1. Como consecuencia de la LO 5/2010 se ha introducido en el art. 270 CP un segundo párrafo, con el objeto de solucionar los supuestos conocidos como “top manta”, esto es, venta callejera de CD y DVD reproducidos ilegalmente. Para un creciente sector de la doctrina3 y la jurisprudencia tales supuestos eran (o debían ser) atípicos, por tres razones: a) se trataría de supuestos en los que el perjuicio ocasionado al titular de los derechos de explotación de la obra es reducido, dado el escaso número de copias que se distribuyen (principios de proporcionalidad, fragmentariedad y subsidiariedad del Derecho penal con respecto al Derecho administrativo);4 b) el concepto de distribución previsto en el art. 19 LPI no comprende la venta al detalle, sino sólo la distribución a gran escala, por lo que es necesaria una mínima estructura organizativa que en los casos de top manta no concurre;5 c) ausencia de engaño en el consumidor, dado el carácter burdo de las copias.

La medicina al llarg de la història ha anat evolucionant a mesura que també ho anava fent la societat. És per això que en el darrer segle existeix una medicina que no està orientada a la curació de la patologia, sinó que tracta d’aconseguir la major qualitat de vida del pacient ancià o jove, amb patologies cròniques, en estadi de final de la malaltia i també en pacients oncològics i no oncològics, és a dir, s’intenta prestar una atenció sanitària, no curativa, als que tenen una malaltia avançada, progressiva i incurable que precisen una sèrie d’intervencions que no només es basen en procediments mèdics, sinó també en socials i psicològics. És per la necessitat que la medicina s’adaptés a les demandes de la societat que al 1990 es crea a Catalunya el Pla de Cures Pal·liatives de Catalunya com a programa pilot de l’Organització Mundial de la Salut (OMS). Aquest programa ha esdevingut tot un referent de les cures pal·liatives (CP) a España, és el Programa d’Atenció Domiciliària i Equips de Suport (PADES) on un equip interdisciplinari (metge, infermer, treballador social, fisioterapeuta i psicòleg) treballen per tenir una cura holística del pacient al seu domicili. Així, doncs, l’objectiu del PADES és alleugerir el patiment i millorar, tant com es pugui, la qualitat de vida i acompanyar-los en el procés de mort al seu domicili.

The objective of this work was to determine the nutritional value of different protein sources for "dourado" (Salminus brasiliensis). Thirty juveniles per group (33.51±1.4 g) were hand fed on a reference diet (70%) added of tested ingredients (30%) and chromium oxide III (0.1%). Apparent digestibility coefficients of the gross energy (ADC GE), crude protein (ADC CP) and amino acids of the tested ingredients were evaluated. Corn gluten meal yielded the best results for ADC GE and ADC CP (95.7 and 96.9%, respectively) amongst plant ingredients. Spray-dried blood meal yielded the best values of ADC GE and ADC CP amongst animal ingredients (94.1 and 96.3%, respectively). Wheat bran yielded poorest ADCs coefficients (77 for ADC GE and 88.2% for ADC CP).

