/yr. Fresh TOC was exported only after a threshold maximum winter MLD of ~200 m was reached. In years with shallower mixing, fresh TOC export and net TOC production in the surface layer were greatly reduced. The decay rates of the exported TOC also covaried with maximum MLD. The year with deepest mixing resulted in the highest export and the highest decay rate (0.003 1/d) while shallow and low export resulted in low decay rates (0.0002 1/d), likely a consequence of the quality of material exported. The exported TOC supported oxygen utilization at dC : dO2 molar ratios ranging from 0.17 when TOC export was low to 0.47 when it was high. We estimate that exported TOC drove 15-41% of the annual oxygen utilization rates in the 100-400 m depth range. Finally, there was a lack of variability in the surface-layer TON signal during summer. The lack of a summer signal for net TON production suggests a small role for N2 fixation at the site. We hypothesize that if N2 fixation is responsible for elevated N : P ratios in the main thermocline of the Sargasso Sea, then the process must take place south of Bermuda and the signal transported north with the Gulf Stream system.

Lateral diffusivity is computed from a tracer release experiment in the northeastern tropical Atlantic thermocline. The uncertainties of the estimates are inferred from a synthetic particle release using a high-resolution ocean circulation model. The main method employed to compute zonal and meridional components of lateral diffusivity is the growth of the second moment of a cloud of tracer. The application of an areal comparison method for estimating tracer-based diffusivity in the field experiments is also discussed. The best estimate of meridional eddy diffusivity in the Guinea Upwelling region at about 300 m depth is estimated to be inline image m2 s-1. The zonal component of lateral diffusivity is estimated to be inline image m2 s-1, while areal comparison method yields areal equivalent zonal diffusivity component of inline image m2 s?1. In comparison to Ky, Kx is about twice larger, resulting from the tracer patch stretching by zonal jets. Employed conceptual jet model indicates that zonal jet velocities of about inline image m s?1 are required to explain the enhancement of the zonal eddy diffusivity component. Finally, different sampling strategies are tested on synthetic tracer release experiments. They indicate that the best sampling strategy is a sparse regular sampling grid covering most of the tracer patch.