RESUME L'obésité et l'hypertension atteignent des niveaux épidémiques aussi bien dans les pays industrialisés que dans ceux en voie de développement. La coexistence de ces deux pathologies est associée à un risque cardiovasculaire augmenté. Traditionnellement on mesure la pression artérielle (PA) au bras au moyen d'un brassard qui détermine la pression systolique et diastolique en utilisant soit la méthode auscultatoire ou oscillométrique. L'utilisation d'un brassard de taille standard chez le patient avec un tour de bras augmenté peut surestimer la pression artérielle. Il semble même qu'il existe un rapport idéal entre le tour de bras, et la taille du brassard La mesure à domicile de la pression artérielle avec des appareils validés donne des valeurs de la PA valables. Plusieurs appareils existent sur le marché et depuis quelques années les appareils de mesure de la PA au poignet font leur apparition sur le marché. Cette étude vise à comparer chez des sujets sains et obèses les valeurs de PA obtenues au poignet avec celles obtenues au bras en utilisant deux appareils validés l'OMRON HEM 705-CP et l'OMRON R6. L'OMRON HEM 705-CP permet l'utilisation soit d'un brassard standard (13x30 cm) ou d'un brassard large (16x38 cm), et l'OMRON R6 mesure la PA au poignet. Nous avons comparé un groupe de sujets obèses [Body Mass Index (BMI) >35kg/m2] avec un groupe de sujets sains (BMI <25kg/m2). Ont été exclues de l'étudé les personnes prenant un traitement antihypertenseur ainsi que celles souffrant d'arythmies. La PA a été mesurée en position assise avec le bras gauche sur une table à hauteur du coeur. Un brassard large a été employé pour les sujets obèses et un brassard standard pour les sujets sains. Trois mesures ont été effectuées, la première après une pause de 5 min et chacune des suivantes avec un intervalle de 2 min. La pression d'inflation maximale a été fixée à 170 mmHg. Nous avons utilisé la formule proposée par Marks LA et al pour déterminer si le rapport entre la taille des brassards fournis avec l'OMRON .HEM 705-CP et le tour de bras de nos sujets était optimal (taille du brassard = 9.34 x log10 taille du bras). Nos résultats ne montrent pas de différence statistiquement significative de la PA diastolique entre les deux groupes, qu'elle soit mesurée au bras ou au poignet. La PA systolique mesurée au bras s'est par contre avérée significativement plus basse chez les sujets obèses que chez les sujets sains. Aucune différence n'a été trouvée lorsque la mesure est effectuée au poignet. En utilisant la formule fournie par Marks le rapport entre taille du brassard (large chez les obèses) et tour de bras a été de 10.30±30 chez les sujets obèses et 9.630.45 chez les sujets sains (p<0.001). Le rapport entre tour de bras et brassard chez les sujets obèses est nettement au-dessus de la valeur optimale, ce qui suggère une possible sous-estimation de la PA systolique chez ces sujets. Ces résultats suggèrent qu'il existe un risque de sous-estimer la PA chez le patient obèse lors de l'utilisation d'un brassard large. Cette erreur pourrait être réduite par l'utilisation d'appareils de mesure au poignet. validés chez le sujet obèse.

Soil consolidation and erosion caused by roadway runoff have exposed the upper portions of steel piles at the abutments of numerous bridges, leaving them susceptible to accelerated corrosion rates due to the abundance of moisture, oxygen, and chlorides at these locations. This problem is compounded by the relative inaccessibility of abutment piles for close-up inspection and repair. The objective of this study was to provide bridge owners with recommendations for effective methods of addressing corrosion of steel abutment piles in existing and future bridges A review of available literature on the performance and protection of steel piles exposed to a variety of environments was performed. Eight potential coating systems for use in protecting existing and/or new piles were selected and subjected to accelerated corrosion conditions in the laboratory. Two surface preparation methods were evaluated in the field and three coating systems were installed on three piles at an existing bridge where abutment piles had been exposed by erosion. In addition, a passive cathodic protection (CP) system using sacrificial zinc anodes was tested in the laboratory. Several trial flowable mortar mixes were evaluated for use in conjunction with the CP system. For existing abutment piles, application of a protective coating system is a promising method of mitigating corrosion. Based on its excellent performance in accelerated corrosion conditions in the laboratory on steel test specimens with SSPC-SP3, -SP6, and -SP10 surface preparations, glass flake polyester is recommended for use on existing piles. An alternative is epoxy over organic zinc rich primer. Surface preparation of existing piles should include abrasive blast cleaning to SSPC-SP6. Although additional field testing is needed, based on the results of the laboratory testing, a passive CP system could provide an effective means of protecting piles in existing bridges when combined with a pumped mortar used to fill voids between the abutment footing and soil. The addition of a corrosion inhibitor to the mortar appears to be beneficial. For new construction, shop application of thermally sprayed aluminum or glass flake polyester to the upper portion of the piles is recommended.

The objective of this work was to produce and characterize specific antisera against Brazilian isolates of Grapevine leafroll-associated virus 2 (GLRaV-2) and Grapevine virus B (GVB), developed from expressed coat proteins (CPs) in Escherichia coli, and to test their possible use for the detection of these two viruses in diseased grapevines. The coat protein (CP) genes were RT-PCR-amplified, cloned and sequenced. The CP genes were subsequently subcloned, and the recombinant plasmids were used to transform E. coli cells and express the coat proteins. The recombinant coat proteins were purified, and their identities were confirmed by SDS-PAGE and Western blot and used for rabbit immunizations. Antisera raised against these proteins were able to recognize the corresponding recombinant proteins in Western blots and to detect GLRaV-2 and GVB in infected grapevine tissues, by indirect ELISA, discriminating healthy and infected grapevines with absorbances (A405) of 0.08/1.15 and 0.12/1.30, respectively. Expressing CP genes can yield high amount of viral protein with high antigenicity, and GLRaV-2 and GVB antisera obtained in this study can allow reliable virus disease diagnosis.

This Phase I report describes a preliminary evaluation of a new compaction monitoring system developed by Caterpillar, Inc. (CAT), for use as a quality control and quality assurance (QC/QA) tool during earthwork construction operations. The CAT compaction monitoring system consists of an instrumented roller with sensors to monitor machine power output in response to changes in soil machine interaction and is fitted with a global positioning system (GPS) to monitor roller location in real time. Three pilot tests were conducted using CAT’s compaction monitoring technology. Two of the sites were located in Peoria, Illinois, at the Caterpillar facilities. The third project was an actual earthwork grading project in West Des Moines, Iowa. Typical construction operations for all tests included the following steps: (1) aerate/till existing soil; (2) moisture condition soil with water truck (if too dry); (3) remix; (4) blade to level surface; and (5) compact soil using the CAT CP-533E roller instrumented with the compaction monitoring sensors and display screen. Test strips varied in loose lift thickness, water content, and length. The results of the study show that it is possible to evaluate soil compaction with relatively good accuracy using machine energy as an indicator, with the advantage of 100% coverage with results in real time. Additional field trials are necessary, however, to expand the range of correlations to other soil types, different roller configurations, roller speeds, lift thicknesses, and water contents. Further, with increased use of this technology, new QC/QA guidelines will need to be developed with a framework in statistical analysis. Results from Phase I revealed that the CAT compaction monitoring method has a high level of promise for use as a QC/QA tool but that additional testing is necessary in order to prove its validity under a wide range of field conditions. The Phase II work plan involves establishing a Technical Advisor Committee, developing a better understanding of the algorithms used, performing further testing in a controlled environment, testing on project sites in the Midwest, and developing QC/QA procedures.

The objective of this work was to compare the oribatid mite and springtail communities in three plots with different soil use - Coffee (CP), secondary vegetation or fallow fields (acahual, A) and a cloud mountain forest (CMF) - within a coffee plantation located in Santa Maria Huatulco, Oaxaca State, Mexico. In each plot 20 samples (10 of soil, 10 of litter) were taken and processed in Berlese funnels. The extracted fauna was preserved in 70% ethanol. A total of 3,031 oribatid mites belonging to 33 species, and 1,177 specimens of springtails belonging to 43 species, were collected. The number of species recorded was: 27 at CP (14 oribatids; 13 springtails), 44 at A (19 oribatids; 25 springtails) and 62 at CMF (32 for each group). A total of 26 oribatid and 27 springtail species was found in the soil, and 25 oribatid and 32 springtail species were found in the litter. The most abundant species were the oribatids Rostroztes foveolatus (Haplozetidae), Tectocepheus sp. (Tecocepheidae), Karenella sp. (Oppidae), Atropacarus (Hoplophorella) cf. fonseciai (Phthiracaridae), Epilohmannia pallida americana (Epilohmannidae), and the springtails Ceratophysella cf. gibbosa (Hypogastruridae), Mesaphorura sp. (Tullbergidae) and Proisotoma cf. minuta (Isotomidae). Fourteen families and 18 species of Oribatida species and 5 families and 34 species of Collembola were recorded for the first time for the State.

O objetivo deste trabalho foi clonar e induzir a expressão de fragmento da proteína capsidial de Banana streak OL virus (BSOLV-CP) em Escherichia coli, bem como purificar a proteína recombinante obtida. Empregou-se um par de iniciadores específicos para amplificar, em PCR, um fragmento de aproximadamente 390 pb, da região codificadora da porção central da BSOLV-CP. O fragmento obtido foi clonado em vetor pGEM-T Easy, subclonado em vetor pQE-30 e transformado em células de E. coli M15 (pREP4) por choque térmico. A expressão da proteína foi induzida por tiogalactopiranosídeo de isopropila (IPTG), e a proteína recombinante BSOLV-rcCP de 14 kDa foi detectada em Western blot e Dot blot. A expressão da proteína BSOLV-rcCP abre novas possibilidades para a obtenção de antígenos para a produção de antissoros contra o BSOLV.

The objective of this work was to determine the proper levels of protein and energy in diets of Hoplias lacerdae fingerlings. The dietary crude protein (CP) and gross energy (GE) levels for fingerlings of giant trahira were evaluated in a completely randomized 4x3 factorial design with 35, 39, 43 and 47% CP and 4,100, 4,300 and 4,500 kcal kg-1 of GE, and four replicates. The survival rate was 99.22%, and a linear improvement on the performance parameters was detected after increasing diet crude protein levels. Feed conversion ratio decreased with increasing levels of dietary protein and energy in the diets. A significant interaction between crude protein and gross energy was observed over body protein and mineral matter. Body lipid has increased linearly as gross energy in the diet increased. The retention of crude protein and energy showed a linear increasing with rising of crude protein levels in the diet. Crude protein level at 47% provides the best performance and energy retention, independently of the gross energy levels in the diet.

[spa] A través de la LO 5/2010 el legislador español introdujo en el CP el art. 286 bis, creando un nuevo delito de corrupción privada. Según el Preámbulo a la LO 5/2010:"La idea fuerza en este ámbito es que la garantía de una competencia justa y honesta pasa por la represión de los actos encaminados a corromper a los administradores de entidades privadas de forma similar a lo que se hace a través del delito de cohecho". En este trabajo se aborda la cuestión del bien jurídico protegido, examinando la postura defendida por la doctrina mayoritaria, partidaria de la tesis de que estamos ante un delito de peligro abstracto, y se propone un planteamiento distinto: entender que se trata de un delito de peligro concreto y no abstracto. Asimismo, se realiza un estudio de la estructura típica del nuevo delito y se analizan algunos de los problemas interpretativos que plantea la corrupción entre particulares.

OBJECTIVES:: For certain major operations, inpatient mortality risk is lower in high-volume hospitals than those in low-volume hospitals. Extending the analysis to a broader range of interventions and outcomes is necessary before adopting policies based on minimum volume thresholds. METHODS:: Using the United States 2004 Nationwide Inpatient Sample, we assessed the effect of intervention-specific and overall hospital volume on surgical complications, potentially avoidable reoperations, and deaths across 1.4 million interventions in 353 hospitals. Outcome variations across hospitals were analyzed through a 3-level hierarchical logistic regression model (patients, surgical interventions, and hospitals), which took into account interventions on multiple organs, 144 intervention categories, and structural hospital characteristics. Discriminative performance and calibration were good. RESULTS:: Hospitals with more experience in a given intervention had similar reoperation rates but lower mortality and complication rates: odds ratio per volume deciles 0.93 and 0.97. However, the benefit was limited to heart surgery and a small number of other operations. Risks were higher for hospitals that performed more interventions overall: odds ratio per 1000 for each event was approximately 1.02. Even after adjustment for specific volume, mortality varied substantially across both high- and low-volume hospitals. CONCLUSION:: Although the link between specific volume and certain inpatient outcomes suggests that specialization might help improve surgical safety, the variable magnitude of this link and the heterogeneity of hospital effect do not support the systematic use of volume-based referrals. It may be more efficient to monitor risk-adjusted postoperative outcomes and to investigate facilities with worse than expected outcomes.
